Abstract

This article aims to examine corruption practices in the regions carried out by political dynasties and prevention efforts from the perspective of responsive constitutional law. It will examine the motives of political dynasties, forms of corruption by dynasties, factors that cause dynasties and efforts to prevent. This article uses a socio-legal method that is an interdisciplinary approach in the study of law by combining social sciences or humanities. Secondary data mainly comes from case, regulations and library. The results of the study show that the dynasties tend to practice the forms of corruption in the regions: corruption in the buying and selling of regional government positions and corruption in regional infrastructure projects originating from the Regional Budget Revenue. Factors causing political dynasties: the high cost of regional head elections and the absence of laws prohibiting dynastic practices in regional head elections. Efforts to prevent the practice of political dynasties for regional head elections from the perspective of responsive constitutional law are in the form of policies to regulate the regional head election system that prioritizes the principle of responsibility for public demands and provides alternative solutions through: reducing the cost of regional head elections, lowering the threshold for candidacy, changing the financing of regional head elections from the Regional Revenue Expenditure Budget to the State Expenditure Budget, separating local and national elections, a political culture that educates the people in voting, and policies for the welfare of the people in order do not elect dynastic candidates in regional head elections.

Abstract

There are too many overlapping MSMEs determination policies which result in hampering MSMEs empowerment. The dynamics of global change require a fast and responsive response because, without policy reformulation, economic growth will stagnate or even slow down. This article delves into the necessity of regulatory reform to enhance the ease of doing business for MSMEs, using the Omnibus Law method. Conducted as normative legal research, this study uses normative legal research and analyzes secondary data to examine the existing challenges. The findings reveal various obstacles faced by MSMEs, including complexities in obtaining business licenses, cumbersome tax payment systems, limited access to business capital, and the absence of a formal business entity. To address these regulatory issues, alternative solutions are proposed through the Omnibus Law method, emphasizing the simplification of regulations, fostering public participation, and harmonizing both vertical and horizontal regulations. Moreover, drawing lessons from the Netherlands, where the government established the Dutch Advisory Board on Regulatory Burdens (ATR) to reduce administrative burdens on SMEs, Indonesia can prioritize similar measures to simplify regulations and lower costs. By emulating the ATR's independent and collaborative approach, Indonesia has the potential to establish its own advisory body, fostering a supportive business environment for SMEs and promoting economic growth.

Abstract

Campus sexual violence is a pervasive issue affecting institutions worldwide, with a concerning upward trend in reported incidents. This article scrutinizes legal policies and the efficacy of collaborative governance in mitigating this pervasive problem. The model of collaborative governance, a globally recognized legal policy approach, is at the heart of this study. Utilizing socio-legal research methods, the article employs comparative legal and conceptual legal approaches, drawing from secondary literature sources. The study reveals that the implementation of legal policies and collaborative governance can significantly curb campus sexual violence in Indonesia. This can be achieved by actively engaging both academic community and the wider public. By drawing lessons from countries such as the United States, the Netherlands, Canada and the United Kingdom, Indonesia can replicate their success in reducing campus sexual crimes. These measures include the creation of legal policies, establishing partnerships with central and local governments, and fostering collaborative governance. Key initiatives that have proven effective in these countries include the development of service guidelines that prioritize victim and survivor protection, amplified anti-sexual violence campaigns on campuses, and the promotion of sexual violence awareness education. The establishment of a National Campus Sexual Assault Commission to evaluate the enforcement of educational ministerial regulations and religious affairs ministerial regulations in preventing and addressing campus sexual violence is also recommended. This article offers valuable insights for policymakers in their efforts to devise effective legal strategies to prevent sexual violence on campus.

