Abstract

A guardian is a person or entity that in fact exercises parental power over a child. Along with the implementation of Government Regulation Number 29 of 2019 concerning Terms and Procedures for Appointment of Child Guardianship in Review of Islamic Law (Case Study In Gunung Tuleh District, West Pasaman Regency). The purpose of this research is how to implement Government Regulation Number 29 of 2019 concerning Terms and Procedures for Appointing Child Guardianship in Gunung Tuleh District, Pasaman Barat Regency, how is the view of Islamic Law regarding the Implementation of Government Regulation Number 29 of 2019 concerning Terms and Procedures for Appointing Child Guardianship in the Subdistrict Mount Tuleh, West Pasaman Regency. This type of research used in this research is field research, namely collecting data from jorong, pious ulama, notes, adoptive parents who have conducted child research in Gunung Tuleh District, West Pasaman Regency. Data collection techniques used are observation, interviews, and documentation. The results of this study indicate that the reason for the guardianship of the child by the adoptive parents is because they do not have children, the biological parents have a poor economy and have compassion for the biological parents. The implementation of child guardianship is only limited to a letter of agreement, it is not recorded at the population service and there is no stipulation. Then in terms of population administration, especially birth certificates and family cards (KK) for all respondents, the adopted children are named after their adoptive parents. And change the status of the child to become a biological child. So the implementation of child guardianship in Islamic law is not in accordance with Islamic law. And from this it can be seen that from the implementation of child guardianship, not from the appointment of a guardian based on the request or will of the parents. And change the status of adopted children to biological children.

Abstract

This paper describes the protection of workers according to Islamic law by analyzing several verses of the Qur'an and the Hadith of the Prophet. There are many verses of the Koran that generally command good to others, as in Surah Al-Qashash verse 77, one form of good deeds is to provide protection to workers as an important component in providing benefits to the company. The Prophet's hadith also came to clarify the importance of good behavior by providing protection to workers. He strictly forbids giving physical punishment to workers, giving heavy work that cannot be done by work, and other physicalist pressures. Instead he cited good behavior towards workers as he treated his servants well

Abstract

Hoax is one form of al-qazf which can be subjected to hudud punishment for the perpetrator that is 80 times volumes. Determination of hoax penalty with punishment jilid based qiyas khafi in terms of scholars Syafi'iyah, or istihsan in terms of scholars Hanafiyah. The illat that causes the analogy is the spread of false news that can harm others. Al-qazf contains false news about allegations of adultery to others, while hoaxes are also lying messages addressed by certain individuals who can harm others

Abstract

From the description above shows that the pattern istinbath Shahrur highest law in determining the law is rationally based on the benefit of objective conditions of social changes that occur in society. Therefore Shahrur assume that the Koran is just qath'i in wurudnya but overall dhalalah is zhanniyah. Qur'an according to him  be interpreted in accordance with the change of the times and the realities of social events. Sunnah also positioned as a pilot ijtihad against the Koran

Abstract

This study examines Leklean gambling in Pudun Jae Village in Review according to Islamic Criminal Law. The type of this research is qualitative or field research and the primary data source is data or information obtained directly through interviews with the people of Pudun Jae Village who carry out Leklean activities including statements from various parties, namely, Village Heads, Traditional Leaders, Ulama, Community, Card Player and Host. The secondary data sources are books, journals and documents that are considered related to this paper, while the data collection techniques are by means of observation, interviews and documentation and then the data analysis technique is qualitative descriptive. The results of this study explain that the implementation of Leklean is a community activity that is present on the night before the celebration event is carried out with many various activities such as preparing for tomorrow's needs, telling stories, keeping the location and playing cards. The factor that makes Leklean activities still exist today is that Leklean activities are very helpful to people who are doing events because if there is a Leklean then the location of the event will be safe from thieves and people who want to interfere with the event. The review of Islamic Criminal Law regarding Leklean is to explain that in Leklean Activities at the Sukur event, there is a card game that uses money as a bet so that the game feels enthusiastic. There are elements of gambling, elements of gambling in Islamic Criminal Law, namely the existence of games and bets, which causes a party to win and a party to lose. Islam forbids its people to seek and collect wealth in a vanity way such as gambling. Because the harm that exists in playing gambling is greater than the benefits.

Abstract

Penelitian ini bertujuan mendeskripsikan (1) Pemenuhan kewajiban terhadap Hak-Hak Pendidikan Anak Pasca Perceraian (2) kepatuhan kewajiban terhadap hak-hak anak pasca perceraian. Penelitian ini menggunakan pendekatan kualitatif bersifat deskriptif. Subjek penelitian ini yaitu pelaku perceraian, anak dari orangtua yang bercerai, tokoh agama dan tokoh masayarakat di Kota Padangsidimpuan Batunadua. Teknik pengumpulan data dalam penelitian ini yaitu wawancara, observasi dan dokumentasi. Hasil penelitian menunjukkan bahwa (1) Pemenuhan kewajiban terhadap hak-hak anak pasca perceraian yaitu dalamn hal pemeliharaan terhadap anak dan pemberian nafkah. Orangtua adalah yang pertama-tama bertanggung jawab atas kesejahteraan anak, kewajiban memelihara dan mendidik anak sedemikian rupa, sehingga anak dapat tumbuh berkembang menjadi orang yang cerdas, sehat, berbakti kepada orangtua, berbudi pekerti luhur, bertaqwa kepada Allah Swt., dan berkemauan serta berkemampuan meneruskan cita-cita bangsa berdasarkan pancasila. Orangtua yang terbukti melalaikan tanggung jawabnya, dapat dicabut kuasa asuhnya dengan putusan Hakim. Pemberian nafkah merupakan kewajiban orangtua terhadap anaknya berupa pakaian, tempat tinggal maupun kebutuhan lainnya. (2) Kepatuhan terhadap pemenuhan hak-hak anak pasca perceraian di Kota Padangsidimpuan Batunadua yaitu hak anak dapat dikategorikan pada empat kelompok yaitu hak untuk hidup, hak untuk tumbuh kembang, hak untuk mendapat perlindungan, dan hak untuk berpartisipasi.

