Abstract

This study aims to review and analyze the policy of controlling fake news or hoaxes and expressions of hatred based on Law Number 11 which has been changed to Act Number 19 of 2016 concerning Information and Electronic Transctions as well as several other provisions. This research method is a qualitative research method by analyzing a statutory regulation. Besides that, it also examines the sources of textbooks, journal books in the library to support data and information in analyzing. The results of this study indicate that the basic policy regarding the dissemination of false news or hoaxes and hate speech that has been regulated in Law Number 19 Year 2016 article 28 paragraphs 1 and 2 has been effective because it can limit the space for the perpetrators of hoaks and hate speech. More specifically, the perpetrators can be charged with other related articles namely article 311 and 378 of the Criminal Code, Article 27 paragraph 3 of Law Number 19 of 2016 concerning Information and Electronic Transactions, Law No. 40 of 2008 concerning the Elimination of Racial and Ethnic Discrimination, as well as the perpetrators of spreading false news may also be subject to articles related to hate speech. Besides that, the more rapid and development of digital technology today, the more diverse the new crimes committed through this digital media, in this case the spread of false news (Hoax) that is rife. As many as 800,000 sites in Indonesia have been indicated as spreading false information.

Abstract

Kurangnya wawasan ataupun pendidikan yang redah akan mengakibatkan butuhnya perlindungan hukum karena sebagai warga Negara tentu saja mempunyai hak yang perlu dibela. Maka dari itu seorang Advokat sangat dibutuhkan dalam mencari kebenaran, dan menegakkan keadilan untuk membela hak asasi manusia dan memberikan pembelaan hukum yang bersifat bebas dan mandiri. Pada kenyataanya, peran Advokat sendiri menjadi pro dan kontra dalam memberikan jasa hukum kepada kliennya. Sejatinya profesi advokat dapat juga menjadi mediator bagi para pihak yang bersengketa yang berkaitan degan pidana, perdata, maupun tata usaha Negara. Advokat adalah pekerjaan yang digolongkan dalam kualifikasi sebagai profesi yang dalam menjalankan sebuah profesi tersebut sudah pasti ada yang namanya kode etik profesi. Dalam menjalankan atau penegakan supremasi hukum, profesi advokat sendiri tidak terikat oleh jabatan atau hierarki yang secara instruktif sehingga dapat mempengaruhi profesi tersebut. Peran advokat dalam mendampingi klien menurut hukum islam sangatlah berkaitan karena terdapat beberapa dalil Al-Qur’an yang menjelaskan bahwa sejak awal islam menerpakan kepasatian hukum dalam artian membela dan memiliki pengungkapan kebenaran di pengadilan.

Abstract

Before the introduction of Islamic law, the Indonesian people adhered to customary law which had various systems and was very diverse in nature. In reality, the Islamic religion has had a big influence on the lives of Indonesian people to this day. Apart from that, the majority of the Indonesian population adheres to Islam, so it is natural that Islamic law always colors national law in Indonesia. The aim of this research is to find out the history of the implementation of Islamic law in Indonesia and the role of Islamic law in the development of national law in Indonesia using library research methods. The conclusion of this research is that Islamic law entered Indonesia at the same time as Islam entered Indonesia, which according to some circles began in the VII or VIII century AD. Meanwhile, Western law was only introduced by the VOC at the beginning of the seventeenth century AD and in the development of Indonesian national law, religious law ( Islamic law) is the most dominant basis, where Islamic law plays a very important role in shaping Indonesian human behavior. Abstract

