Abstract

The Role of Wilayatul Hisbah in the implementation of Number 11 of 2002 Concerning the Implementation of Islamic Sharia in the Field of Aqidah, Worship and Islamic Propagation in Aceh Besar, with a focus on the implementation of legal norms that regulate the order of community worship, especially the regulation of congregational prayers and the cessation of activities during prayer times. This study uses a juridical-empirical method with a conceptual and legislative approach, and is analyzed descriptively-analytical. Data were obtained through literature studies, field observations, and interviews with Wilayatul Hisbah officers and community leaders in Aceh Besar Regency. The results of the study indicate that the role of wilayatul hisbah in enforcing sharia, especially the development and protection of Aqidah, has not been implemented well, where Qanun Number 11 of 2002 should be the best solution for the implementation of Islamic Sharia through routine patrols, direct appeals, and action against violations such as continuing activities, opening businesses, or conducting economic activities when the call to prayer sounds until the prayer is finished. However, awareness of some people to comply with these regulations is still low. Therefore, it is necessary to strengthen coordination between the regional government, Wilayatul Hisbah, and religious leaders so that the implementation of the qanun can be carried out consistently and effectively, while at the same time raising a shared awareness of the importance of respecting prayer times as part of orderly worship in Aceh Besar

Abstract

Perkawinan anak di bawah umur masih menjadi persoalan serius di Indonesia meskipun Undang-undang Nomor 16 Tahun 2019 telah menetapkan batas usia minimal 19 tahun bagi laki-laki dan perempuan. Di Aceh Timur, praktik ini tetap marak terjadi melalui dispensasi perkawinan dari Mahkamah Syar’iyah. Ketiadaan standar baku dalam pemberian dispensasi, minimnya sosialisasi undang-undang, serta kuatnya pengaruh adat dan tafsir fikih klasik menjadikan regulasi sulit ditegakkan secara konsisten, sehingga perlindungan hak anak menjadi lemah. Metode penelitian yang digunakan berjenis yuridis yuridis-empiris, dengan pendekatan kasus, dan perundang-undangan, data diperoleh melalui wawancara semi-terstruktur dengan pihak terkait serta studi dokumen hukum, lalu dianalisis secara tematik untuk mengidentifikasi keterkaitan antara norma hukum, praktik kelembagaan, dan realitas sosial-budaya. Hasil penelitian menunjukkan bahwa, terdapat hambatan implementasi perlidungan haka nak yang mencakup aspek struktural berupa kewenangan diskresioner mahkamah yang sering memberikan dispensasi tanpa asesmen komprehensif, aspek normatif berupa interpretasi agama yang permisif terhadap perkawinan dini, dan aspek sosiokultural berupa pandangan adat yang menganggap perkawinan dini sebagai solusi masalah moral atau ekonomi. Kondisi ini berdampak pada hilangnya akses pendidikan, meningkatnya kerentanan terhadap kekerasan dalam rumah tangga, serta risiko kesehatan reproduksi bagi anak. Upaya pencegahan seperti edukasi publik, pengetatan prosedur dispensasi, regulasi lokal, dan pelibatan tokoh agama telah dilakukan, namun masih parsial dan belum efektif.

Abstract

Used car showrooms in Banda Aceh demonstrate that this industry plays an important role in providing more affordable vehicle alternatives for the community. Showrooms such as Nazwa Jaya Mobil and Graha Jaya Mobil offer a wide selection of used vehicles that have undergone rigorous inspections to ensure quality, as well as after-sales services, including warranties and maintenance. With different approaches, these two showrooms have succeeded in attracting consumers by providing high-quality vehicles and flexible financing options. In addition, showroom owners’ ability to assess the condition of used cars suitable for resale is very important for maintaining consumer trust and preventing fraud that can harm both the showroom and the buyer. Furthermore, in terms of risk protection in used car purchase transactions, showroom owners make various efforts to protect their businesses. Measures such as strict supplier selection, vehicle condition checks, clear supplier contracts, and vehicle insurance are part of risk mitigation efforts. In the context of Fiqh Muamalah, the application of the mabī concept in the bai musāwamah contract provides a strong basis for risk protection, emphasising transparency of information, honesty regarding vehicle condition, and the use of written contracts to regulate the rights and obligations of both parties. Thus, the risk protection system applied in used car transactions can minimise losses and increase the sustainability of the showroom business.

Abstract

The growing potential for marital disharmony arising from low levels of readiness among prospective spouses—mentally, spiritually, and in terms of religious understanding—before entering married life underscores the importance of strengthening premarital counseling at the Kantor Urusan Agama (KUA, Office of Religious Affairs) as an effort to uphold maqāṣid nikah in building a sakinah family. This study aimed to examine the effectiveness of premarital counseling at the KUA of Kute Panang Subdistrict, Aceh Tengah Regency, in realizing maqāṣid nikah as the foundation for a sakinah family. A qualitative approach with field research methods was employed, using in-depth interviews with a marriage registrar (penghulu), religious counselors (penyuluh agama), and three married couples who had participated in premarital counseling. The findings show that the implementation of premarital counseling at the KUA of Kute Panang Subdistrict is effective, as indicated by the appropriateness of the content, the use of lectures and interactive discussions, and its orientation toward instilling Islamic values, spousal responsibilities, and family communication. The impact of premarital counseling is reflected in increased knowledge, attitudes, and religious behavior among prospective spouses, which contributes to the realization of maqāṣid nikah, particularly the protection of religion (ḥifẓ al-dīn), lineage (ḥifẓ al-nasl), and honor (ḥifẓ al-ʿirḍ), thereby fostering families that are sakinah, mawaddah, and raḥmah. Thus, premarital counseling at the KUA of Kute Panang Subdistrict is aligned with maqāṣid al-syarīʿah and reflects the principle of promoting benefit and preventing harm (jalb al-maṣāliḥ wa darʾ al-mafāsid) in the provision of religious services and family guidance.
