Abstract

This article aims to describe and analyze legal strategies in overcoming waste management problems in villages. Rapid population growth in Kebumen Regency, especially Tanuharjo Village, Alian District, Kebumen Regency. Followed by an increase in various economic and social activities of the community which then gave rise to problems in the community. This condition is exacerbated by limited resources from local governments to deal with these problems. In general, this condition is a challenge for the village government to create an environment that can support the lives of all its citizens. Another problem that arises because of the rapid increase in the number of city residents is the increasing volume of waste. The amount or volume of waste is directly proportional to the level of public consumption of goods or materials used daily. Likewise, the type of waste depends on the type of material that the community consumes. Therefore, waste management cannot be separated from the lifestyle of the community, for this reason it must be immediately handled for the alleviation of settlements and slums in Kebumen Regency, especially in Tanuharjo Village, Alian District. The right legal strategy to overcome the waste problem in the village is through making village regulations and supported by existing village facilities.

Abstract

Rejuvinasi demokrasi konstitusional melalui amendemen UUD 1945 merupakan langkah strategis dalam memperkuat sistem pemerintahan di Indonesia. Artikel ini membahas pentingnya amendemen sebagai instrumen untuk menyesuaikan konstitusi dengan perkembangan zaman dan kebutuhan masyarakat. Penelitian ini menganalisis tiga aspek utama: (1) urgensi perubahan dalam konteks dinamika politik dan sosial, (2) proses dan tantangan dalam pelaksanaan amendemen, serta (3) dampak terhadap praktik demokrasi dan penguatan lembaga negara. Dengan pendekatan kualitatif, studi ini menggunakan data dari literatur, wawancara, dan analisis kebijakan. Hasilnya menunjukkan bahwa amendemen UUD 1945 dapat mendorong partisipasi publik yang lebih luas, meningkatkan akuntabilitas lembaga, dan menciptakan landasan hukum yang lebih kuat bagi demokrasi. Namun, tantangan dalam konsensus politik dan resistensi dari berbagai pihak perlu diatasi agar proses rejuvinasi ini dapat berlangsung efektif. Kesimpulannya, amendemen UUD 1945 merupakan langkah penting dalam revitalisasi demokrasi konstitusional di Indonesia, dengan potensi untuk membawa perubahan positif bagi kehidupan berbangsa dan bernegara

Abstract

The Supreme Court has issued Supreme Court Regulation No. 7 of 2022, which has significant impacts despite generating various societal opinions. It is important to evaluate the implementation of this regulation to ensure the presence and effectiveness of compliance in the electronic court proceedings. The conceptual framework of this research is based on the concepts of e-court services and electronic courts, with the theories employed including policy implementation theory, legal certainty, effectiveness, and legal system theory. The Normative Juridical approach is a legal research method emphasizing the study of norms or legal rules stipulated in legislation. The findings indicate that the implementation of e-court services is outlined in Supreme Court Regulation Number 7 of 2022. Courts must prepare skilled judges and provide adequate infrastructure. The implementation of e-court has successfully increased the efficiency of legal processes and reduced the administrative and financial burden on the parties involved in cases. This research concludes that the implementation of e-court services has brought about increased efficiency in the proceedings of religious civil cases. Recommendations for improvement include conducting evaluations to ensure that all case resolutions through e-court services comply with the letter from the Director General of the Religious Courts Agency dated June 7, 2024, No. 1295/DJA/HK2.6/VI/2024.

Abstract

Tingginya angka kecelakaan lalu lintas di wilayah hukum Polres Jembrana menimbulkan tantangan yang cukup besar dalam penyelesaian perkara, sehingga menuntut adanya penegakan hukum yang menjamin adanya keadilan, manfaat, dan kepastian hukum bagi pelaku maupun korban. Selain sistem peradilan pidana, telah diterapkan pula keadilan restoratif sesuai dengan Peraturan Kepolisian Negara Republik Indonesia Nomor 8 Tahun 2021 tentang Penanganan Tindak Pidana Berbasis Keadilan Restoratif. Penelitian ini mengkaji tentang urgensi penyelesaian perkara kecelakaan lalu lintas melalui keadilan restoratif dan implementasinya di wilayah hukum Polres Jembrana. Dengan menggunakan pendekatan yuridis kualitatif sosiologis, pengumpulan data dilakukan melalui observasi, wawancara, dan analisis dokumen yang bersumber dari sumber primer, sekunder, dan tersier. Hasil penelitian menunjukkan bahwa urgensi keadilan restoratif dalam penanganan kecelakaan lalu lintas didukung oleh bukti empiris, sosiologis, dan yuridis yang menyatakan bahwa keadilan restoratif dalam penanganan kecelakaan lalu lintas telah sesuai dengan tujuan hukum yaitu memberikan keadilan, manfaat, dan kepastian hukum. Penegakan hukum tersebut sejalan dengan teori penegakan hukum Joseph Goldstein yang menekankan pada penerapan hukum secara nyata. Implementasi mempertimbangkan komunikasi, sumber daya, disposisi, dan struktur birokrasi berdasarkan teori implementasi kebijakan publik George C. Edward III. Studi ini menyimpulkan bahwa keadilan restoratif sangat penting dan telah diterapkan secara efektif dalam menyelesaikan kasus kecelakaan lalu lintas di Jembrana, memastikan hasil yang adil dan menguntungkan bagi semua pihak yang terlibat.

