Abstract

This study analyzes the implementation of the principles of good governance in the formation of laws and regulations in Indonesia. While principles such as transparency, participation, accountability, and effectiveness are expected to improve the quality of regulation and public trust, the practice still faces various challenges. Overlapping regulations, a lack of substantial public participation, and the accountability of legislative institutions influenced by political interests are the main obstacles. This study uses a normative juridical approach to evaluate the extent to which these principles are applied and their impact on the quality of regulations. The results of the analysis show that the ineffectiveness of the implementation of good governance principles contributes to the low quality of laws and regulations, as well as reduces public trust in the government. Therefore, reforms are needed in the legislative process to ensure that the principles of good governance are effectively integrated, in order to achieve sustainable legal development that is responsive to the needs of society.

Abstract

AbstrakPeraturan Desa partisipatif menjadi sarana agregasi berbagai kepentingan dalam pengelolaan pemerintahan desa yang adaptif dengan aspirasi dan ekspektasi masyarakat. Sistem oligharki dalam pemerintahan desa disadari atau tidak telah berkembang, sekian lama sehingga sulit untuk diselesaikannya, maka salah satu alternatif yang diharapkan dapat menguraikan benang kusut ekses sistem oligharki tersebut adalah peratuan desa partisipatif. Adapun permasalahan yang diteliti meliputi; apakah latar belakang lahirnya gagasan peraturan desa partisipatif, bagaimana sistem oligarki dalam implementasi pemerintahan desa, apakah peraturan desa partisipatif merupakan upaya dalam membongkar kemapanan sistem oligarki dalam pemerintahan desa. Penulisan ilmiah ini dilakukan Dengan menerapkan metode penelitian yuridis normatif yang memiliki spesifikasi penelitian deskriptif analitis. Temuan penelitian ini menunjukan bahwa peraturan desa partisipatif merupakan alternatif solusi atas berbagai permasalahan di atas guna menjadikan pengelolaan pemerintahan desa yang dapat menyediakan pelayanan optimal bagi masyarakat desa sesuai dengan asas profesional, proporsional, legitimit dan memenuhi akuntabilitas publik. AbstractParticipatory village regulations are a means of aggregating various interests in the management of village governance that is adaptive to the aspirations and expectations of the community. The oligarchic system in village governance, whether we realize it or not, has been developing for so long that it is difficult to resolve, so one of the alternatives that is participatory village regulations. The problems studied include; what is the background of the birth of the idea of participatory village regulations, how is the oligarchic system for the execution of village governance, whether participatory village regulations are an effort to dismantle the establishment of the oligarchic system in village governance. This scientific writing is conducted using normative juridical research methods utilizing descriptive analytical research parameters. The outcomes of this research show that participatory village regulations are an alternative solution to the problems above in order to make village government management that can deliver optimal service for the village community in alignment with the values of professional, proportional, legitimate and fulfill public accountability.

Abstract

Hukum Indonesia saat ini merupakan hasil dari akulturasi antara hukum adat, hukum Islam, dan hukum kolonial Belanda, yang saling melengkapi dan membentuk kerangka hukum yang kompleks. Melalui pendekatan yuridis normatif, penelitian ini mengeksplorasi relevansi prinsip-prinsip hukum yang diatur dalam Kitab Kutaramanawa Dharmasastra, yang menekankan nilai-nilai seperti nilai keadilan sosial, nilai musyawarah, dan nilai gotong royong. Hasil penelitian menunjukkan bahwa meskipun terdapat transformasi yang signifikan dalam sistem hukum setelah kemerdekaan, nilai-nilai dasar dari hukum Majapahit masih berpengaruh dalam pembentukan norma-norma hukum modern. Namun, tantangan dalam penerapan prinsip-prinsip tersebut muncul akibat perubahan sosial budaya, perkembangan teknologi, dan globalisasi. Penelitian ini juga menyoroti pentingnya adaptasi nilai-nilai tradisional dalam konteks hukum yang dinamis untuk memastikan keadilan dan perlindungan hak asasi manusia di Indonesia. Dengan demikian, pemahaman mendalam tentang interaksi antara sejarah hukum Majapahit dan perkembangan hukum kontemporer di Indonesia dapat memberikan kontribusi signifikan bagi upaya reformasi hukum dan penegakan keadilan di masyarakat saat ini.

Abstract

The theory of legislation in the formation and change of law in Indonesia has a very important position. This is because the theory of legislation can provide structure and direction for the development of effective law and in accordance with the needs of society. In Indonesia, the theory of legislation aims to create a legal system that is in accordance with the principles of the rule of law and Pancasila. The purpose of this study is to analyze in more depth the Influence of the Theory of Legislation on the Dynamics of Legal Norms in the Indonesian Legal System. The approach method in this study is to use a normative juridical approach, namely a legal research method that examines library materials or secondary data. The identification of problems in this study is the Influence of the Theory of Legislation on the Quality of Implementation of Legal Norms in Indonesia, Factors that Influence the Application of the Theory of Legislation in the Practice of Legal Formation in Indonesia, and the Impact of the Application of the Theory of Legislation on the Stability of Legal Norms in the Legal System in Indonesia. The application of the theory of legislation in Indonesia aims to create systematic, fair, and effective regulations by involving community participation. Therefore, comprehensive reform of the legal system and transparent and professional law enforcement are essential to improve the quality of legal norms and strengthen public trust in the justice system.

