Abstract

Spatial planning policy in Indonesia is not effectively implemented due to land conversions and other problems. This occurs since the spatial planning policy is sectoral especially since the enactment of regional autonomy. This research accordingly tries to explain how the management of spatial policy in Indonesia compared to the Netherlands. The method used was juridical normative. The results of the research showed that in its implementation of spatial policy in Indonesia, regional governments have the authority to make their own policy. Nevertheless, the spatial policy in the Netherlands is based on efforts to improve and secure accessible space with the first priority on users. Therefore, although the spatial policy is based on the community participation, the control remains on the Central Government’s hand. In conclusion, it takes comprehensive measures and social participation to formulate spatial policy. Keywords: comparative law, policy, spatial planning

Abstract

Diawali dari premis bahwa transaksi ekonomi internasional belum diatur secara umum oleh hukum nasional, artikel ini ingin melihat peran perjanjian internasional mengatur globalisasi ekonomi. Artikel ini menyelidiki rezim internasional yang mengatur tentang harmonisasi di era globalisasi melalui nasionalisasi norma transnasional. Dengan melihat konvensi hukum perdata internasional, seperti konvensi hukum acara perdata tahun 1954, perhatian artike ini ditujukan kepada kemungkinan untuk diberlakukan kepada negara-negara anggota ASEAN. Saran penulis adalah ratifikasi norma transnasional di atas merupakan cara paling efektif untuk melaksanakan norma transnasional dalam lingkup nasional

Abstract

Introduction to The Problem: Evidence is a process carried out by the parties in resolving disputes to prove the arguments presented before the judge who decides the legal dispute so that the judge can decide as fairly as possible. Evidence under the civil procedure law is regulated in Article 164 HIR. Supreme Court decision number 3591K/Pdt/2018 discusses documentary evidence in the form of an agreement to transfer and transfer land rights and states that the deed has no legal force.Purpose/Objective Study: The purpose of the study was to determine the legal considerations for the strength of authentic deed evidence in the Supreme Court Decision number 3591K/Pdt/2018, connected with civil procedural law. The research method used is a normative juridical approach to the research specification in descriptive-analytical analysis and qualitative normative.Design/Methodology/Approach: The method used in this research is normative juridical research which focuses on the applicable legal provisions.Findings: The research results that the authentic deed submitted by the Defendants in the Reconvention as evidence has external and formal evidentiary power. However, authentic deeds that are perfect and binding do not have a coercive or decisive character. Authentic deed evidence can be invalidated if there is evidence of the opponent which can prove otherwise. Based on the decision of the Supreme Court number 3591K/Pdt/2018, the Notarial Deed of the Transfer of Land Rights Agreement has no legal force because land rights have been transferred and building use rights are attached.Paper Type: Research Article

Abstract

Penelitian ini mengajukan permasalahan untuk diteliti sebagai berikut. Pertama, bagaimana kewajiban ahli waris terhadap utang pewaris berdasarkan hukum Islam. Kedua, bagaimana pertanggungjawaban ahli waris sebagai debitor pailit terhadap perjanjian jaminan perorangan yang dibuat pewaris ditinjau dari aspek hukum Islam. Metode Penelitian yang digunakan adalah penelitian hukum normative, yaitu penelitian kepustakaan yang sumbernya menggunakan data sekunder yang terdiri dari bahan hukum primer, sekunder, dan tersier. Hasil penelitian menyimpulkan, pertama, ahli waris dari pewaris pemegang jaminan perorangan jika ditinjau dalam aspek hukum waris Islam, maka ahli waris mempunyai kewajiban untuk membayar utang dari pewarisnya sebagaimana ditentukan dalam Pasal 175 ayat (2) Kompilasi Hukum Islam. Kedua, akibat hukum bagi ahli waris pemegang jaminan perorangan dipailitkan maka tidak dapat dilakukan sitaan umum terhadap segala harta kekayaan milik ahli waris untuk melunasi seluruh utang kreditornya. Artinya, tanggungjawab ahli waris bersifat terbatas. Ahli waris hanya bertanggungjawab melunasi utang sebatas dari harta peninggalan pewaris dan tidak diwajibkan untuk menutupi kekurangan yang timbul karena harta peninggalan tidak cukup bagi pelunasan utang.

