Abstract

Kemandirian Desa merupakan tujuan utama dari pemeberian otonomi desa oleh Undang-undang Nomor 6 Tahun 2014 Tentang Desa (“UU Desa”). Sejumlah rekognisi terhadap hak asal-usul desa diberikan oleh UU Desa tersebut. Secara teknis, untuk mewujudkan kemandirian desa supaya makmur dan sejahtera, maka Pemerintah Indonesia membuat kebijakan afirmasi yang sangat kuat dengan dibentuknya Kementerian Desa dan juga dana desa. Penelitian ini menganalisis tentang perwujudan otonomi desa di Indonesia dengan menggunakan metode penelitian studi kasus di Desa Selorejo, Girimarto, Wonogiri, Jawa Tengah. Artikel ini mengklaim, bahwa perwujudan otonomi desa di Indonesia bersifat semu. Hal ini ditunjukkan oleh keharusan desa mengikuti visi-misi Bupati dalam menginisiasi program-program pembangunan desa. Selain itu, intervensi pihak luar desa baik dari pemerintah yang lebih tinggi maupun korporasi dalam pembangunan desa juga sangat besar. Fakta lainnya yang mempengaruhi otonomi desa adalah kuatnya birokrasi pelaporan dana desa, sehingga menjadikan aparatur desa gamang dan takut dalam menyusun program pembangunan desa dan pelaksanaannya. Sebagai akibatnya, kemandirian desa yang dicita-citakan oleh UU Desa berjalan lambat dan kurang inisiatif. Berdasarkan temuan pengabdian ini, maka direkomendasikan agar ada pihak ketiga, seperti perguruan tinggi dan NGOs yang netral untuk melakukan program advokasi dan pemberdayaan kapasitas aparatur dan warga desa, sehingga mereka memiliki kemampuan mengorganisir diri secara independent dalam menyusun dan melaksanakan program-program desa.

Abstract

Abstract Under Article 56 and Article 57 of Law Number 24 Year 2003 regarding the Constitutional Court, the position of the Constitutional Court in testing the law merely as a negative legislator. But from some of the existing ruling, the Constitutional Court made ​​several decisions that sometimes are not just cancel the norm, but also make decisions that are set (positive Legislature). In the juridical-normative perspective, the actions of the judicial activism that led to the positive position of the Legislature is a violation of boundary signs. However, if the study, some of the Constitutional Court ruling that the Legislature containing positive showing a progressive law enforcement side. Therefore, the next question is, why the judge in the Constitutional Court Act makes testing positive verdict Legislature. To answer these questions, is used qualitative research methods with the paradigms of constructivism and hermeneutic approach to the socio-legal research. From this research can be concluded that positive legislature decisions made ​​are based on legal considerations, philosophical and sociological considerations which can not be separated from interpretation of the law. Law is not only seen from the perspective of law texts, but in context to realize the benefits and justice. In this context, the law enforcement of the Constitutional Court can be categorized as a form of progressive law enforcement. Key words: progression, decision, Positive Legislature   abstrak Berdasarkan ketentuan Pasal 56 dan Pasal 57 Undang-Undang Nomor 24 Tahun 2003 tentang Mahkamah Konstitusi, kedudukan Mahkamah Konstitusi dalam pengujian undang-undang hanya sebatas sebagai negative legislator. Namun dari beberapa putusan yang ada, Mahkamah Konstitusi terkadang membuat beberapa putusan yang tidak hanya membatalkan norma, melainkan juga membuat putusan yang bersifat mengatur (positive legislature). Dalam perspektif yuridis-normatif, tindakan aktivisme yudisial yang mengarah pada kedudukan positive legislature tersebut adalah sebuah pelanggaran rambu pembatas. Namun demikian, apabila telaah, beberapa putusan Mahkamah Konstitusi yang mengandung positive legislature tersebut menampakkan segi penegakan hukum yang progresif. Karena itu yang menjadi pertanyaan selanjutnya adalah, mengapa hakim MK dalam pengujian UU membuat putusan positive legislature. Untuk menjawab pertanyaan tersebut, digunakanlah metode penelitian kualitatif dengan paradigma konstruktivisme dan pendekatan hermeneutik pada penelitian socio-legal. Dari penelitian yang dilakukan, didapatkanlah kesimpulan bahwasanya dibuatnya putusan yang bersifat mengatur tersebut didasarkan pada pertimbangan hukum, filosofis dan sosiologis yang tidak terlepas dari penafsiran hukum. Hukum tidak hanya dilihat dari kacamata teks undang-undang belaka, melainkan menghidupkan kemaslahatan dalam kontektualitasnya. Dalam kontek ini penegakan hukum di Mahkamah Konstitusi dapat dikategorikan sebagai bentuk penegakan hukum yang progresif.   Kata kunci : Progresifitas, Putusan , Positive Legislature