Penulisan ini bertujuan untuk berbagi pengetahuan dan memberikan sudut pandang dalam penyelesaian perkara cerai melalui litigasi (mediasi) berhasil sebagian dalam perkara cerai talak kumulasi hak isteri, hak anak serta pengasuhan anak di Pengadilan Agama Binjai. Penyelesaian sengketa melalui mediasi (damai) telah dikenal dalam agama Islam. Islam mengajarkan agar pihak-pihak yang bersengketa melakukan perdamaian. Dalam kasus perceraian, fungsi dari upaya untuk mendamaikan menjadi kewajiban hakim sebagai mediator yang harus dilakukan berdasarkan Peraturan Mahkamah Agung Nomor 01 Tahun 2016 tentang Prosedur Mediasi di Pengadilan. Oleh sebab itu diupayakan perdamaian melalui mediasi di Pengadilan Agama agar pasangan yang hendak bercerai mengurungkan niatnya dan rujuk kembali. Dalam realitasnya pemberlakuan mediasi masih kurang begitu efektif dalam menyelesaikan perkara, terbukti dari sedikitnya perkara yang berhasil diselesaikan dengan mediasi. Namun pada tahun 2022 ini mediasi yang dilaksanakan berhasil meningkat dibanding tahun-tahun sebelumnya dan mediasi berhasil sebagian sampai bulan Juni tahun 2022 sejumlah 7 (tujuh) perkara Nomor Register 6 , 173, 184, 188, 205, 228, dan 230. Permasalahan yang akan dibahas dalam penulisan ini adalah tentang keberhasilan mediasi sebagai sarana mendamaikan perkara, yang tujuan utamanya yakni mengurangi jumlah perkara, dan juga untuk mengetahui tingkat keberhasilan mediasi. Khususnya dalam perkara perceraian yang terjadi di Pengadilan Agama Binjai. Di dalam penulisan penelitian ini, Penulis menggunakan jenis penelitian empirik dalam karya ini dengan menggunakan pendekatan kualitatif Sedangkan dalam metode pengumpulan data yang digunakan adalah observasi. Adapun metode artists data yang penulis gunakan dalam penelitian ini menggunakan metode analisis kualitatif deskriptif. Untuk mengetahui secara jelas tingkat keberhasilan mediasi yang terjadi di Pengadilan Agama Binjai dengan menggunakan data-data yang diperoleh dalam penelitian di lapangan. Hasil penelitian menunjukkan bahwa pelaksanaan dalam proses mediasi dalam perkara perceraian di Pengadilan Agama Binjai dalam mengupayakan perdamaian antara para pihak sudah sesuai dengan apa yang diatur pada PERMA No. 1 Tahun 2016, dan HIR. Selain itu tingkat keberhasilan mediasi dalam perkara perceraian di Pengadilan Agama Binjai, jika dilihat dari penerapan mediasinya sudah efektif dan sesuai dengan PERMA Writing this study aims to share knowledge and provide a perspective in the resolution of divorce disputes through litigation (mediation) partially successful in a divorce cases property wife’s rights, children’s rights and childcare in the religious court Binjai. Mediation is a dispute resolution process through the negotiation process or the consensus of the parties, assisted by the mediator has no authority to decide or impose a settlement In reality the application of mediation is less effective in resolving the case, proved by a case that successfully solved by mediation. But in 2022 mediation successful increased dramatically compared to previous years and mediation partially successful until June 2022 amount 7 (seven) case is registration number 6 , 173, 184, 188, 205, 228, and 230. Issues to be discussed in this study is about the effectiveness of mediation as a means of reconciling the case, the main goal of reducing the number of cases, and also to assess the success of mediation. Particularly in divorce cases that occurred in the Religious Court Binjai. In writing this research, Researchers use this type of empirical research in this work, using a qualitative approach. While the data collection methods used were observation and interviews. The method of data analysis used in this study the author uses descriptive qualitative analysis method. To know clearly the success rate of mediation that occurred in the Religious Court Binjai using data obtained in research in the field.

Abstract

Of the many impacts that occur from the breakdown of a marriage, one of them is the problem of dividing joint assets. Where joint assets are assets acquired by a husband and wife while they were still married. In decision NO.2802/Pdt.G/2018/PA.Dpk, the Depok Religious Court Judge gave a larger share of joint assets to the ex-wife, with details of 70% for the ex-wife and 30% for the ex-husband. Meanwhile, Article 97 of the Compilation of Islamic Law explicitly provides for shares of joint assets in equal amounts between the wife and husband. Where the judge clearly ignored written Material Law, namely the Compilation of Islamic Law, in deciding the case. This research aims to find out the basic considerations of the Depok Religious Court judges in deciding this case, and how the KHI and Islamic law are reviewed from Maslahah Murshalah's perspective on resolving the joint property problem. This research is normative juridical research. This type of research is library research. The results of the research illustrate that the judge decided the case by giving a share of joint assets in both the Convention and Reconvention decisions in the amount of 30% for the Convention Plaintiff/Reconvention Defendant and 70% for the Convention Defendant/Reconvention Plaintiff. In this decision the judge adopted jurisprudence, more precisely, Supreme Court Decision No.266/K/AG/2010 as a legal consideration in deciding the case, however the judge also made legal discoveries using independent legal methods in determining the amount obtained by each partner, because in In this decision, the judge did not fully adopt the Supreme Court's jurisprudence, but rather, chose to dig deeper into the ins and outs of the assets, roles and contributions of the couple during the marriage period.

Abstract

This study aims to find out about the differences in the application of ijbar rights according to fiqh and Law No.39 of 1999 concerning Human Rights, how the legal rules of ijbar rights based on fiqh and Law No.39 of 1999, whether the application of ijbar rights based on fiqh and Law No.39 of 1999 is in line, whether there is special protection for women who are forced to marry by guardians, what are the negative impacts of the application of ijbar rights on the harmony of a marriage. The research method used is library research. Many guardians abuse the right of ijbar and lead to forced marriage, while according to Law No.39 of 1999 a child also has full rights over his survival, one of which is to choose his life partner. With regard to the provisions of the mujbir guardian, the majority of fiqh scholars, such as the maliki, shafi'i, and hambali circles allow the right of ijbar by a guardian to a child or person under his guardianship to marry even without the child's permission, this is very contrary to Law No.39 of 1999.

