Abstract

The majority of people do not know that the importance of personal identity in the law and that there are many things that a person can do using one's personal identity, and can lead to unlawful acts, thus causing people who are unfamiliar with this law to suffer losses due to some individuals who are irresponsible in bringing order. Population administration in areas specifically in Bengkulu Province, Mukomuko Regency. This research method is Empirical Legal Research, with data sources obtained through interviews with the Mukomuko Police. The research results show that law enforcement regarding the dissemination of population data is regulated in the Population Administration Law. The process includes investigation, arrest and trial with the principles of justice. Protection of data confidentiality is strictly regulated, important for maintaining individual privacy and public trust. The obstacles to law enforcement include lack of public awareness, technical obstacles, and limited resources. Collaborative efforts from the government, law enforcement agencies and the community are needed to increase awareness, resources and technology to overcome these obstacles.

Abstract

This research explores the integration of local wisdom in community-based disaster mitigation strategies in Bengkulu, an area prone to natural disasters such as earthquakes and tsunamis. Although local wisdom holds significant potential in reducing disaster risks, there are still gaps in its application within formal mitigation policies. A qualitative approach was used to explore local wisdom practices through ethnographic study, in-depth interviews, and policy document analysis. The findings indicate that while there have been some integration efforts, existing mitigation policies are primarily technical and do not fully account for the potential of local culture as a significant adaptive resource. The study also emphasizes the importance of community empowerment through culture-based education to enhance disaster preparedness and compliance with mitigation regulations. The integration of local wisdom with spiritual principles is expected to provide a strong legal foundation for involving communities in disaster mitigation efforts, creating a more holistic, effective, and sustainable approach

Abstract

The revision of Indonesia's Criminal Code (KUHP) introduces restorative justice as a mandatory consideration in sentencing, requiring judges to evaluate forgiveness from victims or their families as part of the sentencing process. This study examines the implications of this provision when applied to sexual violence cases, particularly in relation to the Sexual Violence Crime Law (UU TPKS), which expressly prohibits non-judicial settlement as a form of victim protection. Using a normative legal research method supported by statute, conceptual, and case approaches, this article analyzes the interaction between the KUHP and the UU TPKS, alongside documented cases where victims experienced pressure to accept restorative agreements. Drawing on victimology and feminist legal theory, the study highlights the risk of revictimization, unequal bargaining power, and reinforcement of patriarchal structures when restorative justice is used in sexual violence cases. Findings show that applying restorative mechanisms to such cases creates legal uncertainty and contradicts the protective mandate of the UU TPKS. This article argues that restorative justice must be normatively limited and not applied to sexual violence. Clear regulatory harmonization and trauma-informed implementation guidelines are necessary to ensure a victim-centered approach to justice when the new KUHP becomes fully enforceable.

Abstract

Kekerasan seksual di lingkungan perguruan tinggi merupakan pelanggaran hak asasi manusia yang berdampak multidimensi terhadap korban serta menciderai nilai-nilai moral dan etika akademik. Penelitian ini bertujuan untuk menganalisis implementasi Undang-Undang Nomor 12 Tahun 2022 tentang Tindak Pidana Kekerasan Seksual (UU TPKS) di perguruan tinggi serta mengidentifikasi tantangan struktural, kelembagaan, dan sosio-kultural yang menghambat efektivitasnya. Metode yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan, konseptual, dan kasus, serta menggunakan data sekunder yang dianalisis secara kualitatif-deskriptif. Hasil penelitian menunjukkan bahwa secara normatif UU TPKS telah memberikan dasar hukum yang kuat bagi perguruan tinggi untuk membentuk Satuan Tugas Pencegahan dan Penanganan Kekerasan di Perguruan Tinggi (Satgas PPKPT), menyusun prosedur pelaporan, dan menjamin perlindungan korban berbasis pendekatan berperspektif korban (victim-centered approach). Namun, dalam praktiknya, sebagian besar perguruan tinggi masih menghadapi keterbatasan sumber daya manusia, minimnya dukungan pendanaan, lemahnya koordinasi lintas sektor, serta rendahnya pemahaman sivitas akademika terhadap prinsip keadilan gender dan hak asasi manusia. Budaya patriarki dan relasi kuasa yang hierarkis juga menjadi hambatan signifikan dalam pelaporan dan penanganan kasus. Penelitian ini menegaskan bahwa keberhasilan implementasi UU TPKS di perguruan tinggi bergantung pada sinergi antara aspek hukum, kelembagaan, dan budaya, serta pada partisipasi aktif mahasiswa dalam forum advokasi kampus yang terbukti mendorong peningkatan pelaporan dan transparansi. Rekomendasi penelitian ini menekankan pentingnya penguatan kapasitas kelembagaan, evaluasi berkelanjutan, serta pendanaan berkeadilan untuk mewujudkan kampus yang aman, inklusif, dan bebas dari kekerasan seksual.

