Abstract

Applicability of the rules of the positive law of a country is limited by territorial boundaries that country. While the legal relationship that lasted between members of the community of nations always occurs and exceeds the limits of the territorial sovereignty of the state law. Therefore, the national law of the countries should continue to be pursued in order to be able to answer a variety of transnational issues that exist. The effort is certainly not intended to be uniform throughout the internal legal system of sovereign states, but merely an attempt to harmonize the rules of international private law. While problem solving for issues specific civil law will be made by the judicial bodies of each country. In order to accommodate this reality, is a conditio sine qua non for Indonesia to consider measures to make international agreements in order to enrich the rules of civil procedure law court. The problem, at least to face the coming force of AFTA in the ASEAN region should be harmonization between the legal systems of the individual ASEAN member countries. If not, the difficulty for the difficulties to be faced every country, when the demands of the right form of execution verdict handed down in a country can not be implemented in other sovereign nations. The situation is certainly less beneficial terms of economic cooperation. Therefore, the establishment of a model law for a convention in the form of the ever pursued by countries in the European region, reasonably considered to be a model in drafting the ASEAN convention. At least these efforts will support the objective of allied countries to achieve harmonization of laws between countries in the ASEAN region. Abstract

Civil law suits according to law should be performed in a simple, quick, cost efficient manner.  Notwithstanding that, it is generally known that the procedure of filing and completing a civil law suit is not as easy as it seems. Understandably even the Civil Procedural Law made specifically for the Indonesian population (Het Herziene Indonesich Reglement) made available the ruling that parties may appoint legal counsel to represent them before court.  The author addresses this practice before Indonesian civil court. Data was collected through observation and interviews.  One finding is that almost 90% of all civil court cases registered involves the use of legal counsels.

Abstract

Hak atas Kekayaan Intelektual khususnya hak cipta atas karya motif batik Cirebonan Trusmi merupakan hal penting sebagai upaya perlindungan karya cipta motif dari penggunaannya oleh pihak lain secara tidak sah dan melanggar hak pengrajin. Pengrajin tersebut telah menghasilkan kreasi seni batik yang baru, namun belum semua dicatatkan hak ciptanya dan belum menggunakan QR Code untuk dicetak pada produk batiknya sebagai identitas dan pencegah penjiplakan/pelanggaran hak cipta kreasi seni batiknya. Adapun tujuan PPM ini adalah memberikan pemahaman pengrajin Batik Cirebonan Trusmi terhadap hak cipta, memberikan pemahaman pengrajin Batik Cirebonan Trusmi tentang perlindungan karya batik yang berteknologi serta mendorong penciptaan karya seni batik lainnya. Metode PPM dilakukan melalui sosialisasi Hak Cipta, sosialisasi QR Code, pencatatan Hak Cipta dan penggunaan QR Code pada produk batik kepada para pengrajin batik Cirebonan Trusmi yang berada di daerah di Desa Trusmi Wetan dan Trusmi Kulon, Kecamatan Plered, Kabupaten Cirebon, Jawa Barat. Berdasarkan hasil PPM, pemahaman para pengrajin Batik Cirebonan Trusmi terhadap hak cipta dan bentuk Kekayaan Intelektual lainnya sebelum dilakukan kegiatan PPM ini masih minim, akan tetapi peningkatan pemahaman terjadi setelah kegiatan sosisalisasi dan diskusi sehingga para pengrajin memahami bahwa karya cipta batik yang dibuat perlu memperoleh perlindungan hukum dengan cara didaftarkan. Pemahaman para pengrajin Batik Cirebonan Trusmi tentang perlindungan karya batik yang berteknologi belum begitu baik, akan tetapi ketika telah dilakukan sosialisasi dan pendampingan pembuatan QR Code dan batik QR Code, para pengrajin mulai paham bahwa terdapat teknologi yang dapat dikolaborasikan dalam karya seni batik yang mendorong penciptaan karya seni batik cirebonan lainnya.

