Abstract

Perkembangan pembangunan dalam ranah reklamasi sudah sangat masif dilakukan di kota-kota besar di Indonesia. Kota Manado termasuk dari kota yang sangat sering melakukan reklamasi hal ini dilakukan untuk pembangunan jalan, pusat perbelanjaan, hotel dan bentuk pariwisata lainnya. Pada kenyataanya, reklamasi di Kota Manado selalu menjadi cerita yang menegangkan terutama bagi para masyarakat pesisir, maka tujuan dari artikel ini untuk mengetahui perlindungan hukum terhadap masyarakat dan lingkungan yang diakibatkan dari adanya reklamasi di Pantai Manado. Penelitian menggunakan metode Normatif-Empiris yakni dengan mengkaji implementasi ketentuan hukum normatif dalam penerapannya di masyarakat. Terlaksananya reklamasi di Pantai Manado banyak tidak melibatkan persetujuan dari masyarakat pesisir dan tidak juga memperhatikan dampak pada aspek lingkungan. Berdasarkan hasil penelitian, reklamasi di Pantai Manado ditemukan bertentangan dengan aturan-aturan yang ada. Pertama, dampak sosial akibat dari reklamasi di Pantai Manado melanggar UU No. 27 Tahun 2007 Pasal 34 ayat (2). Kedua, melanggar Peraturan Menteri Kelautan dan Perikanan No. 25 Tahun 2009 Pasal 16. Selanjutnya, pelanggaran pada aspek lingkungan diatur dalam UU No. 27 Tahun 2007 yang tertera pada Pasal 35 huruf (c) dan (d). Kegiatan reklamasi di Manado pada nyatanya menghilangkan mata pencaharian, sulitnya akses melaut dan kebisingan akan kegiatan dari reklamasi dan juga ditemukan adanya kerusakan terumbu karang yang berdampak buruk pada biota-biota laut.

Abstract

ABSTRAKKeberadaan stockpile batubara di Kabupaten Muaro Jambi perlu dilakukan pengaturan. Stockpile batubara yang berada di pinggir Sungai Batanghari dan disekitar lokasi pemukiman penduduk harus dipindahkan karena dapat menyebabkan pencemaran dan perusakan lingkungan. Pengaturan terhadap stockpile batubara sebagai upaya perlindungan hukum bagi masyarakat yang berada disekitar lokasi stockpile batubara. Tujuan penelitian ini adalah untuk mengetahui pengaturan hukum atas kegiatan stockpile batubara di Kabupaten Muaro Jambi dan untuk mengetahui upaya perlindungan hukum yang dilakukan Pemerintah Kabupaten Muaro Jambi terhadap masyarakat yang terkena dampat kegiatan stockpile batubara di Kabupaten Muaro Jambi. Metode Penelitian yang digunakan adalah penelitian yuridis empiris atau sosio legal terhadap perilaku individu atau masyarakat, organisasi atau lembaga hukum terhadap penerapan atau berlakunya hukum. Hasil penelitian menunjukkan adanya kekosongan hukum dalam pengaturan stockpile batubara dan tidak tegasnya Pemerintah Kabupaten Muaro Jambi melakukan upaya penegakan hukum terhadap stockpile batubara yang telah melakukan pencemaran dan perusakan lingkungan.Kata kunci: perlindungan hukum; pencemaran dan perusakan lingkungan; stockpile batubara. ABSTRACTThe existence of a coal stockpile in Muaro Jambi Regency needs to be regulated. Coal stockpiles located on the banks of the Batanghari River and around residential areas must be moved because they can cause pollution and environmental damage. Coal stockpile regulation as an effort to protect the law for the community around the coal stockpile location. The purpose of this study was to find out the legal arrangements for coal stockpile activities in Muaro Jambi Regency and to find out the legal protection efforts made by the government of Muaro Jambi Regency for communities affected by coal stockpile activities in Muaro Jambi Regency. The research method used is empirical juridical or socio-legal research on the behavior of individuals, communities, organizations, or legal institutions in the application or enactment of law. The results of the study indicate that there is a legal vacuum in regulating coal stockpiles, and the Muaro Jambi Regency Government is not firm in making efforts to enforce the law against coal stockpiles, which have polluted and damaged the environment.Keywords: coal stockpile; legal protection; pollution and environmental destruction.

Abstract

Moving Indonesia’s capital city to the archipelago is a strategic policy aimed at addressing development inequality, reducing the burden on Jakarta, and creating a more sustainable center of government. However, the rapid legislative process and lack of public participation raise questions regarding the legitimacy of the policy. This study aims to analyze the legal politics of the National Capital City Law (UU IKN) as well as the social, economic, and environmental implications of relocating the capital city. Using a normative method with a descriptive and comparative approach, this study examines relevant regulations as well as other countries’ experiences in capital city relocation. The results show that capital city relocation faces challenges in governance, protection of indigenous peoples’ rights, as well as environmental impacts such as deforestation and increased carbon emissions. From an economic perspective, while it is expected to boost investment and regional development, the project faces funding constraints as well as social risks for affected communities. Therefore, more inclusive, transparent and sustainability-based policies are needed to ensure the success of this project. Strong regulations, fair compensation mechanisms for affected communities, and strict environmental policies should be top priorities. With a comprehensive approach, the archipelago can develop into a modern, competitive and sustainable capital city.

