Abstract

Abstrak Dalam hukum Islam sendiri terdapat 3 jenis bentuk kerja sama perjanjian bagi hasil pada lahan pertanian, antara lain “Musaqah”, “Muzara’ah”, “Mukhabarah”. Selain hukum Islam, dalam perundang-undangan-pun pemerintah sudah mengatur peraturan tentang pertanahan tentang Perjanjian Bagi Hasil dalam Undang-Undang Nomor 2 Tahun 1960. Peran undang-undang tersebut bertujuan agar pembagian hasil tanah yang dilakukan oleh pihak yang terikat dalam perjanjian dapat terlaksana atas dasar adil, serta terjamin pula kedudukan hukum yang layak bagi petani penggarap. Isu utama yang diangkat dalam penelitian ini yaitu bagaimana praktik perjanjian bagi hasil di Kecamatan Pitu Riase jika dikaitkan dengan Undang-Undang Nomor 2 Tahun 1960 serta pandangan hukum Islam terhadap kerja sama tersebut. Penelitian ini merupakan jenis penelitian kualitatif yang dilakukan dengan turun langsung ke lapangan (Field Research). Data yang diperoleh berasal dari hasil observasi, wawancara, dan dokumentasi. Berdasarkan hasil penelitian yang dilakukan menunjukkan bahwa kegiatan bagi hasil yang dilakukan oleh masyarakat di desa Bila Riase, Kecamatan Pitu Riase, Kabupaten Sidenreng Rappang merupakan sistem bagi hasil yang memiliki kemiripan dengan sistem mukhabarah. Dan dalam pandangan hukum Islam sendiri memperbolehkan praktik kerja sama tersebut. Selama yang dilakukan masih dalam syariat hukum Islam yang ditetapkan. Masyarakat Bila Riase melakukan perjanjian masih dalam bentuk lisan, bertentangan dengan yang telah diatur dalam Undang-Undang Nomor 2 Tahun 1960 tentang Perjanjian Bagi Hasil bahwa setiap perjanjian dilakukan dalam bentuk tertulis dan dilaporkan kepada pemerintah desa setempat. Implikasi dari penelitian ini, yaitu pemerintah desa setempat harus memberikan perhatian lebih dalam membina masyarakat untuk tidak acuh pada ketentuan hukum yang berlaku. Kata Kunci : Bagi Hasil, Mukhabarah, UU No.2 Tahun 1960, Hukum Islam.   Abstract In Islamic law itself there are 3 types of cooperation agreements for production sharing on agricultural land, including "Musaqah", "Muzara'ah", "Mukhabarah". In addition to Islamic law, the government has also regulated regulations regarding land regarding Production Sharing Agreements in Law Number 2 of 1960. The role of the law is to ensure that the distribution of land proceeds carried out by parties bound in the agreement can be carried out on fair basis, as well as guaranteed proper legal status for sharecroppers. The main issue raised in this study is how the practice of profit-sharing agreements in Pitu Riase Subdistrict is related to Law Number 2 of 1960 and the views of Islamic law on this cooperation. This research is a type of qualitative research conducted by going directly to the field (Field Research). The data obtained comes from observations, interviews, and documentation. Based on the results of the research conducted, it shows that the profit-sharing activities carried out by the community in Bila Riase Village, Pitu Riase District, Sidenreng Rappang Regency are profit-sharing systems that have similarities to the mukhabarah system. And in view of Islamic law itself allows the practice of such cooperation. As long as what is done is still within the stipulated Islamic law. Community If Riase makes an agreement still in oral form, contrary to what has been stipulated in Law Number 2 of 1960 concerning Production Sharing Agreements that every agreement is made in written form and reported to the local village government. The implication of this research is that the local village government must pay more attention to fostering the community not to be indifferent to applicable legal provisions. Abstract

