Abstract

ABSTRAKPerkembangan pembangunan dalam ranah reklamasi sudah sangat masif dilakukan di kota-kota besar di Indonesia. Kota Manado termasuk dari kota yang sangat sering melakukan reklamasi hal ini dilakukan untuk pembangunan jalan, pusat perbelanjaan, hotel dan bentuk pariwisata lainnya. Pada kenyataanya, reklamasi di Kota Manado selalu menjadi cerita yang menegangkan terutama bagi para masyarakat pesisir, maka tujuan dari artikel ini untuk mengetahui perlindungan hukum terhadap masyarakat dan lingkungan yang diakibatkan dari adanya reklamasi di Pantai Manado. Penelitian menggunakan metode Normatif-Empiris yakni dengan mengkaji implementasi ketentuan hukum normatif dalam penerapannya di masyarakat. Terlaksananya reklamasi di Pantai Manado banyak tidak melibatkan persetujuan dari masyarakat pesisir dan tidak juga memperhatikan dampak pada aspek lingkungan. Berdasarkan hasil penelitian, reklamasi di Pantai Manado ditemukan bertentangan dengan aturan-aturan yang ada. Pertama, dampak sosial akibat dari reklamasi di Pantai Manado melanggar UU No. 27 Tahun 2007 Pasal 34 ayat (2). Kedua, melanggar Peraturan Menteri Kelautan dan Perikanan No. 25 Tahun 2009 Pasal 16. Selanjutnya, pelanggaran pada aspek lingkungan diatur dalam UU No. 27 Tahun 2007 yang tertera pada Pasal 35 huruf (c) dan (d). Kegiatan reklamasi di manado pada nyatanya menghilangkan mata pencaharian, sulitnya akses melaut dan kebisingan akan kegiatan dari reklamasi dan juga ditemukan adanya kerusakan terumbu karang yang berdampak buruk pada biota-biota laut. Kata kunci: perlindungan hukum; masyarakat; lingkungan; dampak reklamasi.ABSTRACTDevelopment in reclamation has been massively carried out in big cities in Indonesia. Manado is one of the cities that very often carry out reclamation; this is done for the construction of roads, shopping centers, hotels, and other forms of tourism—the law against society and the environment resulting from the reclamation of Manado Beach. The research uses the Normative-Empirical method by examining the implementation of normative legal provisions in their application in society. The performance of reclamation on Manado Beach does not involve the approval of the coastal community and ignores the impact on environmental aspects. Based on the results of research on reclamation on Manado Beach, it was found to be contrary to existing regulations. First, the social impact of reclamation on Manado Beach violates Law No. 27 Year 2007 Article 34 paragraph (2), which is stated in 35 letters (c) and (d). Reclamation activities in Manado eliminate livelihoods, difficulty accessing the sea, and noise from reclamation activities and also found damage to coral reefs, which negatively impacts marine biota.Keywords: legal protection; society; environment; reclamation impact.

Abstract

Sexual violence against children can have complex impacts, including physical and non-physical loss and suffering. Children who experience sexual violence need to be protected and recovered psychologically and socially. A form of legal protection for children as victims can be in the form of restitution charged to the perpetrator to fulfill the rights of children as victims. This research aims to find out how the implementation of the right to restitution for children as victims of criminal acts of sexual violence is implemented and how judges consider in making decisions that include requests for restitution for children as victims of criminal acts of sexual violence in the jurisdiction of the Bantul District Court. This research uses a type of juridical-empirical legal research and uses interviews and literature study as data collection techniques. There were 35 cases of criminal acts of sexual violence against children at the Bantul District Court from 2020 to 2022, but only 7 cases included a request for restitution against the victim in the prosecution, and there was 1 case where the judge rejected the request for restitution. In 6 cases where restitution was granted, the victim's right to restitution was not fulfilled because the defendant did not have the good faith to pay restitution.

Abstract

This writing aims to examine the existence of Regional Head Regulations according to the hierarchy of laws and regulations in Indonesia and to find out how the force of law binds the material content of Regional Head Regulations which were formed without a legal basis. The research method used in this writing is normative legal research using a statutory approach. The results of the study show that regional head regulations are delegated legislation whose existence can only be recognized if ordered by higher laws and regulations and based on authority so that the contents of regional head regulations cannot conflict with the main regulations and/or regulations above them. The contents of the Regional Head Regulations that have been promulgated in regional news have binding legal force in general and must be obeyed by the public. Content material for Regional Head Regulations whose formation is not in accordance with statutory regulations may be subject to judicial review to the Supreme Court.