Abstract

AbstrakPraktik Korupsi, Kolusi, dan Nepotisme (KKN) yang terjadi di Indonesia dan dilakukan oleh oknum-oknum penegak hukum, termasuk Hakim (judicial corruption) serta Aparatur Sipil Negara (ASN) yang lainnya disebabkan oleh berbagai faktor yang sangat beragam. Namun, rusaknya integritas moral orang per orang adalah faktor internal yang paling dominan yang menjadi penentu terjadinya KKN, sedangkan variabel eksternalnya dapat dikarenakan adanya kecenderungan gaya hidup konsumtif, hedonis, serta kondisi sosial budaya yang cenderung menitikberatkan pada hal-hal yang bersifat duniawi. Sikap asketis (zuhud) diharapkan mampu menangkal fenomena di atas. Seyogianya sikap tersebut inherent dalam diri setiap warga bangsa, terutama para penyelenggara negara serta penegak hukum. Tanpa sikap asketis yang disertai dengan integritas moral serta integritas keilmuan yang tinggi, maka harapan serta upaya membersihkan perilaku KKN di Indonesia akan sia-sia.Kata Kunci: korupsi yudisial, KKN, integritas moral, hakim, Aparatur Sipil Negara. Judicial Corruption and Corruption, Collusion and Nepotism (CCN) in IndonesiaAbstractIn Indonesia, corruption, collusion, and nepotism (CCN) committed by law enforcement officers, including judges and other state's apparatus has been caused by a number of significant factors. However, lack of moral integrity of individuals is regarded as the most dominant internal factor. In addition, there are some external factors which have been contributed to the practice of CCN, including life style, hedonistic, as well as social cultural condition that stimulate consumerism behaviour. It is argued that ascetic behaviour (zuhud) would become the plausible way to prevent CCN. Furthermore, such behaviour should be inherent in the heart of every citizen in particular the state's apparatus and legal enforcement officers. Abstract

This Research focus in Judicial Corruption between community. This research as kualitative descriptive, Based on the description discussed in introduction and discussion section, there are some conclusion that can be drawn as follows: According to the examples given, it is true that judicial corruption that involves government officers occurs in the judiciary institutions. Based on the result of observation, it is found that judicial corruption does not only performed by government officers, but it also involves other parties, in this case; advocates and defendants. Essentially, judicial corruption behavior is also influenced by people’s misconception of legal culture. As the justiciabelen or the seeker of justice, what is perceived by people is to win the civil case, or not to be imprisoned for criminal case. Therefore, this kind of legal culture always uses economic approach. It is true that one of factors that influence the judicial corruption is the violation of government administration law. In this case, such violation is performed by the government officers that are assisted by the advocates altogether.

Abstract

Applicability of the rules of the positive law of a country is limited by territorial boundaries that country. While the legal relationship that lasted between members of the community of nations always occurs and exceeds the limits of the territorial sovereignty of the state law. Therefore, the national law of the countries should continue to be pursued in order to be able to answer a variety of transnational issues that exist. The effort is certainly not intended to be uniform throughout the internal legal system of sovereign states, but merely an attempt to harmonize the rules of international private law. While problem solving for issues specific civil law will be made by the judicial bodies of each country. In order to accommodate this reality, is a conditio sine qua non for Indonesia to consider measures to make international agreements in order to enrich the rules of civil procedure law court. The problem, at least to face the coming force of AFTA in the ASEAN region should be harmonization between the legal systems of the individual ASEAN member countries. If not, the difficulty for the difficulties to be faced every country, when the demands of the right form of execution verdict handed down in a country can not be implemented in other sovereign nations. The situation is certainly less beneficial terms of economic cooperation. Therefore, the establishment of a model law for a convention in the form of the ever pursued by countries in the European region, reasonably considered to be a model in drafting the ASEAN convention. At least these efforts will support the objective of allied countries to achieve harmonization of laws between countries in the ASEAN region. Abstract