Abstract

The existence of administrative tribunals in Indonesia is one of the rechtsstaat pillars. The decision of the Administrative Court is expected to be the main instrument of dispute fulfillment and justice message. Therefore, in accordance with the principle of dominus litis, judges are required to maximize its role in the fulfillment of disputes, including to make dictum of ultra petita, so may reflect society's sense of law justice.Ultra petita decision in the Administrative Court have diverse characters, ultra petita of reformatio in peius, reformatio in melius, repeating the command process, the cancellation decision is not the object of dispute, but is materially related to the object of dispute, the addition of a substantial amar and amar that is declarative.

Abstract

This research aims to analyze the existence of the Kuda Lumping art in Kedungboto Village; the society interprets the art of Kuda Lumping in Kedungboto Village; the society's participation in the preservation of the Kuda Lumping dance in Kedungboto Village. The research method in this study used a qualitative research method. The data collection method used observation, interviews, and observation. The test technique for determining the validity of the data was used triangulation. The data analysis technique used an interactive model carried out by data collection, data reduction, presentation, and verification. This research showed that: The existence of Kuda Lumping art in Kedungboto Village now it's growing and getting better in terms of appearance, clothes, equipment, and music. Society interprets the Kuda Lumping art as; some people consider Kuda Lumping as entertainment; some consider Kuda Lumping a tradition, and some consider Kuda Lumping a ritual. The society's participation in preserving the Kuda Lumping dance Turonggo Wahyu Budoyo and Turonggo Tresno Budoyo were very active and enthusiastic. The form of social participation was through the idea, energy, property, skills, and social participation.

Abstract

Transportation is the activity of transporting goods or passengers from one place to another. Transportation is very important because transportation is something that makes it easier for the general public to reach their goals. The study used a qualitative descriptive approach located in the city of Semarang. Research focuses on socio-economic studies of online drivers. Results of the study, online drivers show that most of them have secondary education. Monthly income range of Rp. 4,000,000,- (four million rupiah), being an online driver, although not an option, can improve the economic welfare of online drivers and their families, especially in meeting basic needs. To meet the needs of daily life, including the cost of children's education, it is done sparingly. This shows that there is a relationship between the level of education completed and the work they have, meaning that the higher a person's level of education will provide the possibility to get a better job.

Abstract

Penyalahgunaan dan peredaran gelap narkotika, psikotropika dan bahan berbahaya lainnya (Narkoba) maupun maraknya sex bebas dengan berbagai implikasi dan dampak negatifnya merupakan suatu masalah global yang mengancam kehidupan masyarakat, bangsa dan negara. Berdasarkan permasalahan tersebut pembinaan hukum dan penyuluhan pendidikan kesehatan di kalangan remaja perlu dilakukan agar remaja dapat lebih mengerti dan memiliki daya tangkal terhadap pengaruh negatif. Metode ceramah, diskusi, dan tanya jawab dipilih untuk menjelaskan mengenai karakteristik dan perkembangan motorik siswa MTs, Selain itu, media film juga dipakai untuk mendukung kelancaran penyampaian informasi. Dengan memperhatikan persentase kehadiran dan keaktifan peserta dalam setiap sesi serta hasil posttest dapat disimpulkan bahwa peserta mampu mengenali dampak hukum dan dampak sosial serta dampak negatif lain akibat penyalahgunaan Narkoba maupun perilaku seks bebas di kalangan remaja. Harapannya mereka mampu secara mandiri menjauhi dan menghindari hal tersebut. Rekomendasi kegiatan ini adalah perlunya penyuluhan dilaksanakan secara berkala, terprogram, dan berkesinambungan, khususnya sehingga kesadaran dan daya tangkal siswa terhadap penyalahgunaan Narkoba dan perilaku seks bebas dapat lebih ditingkatkan.

Abstract

This article aims to show how to improve public services' capability and accessibility through e-government for villagers to reduce the rate of spread and infection of Covid-19 and as community participation in alternative ways of getting public services, Electronic Government (e-Gov) or digital government exists. Electronic government (e-Gov) itself provides information and public services, business affairs, services related to governance, et cetera by using information technology tools. However, the obstacles in this e-government-based public service are in applying the information system and the knowledge and access to information on this e-government-based public service. The digital divide is found in rural communities, often uninformed and reluctant to experience new technologies. Therefore, a community service program is needed, namely Improving Community Capability and Accessibility in Utilizing E-Government Public Services for villagers in the Middle of the COVID-19 Pandemic Outbreak in Semarang Regency.

