Abstract

Restorative Justice is expected to be one of the ways or alternatives to handle crimes or crimes that prioritize the restoration of the balance of the relationship between the perpetrator of the crime and the victim Protection for children who are facing the law is the prerogative of children. The research approach used in this study is the method This research is empirical legal research, The internal factor faced by the Jambi Police in the implementation of restorative justice for children is the lack of time given by law because of the law The invitation only gives a deadline of 30 days, the time is very short, considering that in summoning witnesses and victims it is also quite difficult because they are not necessarily present at the specified time, which hinders investigators in their examination efforts, and sub-directorate IV of the Renakta and the Vulnerable group room still lack skilled and educated investigator personnel in handling children's cases, there is only one investigator who has special expertise as a child investigator. External factors include the factor of the child who is dealing with the law of the child as the perpetrator who commits the crime in the examination still seems afraid to provide information related to the criminal act committed, the factor of the victim and the victim reporter and the complainant does not want to forgive the child who are facing the law and do not want to be resolved through restorative justice.

Abstract

Jambi Province is one of the provinces in Indonesia with natural mining wealth which has a lot of natural resources stored in it and has very good potential for energy sources that can be managed well, such as natural resources which contain coal, one of which is in the region. Kotoboyo village, Dalam sub-district XXIV, Batanghari Regency, Jambi Province, is one of the largest coal producing areas in Indonesia, this area has been very productive in recent years, several coal mining companies have been located in the area, this does not necessarily mean that the results are high. Coal reserves can have a positive impact on the people who live in the surrounding area. In fact, there tends to be no visible environmental impact on the community. The mining activity process around the mine still uses national public road access, causing traffic jams for kilometers and disrupting public road traffic. Local communities, the Central, Regional Government and the Ministry of Energy and Mineral Resources should work together firmly to face the polemics that occur in the community as quickly as possible to provide solutions so that special road access to reduce the massive mobility of coal mining movements is immediately realized for the prosperity of the community's economic movement.

Abstract

BUMDes adalah lembaga usaha desa yang dikelola oleh masyarakat dan pemerintah desa dalam upaya memperkuat perekonomian desa dan dibentuk berdasarkan kebutuhan dan potensi desa, dan Menurut Peraturan Menteri DesaPenelitian ini bertujuan untuk mengetahui dan menganalisa mengenai Bagaimana kewenangan Kepala Desa dalam pengelolaan Badan Usaha milik Desa (BUMDes). Hasil penelitian menunjukan bahwa Kewenangan Kepala Desa dalam mengelola Badan Usaha Milik Desa Secara umum, dimana, tujuan awal pembentukan BUMDes dimaksudkan untuk mendorong atau menampung seluruh kegiatan dalam peningkatan pendapatan masyarakat maupun kegiatan perekonomian yang diserahkan untuk dikelola oleh masyarakat sendiri dengan bantuan yang diberikan oleh kepala desa sebagai naungan dalam membangun usaha tersebut. Sedangkan Masalah dan kendala yang dihadapi dalam pengelolaan BUMDes, Sebagai upaya strategis yang dilaksanakan oleh pemerintah, banyak harapan yang diinginkan terwujud melalui BUMDes. Namun, tidak semua bentuk upaya dapat berjalan sesuai dengan rencana begitu pula dengan keberadaan BUMDes. Hambatan dan tantangan yang dihadapi oleh BUMDes diantara lain aspek manajemen, untuk menganalisis citra medis. aspek SDM, aspek modal, aspek perubahan perilaku pasar, dan aspek lingkungan sosial. Abstract

