Abstract

Jalan adalah suatu fasilitas public yang sangat vital bagi mayarakat. Namun di samping itu, banyak sekali aktifitas-aktifitas pelanggaran yang mengakibatkan terganggunya fungsi jalan. Pelanggaran-Pelanggaran tersebut yaitu menggunakan jalan dengan menutup jalan tersebut. Penutupan yaitu menjadikan tidak terbuka (seperti mengatupkan, mengunci, merapatkan) atau menyatakan tidak boleh di lalui atau di masuki. Konsekuensi Hukum dari pihak yang menutup jalan bertanggung jawab baik secara pidana maupun secara perdata. Seperti halnya kasus yang terjadi di Desa Tarahan, Kecamatan Katibung Kabupaten Lampung Selatan, Provinsi Lampung. Dimana terdapat pembangunan jalan di atas tanah sengketa dengan kepemilikan sertifikat pribadi dan tanah sengketa yang dijadikan jalan tersebut juga merupakan hasil dari Reklamasi Pantai. Dengan adanya permasalahan tersebut, Pihak yang memiliki sertifikat tersebut melakukan Penutupan jalan yang sudah di bangun dari hasil mereklamasi Pantai.

Abstract

Logico-empiricism emphasises the importance of empirical verification as a scientific criterion for distinguishing meaningful from meaningless statements. Although logico-empiricism has made significant contributions to the development of the philosophy of science and has been practically beneficial for every legal scholar, criticisms of the a variety of assumptions underlying logico-empiricism have emerged from several perspectives. Therefore, this article is important to write in order to: 1) explain and deepen the criticisms of logico-empiricism assumptions by focusing on the perspective of dogmatic legal science; 2) offer an alternative epistemology to address these criticisms. This study uses a conceptual approach supported by secondary data sources. The results show that there are six criticisms of the logico-empiricism assumptions of the logical positivism paradigm when viewed from the perspective of dogmatic legal science. These criticisms highlight the tendency of logico-empiricism to reduce legal complexity, limit the scope of explanation, generalise inappropriately, raise questions of objectivity, and ignore social, political, and societal dynamics in the formation and application of law. This critique also demonstrates the limitations of the logico-empiricist approach, necessitating a more inclusive and interdisciplinary alternative epistemology. Several alternative epistemologies proposed to address criticisms of logico-empiricism include hermeneutics, pragmatism, phenomenology, and falsificationism. It is also possible to integrate these various approaches to form a complementary methodological framework, which the author calls "critical-pragmatic hermeneutic phenomenology." This approach is advantageous because it is holistic, open to revision, contextual, practically useful, and respectful of human experience.

Abstract

This study examines the basis for judges' considerations in issuing decisions on cases of violence or threats of violence that force minors to engage in sexual intercourse, with a focus on Decision Number 433/Pid.Sus/2022/Pn. Kot. The background of this study was driven by the rise in cases of sexual violence against children which often place children in vulnerable positions due to unequal power relations and dependence on adults. The case raised in this study highlights how psychological coercion is used by perpetrators to control underage victims. The problems in this study are: the factors causing perpetrators to commit crimes of violence or threats of violence that force underage victims to engage in sexual intercourse with them or with others based on the study of decision number 433/Pid.Sus/2022/PN. Kot. and the basis for judges' considerations in issuing decision number 433/Pid.Sus/2022/PN. Kot. The research method uses a normative juridical and empirical juridical approach. The normative legal approach is pursued through a literature review, examining relevant laws, doctrines, and legal literature. Meanwhile, the empirical approach involves interviews with parties involved or directly familiar with the case to obtain a factual picture of the application of the law in the field. The results of the study indicate that the causal factors of this crime originate from internal aspects in the form of deviant sexual desires from the perpetrator, as well as external aspects including the influence of the social environment, weak moral control, and the negative impact of technological developments. Regarding the judge's considerations, it was found that the decision was taken based on two main bases. Juridically, the judge assessed the fulfillment of the criminal elements in Article 81 paragraph (1) of the Child Protection Law by emphasizing the existence of psychological violence and pressure that made the victim helpless. Non-juridically, the judge considered the deep trauma experienced by the victim as well as the existence of peace efforts and compensation from the defendant's family as mitigating factors in imposing sanctions. The recommendation from this study is that the government and society should continue to focus on strengthening sexual education in schools, increasing the role of families and communities in building awareness of ethics and the impact of sexual violence, and disseminating correct information to the public.

Abstract

Public participation in the drafting of regional regulations (Peraturan Daerah) is a fundamental element in realizing a strongly legitimate local democracy. Normatively, the Indonesian legal system has recognized and regulated the right of public participation in the regional legislative process through Law Number 12 of 2011 in conjunction with Law Number 13 of 2022 concerning the Formation of Legislation and Law Number 23 of 2014 concerning Regional Government. However, empirical evidence shows that public participation in drafting regional regulations remains procedural and symbolic, not yet fully reflecting the principles of deliberative democracy. This article aims to critically analyze the normative ideal of public participation in the drafting of regional regulations, the empirical practice of public participation in various regions in Indonesia, and the factors that prevent such participation from becoming a substantive manifestation of deliberative democracy. This research employs a normative juridical method, drawing on legislative, conceptual, and court decision approaches, specifically using Jürgen Habermas's theory of deliberative democracy as the main analytical framework. The study's findings indicate that although the normative framework has opened up space for public participation, its implementation remains dominated by a procedural democratic paradigm that emphasizes formal stages without ensuring the quality of deliberation. Public participation is often limited to consultation forums that lack rational dialogue, are characterized by unequal power relations, and lack adequate feedback mechanisms. As a result, the regional regulations may lose social legitimacy. This article recommends strengthening the institutional design of public participation, oriented toward substantive deliberation, to achieve democratic, responsive, and equitable regional legislation.