Abstract

Korupsi di Indonesia sudah tidak asing lagi bagi kita saat ini. Korupsi merupakan sebuah permasalahan klasik dan sangat kompleks. Tindak pidana korupsi merupakan masalah yang sangat serius, dapat membahayakan membahayakan pembangunan sosial politik, ekonomi masyarakat, stabilitas dan keamanan negara, bahkan dapat pula merusak nilai-nilai demokrasi serta moralitas. Salah satu upaya pencegahan korupsi adalah dengan menanamkan nilai-nilai pendidikan anti korupsi. Penguatan budaya dan kearifan lokal akan membentuk karakter dalam upaya pencegahan korupsi khusunya bagi para pelajar yang notabenya adalah calon penerus dan pemimpin bangsa. Tingginya kasus korupsi salah satunya masih rendahnya tentang literasi Pendidikan Anti Korupsi. Oleh karena itu, betapa pentingnya penguatan literasi Pendidikan anti korupsi saat ini salah satunya bagi para pelajar. Pemahaman dan penerapan kearifan lokal yang ada di masyarakat akan membentuk budaya dan sikap anti korupsi yang mendasari upaya-upaya pencegahan korupsi. Penelitian ini berdasarkan studi literatur. Hasil dari penelitian ini yakni penguatan literasi Pendidikan anti korupsi dapat dilakukan melalui beberapa literasi yang ada yakni literasi baca, literasi digital dan literasi budaya. Pertama Literasi baca, pelajar dapat membaca dari berbagai literatur baik dari jurnal, e-book yang berkaitan dengan Pendidikan Anti Korupsi; Kedua Literasi digital, pelajar dapat meningkatkan literasi digitalnya melalui berbagai aplikasi yang ada di HP dan optimalisasi sosial media; Ketiga Literasi Budaya dan Kewarganegaraan, pelajar dapat belajar tentang kearifan lokal di seluruh nusantara seperti di Jawa, Lombok, Bali dan lain-lain.

Abstract

Indonesia is one of the countries with a high level of corruption. Corruption in Indonesia is already seen as an extraordinary crime. Corruption has become a frightening scourge and destroys the life of the nation. Corruption behavior is closely related to consumerism and hedonism. But on the other hand, as a plural nation, Indonesia has so much local wisdom that can ward off corrupt behavior. This can happen because local wisdom in Indonesia includes shame, simple life, and socialism. As a tribe that has a distinctive culture of shame, local wisdom in the community has a very important role in shaping the character of the younger generation to have an anti-corruption character. One of the efforts to eradicate corruption with preventive measures is through the implementation of anti-corruption education in social science learning. This study examines the contribution of local wisdom in efforts to prevent corrupt behavior in Indonesia. This research was conducted in junior high schools 3, 9, and 32 in Semarang City, using qualitative methods. Data collection techniques use observation, interviews, and documentation. Test the validity of data using triangulation techniques and source triangulation and analyzed the stages of data collection, data reduction, data presentation, and conclusions. The result of this research is that the anti-corruption education model can be carried out through several strategies, namely by strengthening reading literacy, optimizing digital literacy, and cultural literacy. First, by increasing reading literacy, students can read from various literature, both from reference books, textbooks, modules, diktats, research journals, and e-books related to Anti-Corruption Education; Secondly, by optimizing digital literacy, students can improve their digital literacy through various anti-corruption educational game applications, e-books, e-modules, and various social media such as Tiktok, Instagram, Twitter, Facebook; Third, strengthening cultural literacy, students can learn about local wisdom that contains anti-corruption character values through Javanese culture that they have learned.

Abstract

The Constitutional Court’s decision (Number 91/PUU-XVIII/2020) on the Formal Examination of Law Number 11 of 2020, addressing Job Creation and the subsequent enactment of Law Number 13 of 2022, has catalyzed a profound transformation in Indonesia’s legal system. This legal evolution, explored in the context of the Transformation of the Legislative System in Indonesia Based on the Principles of Good Legislation, delves into the political dynamics of legislation leading to numerous Constitutional Court litigations. The quality of law formation is scrutinized in light of the principles of good legislation, emphasizing transparency, participation, effectiveness, and efficiency. The study assesses how the Indonesian parliament executes its legislative function and underscores the imperative for reformulating planning, institutions, and capacity. The article advocates for an expedited authorization of Information and Communication Technology (ICT) as a crucial step toward digitizing legislation in the pursuit of a thoroughly transformed and principled legislative system.
