Abstract

Pengadilan Tata Usaha Negara menjadi salah satu instansi peradilan yang ada di Indonesia guna menyelesaikan sebuah sengketa atau tindakan dari pejabat tata usaha negara yang dirasa melangggar peraturan perundangan yang telah ditetapkan maupun asas-asas pemerintahan yang baik. Sebagai lembaga peradilan di Indonesia, Pengadilan Tata Usaha Negara perlu menyesuaikan dengan dinamika yang ada, salah satunya adalah penerapan Electronic Court atau E-Court yang dalam hal ini kemudian akan menggantikan adanya sistem peradilan yang konvensional. Dalam penelitian ini ditemukan adanya upaya peningkatan dan penggunaan sistem E-Court di Pengadilan Tata Usaha Semarang dengan metode penelitian non-doktrinal dengan pendekatan kualitatif bersama dengan peneliti terjun langsung ke Pengadilan Tata Usaha Semarang. Kesimpulan dari penelitian ini adalah upaya dari Pengadilan Tata Usaha Semarang dalam menerapkan dan meningkatkan adanya sistem E-Court sebagai kunci dari penyelesaian sengketa di Pengadilan Tata Usaha Semarang yang kemudian akan dijelaskan secara terperinci pada bagian pembahasan.

Abstract

Tulisan ini menganalisis secara sosiologi hukum kasus penganiayaan yang dilakukan oleh Napoleon Bonaparte terhadap Muhammad Kace. Berdasarkan hasil analisis diketahui bahwa peristiwa penganiayaan yang dilakukan oleh Napoleon Bonaparte terhadap Muhammad Kace, merupakan permasalahan dalam tataran penegakan hukum khususnya mengenai fungsi Lapas. Penting untuk para petugas Lapas memahami tugas pokoknya yaitu menjalankan penegakan hukum terhadap Terpidana maupun Tahanan agar Lapas berfungsi sebagaimana mestinya. Ada 5 (lima) faktor yang dijadikan tolak ukur untuk mengetahui efektifitas fungsi Lapas yaitu faktor kaidah hukum, faktor fasilitas hukum, faktor aparat hukum, faktor kesadaran hukum dan faktor budaya hukum. Sehingga apabila bisa disimpulkan bahwa efektifitas fungsi Lapas dalam kasus penganiayaan Napoleon Bonaparte terhadap Muhammad Kace belum tercapai.

Abstract

Indonesia is set the net zero emission target to be achieved by 2060. As part of that, Universitas Diponegoro (UNDIP) is committed to support the achievement of the goal by implementing several strategies. First is to reduce the amount of emission generated by the university daily activities, and second is boosting the activities of mangrove conservation and biodiversity protection. As UNDIP located in the northern part of Central Java, part of 108.000 kilometers coastline region of Indonesia, UNDIP prioritizes its academic activity and research focus on coastal region environmental and ecological development which enthuse the implementation of mangrove conservation and biodiversity protection. The strategy includes the structured mangrove and biodiversity conservation action directed by the University leaders, encouraging research and community service activities focusing on coastal region development and developing environmental-related curriculum for the students. In addition, UNDIP also supports research centers and students’ communities who focus on mangrove conservation, biodiversity protection, and coastal region development. Abstract

Alat bukti dalam Undang Undang Peradilan Tata Usaha Negara (Peratun) bersifat enumeratif dan closed-system menghadapi tantangan ketika munculnya alat bukti elektronik yang diatur dalam Undang Undang Informasi dan Transaksi Elektronik (ITE). Demi menjamin kepastian hukum mengenai alat bukti elektronik, diperlukan harmonisasi ketentuan alat bukti elektronik ke dalam UU Peratun yang dalam belum di atur bahkan dalam pembaharuan ke-2. Tujuan penelitian ini mengharmonisasi ketentuan alat bukti elektronik dalam UU Peratun dan UU ITE. Penelitian ini menggunakan metode penelitian yuridis normatif yang meneliti bahan kepustakaan maupun bahan sekunder. Hasil penelitian menunjukkan diperlukannya konsep, prosedur verifikasi alat bukti elektronik, dan pembaharuan pada pasal tentang alat bukti dalam UU Peratun sehingga dapat memberikan keabsahan terhadap alat bukti elektronik yang digunakan dalam pemeriksaan di Pengadilan Tata Usaha Negara (PTUN), mengingat perkembangan teknologi menjadi salah satu tantangan dalam memastikan keaslian alat bukti elektronik. Hal terpenting yang harus diperhatikan yaitu proses verifikasi dan kebutuhan atas hukum yang mengakomodasi sahnya alat bukti elektronik dan proses verifikasi alat bukti dalam proses pemeriksaan acara PTUN. Kesimpulan penelitian ini perlu menambahkan ketentuan alat bukti elektronik pada Pasal 100 ayat (1) huruf f dan g serta menambahkan ketentuan verifikasi keaslian alat bukti elektronik pada Pasal 100 ayat (2).

