Abstract

In the Arab village of Bondowoso, precisely on the streets of HOS Cokroaminoto and KH. Asy'ari still maintains the custom of nasbiyah marriage. The focus of the research in this study is: what is the meaning of marriage according to the Alawite Arabs; why do 'alawiyyin Arabs in the past make a tradition of 'alawiyyin' Arab marriages; how the Alawite Arabs maintain the tradition of marriage between Alawite Arabs; and what are the views of the Alawite Arabs on the hadiths that prioritize their religious aspects. The results of this study are 1) Marriage is a physical and spiritual bond between a man and a woman to fulfill the purpose of married life as husband and wife by fulfilling the requirements and pillars that have been determined by Islamic law. 2) nasab is a descendant, so nasbiyah marriage is a marriage carried out by sayyid (Arabic man) and Syarifah (Arabic woman) to maintain the descendants that continue to the Prophet Muhammad. 3) it has become a tradition for Arabs to marry fellow Arabs as well, namely the Alawite group, besides that this tradition usually occurs because of the element of matchmaking by both parties, there is even a close family relationship between the bride and groom. 4) the view of the Arab Alawiyyin on the hadith prioritizes the religious aspect, if the lineage is good then the religion will be good too.

Abstract

Abstract: This study examines the conflict between Sunni groups and Syi'ah groups in post-New Order Indonesia. Many studies have revealed the problem of religious sectarianism conflict between the two. Some argue that conflict is triggered by differences in religious identity and theology. Others see economic and political aspects as the main factors triggering religious conflict and violence. Starting from the case of the Sunni-Syi'ah conflict in Jambesari Village (Bondowoso), this study finds an interesting finding that the conflict occurred due to sharpening religious polarization and contestation. At the same time, the infiltration of intolerant religious elites from outside the village also contributed to sharpening polarization, escalating tensions, and even triggering mass acts of violence that were suspected to have originated from Sunni groups over the Syi'ah minority group. Alienation, discrimination, dissolution of recitation, vandalism, and burning of houses belonging to Syi’ah elites are forms of violence both physically and psychologically due to the occurrence of this religious conflict.

So the result is that the idea of interfaith dialogue during the Covid-19 pandemic has become one of the important formulas in religious moderation. Abstract

Contemporary hadith studies have involved many auxiliary sciences, one of which is hermeneutics. As a critical theory, hermeneutics has been utilized by hadith scholars to explore the meanings of hadith not only on the denotative but also on the connotative level. One of the hermeneutical theories that is worth considering and has not been widely used by scholars to read hadith texts is Schleiermacher's objective hermeneutics. Broadly speaking, the main ideas of objective hermeneutics emphasize grammatical interpretation, psychological interpretation, the hermeneutical circle, and the method of divination. Using library research, this study aims to examine the involvement of objective hermeneutics in the study of hadith which some scholars believe is not relevant enough. The results of the study show that the use of objective hermeneutics proves to be relevant and even contributes importantly to revealing the historical (asbabul wurud), epistemological (ulum al-hadis), and interpretive (syarh al-hadis) dimensions. Grammatical interpretation serves to explore ḥadīś textually, psychological interpretation aims to read the context when the ḥadīś appeared, the divination method serves to record the main ideas of the author, the hermeneutic circle is useful to dialogue between text and context until contextualization is born. Thus, Schleiermacher's hermeneutics makes an important contribution to hadith discourse in the modern era, without being uprooted from the roots of classical hadith discourse.

Abstract

The harmonization of Islamic law through the spiritual dimension and the transformation of Islamic teachings in seems to be a disconnect between the spiritual essence of Islam and its legal framework in contemporary times. This disconnect raises questions about the extent to which current Islamic law fully embraces the spiritual principles that have become an integral part of the Nusantara heritage. Therefore, this research aimed to explore how Sheikh Washil's fiqh-sufistic can function as an Islamic legal framework, based on the spiritual principles of the Nusantara and answer contemporary issues. This research used an interdisciplinary approach with two approaches, History and Islamic Law. This research explored the literature of Sheikh Washil including his contribution to Islamic law. The findings of this study: first, fiqh-sufistic contributes to spiritual studies within a legal framework in order to understand and practice the characteristics of Islam Nusantara with an inclusive approach through the values of living ihya in da'wah and thought. Second, fiqh-sufistic presents a balanced approach to Islamic law, which is in harmony with the cultural context and heritage. The integration of fiqh-tasawuf shows the harmonization of Islamic law and the transformation of Islamic teachings in the context of the Nusantara. Third, the prevalence of fiqh-sufistic has had a transformative impact on the inclusive religious landscape, encouraging a deeper understanding of Islam as a way of life, not just a set of legal rules.

Abstract

After The New Era (Soeharto’s regime), the position of our country is claimed to be less expressive than The New Era authoritarianism regime. Our country seems like a new political stage that is so open that every social element can reach it. This melting political system enables every social element to be involved in practical politics to gain access to the state's political stage. Nevertheless, NU Jember also responded to the changing political system after The New Era by engaging in politics. NU Jember's structural constraints in practical politics were addressed by involving the traditionalist Muslim organization in the practical political arena without transforming the organization into a political party, but using it as an asset to participate in practical politics. These politically pragmatic practices led NU Jember to be evaluated as less capable of playing a progressive role in promoting a rapid transition to regional democracy.

Abstract

The higher objectives of the Sharia provide a legal framework within Islamic law to guide independent reasoning in interpreting legal issues based on rational principles. However, knowledge can also be obtained through unveiling. Ibn ‘Arabi argued that intellectual activities without spiritual experience are like spiritual perceptions without intellectual support. His analysis involved a systematic and rigorous approach to understanding and interpreting Islamic law through philosophical, linguistic, and historical contextualization. Ibn ‘Arabi relied on inner knowledge when examining legal issues and performed a type of spiritual ijtihād, but he did not disregard the role of traditional scholarship in Islamic jurisprudence. This balanced approach highlights the integration of rational and spiritual dimensions in legal reasoning, emphasizing the importance of both intellectual and spiritual insights in the interpretation of Islamic law. By combining these elements, Ibn ‘Arabi’s methodology offers a comprehensive understanding of legal issues, ensuring that interpretations are both deeply rooted in traditional scholarship and enriched by personal spiritual experiences. This dual approach underscores the dynamic and multifaceted nature of Islamic jurisprudence, where rational analysis and spiritual insight work together to achieve a holistic understanding of the law.