Abstract

The purpose of this research is to find out the steps for settlement of compensation in the practice of renting a car based on the perspective of the MUI Fatwa Number 43/DSN-MUI/VIII/2004. The formulation of the problem used is how to settle compensation for parties who default (consumers) on verbal agreements made by rental owners (manufacturers) based on MUI Fatwa Number 43/DSN-MUI/VIII/2004. This research includes qualitative research using juridical research methods that use two sources, namely primary and secondary. As well as conducting interviews with several car rental users in Medan City, Medan Marelan District. The results of this study show that several car rental users make verbal agreements between consumers and producers. Regardless of the consequences of the agreement made verbally which will be accepted if one of the agreements is forgotten or not pronounced at the time of the contract, then it will be detrimental to one of the parties. If the consumer commits a default that does not comply with the verbal agreement at the outset, then the consumer will compensate for the loss determined by the producer. According to the perspective of the MUI Fatwa Number 43/DSN-MUI/VIII/2004 general provision number 4, namely the amount of compensation (ta'widh) is in accordance with the value of real compensation (real loss) that must be experienced (fixed cost) in the transaction and not a loss expected to occur (potential loss) due to missed opportunities (opportunity loss or al-furshah al-dhai'ah). Abstract

Advocate profession is closely related to advocate organizations as a forum for advocates. Advocate profession is an honorable profession (officium nobile) because it devotes itself to the interests of society, not only for personal gain. One of the roles of an advocate is as a supervisor and guardian of justice. However, when viewed from the implementation and enforcement so far, it is often seen that the advocate's code of ethics is a complement that most advocates pay little attention to. Violations of the code of ethics are often committed by advocates in carrying out their profession and do not even hesitate to carry out these actions openly. If there is a violation of the Code of Ethics, the Advocate Honorary Council has the right to impose sanctions and decide to impose sanctions in accordance with the articles stipulated in the Indonesian Advocate Code of Ethics contained in Article 7 paragraph (1) of the Law on the Indonesian Advocate Code of Ethics. Abstract

Pembaruan hukum pidana di Indonesia dilakukan untuk menyempurnakan sistem pemidanaan dalam KUHP warisan era kolonial Belanda berdasarkan pertimbangan filosofis, politis, sosiologis, dan praktis, melibatkan pembaruan hukum pidana formal, materil, dan pelaksanaan. Dalam artikel ini, pembaruan sistem pemidanaan dalam KUHP baru akan dikaji dengan menggunakan metode penelitian hukum normatif dengan menggali bahan hukum berupa peraturan perundang-undangan, serta opini dan pandangan para pakar hukum pidana yang dimuat di beberapa media massa dan jurnal ilmiah. Analisis data bersifat kualitatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Hasil penelitian menunjukkan bahwa Undang-Undang Nomor 1 Tahun 2023 tentang KUHP mengadopsi pemikiran aliran neo-klasik dan menjaga keseimbangan antara faktor objektif dan faktor subjektif. Perkembangan pemidanaan dalam KUHP baru memuat perubahan signifikan dalam hukum pidana, termasuk dalam jenis-jenis hukuman yang diatur, terdapat penerimaan terhadap living law sebagai dasar pemidanaan, pertimbangan aspek kemanusiaan, dan meskipun pidana mati masih ada, namun pengadopsian konsep baru menekankan pada pencegahan, rehabilitasi, dan penyelesaian konflik, serta tidak merendahkan martabat manusia.

Abstract

Smoking is a bad habit that has been done since the time of the discovery of tobacco. Initially smoking only aims to warm the body but, over time the habit becomes changed goal is AS a requirement that can not be abandoned or can be said to be addicted. The majority of smokers worldwide are ± 47% male population while 12% are female population with different age categories. Various reasons people smoke a variety, among these people there are several factors that influence a person to smoke for example, prestige factors to be called “champion”, and there are also people who say smoking can trigger inspiration and keupayaan thinking, even there is an interesting pantun used Alaihi Symbolic interactionism is a sociological theory that emphasizes the role of symbols and social interaction in understanding human behavior. In the context of analyzing the influence of the “Gak ngerokok gak ganteng ” advertisement on teenage hangouts, this approach can provide a deep understanding of how the advertisement influences teenagers' perceptions, attitudes and behaviors towards smoking. In symbolic interactionism, symbols such Alaihi Salam words, images, or actions are considered to have meanings given by individuals through the process of social interaction. The “No smoking no handsome” advertisement is a symbol that gives a message to teenagers that not smoking is something cool or attractive. Through the process of social interaction, the symbol can be interpreted and interpreted by teenagers in the context of their daily lives. An analysis of the influence of these ads on teenage hangouts can involve several aspects, including: Perception and attitude, Behavior, Identity and Social Interaction. Using the framework of symbolic interactionism, the analysis can dig deeper into how the “Gak ngerokok gak tampan ” advertisement influences teenagers' mindset and behavior related to smoking, AS well Alaihi Salam how the symbols are interpreted in the cultural and social context of teenagers.
