Abstract

in article 213 of the Act. No. 27 Of 2009 concerning the authority of Inter-Time Replacement had triggered a polemic because it was eliminated, raising the demands of the public who want accountable board members, both in terms of political performance and ethical behavior. Therefore, PAW itself is resurfaced by being regulated in Law No.13 of 2019. The problems of this study are: 1) How is the mechanism of Inter-Time Turnover of Dpr Members in the Indonesian State System? and 2) What is the existence of Inter-Time Change in the Indonesian democratic system?. The type of research and problem approach used is normative legal research. Primary and secondary sources of legal materials. The collection technique in this study is the library study technique. And collected and analyzed by interpretation. The result of this study is PAW from members of the House of Representatives conducted based on the rule of legal mechanisms stipulated in Law No. 27 of 2009. While the operational implementation is contained in the Regulation of the House of Representatives of the Republic of Indonesia Number 1/DPR RI/I/2009-2010 on The Code of Conduct.

Abstract

For people with disabilities, mobility is important, especially in obtaining public services through the expansion of access to avoid discrimination because of its integral role in participating in social activities. This paper aims to discuss the forms of legal protection and its implementation for persons with disabilities in the Tabanan Regency. Then, it is also intended to explore the conditions of legal guarantee provisions for disabilities related to access to public services. This study is classified as an empirical legal study that uses various methodological approaches, including sociology of law; conceptual, and legislation. Meanwhile, the study data collected were obtained through literature studies, interviews, and observations. In the end, it was discovered that there were adequate provisions regarding regulations that discussed legal protection for persons with disabilities whose rights were targeted in the formation of related laws. Meanwhile, several obstacles faced in the implementation of legal protection related to access to public services, among others, limited awareness of parents with children with disabilities, budget funds, and the lack of professionalism of human resources. Finally, the regulations stipulated on the protection of the human rights of persons with disabilities must be made into a Tabanan district regulation.

Abstract

Saat ini pelayanan perizinan mengalami kemajuan dengan penggunaan elektronik yang dikelola dengan OSS pada Dinas Penanaman Modal dan Pelayanan Terpadu di Kota Denpasar, adapun permasalahannya adalah 1) Bagaimana Efektivitas Penerapan Sistem Online Single Submission (OSS) dalam pengurusan Izin Pariwisata pada Dinas Penanaman Modal dan Pelayanan Terpadu Satu Pintu di Kota Denpasar? dan 2) Faktor apa sebagai penghambat dalam pelayanan perizinan Pariwisata pada Dinas Penanaman Modal dan Pelayanan Terpadu Satu Pintu dan Upaya Penanggulangannya? Penelitian ini menggunakan penelitian empiris yaitu melakukan penelitian lapangan. Penerapan Sistem OSS dalam pengurusan Izin Pariwisata pada Dinas Penanaman Modal dan Pelayanan Terpadu Satu Pintu di Kota Denpasar belum efektif disebabkan masyarakat yang tidak memahami dalam akses system OSS dan kurangnya sarana prasarana. Faktor penghambat dalam pelayanan perizinan Pariwisata pada Dinas Penanaman Modal dan Pelayanan Terpadu Satu Pintu yaitu berbagai faktor seperti hukumnya, penegak hukum, sarana, masyarakat, dan kebudayaan. Upaya penanggulangannya memberikan penyuluhan cara akses melalui elektronik OSS dan melakukan regulasi aturan antara NSPK terhadap PP OSS. Saran dalam penelitian ini diharapkan memperbaiki system OSS agar tidak berbelit-belit.

Abstract

For Indonesians, transportation is a very significant activity. It is essential to understand the availability of transportation services that are orderly and entertaining, as well as appropriate to the level of traffic demand. Consequently, a single national transportation system must be created to coordinate road and transit traffic. According to Law No. 22 of 2009 on Road Traffic and Transport and Carrier Liability regarding passenger accidents in public transport on Road Traffic and Transport, the purpose of this review is to outline the various legal protections available to public transport users. By offering safe, convenient, fast, and affordable services, public transport users are afforded legal protection. Public transport must be accessible as it is a crucial daily necessity. The government is in charge of organizing the public transportation system. There are significant issues with legal protection for passengers in the increasing global competition, which requires legal protection.

Abstract

Judging from the terms and conditions of its implementation, interfaith marriage combines two different sets of rules based on their respective religious laws. In the case of an application for marriage registration between people of different religions and beliefs, the judge must adhere to the instructions set out in the circular letter that has been issued. Because of the issuance of this circular letter, married couples with different beliefs are not allowed to register their marriages at the Population Office. Researching library sources is one of the methods in conducting legal research. Both statutory methods and conceptual analytical techniques are applied in this research. Samples were obtained, processed, and then examined. After using qualitative material processing procedures, the data was presented using descriptive analysis. Laws governing the union of individuals with different religious beliefs should be included in official policy, as the Human Rights and Marriage Laws have different requirements. Therefore, the government must also quickly harmonize the various regulations related to marriage.

