Abstract

Praktik santet dalam masyarakat Indonesia sering dianggap sebagai tindakan yang dapat membahayakan seseorang secara fisik dan mental. Meskipun sulit dibuktikan secara ilmiah, dampak santet, seperti gangguan kesehatan yang tidak dapat dijelaskan secara medis, tetap menimbulkan rasa takut dan cemas di masyarakat. Dalam konteks hukum, Kitab Dharmasastra Kutaramanawa yang digunakan pada masa Kerajaan Majapahit mengatur praktik ini dengan memberikan hukuman mati bagi pelaku santet yang membahayakan nyawa. Di zaman modern, sistem hukum Indonesia, melalui Kitab Undang-Undang Hukum Pidana dan Undang-Undang Nomor 1 Tahun 2023, telah memberikan perhatian terhadap praktik serupa, meskipun dengan tantangan besar dalam hal pembuktian. Meskipun tidak secara langsung mengatur santet, hukuman mati dalam Kitab Undang-Undang Hukum Pidana dapat diterapkan pada kasus-kasus yang terkait dengan praktik yang membahayakan nyawa. Berkaitan dengan tujuan pidana hukum modern, yang dalam mazhab ini mengandung aspek ilmiah, tidak hanya bersifat normatif, dan terkait dengan asas-asas yang tertuang dalam rumusan Pancasila, maka hukuman mati perlu ditarik garis “kemanfaatan” bagi kepentingan umum dan masyarakat terlebih dahulu. dan baru kemudian untuk kepentingan individu, dalam penyusunan kedua pola kepentingan itu tidak mudah jika kedua kepentingan itu bersama-sama membutuhkan jaminan pada saat yang sama. Jika sesuai dengan keadaan konkret peristiwa itu dan menurut kepentingannya akan lebih menguntungkan bagi kepentingan individu daripada kepentingan umum atau masyarakat untuk tidak memilih hukuman mati, maka dapat menghentikan untuk menghentikan jenis kejahatan lainnya.

Abstract

The existence of legal principles in the formation of legislation plays a crucial role in modern legal systems. This article examines the challenges and adaptations faced in maintaining the relevance of legal principles amidst rapid changes in society, using a qualitative normative juridical research method. This method focuses on legal norms found in legislation and norms that are living and evolving within society. The aim is to understand how the existence of legal principles has evolved in the context of rapid societal changes, reaching the present era, and how the legislative process reflects adaptation to these changes, as well as to explore examples of legislation that successfully integrate legal principles with the needs of modern society. The findings of this study show that the existence of legal principles relies not only on their ability to uphold timeless fundamental principles but also on their capacity to transform according to the context of the times. By understanding the challenges and opportunities present, legal principles can remain relevant in addressing societal needs and global developments.

Abstract

This research aims to analyse the compatibility between the theory of legislation formation and the practice of legislation in the modern era, especially in relation to the implementation of public aspirations. In the context of a democratic legal state like Indonesia, public participation in the legislative process is not only a constitutional right, but an essential element to ensure the legitimacy and quality of legal products. This research uses a normative juridical approach combined with an empirical juridical approach. Data was obtained through a literature study of legislation and legal literature which was analysed qualitatively. The results show that public participation in the legislative process, as guaranteed in Article 96 of Law No. 12/2011, still faces various challenges, such as the lack of transparency and the dominance of political interests. Modern legislative practices such as the Omnibus Law show the potential for efficiency, but risk creating social justice imbalances if not accompanied by meaningful community involvement. The principles of social justice mandated by Pancasila and the 1945 Constitution must be the foundation in every stage of legislation to ensure inclusive and responsive laws. In conclusion, harmonisation between the theory and practice of law formation is needed so that the law is not only a tool of control, but also a means of empowerment and protection of community rights. Regulatory reform requires broad social dialogue, in-depth legal studies, and open public control mechanisms to strengthen substantive democracy.

Abstract

This research discusses the regulation of the crime of theft in Kutaramanawadharmasastra-a traditional Hindu law book that has a great influence on the legal system of the Majapahit Kingdom-in the perspective of the purpose of punishment. The focus of the study is directed at normative and philosophical analyses of the forms of sanctions imposed, as well as their relevance to the modern punishment system in Indonesia. The main objective of this research is to explore the values of substantive justice and local wisdom contained in the Kutaramanawadharmasastra, as well as to consider its potential as a reference in national criminal law reform. The method used is normative juridical approach with the support of secondary data through literature study, as well as empirical juridical approach to examine the context of law application in the past. The results showed that the book contains principles of punishment that are not only repressive but also restorative, such as restitution and social recovery. Although there are caste-based discriminatory aspects in the sanction system, some elements such as the obligation to compensate, restoration of social relations, and protection of property rights remain relevant and can be selectively adopted in today's restorative justice framework. This research confirms the importance of reflecting traditional legal values to enrich Indonesia's pluralistic legal system, as well as part of the effort to build a more humanistic, contextualised and nationalised punishment system.

