Abstract

Mechanical animal slaughter is an innovation that has an impact on the efficiency of modern food industry production while maximizing the fulfillment of people's needs for meat. On the other hand, mechanical slaughter also creates problems related to its halalness. This study aims to analyze and identify aspects of Islamic law related to the halalness of mechanical slaughter and examine the considerations of Islamic law on its efficiency based on maslahat. As doctrinal research, this study is descriptive with an approach to the concept of maslahat and laws and regulations. Data related to the concept of halal animal slaughter and the concept of maslahat, which are integrated with applicable laws and regulations, are collected from the library, processed and analyzed comprehensively using qualitative methods. This study has implications for the use of mechanical slaughter methods to meet the halal standards set by Islam with consideration of the efficiency offered by the modern food industry. The results of the study indicate that mechanical animal slaughter can increase production efficiency, especially time and cost. This efficiency has challenges in ensuring the halalness of the product, especially those related to slaughtering according to sharia, mentioning the name of Allah and the state of consciousness of the animal. Based on the benefits, the use of technology is acceptable as long as there is certainty that the mechanical slaughtering process does not conflict with Islamic law. Mechanical slaughtering still requires stricter regulation and supervision to ensure that the efficiency of slaughtering carried out in the modern food industry is in accordance with the principles of halal.

Abstract

Facial plastic surgery for aesthetic purposes has become an increasingly prominent practice in modern medical procedures. While such interventions offer significant physical transformations also raise various ethical, medical, and legal questions particularly within the frameworks of law and contemporary Islamic jurisprudence. This study aims to analyze facial plastic surgery from two perspectives: Indonesia’s Health Law No. 17 of 2023 and the views of contemporary Islamic scholar Yusuf al-Qaradawi. Within the context of Health Law, plastic surgery is considered a legitimate medical practice as long as it adheres to principles of patient safety, medical ethics, and does not endanger an individual's health. The law emphasizes the importance of valid medical purposes in clinical practice and calls for strict oversight of aesthetic procedures to prevent exploitation and misuse. Meanwhile, according to Yusuf al-Qaradawi, cosmetic surgery for aesthetic enhancement may be deemed permissible as long as it does not contravene fundamental Islamic principles such as avoiding permanent changes that result in deception or violate the integrity of God's creation. This study employs a literature review method by examining relevant sources related to the Health Law and Yusuf al-Qaradawi's fatwas concerning aesthetics and bodily alteration in Islam. The findings reveal a tension between individual freedom to undergo cosmetic procedures and the obligation to uphold health and medical ethics within both positive law and contemporary fiqh. Overall, both perspectives advocate for a balanced approach to plastic surgery, prioritizing safety, well-being, and noble intentions.

Abstract

Penyalahgunaan narkoba merupakan persoalan sosial yang tidak hanya berdampak pada individu pengguna, tetapi juga menimbulkan krisis ketahanan keluarga sebagai unit sosial terkecil. Artikel ini bertujuan untuk menganalisis dampak penyalahgunaan narkoba terhadap ketahanan keluarga melalui studi kasus pemakai narkoba di Kota Medan. Penelitian ini menggunakan metode kualitatif dengan pendekatan studi kasus, yang disusun secara deskriptif-analitis berdasarkan data Primer berupa wawancara dengan pemakai, dan sekunder berupa laporan lembaga terkait, hasil penelitian terdahulu, serta studi literatur yang relevan dengan isu narkoba dan ketahanan keluarga. Data dianalisis dengan menitikberatkan pada aspek ekonomi keluarga, kondisi psikologis anggota keluarga, relasi suami istri, fungsi pengasuhan anak, serta dampak sosial yang ditimbulkan. Hasil pembahasan menunjukkan bahwa penyalahgunaan narkoba menyebabkan disfungsi ekonomi keluarga, meningkatnya konflik dan tekanan psikologis dalam rumah tangga, melemahnya fungsi pengasuhan anak, serta munculnya stigma sosial terhadap keluarga pengguna narkoba. Studi kasus ini juga mengungkap bahwa pendekatan penanganan narkoba yang berorientasi pada pemidanaan semata belum mampu memulihkan ketahanan keluarga, bahkan berpotensi memperdalam kerentanan sosial keluarga penyalahguna narkoba. Oleh karena itu, artikel ini menegaskan pentingnya pendekatan penanggulangan narkoba yang lebih komprehensif melalui kebijakan non-penal berbasis rehabilitasi, pendampingan psikososial, dan penguatan peran keluarga guna menjaga keberlanjutan ketahanan keluarga dan stabilitas sosial