Abstract

The Indonesian government's implementation of Law No. 4 of 2016 on People's Housing Savings (Tapera) marks a significant effort to provide affordable housing for low-income communities. Ratified in 2020 with the support of Government Regulation No. 25, the Tapera program mandates contributions from employees and employers to create housing savings for workers. However, despite its potential to address the housing shortage, the program faces multiple challenges, including regulatory overlaps with existing housing policies, lack of clarity on participant rights and obligations, and concerns over the financial burden on workers and employers. This study aims to critically analyze the legal framework of the Tapera program, identify the obstacles encountered in its implementation, and provide recommendations for improving its efficiency and transparency. Utilizing a normative legal research method with a statute and conceptual approach, the research analyzes primary legal materials alongside secondary sources, such as the Tapera Act. The findings indicate that while Tapera is intended to provide equitable access to affordable housing, its implementation is hindered by legal ambiguities, coordination issues, and transparency concerns. The study concludes that comprehensive regulatory revision and enhanced coordination between government agencies, BP Tapera, and the private sector are necessary to ensure the success of the Tapera program in achieving its housing affordability objectives.

Abstract

Lingkungan hidup merupakan eksistensi yang patut untuk diperhatikan. Hal itu bertujuan untuk melestarikan kelangsungan lingkungan hidup, dikarenakan banyaknya sektor perindustrian membawa banyak dampak terhadap lingkungan hidup, baik itu dampak positif maupun negatif yang salah satunya berasal dari limbah B3. Tujuan dari penelitian ini adalah untuk mengetahui pertanggungjawaban pidana korporasi beserta faktor-faktor pertimbangan hakim dalam menentukan hukuman pidana bagi korporasi yang mencemari lingkungan hidup dengan limbah B3. Penelitian ini mengimplementasikan metode penelitian yuridis normatif dengan pendekatan perundang-undangan dan pendekatan kasus, disertai dengan menggunakan data-data sekunder yang berbasis pada tiga bahan yakni: bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier. Kemudian teknik pengumpulan data beserta analisis yang dilakukan adalah melalui riset kepustakaan dan menggunakan teknik analisis data secara kualitatif. Kesimpulan dari penelitian yang dilakukan mengungkapkan bahwa bentuk pertanggungjawaban pidana korporasi terhadap pencemaran lingkungan hidup yang diakibatkan oleh limbah B3 dapat dilakukan dengan memberikan sanksi pidana terhadap Terdakwa, yang mana sanksi tersebut dapat berupa sanksi pidana pokok dan/atau sanksi pidana tambahan. Kemudian faktor yang menjadikan majelis hakim menjatuhkan sanksi tersebut didasarkan dengan faktor pertimbangan hakim secara yuridis berupa dihadirkannya alat-alat bukti beserta barang bukti, dan faktor pertimbangan hakim secara non-yuridis berupa keyakinan hakim yang menentukan keadaan memberatkan dan/atau meringankan sanksi pidana.

Abstract

Criminal acts with electronic media in the cyber world are known as cybercrime. Humiliation, reputation pollution, social media fraud are some examples of cybercrime. The most widely used means of cybercrime can be used as evidence to strengthen evidence in court proof. In this case, the author will discuss the settlement of the account suspension, the procedure of the Account suspension and how the legal protection against the victims of the accounts suspension. This writing uses a method of normative jurisprudence, which covers research on the level of synchronization of law, research on legal systematics, and research into the foundations of law. The seizure of social media accounts as evidence in the proof process is permitted because the social media account is an object or something that is directly used in committing a criminal act on social media (cybercrime) and has a clear legal basis of regulation that is the ITE Act. Arrangements regarding arrests deemed illegal or misprocedure by the police are one of the urgent issues to be discussed. The legal protection that the parties to this dispute can apply to a defendant who has been the victim of “illegal” arrest by the police in the trial process is pre-trial.

Abstract

The development of social media can make it easier for bullies to interact on social media which can harm others, so a legal umbrella is needed to protect victims of bullying in the media. Legal Protection provides rights and assistance to create a sense of security for victims. However, there are still no clear provisions regarding legal protection for victims of bullying through social media. So this study needs to be conducted in order to find out what factors cause bullying through social media and how legal protection is provided for victims of bullying through social media. This study was conducted using a normative research method using legal materials in the form of primary, secondary, and tertiary legal materials which were analyzed in a systematic form. The results of the study showed that 2 important factors were found causing bullying on social media, namely external and internal factors. Furthermore, legal protection for victims of bullying on social media has been regulated in Article 27 of the ITE Law and Article 7A of the Witness and Victim Protection Law where victims have the right to receive physical and psychological protection and receive restitution or compensation. The legal protection carried out by the Ministry of Law and Human Rights is preventive in nature in the form of legal counseling and guidance to ensure the provision of legal aid in accordance with legal aid service standards.