Abstract

The phenomenon of baby dumping in Indonesia is a complex criminal offense intersecting with moral, social, and legal dimensions. This study aims to analyze the regulatory framework for baby abandonment regarding the enactment of Law No. 1/2023 (the New Criminal Code/KUHP) and Law No. 35/2014 on Child Protection. Using a normative legal research method with a statutory approach, this study examines primary and secondary legal sources. The findings indicate that Articles 429–431 of the New Criminal Code reorient the provisions on child abandonment from the old Criminal Code toward a progressive justice system emphasizing restorative justice. However, these provisions still overlap with the Child Protection Law, which acts as a lex specialis by imposing more severe criminal sanctions. The novelty of this research lies in its critical analysis of legal synchronization precisely at the transition moment of the National Criminal Code's enactment as of January 2026, mapping the jurisdictional dualism between codified general criminal law and child protection law. Consequently, the success of law enforcement at this juncture heavily depends on the readiness of law enforcement officials, regulatory harmonization, and the strengthening of community-based preventive strategies through inter-institutional synergy and increased public awareness.

Abstract

The criminalization of cohabitation under Article 412 of Law No. 1 of 2023 on the Criminal Code has sparked debate over the legitimacy of government interference in individuals' private domains. This study aims to analyze the philosophical basis of criminalizing cohabitation through the perspectives of legal pluralism and privacy rights, assess its proportionality within a democratic constitutional order, and explain the legal and sociological consequences of implementing this article. This research is a normative legal study with a qualitative, descriptive-analytical approach, utilizing normative and philosophical legal methods by examining primary, secondary, and tertiary legal materials. The results indicate that criminalizing cohabitation does not meet the principles of proportionality and harm in modern criminal law, because consensual relationships between two adults do not cause concrete harm to third parties. Furthermore, it violates privacy rights protected under Article 28G (1) of the 1945 Constitution and Article 17 of the ICCPR, and creates tension within Indonesia's pluralistic legal landscape. The application of this article has the potential to trigger overcriminalization and social stigmatization, thus requiring a reinterpretation of the complaint offense and the prioritization of the principle of ultimum remedium to maintain a balance between public morality norms and individual human rights guarantees within a democratic rule of law framework.

Abstract

Sekolah dasar negeri sadarkarya di kabupaten musi rawas, adapun masalah yang dihadapi masih kurangnya penerapan pemanfaatan sampah di lingkungan sekolah dan kurangnya fasilitas pendukung. Tujuan diadakan program ini tentunya ada banyak manfaat yang bisa diraih oleh siswa, guru dan warga sekitar sekolah adapun dapat meningkatkan kesadaran akan dampak buruk yang ditimbulkan untuk kesehatan dan supaya mampu menanggulangi masalah kesehatan di masyarakat. menciptakan lingkungan yang sehat dan mengningkatkan kualitas siswa dan guru yang lebih sehat dari program ini supaya lingkungan sekolah yang bersih dan sehat agar proses belajar dan mengajar berjalan dengan lancar serta menjaga kesehatan murid dan warga sekolah. Kegiatan ini untuk mengajak anak anak terutama siswa SD Sadarkarya menerapkan pemanfaatan sampah yang berguna dalam kehidupan sehari-hari agar terhindar dari penyakit. Hasil yang saya dapat setelah melakukan edukasi ini lingkungan sekolah yang tadinya sudah menjadi sumber penyakit, sekarang lingkungan sekolah tersebut sudah bersih dari sisa-sisa sampah anorganik maupun organik dan 80% siswa sepenuhnya sudah memahami begitu penting menjaga lingkungan. Harapan saya kepada siswa maupun pihak sekolah yang terlibat agar selalu menerapkan edukasi yang sudah di terapkan oleh mahasiswa KKN Universitas Muhammadiyah Bengkulu sepenunya.

Abstract

This study aims to analyze the authority of the governor in proposing regional regulation drafts (Raperda) in Bengkulu Province from a constitutional law perspective. Such authority constitutes an essential part of the executive function in the regional legislative process, reflecting the principles of decentralization as well as the relationship between the regional government and the Regional House of Representatives (DPRD). This research employs a normative juridical method with statutory and conceptual approaches, supported by an analysis of governance practices at the regional level. The results indicate that, normatively, the governor’s authority in proposing Raperda has been clearly regulated by prevailing laws and regulations. However, in practice, several issues persist, including overlapping authority between the executive and legislative branches, the dominance of local political interests, limited institutional capacity, and weak inter-agency coordination. From a constitutional law perspective, these conditions demonstrate that the implementation of checks and balances and good governance principles in the regional legislative process has not been fully optimized. Therefore, strengthening regulatory frameworks, enhancing institutional capacity, and improving coordination mechanisms and public participation are necessary to ensure the effective exercise of the governor’s authority in proposing regional regulations..