Abstract

The rapid evolution of the labor market, accelerated by the ASEAN Economic Community and an influx of job seekers, intensifies competition not only for employment but also for career stability within companies. At the same time, businesses face mounting pressure to stay competitive, often turning to mergers and acquisitions as a strategy for growth and survival. Yet, while these corporate moves may strengthen business prospects, they often leave workers in a precarious position, facing potential job loss or uncertain changes to their employment status. This research explores the legal protection of workers post-acquisition, focusing on Law No. 13 of 2003 on Manpower and analyzing relevant court decisions. The findings reveal that although acquisitions do not automatically terminate employment contracts, they frequently disrupt workers’ rights, exposing them to unexpected vulnerabilities. This study underscores the urgent need for stronger legal safeguards to protect workers from the fallout of corporate restructuring. By highlighting gaps in current labor protections, this research contributes to ongoing discussions on labor law reform, offering insights for policymakers, legal practitioners, and business leaders striving to balance corporate interests with workers’ rights in an increasingly volatile economic landscape. Ultimately, it raises a critical question: in the wake of corporate acquisitions, who truly stands up for the workers?

Abstract

This study analyzes the legal and operational challenges hindering Indonesia's State Intelligence Agency (BIN) from effectively coordinating national intelligence activities. Findings reveal that BIN's establishment via presidential regulation, rather than statutory law, weakens its authority over law-based agencies like TNI and Polri, causing coordination failures. The absence of constitutional recognition, a permanent coordinating body, and enforcement mechanisms further exacerbates these issues. Urgently, the research proposes: (1) elevating BIN's legal status through constitutional amendment, (2) creating a binding coordination body, and (3) implementing oversight safeguards. These reforms aim to strengthen Indonesia's intelligence system against dynamic threats while balancing centralized authority with democratic accountability. The study contributes a practical framework aligned with international best practices (Thailand and Netherlands) to address critical national security gaps.

Abstract

There is a disharmony between PBI PKBI and PADG PKBI with the PDP Law, P2SK Law, SPK Law and PBSSN Common Criteria in terms of regulating the obligation to use privacy reliability certificates by financial sector business actors under BI, so that there are many cases of customer personal data breaches. By using normative and empirical juridical methods, this study analyzes efforts to harmonize the regulations related to privacy certification obligations in the financial sector under BI. The results of the study show that with grammatical, systematic, and teleological legal interpretation, PBI PKBI and PADG PKBI can be harmonized regarding the privacy reliability certificate as the legal object in question and the nature of the regulatory norms, but it is not harmonized regarding the status of the privacy reliability certificate as a mandatory SNI, because both PBI PKBI and PADG PKBI as technical regulations in the perspective of the SPK Law have not stipulated SNI ISO 15408-2, 15408-3, or 15408-5 as the referenced standard.

Abstract

In the digital age, the use of electronic evidence in civil disputes has become increasingly common. However, judges often face significant challenges in accepting and evaluating electronic evidence due to concerns about its authenticity, integrity, and relevance. This paper examines the factors contributing to judicial doubts regarding electronic evidence in Indonesian civil litigation and explores the implications of such doubts on the resolution of legal disputes. Drawing on case law, legal theory, and practical challenges, the paper identifies key issues such as the ease of manipulation, lack of standardized procedures for collecting and preserving digital evidence, and the limited understanding of technology among many judges. These factors create a significant barrier to the effective use of electronic evidence in court, leading to delays, case dismissals, or unjust outcomes. The paper also discusses potential solutions to overcome these challenges, including the need for clearer legal frameworks, the role of forensic digital experts, and judicial education in information technology. By addressing these concerns, this paper aims to highlight the critical importance of building trust in electronic evidence, ensuring its proper use in civil dispute resolution, and promoting a more efficient and fair legal process. Ultimately, the study proposes strategies to strengthen the role of electronic evidence in Indonesian civil law while maintaining judicial integrity and ensuring the protection of all parties involved.
