Abstract

Program edukasi debat yang diselenggarakan oleh Universitas Pelita Harapan Lippo Karawaci, yang diadakan di Sekolah Dian Harapan Daan Mogot adalah kegiatan pengajaran dengan upaya membekali siswa dengan kompetensi berdebat dan berargumen. Kegiatan ini bertujuan mendeskripsikan pengalaman penulis dalam edukasi debat pada siswa kelas 11 dengan fokus pada keterampilan membedakan fakta, opini, dan hoaks serta memberikan solusi untuk menyelesaikan kendala yang ada. Kemampuan menelaah informasi ini,  menjadi salah satu kompetensi penting yang harus dimiliki pelajar, terutama dalam menghadapi arus informasi digital yang seringkali bercampur antara data valid, pandangan subjektif, dan disinformasi. Melalui metode pembelajaran berbasis debat, siswa dilatih untuk mengidentifikasi karakteristik fakta yang dapat diverifikasi, opini yang bersifat argumentatif, serta hoaks yang menyesatkan. Penelitian ini menggunakan pendekatan deskriptif-reflektif dengan teknik observasi kelas, analisis tugas, dan refleksi guru. Hasil pembelajaran menunjukkan bahwa siswa kelas 11 lebih mampu mengenali kredibilitas sumber, menyusun argumen berdasarkan data, serta memberikan sanggahan yang kritis terhadap klaim yang tidak valid. Namun dalam pelaksanaannya, masih ditemukan kesulitan dalam membedakan opini dengan fakta terselubung, sehingga perlu adanya pendampingan lebih lanjut dan latihan fact-checking menggunakan sumber resmi. Temuan ini menegaskan bahwa dalam edukasi debat tidak hanya berfungsi untuk meningkatkan kemampuan retorika, tetapi juga membentuk literasi informasi yang kuat. Dengan demikian, integrasi latihan membedakan fakta, opini, dan hoaks dalam edukasi debat dapat menjadi strategi efektif dalam membekali siswa menghadapi tantangan di era digital.

Abstract

Perkembangan pengguna kendaraan bermotor di Indonesia telah berkembang sangat pesat, dimana hal tersebut juga mendorong tingginya tingkat kepadatan lalu lintas di Indonesia. Hal tersebut menyebabkan suatu hambatan bagi kendaraan-kendaraan prioritas yang ingin melintas karena alasan kedaduratan. Salah satu solusi dari pemerintah adalah pemberian hak bagi kendaraan-kendaraan tertentu agar dapat menggunakan sirine dan lampu isyarat sebagai tanda peringatan bagi pengendara lainnya. Kemudahan akses dalam memperoleh sirine dan lampu isyarat membuat sebagian masyarakat juga ingin mendapatkan hak prioritas yang sama untuk menghindari kemacetan.Penggunaan sirine dan lampu isyarat yang tidak bertanggung jawab sering ditemukan di tengah masyarakat, padahal seharusnya masyarakat wajib melaksanakan hukum yang ada. Anomali tersebut terjadi karena belum adanya kepastian hukum yang mengikat para penjual perlengkapan sirine dan lampu isyarat di Indonesia. Sebuah permasalahan tidak akan selesai jika tidak dikerjakan dari akarnya; oleh sebab itu, penelitian ini ingin melihat sejauhmana pentingnya peraturan untuk penjualan sirine dan lampu isyarat diperlukan oleh masyarakat. Penelitian ini menggunakan metode penelitian yuridis normatif dan bersifat eksplanatori, dimana penulis menggunakan sumber-sumber hukum dan penelitian terhadulu yang tersedia untuk dijadikan bahan dalam penelitian.

Abstract

Indonesia as a democratic country that emphasizes the rule of law as the main foundation, makes Pancasila as the moral and philosophical foundation for the constitution and laws and regulations. This research aims to evaluate the consistency of Government Regulation Number 28 Year 2022 on the Management of State Receivables with the principles of Pancasila, as well as to assess the extent to which its practical implementation reflects the moral and philosophical values of Pancasila. The method used in this research is juridical-normative with a conceptual and statutory approach, accompanied by qualitative descriptive analysis of relevant statutory documents and legal doctrine. The results of the analysis highlight the importance that Government Regulation No. 28 Year 2022 must comply with the existing legal hierarchy, as well as consistently reflect the principles of Pancasila as a moral and philosophical foundation in the regulation of state receivables. Nonetheless, the addition of new rules concerning liability for state receivables raises debates about consistency and social justice. Therefore, it is important for the government to ensure that the implementation of the rules not only considers the legal and financial aspects, but also the social and humanitarian impacts on the individuals involved. Success in regulating state receivables should be measured by the extent to which the principles of Pancasila are respected and social justice is realized in the process, which will help strengthen the foundations of democracy and the rule of law in Indonesia.