Abstract

Indonesia merupakan negara dengan populasi terbesar di dunia pada tahun 2023, yaitu sebanyak 280, 73 juta jiwa, Jumlah penduduk Indonesia terus meningkat, namun lapangan pekerjaan terbatas menyebabkan pengangguran meningkat. Undang-Undang Dasar Negara Republik Indonesia menjamin hak atas pekerjaan yang layak, namun sulitnya mencari pekerjaan di Indonesia melanggar hak asasi manusia. Keterbatasan lapangan pekerjaan memaksa warga Indonesia mencari pekerjaan di luar negeri yang menawarkan gaji dan fasilitas lebih baik. Jumlah pekerja migran Indonesia di luar negeri terus meningkat. Perlindungan hukum bagi pekerja migran telah diatur oleh Undang-Undang dan Serikat Buruh Migran Indonesia berperan dalam melindungi hak-hak mereka. Pekerja migran sering menghadapi masalah seperti keterbatasan hak, kondisi kerja yang tidak aman, dan diskriminasi. Perlindungan hukum dan dukungan dari serikat buruh penting bagi pekerja migran Indonesia. Diharapkan dengan kehadiran Serikat Buruh Migran Indonesia, perlindungan dan keadilan bagi mereka dapat terwujud.

Abstract

This study aims to analyse the extent to which globalisation has influenced the formation of legislative theory in Indonesia, as well as to examine Indonesia's efforts to maintain a balance between openness to international legal norms and the preservation of national legal characteristics. Globalisation has brought about significant changes in Indonesia's legal system, ranging from the increased adoption of international legal principles to transparency in the legislative process. This study uses a descriptive-analytical method with a normative legal approach and is supported by an empirical legal approach. Data was obtained through a literature review covering legislation, legal literature, and empirical facts related to legislative practices in a global context. The results of the study show that globalisation has encouraged a shift in legislative theory from a normative and centralised approach to a more participatory, adaptive, and democratic approach. Global influences are also reflected in the transformation of legal values that are more open to the principles of social justice, public participation, and the protection of human rights. On the other hand, Indonesia continues to show its commitment to maintaining its legal identity by incorporating the values of Pancasila, customs, and local wisdom into the legislative process. Therefore, legislative theory in Indonesia has developed as a result of dialogue between local values and global demands. This finding underscores the importance of harmonising national law in a way that not only follows global trends but also strengthens the sovereignty and identity of the nation's legal system.

Abstract

This study explains the relationship between law, legal science, and regulations in building a national legal system that is effective, fair, and responsive to societal needs. As a state based on the rule of law, Indonesia utilizes law as the basis for regulating all aspects of national and state life. Legal science plays a crucial role as a guide in the law-making process, from planning, drafting, deliberation, ratification, and evaluation. This study uses a normative juridical approach by studying various legal theories, such as the Stufenbau des Recht (The Law of Law) by Hans Kelsen and Hans Nawiasky, the theory of law as a tool for community development by Roscoe Pound, and the principles contained in Law Number 13 of 2022 concerning the Formation of Legislation. The results show that legal quality is highly dependent on the application of legal science principles, such as clarity of purpose, transparency, and public participation. However, challenges remain, such as poor coordination between institutions, low-quality academic papers, and minimal public participation in the legislative process. Therefore, the consistent application of legal science is essential to produce legal products that are consistent, non-contradictory, and capable of guaranteeing justice and legal certainty. In conclusion, collaboration between law, legal science, and legislation is key to creating a democratic national legal system based on Pancasila and the 1945 Constitution.

Abstract

Child abduction not only violates human rights but also threatens the future of children who will become the next generation of a nation. In Indonesian law, the protection of children who are victims of abduction is regulated under various laws, including Law Number 35 of 2014, which is an amendment to Law Number 23 of 2002 concerning Child Protection. A child is a legal subject with special characteristics, whose rights are protected and regulated by specific laws and regulations. Indonesia is a rule of law country as stated in Article 1, Paragraph (3) of the 1945 Constitution of the Republic of Indonesia. The Indonesian Constitution, UUD 1945, as the highest legal norm, stipulates that “Every child has the right to survival, growth, and development, and has the right to protection from violence and discrimination.”
