Abstract

Latar belakang penulisan ini adalah kekerasan seksual di perguruan tinggi tidak bisa diabaikan begitu saja. Kejadian ini harus diantisipasi karena beberapa kali terjadi di masyarakat, apalagi terjadi di lembaga pendidikan yang seharusnya menjadi tempat yang aman bagi seseorang untuk belajar dan menimba ilmu. Metode pendekatan perundang-undangan dalam penelitian hukum normatif dan pendekatan kualitatif dalam penelitian hukum empiris, dengan menggunakan informasi sekunder dari bidang hukum. Hasil kajian menunjukkan bahwa korban membutuhkan perlindungan hukum yang baik dan memadai serta pelaku kejahatan harus dihukum. Pentingnya penerapan Nilai-nilai Pancasila dijadikan pedoman dalam kehidupan sehari-hari agar ketika kekerasan seksual terjadi, seluruh warga perguruan tinggi memahami bahwa perbuatannya tidak benar dan mengabaikan sila dalam Pancasila yaitu kemanusiaan yang adil dan beradab.

Abstract

Generasi Z memiliki potensi besar untuk memainkan peran yang signifikan dalam Pemilu 2024. Dengan karakteristik dan keterampilan unik yang dimiliki, generasi Z dapat membawa dampak besar dalam proses politik dan masyarakat. Penelitian yang menggunakan metode penelitian yuridis normatif merupakan penelitian yang mengkaji peraturan-peraturan hukum atau norma-norma yang berlaku untuk mengevaluasi atau menganalisis suatu konsep atau hubungan hukum. Dengan potensi-potensi ini, partisipasi aktif Generasi Z dalam Pemilu 2024 dapat menjadi kekuatan yang mendorong perubahan positif dalam politik dan masyarakat. generasi milenial memiliki kontribusi suara tertinggi dalam Pemilu, menunjukkan bahwa keputusan politik dan arah masa depan Indonesia secara signifikan dipengaruhi oleh preferensi dan partisipasi politik generasi ini. Dengan potensi-potensi ini, partisipasi aktif generasi Z dalam Pemilu 2024 dapat menjadi kekuatan yang mendorong perubahan positif dalam politik dan masyarakat. Penting bagi para pemimpin politik dan lembaga terkait untuk memastikan bahwa suara generasi Z didengar dan diwakili dengan baik, sehingga kebijakan publik dapat mencerminkan kebutuhan dan aspirasi mereka. Oleh karena itu, penting bagi para pemimpin politik dan lembaga-lembaga terkait untuk memperhatikan aspirasi dan kebutuhan Generasi Z dalam proses politik dan memastikan bahwa suara mereka didengar dan diwakili dengan baik.

Abstract

Abstrak: Pemilihan umum (Pemilu) adalah salah satu pilar demokrasi yang vital dalam menjaga kesehatan suatu negara. Dalam konteks ini, perlu memperhatikan kelompok unik, yaitu Warga Binaan Permasyarakatan (WBP) yang berada di dalam lembaga pemasyarakatan. WBP sering menghadapi keterbatasan dalam akses terhadap informasi, pendidikan, dan partisipasi politik yang diperlukan untuk menjadi pemilih yang terinformasi dan terlibat dalam proses demokrasi. Hasil kegiatan menunjukkan peningkatan pengetahuan politik di kalangan WBP, meningkatkan partisipasi politik mereka, serta pengembangan keterampilan sosial dan hidup yang berguna setelah pembebasan. WBP menjadi lebih percaya diri dalam berperan aktif dalam proses politik. Hasil kegiatan menunjukkan peningkatan pengetahuan politik di kalangan WBP, meningkatkan partisipasi politik mereka, serta pengembangan keterampilan sosial dan hidup yang berguna setelah pembebasan. WBP menjadi lebih percaya diri dalam berperan aktif dalam proses politik. Kegiatan edukasi di dalam lembaga pemasyarakatan berperan penting dalam mempersiapkan mental dan meningkatkan partisipasi politik WBP. Meskipun memiliki dampak positif, terdapat tantangan dalam hal sumber daya dan akses teknologi yang perlu diatasi. Dengan pengalokasian sumber daya yang tepat dan solusi kreatif, kegiatan edukasi ini dapat memainkan peran penting dalam memperkuat partisipasi politik dan kualitas demokrasi. Kegiatan edukasi di dalam lembaga pemasyarakatan membantu mempersiapkan WBP secara mental dan meningkatkan partisipasi politik mereka, menjaga kesehatan demokrasi, dan menciptakan masyarakat yang lebih inklusif dan demokratis.Abstract: General elections (Pemilu) are one of the vital pillars of democracyin maintaining the health of a nation. In this context, it is important to consider a unique group, namely Incarcerated Citizens (WBP) within correctional institutions. WBP often face limitations in accessing information, education, and political participation necessary to become informed voters and engage in the democratic process. Research results indicate that an increase in political knowledge among WBP enhances their political participation and the development of social and life skills that are useful after their release. WBP become more confident in actively participating in the political process. Research findings also reveal that political education activities within correctional institutions play a crucial role in preparing the mindset and enhancing the political participation of WBP. Despite having a positive impact, there are challenges related to resourcesand technological access that need to be addressed. With proper resource allocation and creative solutions, these educational activities can play a significant role in strengthening political participation and the quality of democracy. Educational activities within correctional institutions aid in mentally preparing WBP and increasing their political participation, thereby safeguarding the health of democracy and creating a more inclusive and democratic society.

