Abstract

Technological developments in the digital era have given rise to marketplace platforms that provide convenience in conducting buying and selling transactions online. The existence of promos in the marketplace platform raises the attraction for the community. In practice there are occnums who make fictitious electronic transactions to get a large number of promos. Delivery marketplace couriers have an important role in the completion of fictitious electronic transaction orders. The act of fictitious electronic transactions is a criminal offense as Article 378 of the Criminal Code and Article 35 of the ITE Jo Law. Article 51 Paragraph (1) of the ITE Law. Although involved in a criminal offense, the reality is that the courier is not carried out by criminal law enforcement. This research aims to examine the enforcement of criminal law against delivery marketplace couriers. This research uses legal research methods to answer problems. The results showed that there were several factors and obstacles that made criminal law enforcement against delivery marketplace couriers who completed fictitious electronic transaction orders ultimately not carried out.

Abstract

AbstractThe crackers in the Indonesian government's electronic system are very disserve on utilizing information technology and realizing the welfare. This article aims to analyze criminal law enforcement model against crackers on government electronic system related with electronic information and transaction law. The research method used is normative legal research. The results shown that the enforcement of law, especially crackers on government electronic system in the ITE Law in Indonesia, which has not materialized the idea of legal certainty as a basic value in Indonesian society and legal purposes. The criminal law enforcement model against crackers on government electronic system must refer to the ITE Law by using the law triad purpose theory based on causal priorities, not only legal certainty is achieved, but also justice and expediency. Countermeasures it can be done through preventive action as a non-penal.Keywords:Law Enforcement, Cracker, Government Electronic System, Ite Law AbstrakKejahatan yang dilakukan oleh cracker pada sistem elektronik milik pemerintah Indonesia sangat merugikan pemerintah, terutama dalam pemanfaatan teknologi informasi dan mewujudkan kesejahteraan masyarakat Indonesia. Penelitian ini bertujuan untuk menganalisis model penegakan hukum pidana terhadap cracker pada sistem elektronik milik pemerintah. Metode penelitian yang digunakan adalah yuridis normatif. Hasil penelitian menyatakan bahwa penegakan pengaturan tersebut khususnya tentang cracker pada sistem elektronik milik pemerintah dalam UU ITE di Indonesia yang ada selama ini belum mewujudkan ide kepastian hukum sebagai nilai-nilai dasar dalam masyarakat Indonesia dan tujuan hukum. Model penegakan hukum pidana tentang cracker pada sistem elektronik milik pemerintah harus mengacu pada pengaturan dalam UU ITE dengan menggunakan teori tujuan hukum berdasarkan prioritas kasuistik agar tidak hanya tercapainya kepastian hukum, tapi juga keadilan dan kemanfaatan secara bersamaan. Upaya penanggulangannya dapat dilakukan melalui tindakan preventif sebagai upaya non penal.Kata kunci: Penegakan Hukum, cracker, Sistem Elektronik Pemerintah, UU ITE

Abstract

Article 2 of Law Number 1 of 2023 regarding the Criminal Code (“KUHP 2023”) not only leaves problems in the context of legality, but also includes mechanisms for the law enforcement process, particularly regarding the measurement of the applicability of Indonesian customary law (“Adat Law”) through regional regulations. One issue that has arisen is the lack of standardized content material that must be regulated in regional regulations in order to determine the applicability of Adat (criminal) Law. This article will analyze to what extent the standard of “law that applies in the place where the law lives” and to what extent the regional regulation regulating “living law” in the perspective of law enforcement prosecutes the perpetrator. The results show that regional regulation can be used as a basis for determining the recognition of Adat Law, but there is no common standard for how to recognize Adat Law under regional regulation. As the concrete of Article 2 Indonesian Penal Code 2023, regional regulation must explicitly regulate the scope of Adat Law (criminal) application related to territorial, personal and protection principles. Meanwhile, in the case of the prohibition act and penal sanction, it needs further studies because Adat Law has no separation between criminal and civil matters.