Abstract

Changes in the parliamentary threshold in the Indonesian election are a crucial issue in the democratic system that has implications for political representation, government stability, and electoral fairness. The Constitutional Court's Decision No.116/PUU-XXI/2023 confirms that the parliamentary threshold of 4% is not fully in line with the principles of people's sovereignty, electoral justice, and legal certainty guaranteed by the 1945 Constitution of the Republic of Indonesia and the values of Pancasila. This study aims to analyze the constitutional effectiveness of changes in parliamentary thresholds and their impact on the electoral system in Indonesia. The research method used is a normative-empirical approach by analyzing the constitutionality of the parliamentary threshold based on legal documents, Constitutional Court decisions, and related legal theories. The results of the study show that the removal of parliamentary thresholds has the potential to increase more proportional political representation, provide opportunities for small and new parties to participate in government, and enrich the diversity of votes in parliament. However, on the other hand, this policy also has the potential to cause political fragmentation that can affect the stability of the government and the effectiveness of legislative decision-making. Therefore, careful policy planning is needed so that these changes remain in line with the democratic principles of Pancasila and do not interfere with legal certainty in the Indonesian electoral system. It is hoped that this research can contribute to policymakers in drafting more inclusive and democratic regulations, while maintaining a balance between the diversity of political representation and the effectiveness of government.

Abstract

Pancasila is the ideological foundation of the Indonesian state that guarantees the unity and integrity of Indonesians entering the era of globalization. Current Indonesian criminal law is obsolete because it does not consider Indonesia's philosophical, sociological, and cultural values and does not follow the changing mindset of modern criminal law. Social policy must be woven into and placed in a carefully integrated social plan, especially to prevent unwanted access related to crime. Indonesian criminal law will continue to apply colonial values that are not based on Pancasila values. The codification of laws that live in society is regulated specifically for public awareness of the potential for the law that can be used as a reference for regional regulations. The basic idea of Pancasila's balance is based on the religious moral paradigm, the human paradigm, the nationality paradigm, the democracy and wisdom paradigm, and the social justice paradigm. Justice is an abstract value that must be realized in the form of legal norms to realize these values in social life without ignoring religious law, customary law, and Western law. This does not correspond to the value contained in Pancasila.

Abstract

Migrasi internasional, terutama di antara calon pekerja migran Indonesia yang menuju ke Jepang, telah menjadi fenomena sosial yang signifikan dalam beberapa dekade terakhir. Meskipun motivasi ekonomi mendominasi keputusan mereka untuk bekerja di luar negeri, penting untuk mengakui bahwa aspek sosial dan budaya juga berperan penting. Kehilangan akar budaya dan identitas nasional selama tugas di luar negeri adalah masalah yang memerlukan perhatian khusus. Kegiatan ini bertujuan untuk menanamkan rasa nasionalisme dan patriotisme dalam para calon pekerja migran Indonesia, serta mengidentifikasi tantangan yang mungkin mereka hadapi melalui wadah PT Multi Generasi Indonesia yang sangat memperhatikan citra Indonesia di mata dunia terhadap peserta yang diberangkatkan dari perusahaan ini. Perusahaan ini menyadari bahwa nilai-nilai nasionalisme dan pemahaman calon tenaga kerja tentang nilai-nilai nasional dapat memengaruhi citra Indonesia di mata dunia. Hasilnya menggaris bawahi kebutuhan perbaikan dalam kurikulum pelatihan tenaga kerja melalui lembaga penyaluran tenaga kerja, penekanan pada program pendampingan di negara tujuan, peran aktif keluarga dan masyarakat, dan peningkatan fokus pada nilai-nilai nasional. Ini adalah langkah penting untuk memastikan bahwa pekerja migran tetap terhubung dengan budaya dan identitas Indonesia saat berada di luar negeri. Kegiatan ini memberikan landasan bagi perubahan dalam persiapan calon pekerja migran dan memperkuat peran mereka sebagai duta budaya Indonesia di mancanegara.