Penyelenggaraan pelayanan publik merupakan upaya negara untuk memenuhi kebutuhan dasar dan hak-hak sipil setiap warga negara atas barang, jasa dan pelayanan administrasi yang disediakan oleh penyelenggara pelayanan publik. Di Indonesia, Undang-Undang Dasar 1945 mengamanatkan kepada negara agar memenuhi kebutuhan dasar setiap warganya demi kesejahteraannya, sehingga efektivitas suatu sistem pemerintahan sangat ditentukan oleh baik buruknya penyelenggaraan pelayanan publik. Penyelenggara pelayanan publik di Indonesia adalah semua organ negara seperti Pemerintah Pusat, Pemerintah Daerah (Provinsi, Kabupaten, Kota). Dinas Penanaman Modal dan Pelayanan Terpadu Satu Pintu di Kota Jambi merupakan salah satu perangkat daerah yang menjalankan fungsinya dengan melakukan pelayanan publik terhadap masyarakat. Secara umum pelaksanaan pelayan publik Dinas Penanaman Modal dan Pelayanan Terpadu Satu Pintu Kota Jambi telah berjalan cukup baik tetapi berbeda dengan pemenuhan penerbitan izin yang dapat dikatakan mengingkari Standard Operating Procedure (SOP). Secara keseluruhan hal itu dapat dilihat dari keseriusan dan kesungguhan dalam melayani masyarakat sebagai abdi masyarakat dan abdi negara yaitu dengan 6 (enam) faktor pendukung pelayanan yang meliputi; Faktor kesadaran, Faktor aturan, Faktor organisasi, Faktor pendapatan, Faktor kemampuan dan Faktor sarana pelayanan.

Abstract

Pasca krisis ekonomi dan moneter di Indonesia memberikan gambaran nyata betapaperan strategi sektor perbankan sangat penting. Ketika sektor perbankan terpuruk,perekonomian nasional juga ikut terpuruk, dan demikian sebaliknya. Peranperbankan dalam pembangunan ekonomi adalah mengalirkan dana bagi kegiatanekonomi yaitu salah satunya dalam bentuk perkreditan bagi masyarakatperseorangan atau badan usaha. Kredit tersebut mempunyai suatu kedudukan yangstrategis dimana sebagai salah satu sumber uang yang diperlukan dalam membiayaikegiatan usaha yang dapat dititikberatkan sebagai salah satu kunci kehidupan bagisetiap manusia. Fasilitas kredit yang diberikan oleh bank merupakan aset terbesarbagi bank. Dalam hal kegiatan bank memberikan fasilitas kredit, resiko kerugiansebagian besar bersumber pada kegiatan tersebut, sehingga bila tidak dikeloladengan baik dan disertai pengawasan yang memadai akan mengancamkelangsungan hidup bank tersebut. Penelitian ini mencoba membahas mengenaipelaksanaan pemberian pinjaman menengah ke bawah melalui kredit usaha rakyatpada Bank Rakyat Indonesia unit Fatahillah Jambi dengan menggunakan metodepenelitian yuridis empiris, yakni dengan menganalisis peraturan perundangundangan yang berlaku, kemudian melihat penerapan serta pelaksanaannya dilapangan.

Perlindungan hukum terhadap pemegang polis asuransi merupakan hal yang penting sekali, oleh karena dihubungkan dengan praktik perjanjian baku pada perjanjian asuransi, pada hakikatnya sejak penandantanganan polis asuransi, tertanggung sebenarnya sudah kurang mendapatkan perlindungan hukum oleh karena isi atau format perjanjian tersebut lebih menguntungkan pihak perusahaan asuransi Permasalahan penelitian ini adalah (1) Bagaimana hak dan kewajiban perusahaan asuransi yang pailit berdasarkan undang-undang nomor 37 tahun 2004 tentang kepailitan (2) Bagaimana perlindungan hukum terhadap pemegang polis ketika perusahaan asuransi dinyatakan pailit berdasarkan undang-undang nomor 37 Tahun 2004 tentang kepailitan berdasarkan hasil penelitian dan pembahasan dapat disimpulkan (1) hak dan kewajiban hukum pernyataan pailit terhadap perusahaan asuransi ialah mengakibatkan seluruh harta kekayaan debitur pailit dalam sitaan umum sehingga debitur pailit kehilangan hak secara keperdataan (2) perlindungan hukum terhadap pemegang polis ketika perusahaan peransuransian mengalami kepailitan tidak jelas pengaturanya disebabkan adanya dua hal pengaturan hukum yang berbeda yang mengatur masalah kepailitan di Indonesia