Abstract

Criminal law should provide protection to all citizens (individually or communities) without regard to their ethnicity, race or religion. In addition, it is also important that its implementation should be done non-discriminatively.  This research is done using a normative juridical approach. The most important finding is that a number of penal regulations (inter alia, prohibiting blasphemy, genocide or in the criminal code draft relating to extra-marital sex) in its implementation and enforcement results in discrimination or even worse persecution of minority groups. The author here argues that, in order to guarantee the principle of equal treatment before the law and protection of (religious) minority groups, those penal regulations should be harmonized and read within the context of other existing penal rules.

Abstract

Constitutional Court verdict have big impact for laws development including criminal law. In criminal law, the verdict caused change in norm both arranged inside Criminal Law Code and outside Criminal Law Code. Futhermore, this issue is interesting to study when it is connected with expansion authority of Constitutional Court from negative legislator to positive legislator. Constitutional Court verdict form as ‘conditional’ verdict either constitutional or conditional inconstitutional are example of the transformed Constitutional Court authority from negative legislator to positive legislator. As known, criminal law is basing on legality principle. Thus, the verdict especially ‘conditional’ verdict raises polemic in its implementation because not all the verdict can be followed by changing criminal law formally. This situation can inflict various difference in criminal law enforcement. Constitutional Court verdict evoke changing criminal law norm by decriminalization, depenalisation, offense transformation or interpretation criminal law elements that impact on material criminal law or formal criminal law. Without any follow up by changing criminal legislation, espesially when it is related with legalty principle, law enforcement officer can rule out Constitutional Court verdict. The inconsistency of law enforcement can provoke law uncertainty and violate citizen rights

Abstract

Indonesia, a nation celebrated for its rich diversity of ethnicities and religions, embodies a societal pluralism that deeply influences perceptions of morality and acceptable behaviour. The enactment of the 2023 Criminal Code reflects these complexities, particularly in its use of "moral policing" to redefine adultery and criminalize cohabitation as moral offenses. These provisions were integrated into contentious articles during the Code's drafting and discussion phases, sparking significant debate. Proponents claim that the existence of these moral transgressions is consistent with Indonesian society's moral and religious values. Conversely, opponents argue that these provisions as an overreach by the state, infringing upon personal freedoms and disproportionately affecting religious minorities whose beliefs and practices may diverge from the majority. Adultery and cohabitation, the focal points of these provisions, are intrinsically linked to the institution of marriage. In Indonesia, marriage transcends its administrative role and is deeply embedded within religious and cultural traditions. This dual significance renders the issue particularly contentious, as interpretations of marriage vary widely across the country's diverse communities. The ambiguity surrounding the definition of "marriage" within the legal framework raises concerns about potential discrimination. Minority religious groups, particularly those whose marital practices are not formally recognized or registered, may find themselves vulnerable to legal repercussions under the adultery and cohabitation clauses.  This article seeks to delve into the nuanced effects of these regulations, focusing on their potential to disproportionately affect religious minorities and the broader question of balancing societal norms with individual liberties in a diverse nation.

Abstract

This research examines the practice of detaining suspects in defamation cases under the Information and Electronic Transactions (ITE) Law, particularly for articles with penalties of less than five years, and its conformity with the grounds for detention according to the Indonesian Criminal Procedure Code (KUHAP) from a Human Rights (HAM) perspective. Despite reduced penalties, detention practices persist based on KUHAP's subjective grounds. This study employs a normative juridical method supported by a socio-legal approach through case studies and interviews. The findings indicate that detention for ITE under 5 years is based on subjective grounds (fear of absconding, destroying/tampering with evidence, repeating the offense), assessed by investigators using various indicators. However, the application of these subjective grounds is often problematic, lacking factual validity, and prone to misuse, especially the ground of repeating the offense, which can stifle freedom of expression. This practice potentially violates the principle of detention as an ultima ratio and the presumption of innocence, drawing criticism from legal experts and civil society organizations due to its impact on human rights. This research recommends revisions to KUHAP and the ITE Law to clarify detention parameters, as well as strengthening oversight mechanisms and enhancing the capacity of law enforcement officials.