Abstrak Sertifikasi halal merupakan sebuah kewajiban yang diatur di dalam peraturan perundang-undangan tidak terkecuali bagi pelaku usaha mikro, akan tetapi faktanya masih banyak pelaku usaha mikro yang tidak melaksanakan sertifikasi halal terhadap produknya khususnya di Kota Palopo. Metode penelitian yang digunakan dalam penelitian ini adalah penelitian hukum normatif empiris dengan menggunakan pendekatan perundang-undangan, konseptual dan pendekatan kasus. Implementasi kewajiban sertifikasi halal pelaku usaha mikro di Kota Palopo belum sepenuhnya dilakukan dikarenakan banyaknya pelaku usaha mikro yang minim pengetahuan tentang jaminan produk halal sedangkan pemerintah memberikan kemudahan sertifikasi halal bagi pelaku usaha mikro dengan bentuk pernyataan halal. Implementasi kewajiban sertfikasi halal juga didorong oleh kenyataan bahwa belum dilakukan sanksi terhadap pelaku usaha padahal di dalam peraturan perundang-undangan diatur mengenai sanksi terhadap pelanggaran jaminan produk halal salah satunya tidak melaksanakan kewajiban sertifikasi halal meskipun tidak secara detail menyebutkan sanksi terhadap tidak dilakukannya sertifikasi halal oleh pelaku usaha yang hanya menyebutkan bahwa diancam dengan sanksi administratif. Jaminan produk halal akan berjalan optimal jika terjadi sinergi antara para pihak terkait seperti pemerintah, pelaku usaha dan konsumen bahwa program ini adalah tanggung jawab dan tugas bersama. Kata Kunci: Halal, Usaha Mikro, Perlindungan Konsumen Abstract Halal certification is an obligation stipulated in the laws and regulations, not least for micro-business actors, but the fact is that there are still many micro-business actors who do not carry out halal certification of their products, especially in Palopo City. The research method used in this research is empirical normative legal research using statutory, conceptual and case approaches. The implementation of the halal certification obligations of micro-business actors in Palopo City has not been fully carried out due to the large number of micro-business actors who have minimal knowledge about halal product guarantees while the government provides convenience for halal certification for micro-business actors in the form of halal statements. The implementation of halal certification obligations is also driven by the fact that sanctions have not been imposed on business actors even though the laws and regulations regulate sanctions for violations of halal product guarantees, one of which is not carrying out halal certification obligations even though they do not specifically mention sanctions for not carrying out halal certification by business actors, which only mention that they are threatened with administrative sanctions. Halal product guarantees will run optimally if there is synergy between related parties such as the government, business actors and consumers that this program is a shared responsibility and task. Abstract

Abstract The labeling of Sharia in a business today is due to the popularity of the term sharia which is free from usury. However, from this, there are still many problems, especially for businesses that only label their business as sharia but in reality do not implement it in accordance with Islamic law. This research is field research which is very close to qualitative research which uses Sharia Economic Law and empirical approaches. The data sources used are primary data sources sourced from the Al-Qur'an, Hadith, Sharia Economic Law Compilation and interviews from PT Intan Nirwana Nusantara Golden View Inn Housing, and secondary data obtained from archive books of property purchases at Golden View Inn Housing. . The research results show that the form of contract implemented by Golden View Inn is the Ishtishna' contract or order which in its implementation is in accordance with the provisions of Sharia Economic Law. Then, regarding the settlement of stalled installments, it is also in accordance with Islamic principles because a deliberation was held to discuss it in good faith first. The implications of this research relate to improving the SPPJB regarding disputes to include the court to be addressed if the good faith process does not run properly. Abstract

This study provides a comprehensive overview of attitude appraisal within the context of narrative and recount texts. The study investigated to use attitude as components of evaluation through language usage in students' recount and narrative text. In this study, qualitative research techniques based on library research were applied. Data collection used documentation methods that were adapted from library sources. Data analysis employs content analysis approaches, where each source or piece of literature is modified and the context's applicability is assessed in light of literature from other books, journals, or studies. Ultimately, the findings emphasize the significance of attitude appraisal in narrative and recount texts, offering insights into the nuanced ways it shapes and enhances the reader's interpretative journey. Taken from four previous studies which had on Appraisal analysis, all data found the use of affect mostly in students’ writing in narrative and recount text. Reaching 50% among the other two types, judgment and appreciation, affect is one of the type of attitude in appraisal showing the way of writer in giving positive or negative feeling and emotion based on what they experienced.