Abstract

Introduction: The Banks as service providers need to provide maximum service to their customers and protect them from third parties trying to take over part or all of the customers' deposits and trust in the bank. Therefore, banks should regulate and establish procedures and mechanisms for the protection and provide solutions in the event of an action or activity that is detrimental to the customerPurposes of the Research:  Based on the background of the problems described above, it can be formulated the problems that the writer will examine, namely: 1). How is the Criminal Accountability Against the Perpetrators of Banking Corruption Crimes in the City of Jambi? 2). What is the Basis of Consideration of the Panel of Judges to decide on the perpetrators of Banking Corruption Crimes (Case Study of District Court Orders No: 04/ Pid.Sus -TPK/2016/PN. Jmb)Methods of the Research: The research method used was normative research. Based on the results of this study, it was concluded that banking crimes are a canteen of crimes that occur within the scope of banking. The complexity of these crimes causes the prosecution of perpetrators of these crimes to apply the Corruption Crime Act.Results of the Research: The results show that or the findings of this study prove that the basis for the judge's decision for the perpetrators of criminal acts in the District Court decisions are aggravating and mitigating matters as stated in the decision.

Abstract

The rapid development of information and communication technology has brought significant benefits to society, but on the other hand, it has also given rise to various threats, including cybercrime. In Indonesia, the increase in cybercrime cases, such as skimming, has caused major economic losses and threatened the stability of digital security. This study focuses on the factors causing the increase in cybercrime and efforts to prevent it. The research method used is a normative legal approach through a literature review that studies related laws and regulations, including Law No. 11 of 2008 concerning Information and Electronic Transactions which was updated in 2016. The results of the study indicate that the main causes of cybercrime include weak network security, low digital literacy of the community, and limitations in law enforcement. This study recommends strengthening regulations, increasing human resource capacity, and implementing technology-based prevention policies as solutions to combat cybercrime. This study is expected to be a reference for policy makers and legal practitioners in dealing with cybercrime problems in Indonesia effectively.

Abstract

The implementation of the ITE Law in general has not been implemented optimally , because the general public's understanding of the ITE Law is still imperfect, including community activities in cyberspace . Activities in cyberspace cannot be separated from human factors and their legal consequences also intersect with humans in society who are in the physical world, therefore the idea emerged about the need for legal rules to regulate activities in cyberspace. The word "Democracy" comes from two words, namely demos which means people, and kratos/cratein which means government, so it can be interpreted as people's government, or what we know better as government of the people, by the people and for the people. This research uses an explanatory type , namely research that explains the implementation of the ITE Law and democracy in cyberspace. From the results of the research that has been carried out, through the process of filling out questionnaires and interview results, it can be concluded that the implementation of the ITE Law in Indonesia is related to democracy in the moderate category

Abstract

In the implementation of the resolution of criminal law violations in customary courts, it is felt to be very effective in dealing with many criminal cases through a restorative justice approach which theoretically relies on values that are characterized by Indonesian harmony, balance and conduciveness to ensuring shared life in society. Therefore, all forms of recognition of customary law must be carried out through acceptance and granting legal status related to the existence of its implementation in areas where the application of customary law is very strong. This research is a qualitative type of research with a normative conceptual and juridical approach. The data source was obtained by examining positive legal norms in the form of applicable laws and customary law norms. The conclusions that can be drawn from this research are: In customary justice it is not considered as non-formal justice outside of the judiciary under the State judiciary institution. The Supreme Court is on par with other customary justice bodies. Customary justice is something that actually occurs in the midst of society, therefore the basis contains the principles of restorative justice which focuses on resolving criminal cases outside of court so that the value of justice can be accepted by each group and individual in the customary law that occurs in Indonesian society.
