Abstract

Prosedur pemeriksaan acara biasa di Pengadilan Tata Usaha Negara (PTUN) adalah mekanisme standar yang digunakan untuk menyelesaikan sengketa tata usaha negara, dengan serangkaian tahapan formal yang dirancang untuk menjamin keadilan dan kepastian hukum. Prosedur ini diatur oleh Undang-Undang Nomor 5 Tahun 1986 tentang Peradilan Tata Usaha Negara, yang telah diubah oleh Undang-Undang Nomor 9 Tahun 2004 dan Undang-Undang Nomor 51 Tahun 2009. Tahap pertama adalah pengajuan gugatan, baik secara langsung maupun melalui pos, sesuai Pasal 53 ayat 1 UU No. 9 Tahun 2004. Setelah itu, panitera melakukan penelitian administratif untuk memeriksa kelengkapan dan keabsahan gugatan, sebelum ketua pengadilan mengadakan rapat permusyawaratan untuk menilai kelayakan gugatan. Tahap selanjutnya adalah pemeriksaan persiapan oleh hakim anggota yang ditunjuk, untuk memastikan gugatan sudah lengkap sebelum sidang. Prosedur ini penting untuk menjamin bahwa sengketa tata usaha negara diselesaikan secara adil dan sesuai dengan ketentuan hukum yang berlaku, memberikan kejelasan dan kepastian hukum bagi semua pihak yang terlibat. Abstract

Penelitian ini mengkaji peran hakim dalam penyelesaian sengketa Tata Usaha Negara (TUN). Metode yang digunakan adalah yuridis normatif dengan studi literatur dari buku, jurnal nasional dan internasional, serta analisis putusan hakim PTUN sebagai data sekunder. Hasil penelitian menunjukkan bahwa hakim memiliki peran sentral dalam proses persidangan, mulai dari menerima, memverifikasi, dan memproses berkas perkara hingga memimpin jalannya persidangan. Hakim juga bertanggung jawab dalam menyusun putusan yang adil, berdasarkan penafsiran dan penerapan hukum yang relevan terhadap fakta-fakta yang terungkap selama persidangan. Pertimbangan hukum dalam putusan hakim melibatkan evaluasi bukti, prinsip keadilan, serta aspek moral dan etis. Putusan yang baik harus memenuhi tiga unsur utama: keadilan, kepastian hukum, dan kemanfaatan. Hakim harus memastikan bahwa putusan tidak hanya memihak salah satu pihak, tetapi juga memberikan manfaat bagi masyarakat luas. Penelitian ini menegaskan bahwa peran hakim sangat krusial dalam menjaga keadilan dan kepastian hukum, serta dalam memastikan bahwa putusan yang diambil memberikan dampak positif bagi perkembangan hukum dan kehidupan sosial. Abstract

This research aims to analyze normative juridically the decisions of the State Administrative Court (PTUN) related to the process of canceling State Administrative decisions (TUN). The method used in this research is a normative juridical method with a statutory approach and relevant cases. Analysis was carried out on PTUN decisions related to the process of canceling TUN decisions, both from a substantive and procedural perspective. The research results show that the PTUN tends to make decisions based on the principles of state administrative law, such as fairness, feasibility, and compliance with established procedures. However, there are challenges in implementing PTUN decisions that require further attention from relevant parties to ensure effectiveness and fairness in enforcing state administrative law. It is hoped that this research can contribute to deepening understanding of the process of canceling TUN decisions through a normative juridical perspective. Abstract

Setiap tindakan yang merugikan seseorang dapat diawasi oleh pengadilan, dan peninjauan tersebut dapat disalurkan melalui Pengadilan Tata Usaha Negara (PTUN). Pengadilan Tata Usaha Negara adalah salah satu pelaksana kekuasaan kehakiman bagi masyarakat yang mencari keadilan atas sengketa administrasi negara. PTUN bertujuan untuk menyelesaikan sengketa administrasi negara. Metode penelitian dalam makalah ini menggunakan metode penelitian yuridis normatif dan teknik pengumpulan data yang dilakukan menggunakan teknik analisis deskriptif, dengan sumber data sekunder, yang mencakup bahan hukum primer seperti undang-undang dan peraturan yang berkaitan dengan hak-hak anak dan istri dalam kasus perceraian, suami yang tidak terlihat, serta bahan hukum sekunder seperti buku, jurnal, artikel, dan doktrin hukum lainnya. Sengketa administrasi negara adalah sengketa yang timbul di bidang administrasi negara antara perorangan atau badan hukum perdata dan badan hukum atau pejabat administrasi negara, baik di pusat maupun di daerah, sebagai akibat dari penerbitan keputusan administrasi negara, termasuk sengketa kepegawaian berdasarkan peraturan perundang-undangan yang berlaku. Dengan metode analisis yuridis, penulis membahas eksistensi PTUN sebagai bentuk perlindungan hukum bagi warga negara dari tindakan administrasi negara (penyalahgunaan kekuasaan). Kata Kunci: Pengadilan Tata Usaha Negara, Perlindungan Hukum, Tindakan Administrasi Negara.

