Abstract

Perlindungan hukum terhadap pemegang polis asuransi merupakan hal yang penting sekali, oleh karena dihubungkan dengan praktik perjanjian baku pada perjanjian asuransi, pada hakikatnya sejak penandantanganan polis asuransi, tertanggung sebenarnya sudah kurang mendapatkan perlindungan hukum oleh karena isi atau format perjanjian tersebut lebih menguntungkan pihak perusahaan asuransi Permasalahan penelitian ini adalah (1) Bagaimana hak dan kewajiban perusahaan asuransi yang pailit berdasarkan undang-undang nomor 37 tahun 2004 tentang kepailitan (2) Bagaimana perlindungan hukum terhadap pemegang polis ketika perusahaan asuransi dinyatakan pailit berdasarkan undang-undang nomor 37 Tahun 2004 tentang kepailitan berdasarkan hasil penelitian dan pembahasan dapat disimpulkan (1) hak dan kewajiban hukum pernyataan pailit terhadap perusahaan asuransi ialah mengakibatkan seluruh harta kekayaan debitur pailit dalam sitaan umum sehingga debitur pailit kehilangan hak secara keperdataan (2) perlindungan hukum terhadap pemegang polis ketika perusahaan peransuransian mengalami kepailitan tidak jelas pengaturanya disebabkan adanya dua hal pengaturan hukum yang berbeda yang mengatur masalah kepailitan di Indonesia

Abstract

This paper examines the increasing tendency of constitutional judges to function as a “positive legislature,” namely by establishing alternative normative standards rather than merely annulling illegal legislation. The paper used a comparative doctrinal methodology to analyze three jurisdictions: Indonesia's Constitutional Court, Bulgaria's Constitutional Court, and Mexico's Supreme Court. The comparison reveals that Indonesia frequently uses conditional rulings with erga omnes effects to effectively establish replacement norms; Bulgaria often mitigates normative vacuums by reviving previous rules and expansive, teleological constitutional interpretation; and Mexico enhances rights protection through the juicio de amparo and the gradual establishment of progressive, binding precedent. Based on these patterns, the article suggests a Constitutionally Guided Positive Legislature (CGPL) model that directs the creation of judicial norms through (i) structured and open normative intervention, (ii) temporary constitutional norms with clear boundaries, (iii) substantial democratic justification, and (iv) a test for the separation of powers. CGPL is meant to keep judicial lawmaking in check, ensuring it remains fair and responsible while also protecting rights, delivering real justice, and keeping democracy alive.

Abstract

This study analyzes the regulation and formulates an ideal model for implementing plea bargaining in Indonesia’s criminal justice system following the enactment of Law Number 1 of 2023 on the Criminal Code and Law Number 20 of 2025 on the Criminal Procedure Code. The study is based on the structural inconsistency between substantive criminal law, which has shifted toward a rehabilitative paradigm, and procedural criminal law, which still reflects a retributive approach. This research uses a normative juridical method with statutory and conceptual approaches. The findings show that the regulation of plea bargaining under the 2025 Criminal Procedure Code still contains significant normative inconsistencies, particularly regarding sentencing limits, procedural stages, and the legal form of decisions in summary proceedings. In addition, the expansion of legal evidence confirms that a confession cannot be the sole basis for conviction. Therefore, plea bargaining must be reformulated not only as a mechanism for judicial efficiency but also as a legal instrument that ensures due process of law, legal certainty, protection of defendants’ rights, and harmony with restorative justice and alternative sentencing policies in Indonesia.

Abstract

Domestic violence requires the role of the state through strong legal regulations to provide optimal protection for victims. This study examines legal regulations related to the crime of domestic violence and efforts to protect victims. The method used is normative legal research with a library approach through a review of relevant laws and legal literature, such as the Criminal Code (KUHP), the Criminal Procedure Code (KUHAP), Law Number 23 of 2004 concerning the Elimination of Domestic Violence, and the Law on Witness and Victim Protection. The results of the study indicate that, normatively, domestic violence has been comprehensively regulated as a public law issue. In practice, victim protection has not been optimally implemented due to obstacles from law enforcement, community culture, and limited supporting facilities.

Abstract

Criminal liability is central to assessing whether a person can be sanctioned for their actions. The theft case in Jambi District Court Decision Number 361/Pid.B/2025/PN Jmb illustrates the practical application of this principle, where defendant Heru Prasetyo was found guilty based on the objective and subjective elements of theft as stipulated in Article 362 of the Criminal Code. This research aims to examine criminal liability and the legal principles used by judges in deciding cases, adopting normative legal research methods through statutory and conceptual approaches, as well as examining court doctrine and jurisprudence. The results show that judges consider fault, intent, capacity to be responsible, the purpose of punishment, and the protection of the victim's rights. This decision also reflects an effort to balance substantive justice and the interests of society, so that criminal law functions as an instrument for law enforcement, restoring victims' rights, and creating a sense of security in community life.

Abstract

The reform of national criminal law through the enactment of Law Number 1 of 2023 concerning the Criminal Code is a strategic step taken by the state to adapt criminal law to the dynamics of social development and the values of justice that exist in society. One of the significant changes in the new Criminal Code is the re-arrangement of the qualifications for petty theft crimes, accompanied by the implementation of a more diverse and proportional sentencing system. This study aims to analyze the provisions of petty theft in the old Criminal Code and compare them with the new Criminal Code, as well as examine their application to the criminal system and law enforcement in Indonesia. The research method used is normative juridical legal research with a statutory regulatory approach and a conceptual approach. The research analysis is based on criminal law theory, the principle of legality, and criminal theory. The results show that the new Criminal Code provides a clearer classification of petty theft and emphasizes the use of alternative punishments, such as fines, community service, and supervision. The implementation of these provisions still encounters various obstacles, especially in terms of the readiness of law enforcement officers and public understanding of the concept of more humanistic and restorative punishment. Therefore, regulatory strengthening and ongoing outreach are necessary.

Abstract

Indonesia, based on Pancasila as a state based on law, affirms the principle of the supremacy of law as stated in Article 1 paragraph (3) of the 1945 Constitution. Domestic violence (KDRT) is a legal violation that often affects women as victims. Law Number 23 of 2004 concerning the Elimination of Domestic Violence (KDRT) aims to provide legal protection and establish strict criminal sanctions for perpetrators. This study aims to analyze the legal review of criminal sanctions in cases of domestic violence and assess whether the sanctions imposed have met the objectives of law enforcement and a sense of justice for victims. The method chosen is normative legal research that prioritizes legal principles and analyzes statutory regulations. The results of the study indicate that criminal sanctions in cases of domestic violence are in accordance with the objectives of law enforcement to protect victims. Law No. 23 of 2004 is designed to provide a deterrent effect on perpetrators. However, the effectiveness of sanctions is highly dependent on consistent law enforcement and support for victims and the rehabilitation of perpetrators. A holistic approach is needed to overcome systemic barriers and achieve justice.

Abstract

The development of digital technology has changed the way government operates, including the Parepare Mayor's Office, which faces challenges in increasing the efficiency and effectiveness of employee performance. This research aims to assess the implementation of a digital management system as a solution to overcome the problems of manual bureaucracy, miscommunication, and lack of data integration. The methods used in this research include observation and interviews with employees from various divisions, as well as quantitative and qualitative analysis to measure system effectiveness through key performance indicators (KPI). The research results show that the implementation of a digital management system has succeeded in increasing work efficiency, transparency and accuracy, with an increase in employee productivity reaching 60% and job satisfaction levels of 85%. Despite challenges such as inadequate infrastructure and resistance to new technology, this program has succeeded in creating a digital-based work culture
