Abstract

This article explores the significance of safeguarding customary rights of indigenous peoples in Indonesia, especially in border regions, with a specific focus on Sota District, Merauke Regency, South Papua. Customary rights, representing the supreme right to land inherited intergenerationally, hold profound social, cultural, and economic value for indigenous communities. Nevertheless, their protection is frequently impeded by agrarian conflicts, deficiencies in the legal system, and the repercussions of climate change. In border areas, customary rights become even more susceptible due to economic interests and the incongruence between government policies and local wisdom. This research employs a qualitative approach, utilizing literature reviews, interviews, field observations, and document analysis, to assess the effectiveness of the legal framework in safeguarding customary rights. Findings indicate that despite a solid legal foundation, the implementation of customary rights protection encounters numerous challenges, necessitating collaborative endeavors from various stakeholders to bolster protection and the well-being of indigenous peoples in border regions.

Abstract

Papua, with Indonesia's richest biodiversity, faces significant climate change challenges. Sustainable policies require synergy among stakeholders, including indigenous communities with their local knowledge and traditional practices. The forest, seen as "Mama" by Papuans, is crucial for their livelihood and customs. Despite their efforts to protect it, indigenous communities remain vulnerable to climate impacts. Their limited participation in planning and decision-making often leads to ineffective climate solutions. This research explores policies by regional and central governments and the active role of indigenous communities, focusing on climate change due to the conversion of customary forests into oil palm plantations and the marginalization of indigenous communities from losing their ancestral forest rights and access. The qualitative study shows that collaboration between the government and indigenous communities can enhance climate policy effectiveness. Indigenous participation enriches local knowledge and strengthens environmental commitments. The article highlights partnership challenges, such as differing perspectives and the need for flexible policy adaptation. The main recommendations are to strengthen communication and build capacity at both government and indigenous community levels for effective climate change mitigation in Papua. This collaboration could serve as a model for other regions facing similar challenges.

Abstract

Large-scale investment expansion in plantation development, food estates, and strategic infrastructure has intensified land conflicts between indigenous communities and investment actors in Merauke Regency. This article examines how the local wisdom of the Malind indigenous community functions as an adaptive strategy for resolving land disputes within an asymmetrical legal pluralism regime. Employing a qualitative socio-legal approach, this study is based on case studies conducted in Wasur, Rawa Biru, Sota, Erambu, and Yanggandur villages through in-depth interviews, participant observation, and document analysis. The findings reveal that land conflicts primarily stem from overlapping claims between customary land (ulayat) and investment concessions legitimized by state law. In the absence of meaningful access to formal legal mechanisms, the Malind community relies on customary deliberation, symbolic rituals, and clan origin narratives as mechanisms of conflict resolution and forms of counter-hegemonic legality. Drawing on legal pluralism, critical agrarian studies, and political ecology, this article argues that local wisdom should be understood not merely as cultural practice but as a form of non-state legality with political significance in defending indigenous living spaces. The study highlights the need for substantive recognition of customary law and indigenous territories as integral components of equitable agrarian governance and investment policy.

Abstract

Abstract This community service program aims to enhance the legal awareness of Wasur Village residents regarding the implementation of the Juvenile Criminal Justice System (SPPA) based on restorative justice principles. The community’s limited understanding of children’s rights within legal processes often results in the violation of those rights, both for child offenders and victims. The program was carried out through participatory legal education and training involving village officials, community leaders, teachers, and youth groups. The activities included legal seminars, interactive discussions, legal case simulations, and dissemination of educational media such as posters and videos. The results indicated a significant improvement in participants’ legal knowledge and a positive shift in community attitudes toward the concept of diversion in child case resolution. This program also strengthened collaboration between academics, village officials, and customary leaders in promoting a more humanistic and inclusive legal culture.

Abstract

Penelitian ini bertolak dari fakta bahwa dalam pendistribusian BBM yang terjadi di lapangan masih di temukannya distribusi minyak secara illegal tanpa adanya rekomendasi dari dinas perikanan kepada nelayan illegal yang tidak mempunyai izin. Tujuan dari penelitian ini adalah untuk mengetahui bagaimana pendistribusian bahan bakar minyak bersubdi kepada nelayan kecil oleh Dinas Perikanan Kabupaten Merauke berdasarkan Undang-Undang Nomor 7 Tahun 2016 Tentang Perlindungan Dan Pemberdayaan Nelayan, Pembudi Daya Ikan Dan Petambak Garam. Metode penelitian merupakan jenis penelitian menggunakan kajian sosiolegal. Secara yuridis mengkaji Undang-Undang Nomor 7 Tahun 2016 Tentang Perlindungan Dan Pemberdayaan Nelayan, Pembudi Daya Ikan Dan Petambak Garam. Secara empiris melihat kenyataan pada Pendistribusian Bahan Bakar Minyak Bersubsidi. Hasil yang didapat ialah Pada tahap pemberian rekomendasi pembelian bahan bakar minyak bersubsidi telah sesuai dengan kewenangan dari dinas perikanan akan tetapi secara das sein menunjukan bahwa ketersediaan BBM masih kurang dan terdapat beberapa masalah terkait dengan pembaharuan data kapal dan masalah teknis pendistribusian BBM bersubsidi sehingga dibutuhkan penambahan kuota terhadap subsidi BBM dan mengakomodir penambahan armada kapal nelayan yang semakin bertambah.

Abstract

Penelitian ini bertujuan untuk mengetahui efektivitas peran pembimbing kemasyarakatan dalam penanganan anak yang berhadapan dengan hukum pada Balai Pemasyarakatan Kelas II Merauke, maupun untuk mengetahui faktor-faktor yang menghambat. Penelitian ini menggunakan jenis penelitian yuridis empiris yang dilakukan pada Balai Pemasyarakatan Kelas II Merauke dengan populasi pembimbing kemasyarakatan. data yang digunakan adalah data yang bersifat primer dan sekunder dengan menggunakan tiga teknik pengumpulan data berupa penelitian kepustakaan, penelitian lapangan dan dokumentasi yang kemudian di analisis secara deskriptif kualitatif. Hasil yang diperoleh penulis dalam penelitian ini menunjukkan bahwa peran pembimbing kemasyarakatan dalam penanganan anak yang berhadapan dengan hukum pada Balai Pemasyarakatan Kelas II Merauke masih kurang dapat berjalan secara efektif, disebabkan masih terdapat kendala internal maupun eksternal sehingga perlu dilakukan peningkatan kualitas dalam penanganan anak yang berhadapan dengan hukum. adapun faktor-faktor yang mempengaruhi efektivitas peran pembimbing kemasyarakatan dalam penanganan anak yang berhadapan dengan hukum pada Balai Pemasyarakatan Kelas II Merauke adalah kurangnya sumber daya manusia pembimbing kemasyarakatan, jangkuan wilayah kerja Bapas, kurangnya sarana prasarana, kurangnya partisipasi orang tua dan pelaku, dan lambatnya koordinasi antar lembaga yang menangani anak yang berhadapan dengan hukum.
