Abstract

This study aims to analyze Community Service Order (CSO) punishment within the criminal law system through the lens of Islamic law, using a multi-dimensional approach. As an alternative to detention, CSO punishment is expected not only to achieve the rehabilitation of offenders but also to provide broader benefits to society. This study explores how the concept of maqāṣid al-sharīʿah with a multi-dimensionality approach—which includes social, economic, and cultural analysis—by looking at the relevance of maqāṣid al-sharīʿah and a comprehensive view of the concept of community service order punishment to achieve a balance between justice, rehabilitation, and social welfare. A multi-dimensionality approach is used to study community service order punishment from social, economic and cultural aspects. The results of the study show that Community Service Order Punishment are not only in line with the principles of maqāṣid al-sharīʿah, but also have the potential to increase the effectiveness of the rehabilitation of perpetrators, reduce detention costs, and increase the positive contribution of perpetrators to society. This study concludes that Community Service Order Punishment can be a more humane and effective alternative in the criminal law system, which is in line with Islamic values and supports the welfare goals of society as a whole.

Abstract

This research aimed to analyze the legality of abortion by medical professionals for rape victims in Indonesia through the perspective of maqashid sharia. This study adopts a normative legal research approach, utilizing statutory interpretation (legal approach) and conceptual analysis (conceptual approach). The results of this study suggest that maqashid sharia emphasizes that abortions should not be performed arbitrarily and are only permissible in urgent situations that fulfill sharia objectives. This includes scenarios where the mother's life is at risk or serious medical conditions prevent the continuation of pregnancy. Such decisions should be made carefully, considering maslahah and mafsadat and involving consultations with medical experts and religious authorities. The maslahah principles elucidated by al-Tufi expand the flexibility in legal interpretation, allowing for Islamic law adaptation to contemporary needs and conditions. This is particularly relevant in abortion cases, where explicit guidance may not always be found in religious texts. Overall, the maqashid sharia approach to abortion underscores the importance of principles of justice, balance, and humanity in Islamic law. By considering all these aspects, Islamic law can provide relevant and adaptive guidance in addressing contemporary issues like abortion while remaining faithful to the primary objectives of sharia to achieve collective good and avoid harm. Penelitian ini bertujuan untuk menganalisis legalitas aborsi oleh tenaga medis bagi korban perkosaan di Indonesia melalui perspektif maqasid syariah. Penelitian ini merupakan penelitian hukum normatif, dengan menggunakan pendekatan peraturan perundang-undangan (legal approach) dan pendekatan konseptual (conceptual approach). Temuan penelitian ini menunjukkan bahwa ada ketegangan antara norma hukum yang ketat dan prinsip-prinsip maslahat dalam maqasid syariah yang mengutamakan kesejahteraan dan perlindungan terhadap korban perkosaan. Hasil penelitian ini menunjukan bahwa maqasid syariah menekankan bahwa aborsi tidak boleh dilakukan sembarangan dan hanya diperbolehkan dalam situasi mendesak dan memenuhi tujuan syariah. Ini termasuk situasi di mana kelangsungan hidup ibu terancam atau kondisi medis yang serius tidak memungkinkan kehamilan berlanjut. Keputusan tersebut harus diambil dengan hati-hati, dengan mempertimbangkan maslahah (barang publik) dan mafsadat (bahaya), dan melibatkan konsultasi dengan para ahli medis dan otoritas agama. Prinsip-prinsip mashlahah yang dijelaskan oleh al-Tufi memperluas fleksibilitas dalam interpretasi hukum, memungkinkan adaptasi hukum Islam dengan kebutuhan dan kondisi kontemporer. Ini sangat relevan dalam kasus aborsi, di mana tidak selalu ada panduan eksplisit dalam teks-teks agama. Secara keseluruhan, pendekatan maqasid syariah terhadap aborsi menggarisbawahi pentingnya prinsip-prinsip keadilan, keseimbangan, dan kemanusiaan dalam hukum Islam. Dengan mempertimbangkan semua aspek ini, hukum Islam dapat memberikan panduan yang relevan dan adaptif dalam menangani isu-isu kontemporer seperti aborsi, sambil tetap setia pada tujuan utama syariah untuk mencapai kebaikan bersama dan menghindari bahaya.

Abstract

This study examines the translation of Shi‘ite and Wahhabi literature in Indonesia. This is a literature study. The primary data was obtained by examining the record of translated and published titles in Indonesian. This study refers to the theory of Mehdi Nakosteen, R.G.A. Dolby, and Abdul Munip regarding the transmission of knowledge through translation activities, their phases, and motives. This study found that these books from Iran and Saudi Arabia, covering various Islamic knowledge, are published and distributed in Indonesia by affiliated and unaffiliated publishers in order to introduce their ideas and doctrines to the wider Muslim community in Indonesia, using the Indonesian language as the medium of transmission. This transmission of knowledge through translation takes place through the awareness, interest, and adoption phases, and has religious, educational, economic, ideological, and stimulative-provocative motivations.

Abstract

The practice of developing sharia financing has actually experienced massive developments, especially in ensuring the existence of legal certainty in transactions. One of the developmental practices of sharia financing is the existence of a contract formulated in the form of a notarial deed. This research focuses on the legal vacuum related to the arrangement of making a shari'ah financing contract in the form of a notarial deed. This research is a normative legal research with a concept and statutory approach. The results of the study show that a sharia financing contract made in the form of a notarial deed according to Islamic law must still refer to the provisions of syar'i law. In the process of shari'ah financing contracts, it is necessary to refer to several syar'i aspects, such as paying attention to the provisions contained in the Qur'an and sunnah, the Sharia Banking Law, to the JN Law. The model for making sharia financing contracts in the form of a notary deed based on the principles of agreement in Islamic law places the position of a notary to guarantee neutrality, professionalism and integrity including fulfilling and complying with the code of ethics. Notaries need to understand the provisions of syar'i or Islamic law in formulating a syari'ah financing contract requiring certification and special training in making sharia banking contracts for notaries