Abstract

Every human being is born with their own religion, ethnicity and culture. Violence in groups that want to eliminate other groups is called the crime of genocide. In connection with this, how is the regulation of genocide in human rights courts in an international perspective? and how is the settlement of genocide events in international courts? This research uses a normative research type. The regulation of genocide in international law has been regulated by the 1948 genocide convention in Article 2 and Article 3 and was first memorialized in the 1998 Rome Statute Article 6. the settlement of genocide uses peaceful settlement and forced settlement. Peaceful settlements, such as negotiations, mediation, conciliation overseen by the United Nations if the settlement does not work effectively then a forced settlement is carried out through an international court.

Abstract

Exploitation means exploitation on a large scale, usually in plantations, mining, or exploitation for personal gain. The existence of exploitation requires massive conservation efforts by all affected groups, because all components of nature need each other and play an equally important role in maintaining the balance of ecosystem resources. This includes law enforcement on the existence of protected wildlife.  The problems are: 1) What are the legal protections for protected sea turtles? 2) What legal responsibilities do the perpetrators face when exploiting protected sea turtles? Research and understand the legal protection of protected sea turtles and the legal consequences for perpetrators of exploitation of protected sea turtles. Liability for perpetrators of protected turtle exploitation may include criminal intimidation under Article 21(2)(a) jo. Article 40(2) of the Law on Biological Protection provides a maximum imprisonment of 5 years and a fine of one hundred million Rupiah.

Abstract

Sibanggede Village is one of the villages in Abiansemal Subdistrict. Geographically, Sibanggede Village is a lowland area, while to the north there are Sibang Kaja Village and Mekar Buana Village, which are located at higher elevations. As a result, during the rainy season Sibanggede Village receives waste carried from upstream areas. In addition, Sibanggede Village has a traditional market that produces waste every day, compounded by household waste management that has not yet been optimal. Therefore, the socialization of Badung Regency Regional Regulation No. 7 of 2013 concerning Waste Management is very urgent to be carried out in order to increase public awareness in waste management. Article 7 of Regional Regulation No. 7 of 2013 states that waste management is carried out through waste sorting, collection, transportation, processing, and final disposal. In terms of sorting and collection, the important roles of housewives (PKK), youth organizations (Karang Taruna), and area managers are essential. Meanwhile, in terms of transportation, processing, and final disposal, the policies lie with the Village Government and the Badung Regency Government (DLHK Office). Regarding waste management in Sibanggede Village, the village already has a Waste Bank and TPS3R facilities, as well as the commitment of housewives (PKK), represented by the PKK representative of Sibanggede Village, to assist with household waste sorting. Meanwhile, the Badung Regency Government (DLHK) will provide the necessary facilities, including residual waste processing through the construction of a TPSD in Mengwitani. Furthermore, the Warmadewa PKM team proposes that producers who manufacture packaged goods are obliged to manage their packaging waste. If this obligation is not fulfilled, it may be proposed that their business licenses be frozen or revoked, as regulated in Article 29 of Regional Regulation No. 7 of 2013 concerning Waste Management.

Abstract

Demonstrasi sebagai implementasi kebebasan menyampaikan pendapat ialah hak konstitusional yang dijamin didalam UUD Negara Republik Indonesia Tahun 1945 dan tertuang lebih lanjut dalam insrumen hukum nasional lainnya, seperti Undang-Undang Nomor 9 Tahun 1998 tentang Kemerdekaan Menyampaikan Pendapat di Muka Umum dan Undang-Undang Nomor 39 Tahun 1999 tentang Hak Asasi Manusia. Namun, pelaksanaan aksi demonstrasi sering kali dihadapkan pada tindakan represif aparat kepolisian yang tidak proporsional sehingga menimbulkan dugaan pelanggaran HAM. Penelitian ini bertujuan untuk mengetahui pengaturan hukum mengenai tindakan represif aparat kepolisian dalam pengamanan aksi demonstrasi serta menganalisis bentuk pelanggaran hak asasi manusia yang dapat timbul dari tindakan tersebut. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan konseptual melalui studi terhadap berbagai bahan hukum primer, sekunder, dan tersier. Hasil penelitian membuktikan bahwa secara normatif dalam pengamanan, kepolisian wajib mengedepankan prinsip legalitas, kebutuhan, dan proporsionalitas, serta menempatkan tindakan represif sebagai upaya terakhir. Namun, tindakan represif yang dilaksanakan secara berlebihan dan tidak proporsional berpotensi melanggar HAM, sebagaimana dijamin dalam UU No. 39 Tahun 1999 mengenai Hak Asasi Manusia dan instrument hukum lainnya. Terdapat konflik norma antara jaminan kebebasan berpendapat dan kewenangan penggunaan kekuatan oleh aparat, yang menjadikan ketidakpastian hukum dan membuka peluang penyalahgunaan kewenangan. Oleh karena itu, diperlukan harmonisasi peraturan serta penerapan pendekatan yang lebih humanis dan berbasis hak asasi manusia dalam penanganan aksi demonstrasi.
