Abstract

This study discusses legal protection and deterrent effects on perpetrators of bullying in Indonesia, with a primary focus on bullying committed by children in the school environment. Bullying is a form of physical or psychological violence that can have significant negative impacts on perpetrators and victims. In a legal context, bullying is considered an unlawful act that requires serious attention. This study uses a normative juridical method with a descriptive approach to analyze related laws and regulations, especially the Child Protection Law (Law No. 35 of 2014) and the Juvenile Criminal Justice System (Law No. 11 of 2012). The results of the study indicate that there are various forms of legal protection for child perpetrators, such as the right to diversion to avoid formal trials, as well as other basic rights in accordance with the principles of restorative justice. The deterrent effect on perpetrators can be achieved through the application of criminal sanctions and proportional actions, such as imprisonment as regulated in Article 80 of Law No. 35 of 2014. In addition, diversion as an out-of-court settlement approach is considered effective in reducing the negative impact of the judicial process on children, while encouraging recovery for victims. This study concludes that legal protection and the implementation of diversion for perpetrators of bullying are important steps in creating a just, rehabilitative, and preventive legal system. The recommendations of this study include increasing consistent legal implementation and socialization to the community to reduce the number of bullying among children.

Abstract

This study was conducted with the aim of determining the legal aspects of customary rights of indigenous peoples in the considerations of judges who decide on customary rights lawsuits in the Supreme Court decision number: 1900/K/Pdt/2024. This study uses normative juridical with a descriptive approach that aims to analyze carefully to solve problems in accordance with the applicable legal framework. In this study, the data sources used are secondary data in the form of Supreme Court case decisions number: 1900/K/Pdt/2024, laws and regulations and literature related to the research problems. Based on the results of the Supreme Court decision Number 1900/K/PDT/2024, it confirms the recognition of the customary rights of Papuan indigenous peoples as a form of collective ownership that is inherited from generation to generation. In this case, the customary land belonging to the Mandacan family is declared to remain theirs because it was never released through a legal mechanism according to customary law. However, land acquisition by other parties, including the issuance of Building Use Rights (HGB) certificates by the National Land Agency (BPN), was carried out without the consent or legal compensation to the customary owners. This action is considered an unlawful act because it does not respect the rights of indigenous peoples guaranteed by Article 18B of the 1945 Constitution. This decision also highlights the important role of state institutions, such as the BPN, in ensuring that land administration processes are carried out with respect for customary law and the rights of indigenous peoples.

Abstract

Terrorism is an extraordinary crime that requires extraordinary measures. Terrorism has become a global phenomenon that has spread to almost every country in the world, including Indonesia. As in other regions, terrorism in Indonesia also has a theological and ideological basis and networks that make it strong resistance. To date, the crime of terrorism is one of the serious threats to national security. Terrorism is a theme that attracts the attention of many groups, especially academics, to study it from various aspects. Acts of terrorism often occur in Indonesia. The incident that occurred domestically, which made the image of Indonesia as a country that is unsafe for foreign citizens was the case of the Bali Bombing. Indonesian society generally condemned the act. The crime of terrorism resulted in the death of many victims, is very contrary to the Qur'an and Law Number 5 of 2018, so that the perpetrators must be subject to criminal sanctions or punishment as a result of their actions, namely the death penalty. This study uses a normative juridical approach method, with analytical descriptive research specifications. The data used in this study are secondary data obtained through literature studies, then analyzed qualitatively using law enforcement theory and Islamic justice theory. The results of this study are that the Government has made a new law in an effort to prevent acts of terrorism, namely Law Number 5 of 2018 concerning Amendments to Law Number 15 of 2003 concerning the Determination of Government Regulations in Lieu of Law Number 1 of 2002 concerning the Eradication of Criminal Acts of Terrorism into Law. Article 6 explains that: "Any person who intentionally uses violence or threats of violence that create an atmosphere of terror or fear in people on a widespread basis, causes mass casualties by depriving others of their freedom or loss of life and property, or causes damage or destruction to strategic vital objects, the environment or public facilities or international facilities shall be punished with imprisonment of at least 5 (five) years and a maximum of 20 (twenty) years, life imprisonment, or the death penalty."

