Abstract

Berdasarkan penelitian yang telah dilakukan untuk memahami tentang ta’zir nusyuz isteri terhadap suami dalam al-Qur’an yang menjelaskan bahwasanya pernikahan yang dianjurkan oleh Islam dimaksudkan pertama sebagai cara yang sehat dan bertanggung jawab dalam mewujudkan cinta dan kasih sayang antara laki-laki dan perempuan. Oleh karena itu, pernikahan juga akan menimbulkan akibat hukum, baik berupa hak maupun kewajiban suami isteri. Ketika seorang isteri tidak menjalankan kewajibannya dengan baik, maka isteri tersebut bisa dikatakan nusyuz. Nusyuz isteri menurut Husein Muhammad, keluarnya isteri dari rumah tanpa izin dan tidak taat terhadap suami, serta keengganan untuk berhubungan intim dengan suami tanpa alasan yang benar. Hasil penelitian menunjukkan dalam Hukum Islam, Allah menetapkan pernikahan dan hak-hak kewajiban bagi suami isteri. Jika isteri tidak menjalankan kewajibannya dengan baik, maka isteri bisa dikatakan nusyuz. Hak seorang suami yang berhak untuk memberikan ta’zir kepada isteri, dengan cara meninggalkan tempat tidurnya. Sedangkan pemikiran Husein Muhammad mengenai ta’zir nusyuz isteri terhadap suami dalam al-Qur’an adalah menentukan perbuatan nusyuz isteri terhadap suami yang berkaitan dengan tahapan terakhir dalam penyelesaian nusyuz, yaitu pukullah. Ada beberapa proses ta’zir untuk isteri yang berbuat nusyuz menururt Husein Muhammad, yaitu dengan cara memberikan nasehat, pisah dari tempat tidur, dan memberikan pukulan kepada isteri yang tidak melukai isterinya.

Abstract

Tulisan ini bertujuan untuk mengeksplorasi bagaimana Kompilasi Hukum Ekonomi Syariah memandang transaksi jual beli akun permainan atau game online di kalangan anak muda. Permainan tersebut dikatakan game online karena ada kaitanya dengan internet yang tentunya juga memerlukan data seluler atau kuota internet. Game tersebut seperti game Clash Of Clans, PUBG, Mobile Legend, HAGO, Free Fire, Domino Gaple Online, dan lain sebagainya. Secara umum akun game online bukanlah sesuatu yang lazim diperjualbelikan. Maka dari itu, tulisan ini mencoba mengungkapkan bagaimana analisis dalam Kompilasi Hukum Ekonomi Syariah terhadap jual beli tersebut. Hasilnya ditemukan bahwa jual beli akun game online merupakan jual beli yang sah, karena memenuhi rukun dan syarat dalam jual beli. Terdapat kesesuaian dalam transaksi jual beli akun game online dengan ketentuan yang ada di Kompilasi Hukum Ekonomi Syariah. Akun game online merupakan benda yang dzohir (tampak) atau ada, akun game online juga bisa diserahkan dan mempunyai ketentuan harga tersendiri. Akun game online tersebut sama-sama diketahui kekhususannya oleh penjual dan pembeli, serta jika ditransaksikan jual beli akun game tersebut mempunyai nilai tertentu.

Abstract

Marriage dispensation is an exception made in emergency situations, and in Islam, it can be applied without violating the principles of Islamic law. It means it can be carried out as long as it complies with the legal requirements of the state and Islamic law, and there is evidence of permission from the Religious Court because of, for example, pregnancy out of wedlock. The purpose of this study is to examine the psychological and juridical implications of marriage dispensation. To help couples understand the purpose of marriage, they must be mentally and physically prepared. The results of this study indicate the impact of psychologically immature marriage dispensation on mindset and psychological immaturity. Therefore, if rules and evidence are not limited, it will lead to several problems such as increasing divorce rates, low economic conditions, vulnerability to domestic violence, and so on. Meanwhile, the juridical impact of Law No. 16 of 2019 indeed regulates marriage dispensation only in a normative sense. However, in practice, sociologically, there is room to facilitate marriage dispensation. Meanwhile Islamic law does not have specific provisions regulating marriage dispensation because most scholars only affirm that maturity (baligh) is a prerequisite for someone's marriage to be valid, without specifying a minimum age limit for marriage.