Abstract

The 1945 Constitution of the Republic of Indonesia, which contains legal norms that form the basis for operational foundations to realize the goals and ideals of the Indonesian rule of law, regulates the formation of the basis or principles for organizing the state. However, in practice, political compromise tends to be the main focus in pouring legal norms in the Constitution into laws. This is considered to have the potential to cause problems due to misunderstandings about the Indonesian justice system. This study uses a normative legal research method using legal materials as data sources. The research findings show that the formation of laws involves a multi-step process that includes phases such as preparation, drafting, discussion, ratification, and implementation. The process of forming laws that represent the goals of society while complying with relevant legal requirements can be understood and analyzed using the conceptual framework offered by the theory of legislation.

Abstract

The general election (Pemilu) is a process by which people elect individuals to political positions at various levels in Indonesia. Elections are conducted to elect leaders such as presidents or executive officials, representatives of the people in the legislature, and village heads. A quality election will certainly give birth to quality leaders as well. The Village Head as a leader at the village level will represent the quality of a village. Thus, the function of the Village Head towards village development is to think, plan, and implement. One of the efforts made by the Cianjur Regency Government to improve the quality of the implementation of the simultaneous village elections is by creating an E-Administration system to be used in the registration process for candidates for village heads. The purpose of creating this E-Administration system is to facilitate the organizers and prospective village head candidates in the implementation of registration The implementation method in this service activity goes through several preparatory stages, namely First, increasing commitment. Second, development and harmonization of the e-administration system prototype. Third, supervision of the legalization process. And fourth, mentoring/technology transfer of the e-administration system. The results of this research are the formation of an E-Administration system designed by the IT Team of the Faculty of Engineering, Suryakancana University, which is adaptive to existing systems in stakeholders or institutions.

Abstract

The Village Head Election (PILKADES) is a crucial process in Indonesia's democracy, where the village head plays a central role in governance and community service. To enhance the quality of the upcoming simultaneous Pilkades in Cianjur Regency in 2025-2026, the E-Administration system is being implemented. This system aims to streamline the registration of village head candidates, improving accountability, transparency, and efficiency, while reducing the potential for data manipulation. The research aims to evaluate the E-Administration system’s implementation and assess its impact on transparency, efficiency, and accountability in the Pilkades process. Additionally, it seeks to provide a model that other regions can adopt in their Pilkades. The research method includes several strategic stages: a Focus Group Discussion (FGD) to align stakeholder understanding, mentoring in the implementation of the system, and continuous evaluation. The results show a significant improvement in the efficiency of candidate registration, with faster verification and fewer data errors. The system has also increased transparency and accountability, with real-time access to data for authorities and the public. The reduction in data manipulation, through digital verification of documents, highlights the potential for the E-Administration system to be a model for other regions to enhance Pilkades quality.

Abstract

This research aims to analyse the situation and frequency of personal data breach cases in Indonesia, identify the factors causing them, and evaluate the preventive efforts that have been made in the context of the Personal Data Protection Law. This research uses a mixed methods approach that combines quantitative and qualitative methods. Quantitative data was obtained through an online survey of Indonesians to measure the level of awareness and experience related to personal data breaches. Meanwhile, qualitative data was obtained through a literature study and in-depth interviews with experts in cybersecurity and law. The results show that cases of personal data breaches in Indonesia are increasing, with the main contributing factors including weak public awareness, lack of data protection by companies, and suboptimal law enforcement. Preventive efforts that need to be improved include socialisation of the Personal Data Protection Law, improving information system security, and cross-sector cooperation. This research provides recommendations for more effective policies to prevent and address cases of personal data breaches in the future.

Abstract

There are several concepts to overcome waste problems through recycling, namely open dumping, zero waste, and circular economy. For zero waste or no waste is a philosophy that encourages the redesign of the resource cycle, from a linear system to a closed cycle, where the author uses a normative juridical law research method that is prescriptive, namely practical or applied and aims to solve problems. The research approach used by the author includes a statute approach, and a conceptual approach that uses primary legal materials, secondary legal materials to solve the subject matter related to the law that regulates the problem of recyclable waste.

Abstract

Penelitian ini bertujuan untuk mengkaji secara komparatif penerapan pidana mati terhadap pelaku pembunuhan sebagaimana diatur dalam Kitab Kutaramanawadharmasastra Kerajaan Majapahit dan Kitab Undang-Undang Hukum Pidana Indonesia. Melalui pendekatan historis dan yuridis, penelitian ini menganalisis dasar filosofis, kriteria penjatuhan pidana, serta pertimbangan-pertimbangan yang mendasari penerapan pidana mati di kedua sistem hukum tersebut. Hasil penelitian diharapkan dapat memberikan kontribusi terhadap pemahaman yang lebih mendalam mengenai perubahan hukum pidana di indonesia, serta menjadi bahan pertimbangan dalam perbaikan terhadap sistem peradilan pidana yang berlaku saat ini. Untuk menjawab penelitian tersebut, penelitian hanya memfokuskan kepada aspek penjatuhan hukum pidananya saja melalui penelitian hukum normatif yang didukung oleh penelitian berdasarkan pengalaman dengan pendekatan sejarah (historical approach) dan pendekatan undang-undang (statute approach).