Abstract

The correctional system aims to restore prisoners, especially women prisoners, as good citizens, and also aims to protect the community against the possibility of criminal acts by prisoners, especially women prisoners. As well as an application and an integral part of the values contained in Pancasila. From some of the possibilities that occur, the government changed the role to the Correctional Institution, meaning that the convicts are placed together and the placement process and activities according to the schedule since the convict entered the institution, in addition to the length of serving the sentence. Although this institution is not directly related to law enforcement, it plays a major role in creating public order in legal life. This research is focused on literature studies or document studies because this research is mostly carried out on secondary data and Primary Data as a trap, the data to be obtained in this study were collected by means of library research (Library Research) The library material referred to consists of primary legal materials, namely related legislation in accordance with the Criminal Code. The research specification used is descriptive analysis, namely describing the results of research with data that is also complete and as detailed as possible. Description is intended for primary, secondary and tertiary data related to legal certainty about the rights of women prisoners in Lubuk Pakam correctional institutions legislation and theories that have been relevant. The presence of Class IIB Lubuk Pakam Correctional Facility is expected to be able to provide good and appropriate guidance to prisoners and provide information to the public about the implementation of inmate guidance in detention centres through mass media and newspapers or other means in accordance with the intention of changing the public's view of prisoners, that prisoners can return to society without discrimination. The implementation of women prisoners' development in Lubuk Pakam Penitentiary contains several procedures starting from the reception of prisoners, registration to the next stage of the implementation of prisoners' development. In the implementation stage itself consists of stages, namely the initial stage of teaching prisoners to have religious and legal awareness, the advanced stage which gives direction to prisoners to always display their talents and skills so that when in the Penitentiary, prisoners have positive activities to do.

Abstract

The Correctional System has been able to change the prison system for the better by treating prisoners as subjects. This is where the human factor is more emphasised and prisoners are also increasingly valued. The hope is that after the prisoner leaves the correctional institution, the prisoner will not repeat the criminal act again or the prisoner has had a deterrent effect on the prisoner. The research used in this journal is normative legal research. Normative legal research is research that examines the laws and regulations that apply to a legal problem. Normative research with the object of study of legislative documents by studying and by examining library legal materials or can be called a study of legal science. Prisoners are people who are undergoing a period of punishment or punishment in the penitentiary, but however the prisoner is also a human being, so the human rights of prisoners must also be protected. Related to the provision of the rights of prisoners in the Provision of services to the rights of prisoners that have been in the Class II B Tanjung Pura Detention Centre including the revocation of conditional release, granting permission to leave the city, requests for medical recommendations given to prisoners, transfer at the request of their own legal counsel in the region or between regions, delegation of correctional client guidance, social rehabilitation for drug users, referral for further treatment outside the prison, legal consultation in the field of correctional services, legal aid facilities, conditional leave for general crimes and the assimilation of general crimes.

Abstract

Talking about victims of crime in general, of course, victims are individuals. In a criminal act, the victim is the party who is harmed by the perpetrator of the crime, both materially and immaterially. This greatly affects the psychological condition of the victim, not to mention the complicated judicial process that makes the victim a very disadvantaged party to the laws and regulations under it. The position of victims in the practice of criminal procedure law is relatively less considered because the provisions of Indonesian law still rely on protection for the perpetrator (offender oriented). Normative legal research is in the form of library research and written documents as data sourced from secondary data including primary legal materials, secondary legal materials and tertiary legal materials. The nature of this research is descriptive analysis. The data obtained in this research will be analyzed qualitatively in accordance with the specifications of the nature of the research to examine between theory and practice in legal protection of victims of criminal acts. To solve the existing problems and then draw a conclusion by utilizing the data collected through interviews and document studies, the results of this study were first analyzed using qualitative analysis. The Criminal Code (KUHP) has implicitly provided protection for victims of crime with all efforts to fulfill rights and provide assistance to provide security to victims who must be implemented by the Witness and Victim Protection Agency (LPSK) or other institutions in accordance with the provisions. As it is known that the KUHAP is not too optimal because there are more victims like the position of the perpetrator which results in a legal vacuum, and in the context of protecting victims of crime, there are preventive and repressive efforts made, both by the community and the government (through law enforcement officials). Another thing that is noted that in the Law on Witness and Victim Protection is the absence of coercive efforts regarding compensation from the perpetrator to the victim, namely not regulating the payment of compensation from the perpetrator to the witness or victim, even though the victim as a witness who is harmed by someone's unlawful actions, but is not protected.

Abstract

This study aims to analyze the Effect of Institutional Ownership, Profitability, Sales Growth, and Leverage Against Tax Avoidance In Construction Subsector Companies listed on the Indonesia Stock Exchange in 2017 –2019, this research consists of 16 Construction Subsector companies listed on the Stock Exchange Indonesian Effect. by using the type of associative research analysis with data design the panel is a combination of time series data and cross-sectional data. The type of data used is panel data (pooled data), Regression analysis panel data with Fixed Effect Model (FEM) estimation method and reviews 10 SV programs. Hypothesis testing carried out is the Coefficient of Determination Test (R Square), F Test, and t-test. The results of the study show that the institutional ownership variable affects negative and positive effects on tax avoidance, Profitability Variable positive effect, and positive effect on tax avoidance. Variable Sales growth has a positive and positive effect on tax evasion. Leverage has a negative and positive effect on tax evasion.