Abstract

The compounding of criminal acts of TIPIKOR and TPPU is not a new thing, there are several previous studies that discuss this matter but in mining cases there has been no deeper discussion, this makes the author interested in researching related to the compounding of criminal acts in TIPIKOR and TPPU in the mining sector. This research aims to obtain knowledge related to the factors of concurrent criminal acts in TIPIKOR and TPPU in the mining sector. This research is a normative juridical research. The results of the research are: the factors causing concurrent criminal acts, namely TIPIKOR and TPPU in the mining sector based on the author's analysis in verdict number 06/pid.sus-tpk/2022/pn.bjm, namely the factors of power and opportunity possessed by the perpetrator, which made the perpetrator commit concurrent criminal acts, namely TIPIKOR and TPPU. Abstract

This study analyzes the impact of what happens to communities in North Maluku Province due to manganese and nickel mining. The purpose of this study is to determine what impacts occur on communities in North Maluku Province due to manganese and nickel mining and provide solutions to the research results. In contrast to previous research, this study focuses on the impacts that occur that harm the community and the concepts that should be done in dealing with it through a conflict resolution approach. This research is a Normative legal research. The results found that: The impact of Manganese and Nickel mining in North Maluku Province from the results of the author's research has a positive impact as an economic support and has a negative impact on the environment and according to the author is more likely to have many negative impacts, including: water pollution, air and soil pollution due to Manganese and Nickel mining activities in Central Halmahera Regency, North Maluku Province, according to the author, is a serious problem. The government's desire to make Indonesia as a major producer of Nickel-based products, the lives of the people of Central Halmahera in the Nickel mining area were deprived. They have to give up losing their livelihood until their health is compromised. There is no accountability from PT. IWIP for the impact that occurs is also influenced by the new applicable rules, namely Article 88 Article 88 of Law Number 6 of 2023 concerning the Stipulation of Government Regulations in Lieu of Law Number 2 of 2022 concerning Job Creation Being a law, where provisions without proving the element of guilt have been removed, this will make it difficult for the community to prove the impact of environmental pollution that occurs. Abstract

One of the elements of human rights is the right to a safe and healthy environment—industrialization's role as an economic booster. However, the Konawe Nickel Industrial Area's industry impacts the environment. This research examines the legal liability for (VDNI) Virtue Dragon Nickel Industry Inc.'s environmental impacts in Morosi District, Konawe Regency. The findings revealed that the nickel smelter industry Konawe's VDNI Inc. activity resulted in a change in ambient air quality that exceeded the required air quality standard, noise disturbance that exceeded the quality of noise needed standard, as well as Toxic and Hazardous Waste (B3) waste and non-Toxic and Hazardous Waste (non-B3) taste that was still stored in one place and did not report their business activities to the Provincial and Regency Environmental and Forestry Services and the Industry and Energy Office regarding the use of coal-fired power plants in the electricity sector. As a result, VDNI Inc. must be held entirely accountable (strict liability) in administrative, civil, and criminal law.

Abstract

This research discusses in-depth strategies for handling crimes of severe abuse that occur in the context of archery cases among the community by adopting a holistic perspective from criminology and criminal law. The aim is to analyze and compare these two different points of view, as well as explore the possibility of collaboration between them, resulting in a more practical approach to dealing with this problem. The method used in this research is library research, where data collection is carried out by reviewing various literature, books and reports that are relevant to the topic being discussed. The findings obtained indicate that integration between a criminological approach which focuses on aspects of prevention and rehabilitation with firm law enforcement from a criminal law perspective is critical to creating a comprehensive solution. Therefore, this study recommends the development of collaborative programs involving various stakeholders, including government, social institutions, and communities, to develop treatment strategies that are more effective in preventing severe abuse in society as a whole.

Abstract

Penelitian ini bertujuan untuk mengetahui penerapan justice collaborator dengan pendekatan efektivitas hukum di Indonesia. Selain itu pasal ini menggunakan metode normatif dengan sumber data pustaka dan dokumen hukum peraturan terkait. Temuan dalam penelitian ini adalah justice collaborator pernah mengalami permasalahan mengenai perlindungan hukum terhadap justice collaborator dan penetapan justice collaborator. Justice Collaborator mempunyai banyak kelemahan dalam sistem hukum, dan penetapan justice collaborator, dan banyak ahli berpendapat bahwa undang-undang tentang justice collaborator dan penetapan justice collaborator perlu menciptakan aturan-aturan baru yang dapat menjangkau ranahnya untuk mencapai efektivitas, sehingga keadilan harus ada. dilakukan. Para kolaborator harus memiliki domain hukum yang jelas dalam hal penetapan, perlindungan, dan fasilitas lainnya, dimana peran justice collaborator adalah membantu aparat penegak hukum mengusut pelaku utama kasus korupsi yang mana para justice collaborator akan mendapat ancaman yang membahayakan nyawanya.