Abstract

Abstract

ABSTRAKMelakukan peran sebagai sarana edukasi dan hiburan, film bermuatan budaya memiliki nilai lebih karena di dalamnya penonton berkesempatan untuk belajar mengenai persamaan dan perbedaan antar budaya. Eksistensi film sebagai sarana hiburan memungkinkan masyarakat menyerap dengan lebih mudah unsur-unsur budaya yang sebelumnya tidak mereka ketahui dan pahami. Melalui kegiatan pendampingan untuk menambah pemahaman budaya, kegiatan pengabdian masyarakat ini mengajak siswa-siswa SMA untuk memiliki literasi budaya sehingga topik tayangan film yang di dalamnya terdapat unsur-unsur budaya seperti etika, norma, gaya hidup dapat mereka sikapi dengan bijakKata kunci : film, budaya populer, literasi budaya, pemahaman budaya  ABSTRACTPlaying its role as a means of education and entertainment, films with cultural content have added value since the audience has the opportunity to learn about the similarities and differences among cultures. Abstract

Persaingan dunia UMKM semakin beragam dan berkembang seiring dengan makin dinamisnya perkembangan ekonomi dewasa ini. Untuk menghadapi persaingan, setiap produk UMKM perlu mengembangkan strategi promosinya dengan baik agar tujuan yang ingin dicapai dapat diraih.. Para pelaku UMKM khususnya yang berelasi langsung dengan konsumen seperti pedagang sayur, perlu mengembangkan model promosi yang tidak konvensional. Kajian dalam artikel ini merupakan hasil dari kegiatan penyuluhan kepada komunitas pedagang sayur Jamiatul Nisa Kabupaten Karanganyar. Dengan metode ceramah, diskusi dan latihan sederhana, para peserta memahami seluk beluk menyusun promosi usaha yang lebih menarik yang bisa mereka terapkan melalui media sosial.Kata kunci : promosi, komunitas, media sosial, sosialisasi Competition in the world of UMKM is increasingly diverse and growing along with the increasingly dynamic economic development today. To face competition, every UMKM  product needs to develop a good promotion strategy so that the objectives can be achieved. UMKM sellers, especially those who are directly related to consumers such as vegetable traders, need to develop unconventional promotion models. The study in this article is the result of socialization activities for the Jamiatul Nisa vegetable trader community in Karanganyar Regency. Using lectures, discussions and simple exercises, the participants understood the strategies in developing more attractive business promotions that they could apply through social media.Keywords: promotion, community, social media, socialization

Abstract

Indonesia’s Election Management Bodies (EMBs), constitutionally mandated to manage legislative and presidential elections, face substantial risks, including accidents and fatalities. However, their social security rights are often overshadowed by the focus on civil servants and private-sector workers. This study, employing normative legal research, urges the need for state protection of EMBs’ social security rights, drawing on secondary data sources. EMBs should receive comprehensive work-related accident benefits, death benefit programs, and old-age protection schemes from the Workers Social Security Agency (BPJS Ketenagakerjaan). The legal basis for these social security rights can be found in several legislative provisions, including the Indonesian 1945 Constitution, the National Social Security System Law, and other related regulations. Recognizing EMBs as state-serving workers is a crucial step in safeguarding their social security rights. This recognition is not merely a matter of legal interpretation; it is a necessity to ensure a fair and secure electoral environment. By ensuring that EMBs are accorded the same rights and protections as other workers, the state can create a more equitable electoral process and reinforce the integrity of its democratic institutions.

Abstract

The idea of capitalism always refers to the triumph of the U.S. giant industry. In economic field, American and British capitalism is called as individual capitalism – the contrary of communal capitalism a la Japan and Germany. This paper is intended to examine the identity of economic character of individual capitalism in two Hollywood movies Thank You for Smoking (2006) and The Company Men (2010). Exploring the theory of individual and communal capitalism stated by Lester Thurow, it can be found that through mechanistic relationship, hard individual competition and unending punishment, those all erase emotional bound between individual and corporation. In short it becomes one of the reasons why American industry perishes its superiority slowly.

Abstract

This research aims to study and explore the phenomenon of corruption in local government and strategic efforts to prevent it from realizing good local governance. This type of research is socio-legal research with a statutory and conceptual approach and is presented in descriptive-qualitative form. The results of the study show that the factors that cause corruption in the regions are high political costs of regional elections, Regional heads' intervention in the planning of the Regional Expenditure Budget (APBD), regional heads intervene in the management of the APBD, regional heads participate in determining the implementation of permits, regional heads determine the procurement of goods and services, and regional heads buy and sell positions. The strategies to prevent corruption in the regions include reducing the political costs of direct elections, prevention through strengthening internal government supervision, prevention through the performance accountability system of government agencies, prevention through LHKPN reporting and transfer of officials' wealth to the state, and prevention of corruption favoritism.
