Abstract

This study aims to determine how the implementation of rural area development in Bone Bolango Regency is based on Ministerial Regulation Number 5 of 2016. The legal basis of the rural area development policy is Law Number 6 of 2014 concerning Villages. The law has the purpose and function of creating a strong, independent, peaceful, and democratic village that is used to regulate the development of rural areas. The results of this study are; 1). The implementation of rural area development in Bone Bolango Regency based on Ministerial Regulation Number 5 of 2016 can be carried out by forming a Coordination Team for Rural Area Development, planning the preparation of the development plan in question, and cooperation and determination of the village sarasan; 2). Obstacles in the implementation of rural area development in Bone Bolango Regency based on Ministerial Regulation Number 5 of 2016 are the lack of formation of a Rural Area Development Coordination Team (TKPKP), and the lack of maximum implementation of rural area development in Bone Bolango Regency

Abstract

The purpose of this research is to find out what is the effectivenesstackling homeless and beggars in Gorontalo City based on Article 23 of Regional Regulation No. 1 of 2018 concerning Public Order. Then also to know and explain what are the factors that hinder the handling of homeless people and beggars. The results of the study show that the prevention of homeless people and beggars in Gorontalo City has not been effective. This is due to the fact that the efforts being made are limited to repressive efforts by using the Civil Service Police Unit as a government apparatus based on the Gorontalo City Regional Regulation Number 1 of 2018 concerning Public Order. Then the factors that hinder the handling of homeless and beggars are divided into internal factors, including: limited operational costs, lack of facilities and infrastructure, lack of agencies involved, and leakage of information to the public. The external factors are: the presence of persons coordinating the homeless and beggars, and the habit of the people who like to give.

Abstract

The purpose of this study is to determine the validity of the Terms of Agreement on Transactions through e-commerce conducted by minors, which is divided into two sub-discussions, namely first how the validity of agreements in e-commerce transactions according to Article 1320 of the Civil Code and second how the legal protection of the parties in conducting e-commerce transactions conducted by minors. This type of research is a qualitative literature research with a juridical-normative approach. The results of this study show that agreements through e-commerce are declared valid and declared born when an agreement is reached regarding the object being promised, and cannot be separated from what has been basically stated by Article 1320 of the Civil Code by using electronic media so that the contract is not realized in writing. E-commerce transactions are carried out by parties, one of which is under age, the agreement is considered valid as long as it does not harm both parties, and the underage party understands the agreement that must be fulfilled and is responsible for what has been agreed upon.

Abstract

The purpose of this study is to analyze the judge's decision in case number: 132/Pdt.P/2019/PA.Gtloviewed from the Compilation of Islamic Law This research uses a normative-empirical legal research type, where an analysis of the written law is carried out with factual events in the field. In this study, the data sources used are primary data consisting of the results of interviews and field observations, the Civil Code, ILC, and judges' decisions related to the issues being discussed; and secondary data (supporting) scientific works, and other sources related to the problems discussed.The results of the study show that first, the substitute heirs proposed by the applicants in case no. 132/Pdt.P/2019/PA.Gtlo from the late. Zubaida Datau may become a substitute heir based on the provisions formulated in the Compilation of Islamic Law (ILC), provided that the plot of land is the property of the late. Saini Datau. However, if the plot of land is the property of the Almh. Kamaria Datau, then the substitute heir proposed by the applicant, must be declared not accepted by the panel of judges at the Gorontalo PA because he is prevented from becoming an heir based on the ILC formulation. Legal considerations of the panel of judges examining case No. 132/Pdt.P/2019/PA.Gtlo, where the case is declared unacceptable, is that it is unclear/fuzzy, no longer voluntary, but a contentious case, because it contains a dispute between the heirs of the deceased's heirs. Abstract

This research examines the pattern of recruitment of women in political parties to meet the threshold of 30% of Legislative Members in Indonesia, starting from regulations governing the rights and obligations of political parties as regulated in law, and specifications related to the recruitment process from political parties contained in in the AD/ART of political parties. This research is classified as normative empirical research with a statutory approach and a case approach. Research material was collected through interviews and document studies and then analyzed from a perspective. The results of the research show that the recruitment process for each political party is different and by stating the party's interests, there is no reference process regulated in statutory regulations. The researcher provides recommendations in this research related to the formation of statutory regulations for the recruitment process so that they become a reference for each party. politics, as well as providing political education to women in stages as well as evaluations that become material for party development.