Abstract

This study investigates the academic challenge of reconciling economic development with ecological sustainability in the context of coastal reclamation in Tapakerbau, Sumenep, Indonesia—a process that has generated social conflict, environmental degradation, and distributive injustice. Utilizing the maqāṣid framework, the research employs a qualitative socio-legal methodology, incorporating in-depth interviews, field observations, and analysis of legal documents alongside a review of literature on Islamic environmental jurisprudence (fiqh al-bī'ah). The findings reveal that, despite the brief duration of the reclamation project, it resulted in initial ecological damage, restricted fishermen’s access to coastal resources, and reinforced the dominance of local political and economic elites. This study emphasizes the significance of environmental preservation (ḥifẓ al-bī'ah) as a fundamental objective within the framework of maqāṣid discourse, particularly in the context of contemporary ecological challenges. It highlights the imperative for coastal development models that are inclusive, participatory, and ecologically equitable. Practically, the Tapakerbau case provides a crucial lesson for environmental conservation in Indonesia, emphasizing the importance of addressing sustainable development and environmental justice issues.

Abstract

A hidden defective product in an online buying and selling transaction is selling a product whose condition is not in accordance with the original purpose of making the product. The product does not meet the proper product standards and has decreased function due to damage caused by the negligence of business actors, whether intentional or not. The most widely used platform in online buying and selling is personal media or social media, where there are only two parties to the trade agreement, namely business actors and consumers, so legal protection for consumers in this phenomenon is absolute and very much needed. The existence of a form of consumer loss from the case of hidden defective products certainly violates what is the provision of muamalah in sharia. Therefore, this research aims to analyze the application of Islamic business ethics to hidden defective products in online trade transactions and legal protection efforts that can be provided to consumers who suffer losses due to hidden defective products. This research uses the normative juridical analysis method to see the extent of legal protection efforts against consumers and how Islamic business ethics view the phenomenon. This study concludes that business actors who deliberately sell hidden products in online buying and selling clearly violate Islamic business ethics which prohibit hiding defective goods, unlike business actors who do not know the defects in the product, but business actors still have an absolute obligation to be responsible to consumers. The form of legal protection efforts for consumers of hidden defective products has been regulated in such a way in Law Number 8 of 1999 concerning Consumer Protection and the Civil Code.   [Produk cacat tersembunyi dalam transaksi jual beli online adalah menjual produk yang kondisinya tidak sesuai dengan tujuan awal pembuatan produk. Produk tersebut tidak memenuhi standar produk yang semestinya dan mengalami penurunan fungsi akibat kerusakan yang disebabkan oleh kelalaian pelaku usaha, baik disengaja maupun tidak. Platform yang paling banyak digunakan dalam jual beli online adalah media personal atau sosial media, yang mana hanya terdapat dua pihak yang melakukan perjanjian perdagangan yaitu pelaku usaha dan konsumen, maka perlindungan hukum terhadap konsumen dalam fenomena ini bersifat mutlak dan sangat dibutuhkan. Adanya bentuk kerugian konsumen dari kasus produk cacat tersembunyi tentu saja melanggar apa yang menjadi ketentuan bermuamalah dalam syariat. Oleh karena itu, penelitian ini bertujuan untuk melakukan analisis terhadap penerapan etika bisnis Islam terhadap produk cacat tersembunyi dalam transaksi perdagangan secara online dan upaya perlindungan hukum yang dapat diberikan kepada konsumen yang mengalami kerugian akibat produk cacat tersembunyi. Penelitian ini menggunakan metode analisis yuridis normatif untuk melihat sejauh mana upaya perlindungan hukum terhadap konsumen dan bagaimana pandangan etika bisnis Islam terhadap fenomena tersebut. Penelitian ini menyimpulkan bahwa pelaku usaha yang sengaja menjual produk tersembunyi dalam jual beli online jelas melanggar etika bisnis Islam yang melarang untuk menyembunyikan barang cacat, berbeda halnya dengan pelaku usaha yang tidak mengetahui adanya cacat pada produk tersebut, namun pelaku usaha tetap memikul kewajiban mutlak untuk bertanggungjawab kepada konsumen. Abstract