Abstract

This study aims to examine the legal implications and validity of nominee arrangements in the ownership structure of limited liability companies in Indonesia, particularly in the context of restrictions on foreign investment. The research seeks to analyze the alignment between the practice of nominee shareholding and the principles of legality, justice, and legal certainty as upheld in Indonesian corporate and investment law. Employing a normative juridical approach, the study focuses on written legal norms, statutory regulations, and doctrinal analysis within the national legal system. The research data were obtained from secondary legal materials, including legislation, judicial decisions, scholarly writings, and relevant literature collected through systematic document review and library research. Data were analyzed using deductive reasoning and a descriptive-analytical technique to assess the coherence and consistency among the applicable legal norms. The findings reveal that nominee practices, although often justified under the principle of contractual freedom, in substance contradict the legal prohibition on indirect foreign ownership as stipulated in investment law. Such arrangements undermine the doctrine of good faith, distort the principle of limited liability, and create ambiguity in shareholder accountability. Consequently, nominee agreements are deemed legally flawed and contrary to public order because their intent conceals actual ownership and circumvents statutory limitations. The study concludes that reformulating corporate and investment regulations is essential to ensure transparency, uphold justice, and reinforce the rule of law in Indonesia’s investment environment.

Abstract

This article aims to analyze the ongoing negotiations between Indonesia and China regarding the Natuna Islands from the perspective of international law. As a maritime nation comprising over 17,000 islands, Indonesia possesses vast territorial waters and abundant natural resources, including fisheries, minerals, and hydrocarbons. These assets render territorial disputes inevitable, particularly in contested maritime zones. The Natuna Islands, located in the northern part of Indonesia's exclusive economic zone (EEZ), have emerged as a focal point of contention with China, whose expansive claims in the South China Sea overlap with Indonesia's sovereign rights. The dispute stems from China's assertion of historical rights over the South China Sea, encapsulated in its "nine-dash line," which Indonesia rejects as incompatible with the United Nations Convention on the Law of the Sea (UNCLOS). Under UNCLOS, coastal states like Indonesia are entitled to an EEZ extending up to 200 nautical miles, encompassing rights to exploit resources and enforce jurisdiction. Incidents, such as Chinese fishing vessels entering Indonesian waters in 2016, have escalated tensions, prompting diplomatic protests and military patrols. These clashes highlight the broader geopolitical rivalry, where China's Belt and Road Initiative intersects with Indonesia's strategic interests. The ramifications of this unresolved dispute are multifaceted. Economically, it fosters instability by deterring foreign investment in resource-rich areas like the Natuna's oil fields, potentially costing billions in lost revenue. Globally, it contributes to polarization, exacerbating divisions between Western-aligned nations and those like China, while straining ASEAN unity. Politically, it undermines Indonesia's domestic stability, fueling nationalist sentiments and social unrest amid rising populism. Socially, it burdens communities dependent on maritime livelihoods, exacerbating issues like illegal fishing and environmental degradation. In light of these consequences, a peaceful resolution is imperative. Pursuing such an outcome could enhance economic prosperity through collaborative oil exploration, ensuring equitable resource sharing under international oversight. Improved border monitoring and management, facilitated by joint patrols or technology transfers, would mitigate incursions and foster trust.

Abstract

Law enforcement is the process of realizing the values of justice, certainty, and benefit in the life of the nation and state. In the context of the Indonesian legal system, law enforcement is not solely oriented towards the imposition of criminal sanctions, but also involves administrative legal instruments that are preventive and corrective in nature. Criminal provisions are used to punish violations that have a serious level of wrongdoing and social impact, while administrative sanctions are used to enforce compliance without going through lengthy criminal court proceedings. This article analyzes the relationship, differences, and application of criminal and administrative sanctions in the Indonesian legal system, as well as examining how these two instruments play a role in achieving effective law enforcement. The research method used is normative juridical with a regulatory approach and legal doctrine analysis. The results show that the effectiveness of law enforcement in Indonesia is highly dependent on the balance between repressive (enforcement) and preventive (prevention) efforts, as well as coordination between legal institutions that apply the principles of substantive and procedural justice.

Abstract

This research analyzes constitutional law in the handling of idle land based on Government Regulation Number 48 of 2025 concerning the Regulation of Areas and Idle Land. Focusing on constitutional and juridical aspects, this study evaluates the extent to which the GR aligns with the principles of Indonesia's constitutional law, such as the supremacy of law, social justice, and state resource management for the prosperity of the people as mandated in the 1945 Constitution. Idle land is a significant issue related to land ownership inequality and neglect of the social function of land, requiring state intervention for fair redistribution. The research method uses a normative juridical approach, analyzing legislation such as the Basic Agrarian Law (UUPA) and Government Regulation Number 11 of 2010, as well as court rulings and customary law, to provide a comprehensive review of the legal framework for handling idle land. The research results highlight the complexity of the problem, with factors such as unclear ownership, neglect, and regulatory deficiencies as major challenges. Government Regulation Number 48 of 2025 strengthens regulatory mechanisms by expanding coverage to areas and integrating data-based monitoring. However, obstacles such as lack of inter-agency coordination, technical limitations, and authority conflicts persist. From a constitutional law perspective, this GR supports the rule of law through attribution, delegation, and mandate of authority, ensuring transparent resource management. In conclusion, firm legal steps are necessary, including policy revisions, regulatory strengthening, and inter-agency cooperation. Recommendations include integrating digital technology and community participation for the effectiveness of Government Regulation Number 48 of 2025, to achieve agrarian justice. Further research is needed for more comprehensive solutions.