Abstract

Pancasila is the ideological foundation of the Indonesian state that guarantees the unity and integrity of Indonesians entering the era of globalization. Current Indonesian criminal law is obsolete because it does not consider Indonesia's philosophical, sociological, and cultural values and does not follow the changing mindset of modern criminal law. Social policy must be woven into and placed in a carefully integrated social plan, especially to prevent unwanted access related to crime. Indonesian criminal law will continue to apply colonial values that are not based on Pancasila values. The codification of laws that live in society is regulated specifically for public awareness of the potential for the law that can be used as a reference for regional regulations. The basic idea of Pancasila's balance is based on the religious moral paradigm, the human paradigm, the nationality paradigm, the democracy and wisdom paradigm, and the social justice paradigm. Justice is an abstract value that must be realized in the form of legal norms to realize these values in social life without ignoring religious law, customary law, and Western law. This does not correspond to the value contained in Pancasila.

Abstract

The growth of e-commerce transactions in Indonesia reached 533 trillion Rupiah in 2023, reflecting a significant transformation in the national business landscape. This increase opens new opportunities for companies to expand their markets but also presents challenges related to business competition and intellectual property rights protection. Trademarks, as valuable assets representing the reputation and quality of products, require effective protection to build consumer trust and maintain brand integrity. This protection becomes increasingly crucial in the digital era due to the rising cases of trademark infringements, including unauthorized use and counterfeiting. This study highlights the importance of adaptive legislation and the role of technology in detecting counterfeit products in e-commerce. By employing normative juridical methods, this research analyzes the effectiveness of regulations and practices in trademark protection in Indonesia, comparing them with best practices in other countries. The study also evaluates the impact of trademark protection on human rights, emphasizing that the right to a trademark is part of intellectual property rights that protect the economic and social interests of trademark owners. E-commerce platforms play a crucial role in protecting trademarks by implementing internal policies, reporting mechanisms, and cooperation with relevant authorities. Despite progress, challenges remain, particularly in monitoring the large volume of products and addressing increasingly sophisticated infringement methods. Effective trademark protection not only enhances consumer trust but also fosters innovation and digital economic growth. This research provides recommendations to improve collaboration between the government, e-commerce platforms, and trademark owners in protecting intellectual property rights in Indonesia.

Abstract

This study describes the challenges and solutions in implementing e-government in Indonesia using a qualitative and case study approach. The study aims to understand the policy framework underpinning the implementation of e-government in Indonesia, identify the challenges faced, and develop practical recommendations to improve the effectiveness and efficiency of e-government. This research involves the analysis of official documents such as government policies, reports from official government and international agencies, legislation, and other related documents. Data are analyzed qualitatively using thematic analysis methods by classifying and identifying the main themes from the analyzed documents. The validity of the findings is confirmed through data triangulation by comparing relevant official documents and by considering case studies from other countries that have successfully implemented e-government as comparative material. The results show that the main challenges in implementing e-government in Indonesia include the digital divide, limited internet access, high costs, low public awareness, language and literacy issues, privacy and data security concerns, and resistance to change. Based on these findings, practical recommendations are formulated, such as enhancing digital infrastructure, providing education and training for the public, and strengthening regulatory frameworks to support more effective and efficient e-government implementation in Indonesia.

Abstract

Pelaksanaan perhelatan pemilihan gubernur, wakil gubernur, bupati, wakil bupati, wali kota, dan wakil walikota sebentar lagi akan dilaksanakan. Tepatnya menurut jadwal perencanaan dari KPU adalah tanggal 27 November 2024 secara serentak yang akan dilaksanakan di TPS-TPS seluruh wilayah dan kabupaten se-Indonesia. Pemilihan kepala daerah (Pilkada) yang dilaksanakan setiap lima tahun memiliki angka partisipasi hak pemilih yang cukup rendah oleh karena itu salah satu tujuan sosialisasi dalam program pengabdian masyarakat ini adalah untuk dapat memberikan informasi dan pemahaman yang cukup komprehensip selain bagi pemilih tetap khususnya bagi pemilih pemula dalam pelaksanaannya di MA Alfalah Buduran Sidoarjo, Jawa Timur menggunakan konsep sosialisasi online yang telah dilaksanakan pada 15 Oktober 2024 dalam rangka sosialisasi Pilkada bagi pemilih pemula tahun 2024. Bagi masyarakat, khususnya pemilih pemula, mengenai pentingnya mempersiapkan diri dengan baik, mengikuti semua tahapan, dan menggunakan hak pilih mereka secara bijaksana. Sosialisasi ini tidak hanya memberikan wawasan teknis, tetapi juga menjadi wadah interaktif, di mana peserta dapat berdiskusi dan mengajukan pertanyaan terkait proses pemilihan.

