Abstract

Mudarabah, as an icon of commercial products in Shariah Economic,  factually proven toughness in facing  the financial crisis during this time. By placing the product mudarabah proportionally in the financial business institutions have a significant impact on economic sustainability in strengthening the real sector. Some of the benefits include Mudarabah product; has  a rate of return higher than the interest rate applicate on interest bank, based on “production–based” by  transactions based on real assets and not solely on the paperwork that are derivatives and free from elements of speculation. Mudarabah based on production. Therefore, the financial crisis can be minimized because the balance sheet of company is stable relatively. To maintain it in the real sector, government support in the form of policies by strengthening the role of national banking intermediation in the financial and real sector investment is needed to minimize the level of unemployment.

Abstract

The concept of Time Value of Money in the LKS is not accepted because of riba, but in practically mainly on small investors to invest, will face a big problem if it rejects the principle of Time Value of Money, whenever any country will have inflation. will be injustice when Islamic banking do not give a rate of return to the investor. The research is a qualitative, primary data sources and data collection consisted of a document. The Brochure of Product Financing Transactions in LKS, b). Fatwa DSN-MUI 2000, c). CD-ROM File Maushuah al-Hadith al-Sharif al-Tisah 1997 Edition II, d). The Books related to the concept of Time Value of Money, e). SOP (Standard Operational Product) financing and acounting system. Secondary data consists of various books related to the concept of Time Value of Money both modern and classical fiqh books and  Research results related to this research problem. This research analyzes the discriftive approach, with results as follows: 1. Time Value of Money in the LKS is not acceptable, because the increase in the Time Value of Money earned should be of real business, not because of the debt contract / qardh 2. Time Value of Money by economic concepts Hadis Muhammad saw among other things contained in the contract of salam/ indent, BBA and disconto, araya and provision for debt payments 3. the occurrence of in-consistency between ideology Time Value of Money with praxis in LKS due in addition to not paying attention to the business logic of the Prophet, helplessness in operating system usage still based on the operating system Conventional Financial Institutions (LKK).

Abstract

Mudhārabah practices as an icon rather than LKS (Sharia Financial Institution) is still raise unresolved polemic associated with akunting system and balance, especially in the domain of financing, so that the stigma of people who think that the operating system is the same as the system of financial calculating interest only the different’s name has been continues. When examined in detail, there are other products that legitimized the contract either by the arguments Syara agreed by the majority of scholars and schools of jurisprudence, namely the contract of Ba‘i Bitsaman Ājil (BBA) or purchase by way of pay gradually. This article concludes; First, offers a BBA in finance BMT Damar and BMT-KJKS IAIN Walisongo experiencing significant growth, in addition to a simple transaction models are not complex, almost the akunting system likes fixed rate (fixed rate) so that customers become more familiar because the system is not much different from the credit money. Second, BBA financing acounting system can be separated from other products offered by BMT and not to be come one system with murābahah financing. Third, although the BBA acounting system similar to the system of interest and somewhat complicated because managers have the purchase to be come representer for wakālah contract to goods of customers, but offers and akunting BBA financing is more flexible and is not affected by rising interest rates as the often occurs in LKK )Conventional Financial Institutional)

Abstract

Internal religious conflicts in the practice of religion in daily life in Islam is prompted by, among others, different schools of thought among the scholars of hadith from the early Islamic period to the present, especially in determining the quality of the hadith as hujjah syar’iyyah. The type of this research is the research library. Data sources are documents consists of: The Book of Hadith Sciences History, Introduction to Hadith, Science of Mustalah al- Hadith, the book of al-Jarh wa al-ta'dil,  hadith collection books (kutub al- tis’ah) and their commentaries.  Research findings are as follows: a). There are four schools of scholars in determining the quality of the hadith, namely, mutasyaddid (strict) muta'annut (excessive), mutawassit (moderate) and mutasahhil (permissive). b). the school mutasyaddid implies that hadith which do not meet the standard of validity may not be used as hujjah syar’iyyah.  The school of mutawassit share this view, noting that unless there is a theorem (from Quran or Hadith) supporting it. The schools of muta'annut and mutasahhil tend to accept hadith with dhaif  quality as reference for the purpose of moral virtue.

Abstract

Abstract: Islamic teachings spread in Indonesia, especially in Java, when the Mangkunegara IV authority, through its mysticism (Sufism) teaching, was adjusted to the religious teachings and beliefs containing moral values and character building inspired by thinking paradigm of cultural values of Javanese (Kejawen). This indicates that development of Islam in Indonesia has been strongly influenced by Islamic mysticism, especially, of Javanese culture. It can be seen from literature of Javanese Islamic teaching. Some identities and characteristics of Javanese teachings that still survive up to now are the principle teachings of worship to God and good deed. Both principles are relevant to the teachings of Qur’an and hadith. These teachings were also practiced by Sunni mysticism such as al-Ghazali and non-Sunni mysticism like Al-Hallaj and Ibn ‘Arabi. Additionally, in Indonesia, specially in Java, the absorption process of Islamic teachings can not be separated from the influence of Javanese culture which contains religious values of Sufism teachings. The concept of worship and good deed is done by the mysticism doers both by Sunni and non-Sunni followers.

Abstract

The focus of this paper is the authenticity of the hadith, because in addition to the problem of the method used, it is also a matter of sources that are problematic. One source that is often used is literature, especially pre-Islamic Arabic literature (jahiliyah). The relevance of literature in authenticating hadith gives rise to a question, the extent to which the validity of pre-Islamic Arabic Literature can be used as evidence and what are the requirements that must be met when the study of the authenticity of hadith uses pre-Islamic Literature as one of the proofs. Using a Using a descriptive analytic method with a historical approach, this paper concludes that pre-Islamic Arabic literature when used as a source of authenticity of the hadith then the task of research is to reduce the difference in question. The reduction is intended so that the legality of literature as a source of hadith authentication can be accepted. This reduction includes: (1) authorship. Just as the news attributed to the Prophet must be proven to have its source in the Prophet, pre-Islamic Arabic Literature must also be proven to come from pre-Islamic Arabic writers, (2) narration. Pre-Islamic Arabic literature must also be tested extrinsically as an extrinsic factor test on the Hadith of the Prophet, (3) context. Literature was born not in an empty space so that the content of pre-Islamic Arabic literature must also reflect the life of the Arab Nation in pre-Islamic times. Therefore, when the reduction has not yet been carried out, in the context of the accuracy of the study of the authenticity of the hadith it cannot be accepted.

Abstract

This study aims to evaluate the readiness of Sharia Business Units (SBUs) in Indonesia to undertake the mandated 2023 spin-off, which would result in these units operating independently from their parent banks. The research employs a qualitative approach, with data collected through documentation and literature review. The study focuses on 20 SBUs, which include one unit from a state-owned enterprise (BUMN), 13 units from regionally-owned enterprises (BUMD), and six units from private banks. Findings indicate that approximately 50% of these SBUs are not sufficiently prepared to separate from their parent institutions due to constraints in assets, capital adequacy, and health metrics. This lack of preparedness is compounded by deficiencies in infrastructure and human resources, which collectively affect the financial, operational, and human capital stability of these units. Consequently, the findings suggest that most SBUs are not ready for a spin-off by 2023. Policy implications: The findings underscore the need for regulatory and developmental support to strengthen SBUs prior to spin-off. The study recommends that future policy address the capital and human resource limitations in Islamic banking to ensure successful spin-offs and sustainable growth in the sector.