Management of the implementation of Law No. 33 of 2014 aims to achieve an increase in the making of halal certificates for business people in Jambi province. To find out how the management of the implementation of the law, data collection was carried out with a qualitative approach through interviews, observations, and documentation methods to the Halal Task Force under the Ministry of Religion of Jambi Province. The results of the study found that the management of the implementation of Law No. 33 of 2014 in Jambi Province uses collaborative management. All activities are well planned, and supervision and inspection are carried out by the Halal Product Guarantee Agency (BPJPH), the Halal Examining Agency (LPH), and the Indonesian Ulema Council (MUI) in accordance with the job descriptions listed in the law. The division of tasks is carried out centrally and supervisory authority applies decentrally. Planning, implementation, and supervision involve BPJPH, LPH, MUI, Ministry of Religious Affairs, local government, private sector, and the community. The study recommends that the central and regional governments encourage the acceleration of halal certificates by maximizing socialization in each ministry and providing assistance to micro and small businesses.

Abstract

The definition of positive law was law in the form of laws that regulate the relationship between humans and humans, or with legal entities, while the understanding of Islamic law was a system of 'obligations' and 'prohibitions' rather than specific laws. Islamic law was broadly defined by rules which were the result of understanding and deduction from the provisions revealed by Allah SWT to the Prophet Muhammad SAW. Therefore, the main sources of Islamic law were the Qur'an and Hadith. source of pure positive law from society. This was due to the retrieval or discovery of positive law using the inductive method. That was by observing the actions and attitudes of community members. From these observations, general regulations that bind the whole community were made. In this article, the author tried to explain further the analysis of the concepts and sources of the two laws, and their comparative analysis

Abstract

The phenomenon of cohabitation in Indonesia is becoming increasingly prevalent, in line with social changes in modern society, which tends to be more open to relationships outside marriage. This situation raises legal issues concerning the boundaries between the private sphere of the individual and the state’s authority to regulate public morality. Under the provisions of the Criminal Code (Law No. 1 of 2023), cohabitation is classified as an offense punishable under certain conditions, thereby sparking debate within society. This study employs a normative legal methodology using both a legislative and a conceptual approach. The data sources consist of primary, secondary, and tertiary legal materials analyzed qualitatively. The issues addressed in this study include how the criminalization of cohabitation is regulated under Indonesian positive law. Furthermore, this study examines the perspective of Islamic law on cohabitation. Another issue is why there is debate regarding the criminalization of cohabitation in Indonesia. The research findings indicate that the criminalization of cohabitation under Indonesian positive law is regulated as a complaint-based offense, limiting law enforcement to specific parties. From an Islamic law perspective, cohabitation is a prohibited act as it falls under the category of zina, which contradicts the principles of Sharia. The debate arises due to a conflict between moral and religious values and the principles of privacy rights and individual freedom within the modern legal system.

Abstract

This study examines how Islamic economic law is implemented in Indonesia’s maritime border region, focusing on the Riau Islands, and explains why its application in this socially plural, geographically fragmented, and transnational setting differs from more institutionally developed regions. This research employed a qualitative explanatory case study in three areas of the Riau Islands Province: Batam City, Tanjungpinang City, and Lingga Regency. Primary data was collected through participatory observation and in-depth interviews with 14 informants, including government officials, religious leaders from Islamic organizations, practitioners of Islamic economics, and operators of halal SMEs; secondary data was obtained from an analysis of dozens of reputable academic articles and relevant books. The data were analyzed thematically using the Miles and Huberman interactive model and validated through triangulation and member checking. The study finds that Islamic economic law is practiced primarily as a lived ethical system rather than as a fully formalized legal framework. In many local transactions, values such as honesty, fairness, trust, and the avoidance of riba are strongly maintained, yet formal sharia contracts, regulatory support, and institutional access remain uneven, especially in island and peripheral areas. Its implementation is shaped by low Islamic financial literacy, limited institutional infrastructure, dispersed geography, and continuous negotiation between sharia principles, market efficiency, and interfaith social relations. The findings are limited to a qualitative case study in three locations and therefore are not statistically generalizable to all maritime border regions. However, they highlight the need for context-sensitive policies, literacy strengthening, and community-based Islamic economic development. This study contributes to Islamic economic law scholarship by bringing border-region evidence into a field largely dominated by urban and institutional studies, showing that implementation depends not only on legal formalization but also on local culture, social networks, and transnational realities.
