Abstract

This research is a qualitative study with a descriptive-analytical (field research) approach aimed at examining the practice of selecting a prospective husband through a lottery mechanism to solve cases of out-of-wedlock pregnancy, viewed from the perspective of structural functionalism. The primary focus of this study is the social phenomenon occurring in the community of Purwosari Village, Babadan Sub-district, Ponorogo Regency, where a lottery marriage is conducted to determine which man must marry a pregnant woman when the actual father is unknown. The data were obtained through direct field observations, in-depth interviews with community figures, and documentation studies. The primary data sources include local community members, victims, family members, religious leaders, and village officials. Data collection methods comprised participatory observation, in-depth interviews, and document analysis. The data were analyzed qualitatively using Talcott Parsons’ structural functionalism theory, particularly the four AGIL schemes (adaptation, goal attainment, integration, and latency), along with Peter L. Berger’s theory of social construction through the stages of externalization, objectification, and internalization. The results show two main findings: (1) The lottery marriage practice due to out-of-wedlock pregnancy is perceived by some community members as a pragmatic solution, despite contradicting religious norms and legal standards that only permit marriage with the actual biological father; (2) Although considered a temporary solution, this practice raises negative social implications such as normalizing premarital sexual behavior and creating instability in family structures. In conclusion, lottery marriage is a form of social adaptation to urgent situations, yet it cannot serve as a long-term solution due to its moral and legal contradictions.

Abstract

This study aims to explore and understand the concept of family resilience in couples who do not yet have children in Balerejo Village, Kebonsari District, Madiun Regency. Family resilience is essential to study because even though they have not been blessed with children, these couples can still maintain the integrity and harmony of their household. This study is a qualitative study with a phenomenological approach. Data were collected through in-depth interviews with four couples who experienced the absence of children in their married life. Data analysis techniques were carried out thematically to find patterns of meaning that shape family resilience. The study results show that family resilience is formed through several essential aspects: open communication, emotional support between couples, involvement in religious activities, and utilization of social resources in the surrounding environment. In addition, couples also demonstrate the ability to manage psychological stress, develop survival strategies, and maintain hope for having children. The strength of interpersonal relationships, spirituality, and adaptation to reality influences the success of couples in preserving family integrity even without children. These findings provide important insights into family survival strategies and resilience, which can be used to strengthen social and psychological interventions for couples in similar situations.

Abstract

The phenomenon of career women undergoing the waiting period (‘iddah) after the death of a spouse raises legal and social challenges, particularly regarding the implementation of Islamic rules amid professional responsibilities. This study analyzes the practice of ‘iddah among female teachers at MTs YP. KH. Syamsuddin Duri Sawo and to evaluate the school's leave policy through the lens of maṣlaḥah and maqāṣid al-sharī‘ah. This is qualitative research using a case study approach. Primary data were collected through in-depth interviews with teachers, the principal, and foundation officials, while secondary data came from institutional policy documents and Islamic legal literature. Data collection methods included interviews, observation, and documentation, with data analyzed interactively through reduction, presentation, and conclusion-drawing stages. The results show that the implementation of ‘iddah among the teachers does not fully comply with classical fiqh rules, particularly regarding leaving the house, adorning oneself, and the duration of ‘iddah, yet is practiced within socially and professionally accepted boundaries. The 40-day leave policy the school applies is not ideal in normative terms, but it contains significant benefits in protecting life, intellect, and wealth. In conclusion, the observed practice of ‘iddah can be justified Islamically through the concepts of maṣlaḥah mursalah and maqāṣid al-sharī‘ah, reflecting the flexibility of Islamic law in responding to the realities faced by modern career women.

Abstract

Background/Introduction: Marriage practices based on Javanese customs are still widely found in Pupus Village, Lembeyan District, Magetan Regency. One enduring tradition is the prohibition of certain marriages, which continues to be strongly believed by the community. Research Objectives: This study aims to examine the level of community belief in marriage prohibitions within Javanese customs and to analyze the underlying social construction. Methodology: This research employs a descriptive qualitative field approach. Data were collected through interviews, observations, and documentation, and analyzed using data reduction, data display, and conclusion drawing. Results: The findings indicate that community belief is influenced by the tradition of ilmu titen, which has been passed down through generations. The social construction is formed through three stages: externalization (adjustment to cultural values), objectification (acceptance as a collective heritage), and internalization (the absorption of values into individuals). Differences in education level and religious understanding also affect the degree of belief. Unique Contribution: This study contributes to socio-cultural studies by applying social construction theory to explain the persistence of marriage prohibitions in a rural Javanese context. Conclusion: Marriage prohibitions persist due to strong social construction embedded in community life. Recommendations: Efforts are needed to promote contextual religious and cultural education and to encourage further research integrating local traditions with contemporary perspectives.

Abstract

This study aims to examine Imam al-Ghazali's contribution to the formation of the usul al-fiqh scientific framework through an analysis of his monumental work, al-Mustasfa min 'Ilm al-Ushul. Using a qualitative method with a descriptive-analytical approach, this study traces the structure of thought, methodology, and integration between philosophical rationality and Islamic scientific tradition in the work. The results of the study show that al-Ghazali succeeded in compiling a comprehensive ushul al-fiqh system by balancing between naqli evidence and aqli approach. Al-Mustasfa is considered the pinnacle of the development of the mutakallimin school of ushul al-fiqh and an important reference in the study of classical to contemporary Islamic law. This research emphasizes that al-Ghazali's contribution is not only normative, but also methodological, capable of bridging the need for ijtihad across eras.