Sistem hukum setiap negara bangsa yang merdeka serta berdaulat di dunia, lazimnya akan ditentukan atau dipengaruhi oleh ideologi yang dianut oleh bangsa tersebut. Tidak terkecuali Sistem Hukum yang berlaku di Indonesia. Republik Indonesia yang sejak dikumandangkannnya Proklamasi Kemerdekaan 17 Agustus 1945 sampai sekarang, secara tegas maupun diam-diam; disadari maupun tidak telah mewarisi sisa-sisa tertib hukum kolonial yang terdiri atas struktur (termasuk segala bentuk prosesnya) serta substansinya, juga terus menerus berupaya untuk menyelaraskan sistem serta struktur, dan substansi hukum yang diwarisi itu dengan sistem yang hidup dalam masyarakat yakni menggunakan hukum adat yang bermuatan tradisi bangsa dengan “local characteristic”-nya. Bagi Indonesia, idealnya untuk membangun suatu sistem hukum nasional yang modern dalam era globalisasi di samping mengandung “local characteristic” seperti Ideologi bangsa Pancasila, kondisi-kondisi manusia, alam, dan tradisi bangsa, juga harus mengandung kecenderungan-kecenderungan internasional (international trends) yang diakui oleh masyarakat dunia yang beradab. Tanpa melakukan upaya penyelarasan semacam itu, maka Indonesia sebagai suatu negara bangsa akan terombang-ambing dalam menghadapi persoalan yang timbul, baik dalam menangani persoalan internal masyarakatnya sendiri maupun dalam menangani persoalan-persoalan yang melibatkan masyarakat bangsa-bangsa di dunia. Oleh karena itu, peranan ideologi Pancasila menjadi sangat penting sebagai sumber jatidiri, kepribadian, moralitas, dan haluan kehidupan bangsa, sekaligus landasan ideal bagi pembentukan sistem hukum Indonesia yang akan dibangun pada masa yang akan datang.

Abstract

Sexual violence is a term that refers to derivative sexual behavior or relationships that are distorted, harming the victim and destroying peace in society, for example, cases of sexual violence that occur to women (including girls) are carried out by those closest to them. Based on the fact sheets in the 2020 Komnas Perempuan Annual Records, sexual violence was perpetrated by 1,528 boyfriends, 425 biological fathers, 322 uncles, 205 stepfathers, 192 husbands, 89 siblings, and 58 biological grandfathers. This research is a normative legal research. One form of violence against women is sexual violence. From the available data it appears that sexual violence in places against women is as much as non-sexual violence. In our country's Criminal Code it only includes articles on rape or obscenity, this is what is then from a human rights perspective, the position of women's human rights feels humiliated and even abused, while human rights issues in our country already have rules that regulate and even guarantee human rights guarantees for everyone. namely Law Number 39 of 1999 concerning Human Rights

Abstract

The terminology is not only just a figment or slander. In fact, its present has been confirmed by the establishment of the Judicial Mafia Eradication Task Force by President Susilo Bambang Yudhoyono. Lately, some important events have occurred in Indonesian judiciary organs. The welfare improvement program for judges, which was manifested by the Judicial Commission, Government and Parliament of the Republic of Indonesia in the form of increased allowances of judges, has not been able to significantly erode the corrupt behavior of some unscrupulousgreedy judges.Therefore, in order to respond to the objective conditions that occur lately, the President of the Republic of Indonesia has to 9establish Policy Package on Law Reformation for judicial authorities in Supreme Court.