Abstract

Universitas Diponegoro, with an open forest area and planted vegetation of 30 – 40%, produced vast amounts of organic waste, especially tree litter. Piles of tree litter are everywhere if it is not properly managed. Universitas Diponegoro has taken a comprehensive approach to handling leaf and tree litter by converting it into economically valuable and beneficial products to meet the objectives of SDGs 12, which are focused on Responsible Consumption and Production. Through the Technical Implementation Unit for Occupational Safety, Health, and Environment (UPT K3L) Universitas Diponegoro has pyrolyzed tree branches to create liquid smoke and anaerobically converted leaf waste into compost. Later, the liquid smoke produced by pyrolysis and compost can achieve the consumer demand standard. In addition, from the policy approach, it is mandatory for every building to handle tree litter surrounds into compost using composting pits and composting bags. The circular economy idea has been incorporated into waste management at Universitas Diponegoro.

Abstract

This study explores the integration of technology in Indonesia’s Administrative Court system, particularly the impact of electronic justice (e-court) in the Society 5.0 era. With advancements in technology reshaping societal functions, the study examines how these changes have influenced legal proceedings within the Administrative Court. The research focuses on the implementation of Supreme Court Regulation No. 1 of 2019, which governs e-court proceedings, and how these technological advancements align with Indonesia’s legal culture and the values of Pancasila, particularly social justice. It highlights fundamental shifts, such as the introduction of electronic summons, electronic domicile, and online hearings, as part of the modernization of judicial processes. Through qualitative research and doctrinal legal analysis, this study emphasizes the significance of legal culture in ensuring the smooth transition to digital procedures and fostering public awareness of citizens’ rights and obligations. The findings suggest that while technological progress in the court system brings efficiency, the successful adoption of these changes requires legal culture to promote public understanding and participation, ultimately supporting the realization of social justice as outlined by Pancasila.

Abstract

As a higher education institution with a vision to become a research university, programs and activities related to research are Universitas Diponegoro main concern. Research is one of the three main pillars of higher education in Indonesia, apart from education and community service. Besides that, as a state university, its development is also influenced by central government policies. Currently, Undip is a state university with legal status and has wide autonomy. This paper explains research programs, activities and challenges that still need to be addressed in the future. To increase research capacity at Diponegoro University, there are five main programs, namely: 1. Increasing the capacity of human resources; 2. Improvement of facilities and supporting facilities; 3. Increasing the availability of research funds, 4. Collaboration and 5. Creating a conducive environment to research development at universities. Based on the application of the five programs, there has been a substantial increase in a research capacity, especially when viewed from indicators of international scientific publications, and an increase in the number of patents obtained. But there are still many challenges that need to be overcome, including the increase in the citation of published papers and the utilization of patent by industries.

Abstract

Indonesia’s constitutional framework enshrines the separation of powers among the executive, legislative, and judicial branches, yet only the legislature lacks explicit term‐limit provisions for its members. This normative legal analysis examines the democratic and legal implications arising from this regulatory gap and proposes strategies to safeguard legislative renewal. Utilizing primarily on secondary sources—statutes, academic literature, and comparative analyses—the research employed both statutory and conceptual approaches to assess existing laws, notably Law No. 17 of 2014 on the People’s Consultative Assembly and House of Representatives and Law No. 7 of 2017 on General Elections. The analysis identifies three core deficiencies: first, the lack of term limits undermines legal certainty by leaving tenure duration indeterminate and susceptible to arbitrary interpretation; second, unlimited re‐election fosters power entrenchment, increasing risks of corruption, collusion, and nepotism, and weakening the legislature’s oversight and budgetary functions; third, perpetual incumbency impedes generational renewal, diminishing internal party democracy and restricting political recruitment. Drawing comparative insights from Australia’s staggered Senate terms illustrate how structured tenure can promote dynamism while retaining institutional memory. In response, the study advocates for a clear legislative amendment that caps legislators’ service to two consecutive terms, aligned with principles of accountability, rotation of power, and open political recruitment. Additionally, it recommends that political parties institutionalize transparent internal mechanisms and enforce term‐limit rules to ensure cadre development and democratic governance. By codifying legislative term limits and fostering proactive party roles, Indonesia can strengthen constitutional checks and balances, enhance the legislative quality, and secure sustainable democratic renewal.