Abstract

This article examines the dynamics of the development of contempt of court using legal theory in the context of modern Indonesia by emphasizing the importance of a deep, open way of thinking, and involving various fields of knowledge. The author uses a qualitative method with a sociological approach, and refers to M. Lawrence Friedman's theory that sees law as part of social life with a case study of contempt of court. Legal understanding cannot be separated from social and political influences, the rigid theory of legal positivism is no longer adequate to answer the complexity of legal problems in Indonesian society. A transdisciplinary approach is offered as a conceptual solution to enrich legal theory through integration with social science, ethics, and legal philosophy. The results show that contempt of court requires the establishment of a separate law to strengthen legal legitimacy and public trust in the judiciary.

Abstract

The strategy of strengthening a competitive domestic economy supported by agricultural development is a strategy that is close to the countryside. Pakintelan is a village located in Gunungpati District, Semarang City. The vast area of the Pakintelan Village is a capital or asset for the people of Pakintelan to make a living because most of the people of Pakintelan are farmers and traders. The purpose of this program is to identify the legal aspects in the management and marketing of superior products in Pakintelan Gunungpati Semarang. The method used in this program in addition to socialization, also carried out observation and documentation of existing resources. This paper confirms that strengthening the legal aspects in the management and marketing of superior products in Indonesia, especially in Pakintelan, Semarang, Central Java, is becoming very important in the midst of globalization and industrial growth. Strengthening these legal aspects must also be supported and carried out by various elements of society including the sword community and the community around the Semarang State University campus which is one of the target markets in the Pakintelan community's small business.

Abstract

Homeworkers are work that is done at home either on the basis of orders from others or doing on the basis of oneself. This type of work is referred to as informal workers, which is clearly difficult to obtain legal protection. Labor laws in Indonesia provide legal protection for both formal and informal workers, but the practice for informal workers is difficult to obtain legal protection. This program aims to describe and analyze the legal protections of women homeworkers in Semarang City in their efforts to make their families prosperous. This program uses socialization methods, interviews, observation and documentation. This program is conducted in the city of Semarang. The results of this program can be seen that the protection of homeworkers is still very minimal, especially for independent homeworkers. The implementation of statutory regulations has not been optimal, especially in manpower laws. The government is still not optimal in providing legal protection for informal workers, especially for homeworkers. Low wages, long working hours and the absence of health insurance are among the elements that homeworkers need to improve and increase in their efforts to make their families welfare. In the effort to achieve welfare for homeworkers' families, it is necessary to carry out supervision and guidance for homeworkers. Supervision and guidance can be carried out by the central government, local governments, non-governmental organizations, the academic community, observers of labor.

Abstract

This paper aims to analyse the urgency of establishing independent institutions in environmental management and protection in Indonesia, especially in dealing with illegal logging and the preservation of endangered animal habitats. Using normative juridical methods as well as conceptual and comparative approaches, this study highlights the weaknesses of the OSS-RBA-based licensing system as well as the weak law enforcement against the exploitation of natural resources. The results of the study show that gaps in the licensing system open opportunities for illegal logging practices that increasingly threaten the sustainability of the ecosystem and cause a decline in the population of endangered animals. Compared to other developed countries, Indonesia does not yet have an independent institution specifically supervising licensing and law enforcement in the environmental sector. This study confirms that policies in Brazil can provide a deterrent effect for illegal logging perpetrators by applying strict sanctions in the form of large fines, asset confiscation, and prison sentences of up to 10 years. The establishment of independent institutions in Indonesia is urgently needed to ensure strict supervision and the application of strict sanctions to protect ecosystems and prevent unsustainable exploitation.

Abstract

The Central Java Province contains five significant slums focus, contains Sukoharjo Regency, Wonosobo Regency, Banjarnegara Regency, Brebes Regency, and Kebumen Regency. Kebumen Regency is one among the regions with a notable slum area. This community service aims to identify strategies to enhance the efficacy of the district village legislator (BPD) and village administration in waste management via village regulation, focusing on a case study of Bandung Village, Kebumen Regency. This community service utilizes direct counseling as its methodology. The community service outcomes indicate that the BPD and the Village Government in Bandung Village, Kebumen, collaborate effectively in waste control through the formulation of Village Regulations. The BPD formulates legislation and oversees the community, whereas the Village Government administers technical implementation and engagement. Participatory procedures, the establishment of waste banks, and the principles of transparency and accountability are essential for the efficacy of sustainable waste management in this context.

Abstract

Although Indonesia’s mineral downstreaming policy aims to enhance value added, its implementation is impeded by fundamental regulatory disharmony. This study aims to evaluate the legal framework of the downstreaming policy to identify inconsistencies and to examine its substantive provisions from an EAL perspective. Employing an interdisciplinary legal research method, this study applies a RIA framework to analyze secondary data comprising statutory instruments and relevant literature. The findings reveal that the policy’s legal framework, while vertically coherent, suffers from severe horizontal disharmony with environmental and spatial planning laws. This disharmony is proven to create significant economic inefficiencies, negative externalities, and high-cost legal uncertainty. The study concludes that active regulatory intervention is a necessity. Therefore, a multi-track strategy is recommended: first, the issuance of precise implementing regulations as a short-term solution; second, the parallel strengthening of non-regulatory interventions; and third, a long-term legislative harmonization agenda.