Abstract

This paper describes the verses of the Qur'an relating to Ahl al-Kitab to see the contents of the verses with the interpretation approach. Broadly speaking, the verses of ahl al-kitab are related to the prohibition on choosing ahl al-kitab as the leader, relating to their attitude of dishonesty towards Muslims if they do not convert to their religion, and the mu'amalah relationship between Muslims and ahl al-kitab . The study of these verses shows that these verses do not give a negative tendency towards them but there are things that according to Allah Almighty must be more careful in giving attitude to them, such as the prohibition of choosing non-Muslims as leaders, does not mean the Ummah Islam is allowed to hate them, but they must be respected as creatures of Allah. The prohibition on choosing non-Muslims as leaders is only the political rights of the people which Allah SWT legalizes through his word. Some other verses show the permission to bermu'amalah with them. Therefore these verses describe the relationship of mutual respect for fellow believers. Interpretation between these verses laid the foundation of tasamuh (tolerance) between Muslims and scribes not leading to a radical understanding.

Abstract

The verses of the Qur'an and the Hadith of the Prophet are the main guidelines for determining the direction of Qibla in performing prayers, the times for praying five times a day and night, and determining the beginning of the month of Ramadan, the beginning of Sawal, and Eid al-Adha. Under certain conditions the Qibla direction, prayer times and the start of Ramadan and Sawal, can be determined easily manually. However, in conditions that are far apart and the natural conditions are not always sunny, the determination of the times of worship cannot be done manually. In this condition, the verses of the Qur'an and the hadith of the Prophet SAW cannot be used as independent benchmarks to determine the times of worship above, but he needs modern science to help make it easier to determine the times of worship. This conditions encourages the emergence of falakiyah scientists who combine science and syara' in determining the Qibla direction, prayer times, and determining the beginning of Ramadan and Shawwal.

Abstract

Tujuan penelitian ini adalah untuk mengetahui pelaksanaan bimbingan perkawinan di Kecamatan Angkola Timur Kabupaten Tapanuli Selatan. Untuk mengetahu implementasi bimbingan perkawinan terhadap keharmonisan rumah tangga di Kecamatan Angkola Timur Kabupaten Tapanuli Selatan. Adapun penelitian ini menggunakan pendekatan kualitatif dengan metode deskriptif. Hasil penelitian menunjukkan bahwa bimbingan perkawinan terhadap masyarakat di Kecamatan Angkola Timur Kabupaten Tapanuli Selatan dimana peserta bimbingan perkawinan di Kecamatan Angkola Timur Kabupaten Tapanuli Selatan adalah mereka yang sudah mendaftar di Kantor Urusan Agama (KUA) tetapi belum melangsungkan perkawinan. Metode yang penyampaian materi dengan ceramah dan Tanya jawab, fasilitator bimbingan perkawinan yang bersertifikat ada empat orang terdiri dari tiga orang dari Kementerian Agama Kabupaten Tapanuli Selatan dan satu orang dari Dinas Kesehatan Kabupaten Tapanuli Selatan. Pelaksanaan bimwin selama dua hari yaitu 16 JPL (Jam Pelajaran). 2) Implementasi bimbingan perkawinan terhadap nasyarakat di Kecamatan Angkola Timur Kabupaten Tapanuli Selatan adalah Setelah mengikuti bimbingan perkawinan, kepercayaan diri masing-masing calon pengantin meningkat, tidak sering bertengkar, memperlakukan pasangan dengan baik, tercukupinya kebutuhan keluarga, bersikap santun terhadap sesama anggota keluarga,terlibat aktif dalam masyarakat, rumah tangga terjaga dari pengaruh buruk, rumah tangga yang Islami.

Abstract

Tattooing is a part of art that many people do. However, Islamic law prohibits people with tattoos, on the other hand, medical science also prohibits people with tattoos from donating blood. This article tries to explain whether there is a match (relevance) between the prohibition of tattooing according to Islamic law and the prohibition of blood donation for people with tattoos according to medical science. To answer this question, the author collects data from various sources of scientific writings in the form of books or journals that describe the prohibition of tattooing according to Islamic law and also scientific writings related to the prohibition of blood donation for people with tattoos according to health. This disclosure is important to explore to uncover the maqasid al-syari' in prohibiting the act of tattooing according to Islamic law. The results obtained from the scientific data above show that the Prophet Muhammad forbade his people from getting tattoos. This prohibition is stated in several hadiths of the Prophet Muhammad with a clear prohibition expression, namely using the phrase "la'ana" (Allah/Rasulullah curses). The use of this phrase for a legal act, namely getting a tattoo, shows that the act is forbidden. Medical also prohibits blood donation for people with tattoos, this is because the behavior of sticking needles and alcohol into the pores of the body is an act of damaging body parts. The reason for the medical prohibition for people with tattoos to donate blood is also the concern of contracting various diseases in the blood cells of people with tattoos caused by the needle being inserted into the blood vessels through the skin, and the entry of other substances into the blood cells. The prohibition of tattoos by the Prophet Muhammad SAW turns out to be in accordance with medical science which prohibits people with tattoos from donating blood. This conformity can be seen in the principles of Islamic law which forbids harmful acts, and medical also positions the act of tattooing as having harm.