Abstract

Abstract This research is entitled Islamic Law Review of the Validity of Self declare in the halal certification process of micro and small businesses (MSEs). The main problem of this research is How is the Islamic Law Review of the validity of self-declaration in the halal certification process of micro and small businesses (MSEs)? From this main problem, sub- problems can be formulated, namely (1) What is the concept of self-declaration in halal certification in Indonesia? (2) How are the provisions of Islamic law regarding certification given on the statement of business actors? The objectives of this study are (1) to find out how the concept of self-declaration in halal certification in Indonesia, (2) to find out how the provisions of Islamic law on certification are given on the statement of business actors. The type of research used is library research or library research. The method used is data collection which is done by reading references and literature with the aim of supporting this research. The research approach used is the Shari'i Theological Approach with a normative juridical approach. The results of the study indicate that halal certification with a self- declaration scheme in the perspective of Islamic law is said to be valid, because the concept of self-declaration in Indonesia does not necessarily mean that business actors can declare that their products are halal, but there are still mechanisms that regulate the self-declaration such as products that are not risky or use materials that have been confirmed halal and PPH assistance is carried out. In addition, the presence of self-declaration has fulfilled the three basic principles of muamalah fiqh, namely the Principle of Tawhid, the Principle of Mubah, the Principle of Maslahah. The implication of this research is to help ensure that products claimed to be halal by micro and small businesses (MSEs) through the self-declaration scheme actually meet halal standards recognized by Islamic law, so that consumers can have greater confidence in the products in circulation, besides that this research is also expected to be the basis for improving regulations related to halal certification of self-declaration schemes, including improving supervision and monitoring mechanisms to prevent unauthorized self-declaration practices. Abstract

Penelitian bahasa evaluatif dalam teori Apraisal ini menggambarkan makna yang terdapat dalam teks dialog para penyandang ansietas (anxiety) dalam grup Bye-Bye Cemas 3 (BBC3) yang dapat berupa sumber-sumber bahasa yang tidak hanya memiliki nilai negatif tetapi juga bersumber dari bahasa-bahasa yang memiliki nilai positif. Tujuan penelitian ini adalah (1) untuk memerikan apraisal Sikap dalam teks dialog penyandang anxiety dan (2) menganalisis apraisal Sikap yang terbentuk dalam teks dialog penyandang Anxiety. Metode penelitian yang digunakan adalah penelitian deskriptif analitis. Data yang bersumber dari teks dialog penyandang anxiety di grup whatsApp BBC3 dikumpulkan, dikelompokkan dan dianalisis berdasarkan data apa adanya yang dikomunikasikan oleh para penyandang anxiety. Berdasarkan analisis data disimpulkan: (1) penggunaan sumber-sumber subsistem Afek dalam apraisal Sikap paling dominan dibandingkan dengan kedua subsistem lainnya yaitu Penghakiman/Penilaian dan Apresiasi. (2), penggunaan sumber-sumber “takut” bernilai negatif paling dominan dalam subsistem Afek, kemudian diikuti sumber-sumber “ingin/hasrat” yang bernilai positif. Setelah itu, penggunaan sumber-sumber “kapasitas” bernilai possitif paling dominan dalam subsistem Penilaian/Penghakiman, kemudian diikuti sumber-sumber “tenasitas” yang bernilai negatif. Penggunaan sumber-sumber “kualiatas” bernilai positif paling dominan dalam subsistem Afek, kemudian diikuti sumber-sumber “valuasi” yang bernilai negatif. Dominasi penggunaan leksis subsistem Afek dalam percakapan para penyandang anxiety di WhatsApp BBC pada umumnya disebabkan para penyandang anxiety berbicara tentang ekspresi emosi dan perasaan mereka berkaitan dengan penyakit cemas dan takut yang menerpa mereka.