Abstract

Generasi Z memiliki potensi besar untuk memainkan peran yang signifikan dalam Pemilu 2024. Dengan karakteristik dan keterampilan unik yang dimiliki, generasi Z dapat membawa dampak besar dalam proses politik dan masyarakat. Penelitian yang menggunakan metode penelitian yuridis normatif merupakan penelitian yang mengkaji peraturan-peraturan hukum atau norma-norma yang berlaku untuk mengevaluasi atau menganalisis suatu konsep atau hubungan hukum. Dengan potensi-potensi ini, partisipasi aktif Generasi Z dalam Pemilu 2024 dapat menjadi kekuatan yang mendorong perubahan positif dalam politik dan masyarakat. generasi milenial memiliki kontribusi suara tertinggi dalam Pemilu, menunjukkan bahwa keputusan politik dan arah masa depan Indonesia secara signifikan dipengaruhi oleh preferensi dan partisipasi politik generasi ini. Dengan potensi-potensi ini, partisipasi aktif generasi Z dalam Pemilu 2024 dapat menjadi kekuatan yang mendorong perubahan positif dalam politik dan masyarakat. Penting bagi para pemimpin politik dan lembaga terkait untuk memastikan bahwa suara generasi Z didengar dan diwakili dengan baik, sehingga kebijakan publik dapat mencerminkan kebutuhan dan aspirasi mereka. Oleh karena itu, penting bagi para pemimpin politik dan lembaga-lembaga terkait untuk memperhatikan aspirasi dan kebutuhan Generasi Z dalam proses politik dan memastikan bahwa suara mereka didengar dan diwakili dengan baik.

Abstract

Indonesia, as a state based on the rule of law, adheres to the principle that every governmental act must be grounded in applicable regulations. Nevertheless, in practice, there are circumstances not explicitly addressed by legal provisions, creating the necessity for public officials to exercise discretionary authority. Discretion serves as a mechanism that enables flexibility in administrative decision-making to address legal gaps while remaining within the limits of existing legal frameworks. This study examines the concept, scope, principles, and boundaries of discretionary authority in administrative law and evaluates the Minister of Trade’s exercise of such authority in the 2015–2016 sugar import case. Employing a normative juridical method with legislative and conceptual approaches, this research reveals that discretion is tightly regulated to prevent abuse of power, including the requirement of procedural compliance and inter-agency coordination. The findings from the sugar import case demonstrate that although the Minister’s policy was intended to serve the public interest, it did not comply with procedural coordination requirements and breached established procedures, thereby raising disputes over the legality of the discretionary action. The study concludes that discretion must always be carried out in accordance with the principles of legality, accountability, and effective coordination between relevant governmental bodies. This study contributes to clarifying the boundaries between legitimate discretion and abuse of authority within Indonesia’s state administrative law framework.

Abstract

The land sector digital transformation represents a core aspect of Industrial Revolution 5.0 because it requires human-technology collaboration. The Ministry of Agrarian Affairs and Spatial Planning/National Land Agency (ATR/BPN) launched electronic land certificates as a strategic move to enhance public administration efficiency and service transparency and land ownership legal certainty. The new system creates multiple difficulties which affect data protection and legal frameworks and administrative safeguarding of land ownership rights. The research investigates electronic land certificate distribution through state administrative law and community legal protection frameworks. The research design combines normative juridical analysis with evaluations of applicable laws and regulations and doctrinal interpretations and judicial decisions and digital technology integration in land administration. The research findings demonstrate that electronic land certificate distribution through blockchain systems or integrated servers provides reliable and efficient operations yet faces security threats and conflicting rules and user digital competence restrictions. The legal framework requires alignment between Law No. 11 of 2008 about Electronic Information and Transactions and Law No. 5 of 1960 about Basic Agrarian Principles and BPN implementing regulations to validate rights holder protection. The Industrial Revolution 5.0 requires electronic land certificate implementation to include enhanced data protection systems and digital bureaucracy accountability measures and flexible legal oversight that protects community rights through technological advancements.

Abstract

The government provides education for every citizen and community, including persons with disabilities. From the data in the field, it was found that very few schools and tertiary institutions have infrastructure facilities for persons with disabilities. The main point of discussion in this study is that higher education in services for disability facilities has not been optimally provided in educational environments evenly, only available in a number of state universities, while the private sector has not been many and able to provide infrastructure facilities for disabilities. The method used in this research is the sui generis method in legal research which is called the normative legal method. The 1945 Constitution of the Republic of Indonesia, especially those that regulate disability, namely Law number 8 of 2016, in implementation it is not yet relevant according to the contents in the preamble to the 1945 Constitution of the Republic of Indonesia and has not been realized optimally according to article 31, especially in several private tertiary institutions not yet available service facilities for persons with disabilities overall. It would be nice for the tertiary level, especially private universities, to provide support for people with disabilities with the support of the government, in the teaching and learning process to provide facilities, for example according to the competence of study programs or those with disabilities who are most interested.