Abstract

The increasing number of criminal cases, one of which is the crime of theft, sadly the perpetrators are not only adults but children also have the potential to become perpetrators, this is caused by various factors both internal and external. Law Number 11 of 2012 (UU SPPA) provides an update for the juvenile justice system because it applies the concept of restorative justice, namely through diversion. Seeing this reality raises questions regarding the mechanism for resolving cases through diversion. The purpose of this writing is to find out how the mechanism for resolving criminal cases of theft by children through diversion at the Bantul Police. This study uses a normative research method, namely through literature studies by utilizing secondary data to obtain the information needed, to strengthen the data the author also conducted interviews with the Head of the PPA Unit of the Bantul Police Criminal Investigation Unit Aibda Mustafa Kamal S.H. The results of the study show that the diversion mechanism carried out by the Bantul Police starts from the reported crime, if the perpetrator is a child, diversion will be attempted, the success or failure of diversion is very dependent on the diversion deliberation carried out by the parties involved. In cases handled by the Bantul Police from 2018-2023, there were 11 cases of theft by children, but only 1 case of diversion with a successful status because the ABH and the victim agreed to a form of accountability in the form of compensation (restitution) according to the nominal value of the stolen goods, then the ABH was returned to the parents and as a form of supervision, the Bantul Police enforced mandatory reporting.

Abstract

The Thematic Regular Community Service Program Group 166 of Universitas Muhammadiyah Yogyakarta (UMY) conducted a community service program in Klaci II Hamlet, Margoluwih, Seyegan, Sleman, Yogyakarta. The program focused on organic and inorganic waste management to address environmental pollution issues. Two primary approaches were implemented: the creation of biopore infiltration holes and the establishment of a waste bank. This initiative aimed to improve waste management practices, reduce the volume of waste sent to landfills, and create a cleaner and more sustainable environment. The methods employed included three main stages: education, demonstration, and consistency. The education stage involved raising public awareness about the benefits of biopores and waste banks, including flood risk reduction and soil quality improvement. Demonstrations were conducted through hands-on activities in creating biopore infiltration holes in several neighborhoods within Klaci II Hamlet. The consistency stage involved regular monitoring of biopore holes and evaluating their environmental and economic impacts. The waste bank program was designed to encourage active community participation by offering incentives for sorting and recycling waste with economic value. This activity was held weekly, involving various community groups to foster habits of recycling and proper waste management. The results showed increased community awareness regarding waste management, the use of organic waste as compost, and reduced environmental pollution. Through a community-based approach, this program successfully fostered behavioral changes in waste management practices in Klaci II Hamlet. Beyond providing direct benefits to the local community, this model has the potential to be replicated in other regions as a sustainable solution for addressing waste management issues. By collaborating with the community, the program not only enhanced environmental quality but also strengthened communal independence in preserving the environment.

Abstract

Family Medicinal Plants (TOGA) are types of plants that have many benefits as natural herbal medicines and can be cultivated independently in the household environment. The use of TOGA is not only beneficial for health, but can also improve the nutritional quality of the family, and provide economic benefits by making it a commodity that can be sold. However, many people still have difficulty in optimizing TOGA cultivation, especially in the use of the right fertilizer to increase agricultural yields. This Community Service Program aims to improve skills and optimize TOGA planting on land owned by Women Farmers Groups (KWT) with an approach based on environmentally friendly agriculture. One of the efforts made is the use of quality organic fertilizers that can increase soil fertility without causing negative impacts on the environment. In addition, monitoring the quality of fertilizers using fertilizer measuring tools is also applied to ensure efficient use of fertilizers and in accordance with plant needs. This activity includes socialization of the benefits of TOGA as well as planting medicinal plants, training in the manufacture and use of liquid organic fertilizers, and the application of simple technology to monitor the quality of the fertilizers used. The results of this activity show an increase in the understanding and skills of KWT members in sustainable TOGA cultivation. KWT members now understand better how to care for and manage TOGA plants using more environmentally friendly organic fertilizers. In addition, there is an increase in TOGA plant productivity thanks to the use of more controlled fertilizers. Thus, this program is expected to encourage environmentally friendly agriculture, improve community welfare, and have a positive impact on the surrounding environment