Abstract

Qibla direction is an important issue for Muslims, because facing the Qibla is one of the conditions for the validity of prayer. Scholars agree on the obligation to face the Qiblah. However, they differed in terms of whether what was demanded should be facing the ainul ka'bah (the building) or was it just the direction. In the 12th century H, the famous figure of the Shafi'i School at that time was Sheikh Muhammad bin Sulaiman al-Kurdi (1127-1194 H). He was the main teacher of Sheikh Muhammad Arsyad al-Banjari in the field of fiqh. In 1772 M, when Sheikh Muhammad Arsyad al-Banjari and his three friends returned from Haramain and then stopped by Batavia, he saw the mihrabs there were not facing the Kaaba . He argued that the mihrab should be aligned with the qibla by shifting 25 degrees to the right or north. At that time Sheikh Arsyad changed the Qibla of one of the mosques in Batavia, and then a commotion arose in the people of Jakarta, and received a letter of rebuttal from a sheikh of the congregation at that time Sheikh Abdullah bin Abdul Qohhar al-Jawi. This conflict involved the Governor General of the Dutch East Indies Petrus Albertus van der Parra (1761-1775) and a priest who was an astronomer Johann Mauritz Mohr (1716-1775). And in the end, Sheikh Arsyad's argument was accepted by all parties and the conflict ended peacefully, as documented in his story in the treatise "Mas-alatul Qiblah fil Batawi" written by Sheikh Muhammad Arsyad al-Banjari in 1772 M.

Abstract

Background: Premature rupture of the membranes (PROM) is usually defined as rupture of membranes at any time before the onset of uterine contractions. PROM which occurs prior to 37 weeks of gestation. Methods: This systematic review focused on full-text English literature published between 2014 and 2024 using the PRISMA 2020 guidelines. Editorials and review pieces published in the same journal as the submission without a DOI were not accepted. The literature was compiled using PubMed, ScienceDirect, and SagePub, among other online venues. Result: Five publications were found to be directly related to our ongoing systematic examination after a rigorous three-level screening approach. Subsequently, a comprehensive analysis of the complete text was conducted, and additional scrutiny was given to these articles. Conclusion: The exact cause of PROM is not known and the causes could be multifactorial. There are various factors that are related to PROM including prior preterm birth, cigarette smoking, polyhydramnios, urinary and sexually transmitted infection, prior PROM, work during pregnancy, low body mass index, bleeding, and low socioeconomic status.

Abstract

This article explores the potential integration of qawă id fiqhiyyah into the reform of civil procedural law in Indonesia. Within a legal system still largely influenced by colonial legacies. Islamic legal values often remain underrepresented, particularly in procedural aspects of litigation. This study aims to identify the challenges and opportunities in adopting these legal maxims as foundational principles of civil procedure. Using a qualitative approach based on literature review of classical Islamic jurisprudence and relevant statutory documents, the study finds that the main obstacles include the limited recognition of gawa id fighiyyah as independent legal sources, gaps in practitioners' understanding, and the need for harmonization across different Islamic legal schools and legal codification. Nonetheless, there is significant potential to align the substantive justice values of Islamic law with the national legal system through institutional strengthening and Islamic legal education. This article recommends a procedural law reform grounded in maqășid syarī ah to promote a more responsive, just, and contextually Islamic legal system in Indonesia.

Abstract

Abstract Islam provides guidance and guidance for humans in all aspects, one of which is the command to eat halal and good food. As a country that has a majority Muslim population, consumer protection in the form of guarantees of halal products is carried out. The Halal Product Guarantee Law has regulated the obligation to carry out halal certification, including micro and small business actors, so there is an obligation to carry out halal certification for their products. The research method used in this research is normative legal research using a statutory approach and a normative theological approach to study the obligation of halal certification based on the provisions of applicable laws and regulations and based on sources of Islamic law. The implementation of halal product guarantees has been regulated in such a way in statutory regulations that require all business actors to carry out halal certification, including micro and small business actors, by providing an easy halal certification process in the form of a statement (self-declare) with the provisions on the type of product and business actor that has been implemented. regulated in BPJPH regulations. Sanctions against micro and small business actors who do not carry out halal certification are not regulated so violations of this obligation are interpreted based on the provisions for violations of halal product guarantees which carry the threat of sanctions in the form of administrative sanctions, but the form of violation of halal product guarantees which is threatened with sanctions is not clearly stated. administratively, but if you look at the provisions of statutory regulations, sanctions can be in the form of written warnings, fines, and even withdrawal of goods from circulation. in the context of halal certification, micro, and small business actors need to implement regulations from Law 6 of 2023 regarding halal product guarantees Keywords: Halal Product, Self Declare, Micro and Small Enterprises