Abstract

This study discusses the rampant spread of online gambling advertisements in Indonesia, which contravenes the Criminal Code (KUHP) and Law No. 11 of 2008 on Electronic Information and Transactions (UU ITE) and its amendments, which prohibit gambling. Law enforcement faces significant challenges, one of which stems from the self-regulatory policies of Electronic System Operators (ESOs) for User-Generated Content (UGC), which do not fully prohibit online gambling advertisements. The objective of this study is to analyze the spread of such advertisements and the legal framework governing ESOs for UGC based on cyberlaw provisions. The methods used include a normative legal approach to examine principles, theories, and legal history, as well as a sociological legal approach utilizing secondary data through the integration of legal and social sciences. This research is descriptive-analytical, using data from literature reviews and semi-structured interviews. The results of the study indicate that the spread of online gambling advertisements is driven by the advertising features of PSE UGC and the weak effectiveness of existing self-regulatory policies. Additionally, the government is deemed to have been lenient in imposing administrative, criminal, or civil sanctions on PSE UGC, exacerbated by the ambiguous provisions of the Criminal Code (KUHP) and the ITE Law regarding gambling regulations. The research recommendations are for the government to pressure PSE UGC to strengthen internal policies regarding the prohibition of online gambling content, enforce administrative sanctions strictly, and revise ambiguous phrases in the Criminal Code and ITE Law to clarify regulations and strengthen law enforcement efforts against the spread of online gambling advertisements in Indonesia.

Abstract

Perkembangan teknologi di era digital telah memunculkan platform marketplace yang memberikan kemudahan dalam melakukan transaksi jual beli secara online. Keberadaan promo dalam platform marketplace memunculkan daya tarik tersendiri bagi masyarakat. Dalam praktiknya terdapat oknum yang melakukan transaksi elektronik fiktif untuk mendapatkan jumlah promo yang banyak. Kurir marketplace pengantar barang memiliki peran yang penting dalam terselesaikannya order transaksi elektronik fiktif. Perbuatan transaksi elektronik fiktif merupakan tindak pidana sebagaimana Pasal 378 KUHP dan Pasal 35 UU ITE jo. Pasal 51 Ayat (1) UU ITE. Meskipun terlibat dalam suatu tindak pidana, kenyataannya terhadap kurir tersebut tidak dilakukan penegakan hukum pidana. Penelitian ini bertujuan untuk mengkaji penegakan hukum pidana terhadap kurir marketplace pengantar barang. Penelitian ini menggunakan metode penelitian hukum untuk menjawab permasalahan. Hasil penelitian menunjukkan bahwa terdapat beberapa faktor dan hambatan yang membuat penegakan hukum pidana terhadap kurir marketplace pengantar barang yang menyelesaikan order transaksi elektronik fiktif pada akhirnya tidak dilakukan.

Abstract

This paper discusses the impact of the regulation of gross violation of human rights in the Penal Code 2023 on the validity of the principles stipulated in Act Number 26, 2000 as the special law. The method used is normative research with data collection through literature study. The findings show that regarding the Article 187 and Article 620 of the Penal Code 2023, it can be said that these articles have actually provided a ‘guarantee’ to ensure that the existence of the Penal Code 2023 will not reduce or have any impact on the special principles in Act Number 26,2000. This is then strengthened by the provisions of Article 622 paragraph 1 letter m which only revokes several articles from the Act, namely Articles 8, 9, 36-40 on criminal offenses and sanctions for gross violation of human right. By using the theory of codification & the amendment of Article 3 of the Penal Code 2023, it was revealed that the regulation on gross violation of human right in the Penal Code 2023 is potentially to create new problems, from the issue of conflict of principles to of multiple interpretations. Different interpretations of Article 187, Article 620, and Article 3 of the Penal Code 2023 can actually lead to the inapplicability of special principles stipulated in Act Number 26, 2000, therefore, the provisions of gross violation of human right, in the future, are very likely to be subject to the general principles contained in Book I of the Penal Code 2023.