Abstract

The prerogative is a privilege that belongs to the President which cannot be contested by other state institutions that use a presidential government system, namely the president is the head of state as well as the head of government in Indonesia. In the prerogative there is nothing specific to oversee a prerogative, but one of the supervision of this privilege is supervision in the cabinet ministers who are assistants to the president.The problems studied are 1) What is the meaning of the President's prerogative in the Indonesian government system. 2) How to Use the President's Prerogative in Appointing Ministers in the Indonesian Government System 3). What are the Forms of Supervision of Prerogatives in Cabinet Ministers? This study aims to identify and explain the meaning of presidential prerogatives, the system of government used in the application of prerogatives and oversight of privileges used in Indonesia. This research uses research methods through library research and normative research with reference to relevant laws and regulations and other legal materials related to substance in research and application regarding reading, listening, understanding, and reviewing the application of laws, scientific work. , books and literature related to the problem under study. In the meaning of prerogative is a privilege of a head of state in carrying out state duties.

Abstract

In terms of the ratification of Perppu Number 2 of 2022 concerning Job Creation, this raises pros and cons in society. This is because the Supreme Court Constitutional Decision Number 91 / PUU-XVIII / 2020 states that Law Number 11 of 2020 is unconstitutional conditional and must be immediately revised within 2 (two) years from the time the decision is issued. One of the reasons is because in the formation of the Job Creation Law, it does not involve full community participation and is not guided by the principle of openness. But the government actually responded by issuing the Job Creation Perppu which was later passed into law by the DPR-RI. In fact, between Law Number 11 of 2020 concerning job creation and Perppu Number 2 of 2022 concerning job creation, it is relatively the same in terms of content. This study aims to examine a legal truth related to the mechanism for ratifying Government Regulations in Lieu of Law based on actual legal provisions. One of the legal provisions in the formation of laws and regulations is to make the principle of forming laws and regulations one of the conditions that must exist in the process of forming laws. One of its principles is the principle of openness. and the method used in this study is Normative. And in the results of this study, it shows that the ratification of the Job Creation Perppu is not in accordance with the mechanism for the Establishment of Laws and Regulations because it is not guided by the principle of openness.

Abstract

This research aims to (1) determine the Inspectorate's supervisory function in preventing misuse of Village Funds and (2) to analyze and formulate what factors influence the Inspectorate's function in carrying out its function as a supervisory element to prevent misuse of Village Funds in South Bolaang Mongondow Regency. This type of research is empirical research, namely research that examines community behavior that arises due to the existence of a legal rule, or vice versa, the formation of a legal rule due to behavior in society by conducting field research and literature review. The results of this research show that the prevention process carried out The Regional Inspectorate prevents misuse of Village Funds by supervising and controlling the management of Village Funds. Factors that influence its effectiveness are legal substance: There are no regional regulations or regent regulations regarding supervisory procedures. Legal structure: The number of auditors is still limited. Legal culture: An inspection process that does not fully reach the field. Where the law applies: There are 7 sub-districts and 83 villages in South Bolaang Mongondow Regency. Infrastructure: Limited facilities for mobilization and the absence of an online site as a source of information and public complaints. The research conclusion shows that the supervision carried out by the Regional Inspectorate of South Bolaang Mongondow Regency has not been effective.

