Abstract

Manufacturers of electronic products often provide warranties to customers, subject to certain conditions, because of the inherent risk of future defects or loss in any transaction involving such items. However, there are times when the collateral for installments is damaged or even lost. This research aims to determine the views of the Compilation of Sharia Economic Law regarding the responsibility of business actors for damage to collateralized credit goods. In this research, the method used is empirical juridical. Data collection uses interviews and data analysis techniques using legal content analysis and case studies. The research results show that the Compilation of Sharia Economic Law states that business actors must provide compensation to customers for damaged goods, and the furniture shop's policy in paying to repair or replace damaged goods is in accordance with this obligation, because it is in line with Islamic principles.

Abstract

Insurance constitutes a risk transfer mechanism or a contractual agreement among multiple parties, wherein the insurer obligates itself to the insured by accepting a premium in exchange for compensation related to losses, damages, or anticipated profit losses. This research aims to identify the factors contributing to customer claim failures and to understand the resolution of issues faced by customers at BPRS Puduarta Insani Medan. The text subsequently details the resolution of the outstanding insurance claim payment financing that was denied at BPRS Puduarta Insani Medan, analyzed in accordance with POJK Number 69/POJK.05/2016. The author utilizes the empirical legal research method in this study, incorporating data collection techniques including direct interviews and observation within the company. This is subsequently presented as descriptive report. The customer's claim was unsuccessful due to their failure to comply with the pertinent legal provisions. BPRS Puduarta Insani Medan discovered that the customer had acted dishonestly by concealing their ailment from the bank when insuring themselves as a customer. The customer's claim failure at BPRS Puduarta Insani Medan was resolved as a consequence of data manipulation disguised as a health history letter. As a result, the bank and the heirs achieved an agreement that the payment would continue and be settled by the heirs, as it was not regulated in the agreement regarding the customer's demise. POJK Number 69/POJK.05/2016 has established a comprehensive framework for safeguarding the interests of financing companies and the heirs of customers when navigating delicate and intricate circumstances, such as the passing of a debtor. Heirs should carefully examine the financing agreement and the relevant insurance policy to confirm their obligations and rights in these circumstances.

Abstract

This research explores contextual factors and operational dynamics of implementing the Internal Quality Assurance System (SPMI) at several State Islamic Universities in Indonesia, namely Syarif Hidayatullah State Islamic University (UIN) Jakarta, North Sumatra State Islamic University (UINSU), State Islamic University (UIN) Sjech M Djamil Djambek Bukittinggi, Syekh Ali Hasan Ahmad Addary State Islamic University (UIN) Padangsidimpuan, and State Islamic College (STAIN) Mandailing Natal. This type of research is qualitative with a multi-case study approach. Data collection includes documentation, field notes about process dynamics, observations and interviews with the Head of the Quality Assurance Institute (LPM) and Focus Group Discussions with stakeholders such as study program managers, lecturers, students, alumni and university auditors. The validity of the data is ensured through reliability checks, triangulation, member checking, and audit trails. The research results show that in-case analysis examines contextual factors and operational dynamics that are unique to each institution. Various universities are exploring variations in adherence to Total Quality Management (TQM) principles. UIN Syarif Hidayatullah Jakarta's transition to a paperless system through the SIQA application is an example of TQM principles by increasing efficiency and data management in the Internal Quality Audit (AMI) process. UIN Sjech M. Djamil Djambek Bukittinggi faces challenges in auditor capacity and role clarity, requiring organizational adaptation to increase AMI's effectiveness. Overall, this research contributes to the academic discourse regarding internal audit quality and underlines the importance of systems theory and organizational change theory in improving educational quality assurance practices in State Islamic Universities and Colleges.

Abstract

This study titled "Judges' Considerations in Granting and Rejecting Child M??iyah Support Claims from a Progressive Legal Theory Perspective" focuses on analyzing judicial considerations in two Religious Court decisions, specifically Decision Number 1172/Pdt.G/2018/PA.Smd. and Decision Number 41/Pdt.G/2014/PA.Tkl. The research aims to identify how progressive legal theory influences judicial decisions regarding child m??iyah support and its implications for justice for neglected children. The study employs a normative juridical method with case study and comparative approaches, offering a deep exploration of the judicial reasoning that shapes outcomes in sensitive family law cases. The findings reveal that applying progressive legal theory can result in fairer and more responsive decisions to children's needs, highlighting the critical role of judicial discretion in interpreting the law beyond its literal text. In Decision Number 1172/Pdt.G/2018/PA.Smd., the claim was rejected on formalistic grounds, reflecting a rigid adherence to precedent, whereas in Decision Number 41/Pdt.G/2014/PA.Tkl., the claim was granted based on substantive justice considerations, prioritizing the child’s welfare. The study concludes by emphasizing the importance of applying progressive legal theory to ensure the protection of children's rights and achieve social justice within the context of Islamic and positive law in Indonesia. Furthermore, it suggests that a more dynamic and empathetic approach in judicial decision-making can significantly impact the realization of equitable outcomes in family law.

Abstract

Determination of the marriage age limit through Law No. 16 of 2019 reflects progressive steps in protecting children's rights and preventing the negative impacts of early marriage. This study aims to analyze the relevance of maqashid sharia in supporting this policy, especially in maintaining the five main principles: protection of religion (hifz al-din), soul (hifz al-nafs), reason (hifz al-'aql), descendants (hifz al-nasl), and property (hifz al-mal). With a normative approach and qualitative analysis of Islamic legal literature and related legal documents, this research reveals that a higher marriage age limit is in line with the Sharia goal of ensuring the welfare of individuals and society. Apart from that, the implementation of Law No. 16 of 2019 is faced with challenges, such as cultural resistance and lack of legal awareness, which require educational strategies and strengthening regulations. This study provides practical recommendations for policy makers to align maqashid sharia with the implementation of the law, to support quality and sustainable family development.

Abstract

The Supreme Court, through Decision Number 485 K/Ag/2013, issued a decision regarding determining the inheritance rights of non-Muslim heirs through the 'aṣabah sababiyah route. The legal basis regarding 'aṣabah sababiyah is not contained in the marriage law or the compilation of Islamic law. In its decision, the Supreme Court referred to the 'aṣabah sababiyah theory of Egyptian inheritance law. This decision is a legal effort based on the decision of the Medan Religious Court Number 751/Pdt.G/2011/PA.MDN, which stated that, in inheritance law, the number of ulama agreed to require that heirs and heirs must have the same religion, namely Islam. This problem is interesting to study in more depth through the views of the Medan Religious Court judges and analyze based on a progressive legal perspective. This research is empirical legal research with a qualitative approach, and data collection in this research uses observation, interview techniques, and then analysis. This research found that 'aṣabah sababiyah is an asabah in the class of heirs, which occurs because of freeing both male and female slaves. The views of the Medan Religious Court judges regarding Supreme Court decision Number 485 K/AG/2013 concerning the Determination of the Heirs of 'Ashabah Sababiyah are in two groups, namely accepting the decision and rejecting the decision. If the disparity in the decisions of the Supreme Court and the Medan Religious Court in determining heirs of different religions is viewed based on progressive law, then Supreme Court Decision Number 485 K/AG/2013 is closer to the value of legal progressivity because one form of application of progressive law by judges is to realize social justice through the method of legal discovery by placing social justice in society above statutory regulations.