Abstract

Indonesia’s location between the Indian and Pacific Oceans positions it as a crucial maritime route, thereby revealing significant maritime opportunities. This strategic location also presents significant vulnerabilities, especially from foreign vessels involved in unlawful activities, including illegal, unreported, and unregulated (IUU) fishing. IUU fishing represents a widespread issue that threatens regional security and the sustainability of marine ecosystems, ultimately impacting food security and economic viability.  This research adopts a normative legal methodology, incorporating an extensive literature review to examine the philosophical underpinnings and regulatory benchmarks pertinent to Indonesia's enforcement framework addressing IUU fishing.  This analysis scrutinizes current legal resources and explores the intricate dynamics of overlapping jurisdictions among maritime agencies, intensifying enforcement inefficiencies and generating operational uncertainties. This study proposes implementing the Single Agency Multi-Tasks (SAMT) system as a comprehensive approach to enhance law enforcement efforts targeting foreign vessels involved in IUU fishing within Indonesia's Fisheries Management Areas (FMAs), considering the existing challenges.  The SAMT framework aims to centralize authority within the Marine Security Agency (BAKAMLA) to streamline operations and improve regulatory compliance, ultimately contributing to a strong maritime governance structure. The results highlight the importance of implementing legal reforms and establishing coordinated governance mechanisms by national and international maritime regulations. This study significantly enhances the discussion surrounding optimizing fisheries management and reinforcing Indonesia’s sovereignty in its maritime areas while also tackling the widespread challenges IUU fishing activities present.

Abstract

As the smallest unit in the Indonesian government system, villages play a crucial role in maintaining social harmony and resolving conflicts within communities. Village heads and their staff, such as neighborhood heads and hamlet heads, have legal and moral responsibilities as extensions of the local government. Based on Law Number 6 of 2014 and its most recent amendment, Number 3 of 2024, village heads are obligated to resolve disputes within village communities. This study aims to analyze the role of village heads and village community institutions in conflict resolution through customary law and non-litigation approaches. This study used qualitative methods, focusing on analyzing the role of village heads and community institutions in conflict resolution through customary law and non-litigation approaches. Furthermore, this study highlights the harmonization of Pancasila values in pluralistic village communities and identifies challenges and solutions in implementing the latest regulations at the village level. The results indicate that empowering village heads through mediator training and legal support can increase the effectiveness of peaceful and just resolutions. In conclusion, harmonizing Pancasila values and integrating customary law into village conflict resolution mechanisms is crucial for maintaining the unity and well-being of village communities.

Abstract

Legal protection for teachers and lecturers in the post-COVID-19 pandemic period needs to be pursued, because it is part of improving their welfare in addition to safety in every activity and task. As referred to in article 14 paragraph (1) point e "Law No. 14 of 2005 concerning Teachers and Lecturers which includes legal protection, professional protection, occupational safety and health protection, and intellectual property rights (IPR)". This study intends to describe how the development of education in the implementation of Law No. 14 of 2005 concerning Teachers and Lecturers is viewed from the rights and obligations in the perspective of dignified justice. Research methods used normatively and empirically and literature review that supports descriptive exposure to strengthen argumentation and persuasion that explains facts in the field and the results of relevant data collection from various applicable legal sources. The COVID-19 pandemic has ended with Presidential Decree No. 17 of 2023, but the impact felt on teachers and lecturers, especially private universities, is still being felt today. The duties of teachers or lecturers, both public and private, have the same duties, it's just that the obligations are different, where it is determined by the conditions of each institution that houses the public and private. The task of the state in this case is that policy makers who oversee the education and private sectors through  their corporate social responsibility (CSR) would be nice to facilitate and support the duties of teachers and lecturers, because the duties of teachers and lecturers have the same duties, but judging from private universities in their operational management is still determined by the foundation of the university, especially related to the tri dharma of higher education and needs to be considered The welfare of its human resources, thus as a suggestion to pay more attention to supporting the welfare of human resources of private universities, land and building tax subsidies, electricity subsidies, rewards for authors of the Scopus journal, Sinta, or special grants for private universities, in order to restore the management of private universities, especially financial management operations so that they can compete with state universities. In implementing Law No. 14 of 2005 concerning Teachers and Lecturers, especially in the post-COVID-19 pandemic, private educational institutions are expected to get special attention and for private educational institutions the impact is very influential, especially in the field of financial management, in order to harmonize their financial management as before the COVID-19 pandemic, especially for teachers and lecturers who obtain welfare from private educational institutions in order to harmonize rights and obligations as stated in Law no. 14 of 2005 and realizing alenia 4 "educating the life of the nation" NRI Constitution 1945 and Pancasila which are justice-oriented with an intention.