Abstract

Penelitian ini bertujuan untuk mengeksplorasi peran mediasi dan kesepakatan bersama dalam menyelesaikan hak asuh anak tanpa konflik antara kedua orang tua yang bercerai. Melalui pendekatan kualitatif dengan wawancara mendalam, data dianalisis untuk memahami bagaimana mediasi dapat memfasilitasi penyelesaian yang efektif dan berkelanjutan dalam konteks hak asuh anak pasca perceraian. Hasil penelitian menunjukkan bahwa mediasi memainkan peran krusial dalam menciptakan ruang yang aman dan terbuka bagi kedua orang tua untuk berbicara dan mencari solusi yang adil. Mediator yang netral membantu mengelola emosi dan konflik yang muncul, serta memfasilitasi diskusi yang konstruktif untuk mencapai kesepakatan yang memadai untuk semua pihak, dengan memprioritaskan kepentingan terbaik anak-anak. Kendala dalam pelaksanaan hak asuh anak setelah perceraian, seperti kurangnya rasa tanggung jawab, kondisi mental yang tidak siap menghadapi perceraian, dan kurangnya pengetahuan agama dari salah satu pihak, dapat diatasi melalui pendekatan yang holistik. Solusi yang diusulkan, termasuk memberikan pemahaman tentang tanggung jawab sebagai orang tua, dukungan mental, dan pembinaan agama, membantu meningkatkan efektivitas mediasi dan penyelesaian hak asuh anak. Penelitian ini menyoroti pentingnya mediasi dan kesepakatan bersama sebagai alternatif penyelesaian konflik yang dapat menghasilkan solusi yang adil dan berkelanjutan bagi kedua belah pihak. Implikasi praktis penelitian ini adalah peningkatan akses dan penggunaan mediasi dalam menyelesaikan sengketa hak asuh anak pasca perceraian, serta pelibatan lebih banyak tokoh agama dan konselor dalam mendukung proses ini.

Abstract

Riset ini berfokus pada analisa yuridis kepada pelaksanaan pengujian teratur kendaraan bermotor yang dicoba oleh Dinas Perhubungan Kabupaten Asahan. Pengujian teratur kendaraan bermotor ialah salah satu usaha yang diharuskan oleh penguasa buat membenarkan kendaraan penuhi standar keamanan, kesehatan lingkungan, serta keamanan di jalan raya. Dalam riset ini, pengarang meninjau penerapan pengujian berkala itu bersumber pada Peraturan Menteri Perhubungan Nomor 19 Tahun 2021 mengenai Pengujian Teratur Kendaraan Bermotor. Riset ini bermaksud buat mengenali serta menganalisa kesesuaian penerapan pengujian teratur di Kabupaten Asahan dengan peraturan yang sudah diresmikan, tercantum hambatan- hambatan yang dialami dalam implementasinya. Informasi yang dipakai mencakup informasi pokok berbentuk wawancara dengan pihak terkait dan informasi inferior dari dokumen peraturan serta kesusastraan hukum. Hasil riset ini diharapkan membagikan cerminan hal daya guna pengujian teratur di Kabupaten Asahan dan membagikan saran perbaikan supaya cocok dengan determinasi perundang- undangan yang berlaku. Penemuan ini bisa jadi referensi untuk biro terpaut buat tingkatkan mutu pelayanan pengujian teratur untuk tercapainya keamanan serta keselamatan transportasi di wilayah itu.

Abstract

Optimization of the justification for the establishment of prisoner guidance so far, is based on policies that maintain the types of criminal penalties as regulated in Article 10 of the Criminal Code. Prisoner guidance is one type of sanction in criminal law that is often used as a means to overcome crime problems. The use of prisoner guidance as a means to punish perpetrators of criminal acts began in the late 18th century which was based on the ideology of individualism and the humanitarian movement. Prisoner guidance increasingly plays an important role and shifts the position of the death penalty and corporal punishment which are considered cruel.In general, the image of prison is a very scary place, not getting good food, sleeping on the floor and being bitten by mosquitoes, there is torture and it is very uncomfortable, it is difficult to communicate with the outside world and family, there is no entertainment and suffering and limited in everything. Teguh Prasetyo, explained that prison gives an image to the general public, as a place where criminals are deprived of their freedom and tortured and employed or trained so that they can form good behavior and character after leaving prison. Therefore, the image was changed to prisoner development. The image of prison that gives a scary image to the general public, aims to provide a deterrent element for criminals, so that they become aware and change their evil attitudes and behavior. Based on the background above, the following problem formulation is determined: How to Optimize the Implementation of Prisoner Development in Changing Behavior Towards Inmates?. This research is an empirical legal research, which examines the optimization of the implementation of prisoner guidance in changing the behavior of inmates carried out at the Class III Langkat Youth Penitentiary. The implementation of empirical legal research aims to see the empirical conditions of the optimization of the implementation of prisoner guidance in changing the behavior of inmates at the Class III Langkat Youth Penitentiary, as well as its influence on changes in prisoner behavior.
