Abstract

The increasing involvement of children as perpetrators of crimes has become a serious concern in Indonesia. This study aims to analyse the factors contributing to juvenile delinquency using a juridical empirical approach. It examines three cases of children in conflict with the law involving acts of assault, sexual misconduct, and theft. The findings reveal that the primary factors influencing such behaviour include unstable family conditions, such as parental divorce and lack of parental attention, negative peer environments, and the adverse effects of technology, particularly easy access to pornographic content. Additionally, online gaming addiction significantly contributes to criminal behaviour, especially in theft cases. This study underscores the importance of family roles in moral education, supportive social environments, and monitoring the use of technology to prevent children from engaging in criminal acts. It recommends a holistic approach involving families, communities, and the government to address this issue. Effective interventions include strengthening family based education, enhancing digital literacy, and developing community based rehabilitation programs for children involved in criminal activities.

Abstract

Marriage agreements based on their benefits in fact do not run as they should because many people still do not understand how important marriage agreements are to protect women’s rights in marriage, so this research aims to analyze the marriage agreement influencing the Decision of the Panel of Judges in the division of joint property and examine the concept of separation of property in the household contained in the marriage agreement from a legal purpose perspective. The results of this study indicate that (a). the division of joint assets in the Religious Court sees the existence of a Marriage Agreement, namely the Samarinda Religious Court Number 1726 / Pdt.G / 2019 / PA.Smd and the Balikpapan Religious Court Number 1672 / Pdt.G / 2023 / PA.Bpp, prioritizes maslahah, namely an effort to bring benefits and goodness by rejecting harm that will cause damage to humans, this is known as the substantive justice of the judge as a case resolver who fulfills the sense of justice of the community, while for cases where there is no marriage agreement, the Panel of Judges adjudicates in accordance with Article 97 and Article 98 of the Compilation of Islamic Law in conjunction with Article 35 of Law No. 16 of 2019 concerning Amendments to Law Number 1 of 1974 concerning Marriage, namely dividing joint assets for the wife ½ part and the husband ½ part, b) Marriage Agreement in accordance with Jeremy Bentham's opinion where the law must contain legal objectives in the form of maximum benefits for many people, by fulfilling several factors, namely to provide a living, to provide abundant food, to provide protection, to achieve equality, then the Marriage Agreement can protect the wife's rights in marriage

Abstract

The problem of gender equality in religious discourse is not only related to differences in roles between men and women, but also injustices that arise due to social constructions that limit access and opportunities for one gender. In Islam, the debate over gender has created two main groups: conservatives and progressives. Conservative groups believe that Islam is fair in regulating gender roles, while progressive groups believe that gender inequality occurs due to biased interpretations influenced by patriarchal culture. Different interpretations of religious texts are a major factor in determining views on gender roles, with a literal approach supporting gender hierarchies and a reformist approach encouraging equality based on Islamic principles of justice. This research uses the library research method with a case study approach that focuses on gender in religious discourse. Apart from that, quantitative analysis is also used to identify patterns and trends in people's perceptions of gender roles through surveys and statistical analysis. The data obtained were analyzed using descriptive methods, regression and correlation tests to understand the relationship between religiosity, education and understanding of religious teachings with gender views. It is hoped that the results of this research will provide insight into the impact of religious discourse on gender equality and encourage interpretations of religious teachings that are more inclusive and relevant to current social challenges. With increasing awareness of the importance of gender equality, this research can be a basis for formulating fairer policies for women in social, economic and political life.

Marriage is a contract, namely a handover between the guardian of a female candidate and a male candidate, this handover and acceptance is a form of responsibility for one goal. Early marriage is a marriage carried out by couples who are considered teenagers, namely those under 19 years of age. It will be difficult for women to report incidents of domestic violence that happen to them for several reasons, personal, family, and even cultural reasons surrounding the victim of domestic violence. Therefore, maintaining family integrity can avoid factors that cause divorce, one of which is domestic violence. The researchers used qualitative research methods with library methods and data collection techniques using secondary source data to help strengthen this research. Therefore, how can families maintain family ties to build a sakinah mawaddah warahmah family, and then also look for solutions and solutions to solve domestic violence problems so that undesirable things do not happen. This research helps to determine how families can build family resilience and provide solutions, and also helps families to avoid factors that cause divorce in the family

Abstract

The phenomenon of female converts marrying under the guardianship of religious leaders in Batu Ampar District presents a unique issue, as it does not entirely align with national legal procedures, yet enjoys broad acceptance within the local community. While earlier studies have focused on court-appointed guardians (wali hakim) or the role of wali muhakkam in emergencies, limited research has analyzed this phenomenon through the lens of hearing shari'ah. This study seeks to address that gap by exploring the underlying factors, examining the validity of the marriage process according to classical Islamic jurisprudence, and interpreting it through the objectives of Islamic law. Using a qualitative descriptive method, data were collected through interviews and field observations. The findings reveal that the factors prompting the use of religious leaders as marriage guardians include the absence of a Muslim lineage guardian, economic limitations in accessing formal legal procedures, social pressure to maintain family honour, and the high legitimacy of religious leaders within the community. From the perspective of fiqh procedures, the marriage fulfilled all the essential pillars and conditions, such as the presence of acceptance (offer and acceptance), two just witnesses, a guardian (still), and a dowry (mahar). From the viewpoint of maqashid syari’ah, the marriage achieved the protection of religion (hifzh al-din), life (hifzh al-nafs), honor (hifzh al-‘ird), lineage (hifzh al-nasl), and property (hifzh al-mal).

Abstract

The cycle of suffering. According to validated data from the Ministry of Women’s Empowerment and Child Protection (PPPA) in 2023, a total of 27,312 cases of alleged violence were reported, with 23,965 of the victims being women. Domestic violence committed by spouses is among the most common cases, with 20.2% of the victims being housewives. In light of this, the researcher conducted a study to examine the meaning of sexual violence within the context of law and Islamic teachings, particularly in Islamic households, with the aim of finding a balance of rights and obligations between husband and wife from the perspective of Qirah Mubjadi. The research method employed is a literature study. The results show that from the perspective of Qirah Mubjadi, sexual violence in marital relationships can be addressed through the principles of mutuality, mutual understanding, and reciprocal respect between husband and wife.