Abstract

Tulisan ini bertujuan sebagai luaran laporan Program Pengabdian KKN terkait dengan penanganan stunting. Stunting dapat memberikan dampak buruk terhadap tumbuh kembang anak, tidak hanya dari sisi fisik tetapi juga dari sisi kognitifnya. Jika hal ini terus dibiarkan maka akan mempengaruhi proses pembangunan sumber daya manusia Indonesia seutuhnya. Kabupaten Pohuwato merupakan daerah yang memiliki kasus stunting yang cukup signifikan. Sehingga diperlukan upaya partisipatif yang bersumber dari masyarakat dalam rangka mendukung kebijakan daerah dalam penanganan stunting. Desa Balayo yang menjadi tempat pelaksanaan KKN Tematik Stunting merupakan wilayah yang belum ditemukan adanya kasus stunting, meski demikian sebagai upaya pencegahan perlu dilakukan pendampingan kepada masyarakat dan pemerintah Desa Balayo dalam mengambil langkah-langkah yang terstruktur dalam penanganan stunting. Oleh karenanya melalui program KKN Tematik ini, diusulkan kegiatan  yang berjudul Pencegahan Stunting Melalui Pembentukan dan Pendampingan Kelompok Kerja Gerbos Emas (Gerakan Kolaborasi Mengentaskan Dan Mencegah Anak Stunting) di Desa Balayo Kecamatan Patilanggio. Metode yang digunakan dalam pelaksanaan kegiatan ini adalah pemberdayaan melalui penyuluhan dan pendampingan. Hasil dari pelaksanaan kegiatan ini adalah terlaksanya pendampingan dan pembentukan Kelompok Kerja Gerakan Kolaborasi Mengentaskan Dan Mencegah Anak Stunting di Desa Balayo dengan memperhatikan segala potensi desa.Kata Kunci : Pencegahan Stunting ; Gerbos Emas; Desa

Abstract

Program dalam kegiatan ini berupa Pemetaan Sumber Daya Karang Taruna Desa Buhu. Tujuannya adalah memberikan manfaat khususnya terhadap aparat pemerintah desa beserta organisasi pemuda karang taruna desa agar lebih produktif dalam pengembangan desa. Adapun manfaat dalam pengembangan kehidupan perekonomian masyarakat ke arah yang lebih baik, melalui pemetaan potensi yang ada di desa, serta terjalinya kemitraan Desa dengan Perguruan Tinggi khususnya Fakultas Hukum Universitas Negeri Gorontalo. Hasil dari pengabdian ini adalah berdasarkan RPJM Desa Buhu menunjukkan bahwa terdapat beberapa potensi desa disektor Pertanian, Perikanan, dan Peternakan. Menjadi suatu persoalan dewasa ini, pemuda Karang Taruna Desa Buhu belum bisa menangkap peluang bisnis dan usaha kreatif dan pengelolaan potensi desa Buhu. Sehingga melalui program pengabdian pemetaan sumber daya Karang Taruna Desa Buhu ini diharapkan mampu memberikan edukasi yang dapat menciptakan dan memotivasi pemuda karang taruna untuk lebih produktif dalam pengelolaan potensi desa yang dikemas dalam usaha ekonomi produktif. The program in this activity is in the form of Mapping coral resources of Buhu Village Cadets. The goal is to provide benefits, especially to village government officials and village cadet coral youth organizations, to be more productive in village development. The benefits in developing the community's economic life in a better direction through mapping the potential in the village, as well as establishing village partnerships with universities, especially the Faculty of Law, Gorontalo State University. The result of this service is based on the Buhu Village Medium-Term Development Plan, and it shows several potential villages in the Agriculture, Fisheries, and Animal Husbandry sectors. It is a problem today, the youth of Karang Taruna Buhu Village have not been able to grasp business opportunities and creative efforts and manage the potential of Buhu Village. So that through the Buhu village coral cadet resource mapping service program, it is hoped that it will be able to provide education that can create and motivate coral cadet youth to be more productive in managing the potential of the village packaged in productive economic efforts.