Abstract

Artikel ini membahas permasalahan pengaturan dan penerapan harta sepencarian dalam perkawinan poligami berdasarkan Islamic Family Law Malaysia. Kajian ini menitikberatkan pada sejauh mana norma hukum mampu memberikan keadilan dan melindungi hak ekonomi istri dalam praktik poligami. Penelitian dilakukan dengan metode hukum normatif melalui pendekatan peraturan perundang-undangan, konsep hukum, dan analisis kasus, dengan mengkaji Islamic Family Law (Federal Territories) Act 1984 (Act 303) doktrin hukum keluarga Islam, serta praktik peradilan mahkamah syariah. Hasil penelitian menunjukkan bahwa persoalan utama harta sepencarian dalam poligami bukan terletak pada kekosongan aturan hukum, melainkan pada penerapan hukum yang masih bersifat formal dan administratif. Tidak adanya kewajiban pemisahan dan pencatatan harta sepencarian sebelum poligami, serta pembuktian yang lebih menekankan kontribusi finansial, menyebabkan peran dan kontribusi domestik istri kurang dihargai secara hukum dan memicu ketimpangan ekonomi antar istri. Dari sudut pandang maqāṣid al-sharī‘ah, khususnya perlindungan harta dan martabat perempuan, kondisi ini menunjukkan adanya jarak antara tujuan ideal hukum keluarga Islam dan praktik peradilannya. Oleh karena itu, artikel ini menekankan pentingnya perlindungan harta sepencarian sebagai syarat utama dalam pemberian izin poligami, agar keadilan dan kemaslahatan keluarga dapat terwujud secara nyataArtikel ini membahas permasalahan pengaturan dan penerapan harta sepencarian dalam perkawinan poligami berdasarkan Islamic Family Law Malaysia. Abstract

Post-divorce conditions frequently result in the neglect of children’s rights, particularly financial support, despite clear legal obligations imposed on parents. Children, as a vulnerable group, require both normative and practical protection to ensure their well-being and sustainable development. This article examines the protection of child support rights after divorce through an integrative analysis of maslahah (public benefit) and Law Number 35 of 2014 on Child Protection. A qualitative approach is employed by combining normative juridical analysis with limited empirical insights derived from interviews with legal practitioners, enabling a more contextual understanding of the gap between legal norms and their implementation. The findings reveal that although legal frameworks and Islamic principles consistently position child support as a mandatory responsibility—primarily borne by the father—its enforcement remains weak due to limited monitoring mechanisms, low legal awareness, and socio-economic constraints. From the perspective of maqasid al-sharia, the fulfillment of child support constitutes a fundamental effort to preserve life, intellect, and lineage, thereby reinforcing its urgency beyond formal legality. The novelty of this study lies in its integrative framework that bridges positive law and Islamic legal philosophy to strengthen child protection discourse. Strengthening enforcement mechanisms, enhancing institutional supervision, and internalizing ethical-religious values are essential to ensure a more just, effective, and sustainable protection of children’s rights.

Abstract

This study aims to analyze child neglect following parental divorce from the perspectives of Law No. 35 of 2014 concerning Amendments to Law No. 23 of 2002 on Child Protection (UUPA) and the Compilation of Islamic Law (KHI). This research employs a normative juridical approach. Through qualitative methods, the study finds a highly contrasting difference in perspectives between the UUPA and KHI regarding the issue of child neglect after parental divorce. The UUPA views such actions as a criminal offense, and the perpetrators are subject to legal sanctions. In contrast, the KHI considers child neglect after divorce as an internal civil matter between parents and children, and therefore does not recognize criminal sanctions. Meanwhile, the Religious Court, as a special judicial body that adjudicates divorce cases for Muslim citizens, applies the KHI as its legal basis. Based on these findings, it is concluded that the increase in child neglect parallels the rising number of divorces due to these differing perspectives in addressing the issue. As a result, there is no clear legal certainty serving as a specific reference for resolving cases of child neglect after divorce. In this regard, the author proposes several recommendations: (1) there should be a harmonization of perspectives between the UUPA and KHI concerning child neglect after divorce, recognizing that such acts may result in criminal sanctions; (2) the Supreme Court is encouraged to issue a regulation (PERMA) requiring judges in Religious Courts to include children’s post-divorce rights in their legal considerations even if not explicitly requested, and to impose penalties on parents who fail to comply with such rulings; and (3) the government is advised to establish a special institution or supervisory service unit to monitor child support obligations.

Abstract

This article aims to analyze the relationship between sharia, fiqh, and qanun from a siyāsah syar'iyyah perspective by examining historical practices during the Ottoman Empire and the Mamluk Dynasty. This research uses qualitative methods with a library study approach, drawing on classical and contemporary literature on Islamic law and Islamic political history. The results show that sharia serves as the primary normative source, fiqh as the dynamic interpretation of Islamic scholars, and qanun as an implementable form of codification of state law. From a siyāsah syar'iyyah perspective, these three elements form an integrative and adaptive relationship in responding to societal needs. Studies of the Ottoman period demonstrate a legal dualism between sharia and qanun that developed into a complex legal system, particularly during the Tanzimat period. Meanwhile, during the Mamluk period and the development of law in Egypt, a transformation from the dominance of fiqh to a legal system influenced by modern codification and Western law is evident. Thus, the relationship between sharia, fiqh, and qanun is not static, but rather dynamic and contextual, and oriented toward achieving public welfare as the primary goal of Islamic law.

Abstract

AbstrakPenelitin ini bertujuan untuk menganalisis i’jaz Al-Qur‟an dan Relevansinya dengan perkembangan ilmu pengetahuan dan teknologi. Penelitian ini dianalisis dengan metode library research, dengan teknik pegumpulan data berupa dokumentasi. Salah satu pendekatan tersebut adalah pendekatan stilistika. al-Qur’an memilki uslub/gaya bahasa yang tinggi sehingga menjadi salah satu unsur kemu’jizatannya. Hasil penelitian menemukan bahwa hakikat dari i’jaz Al- Qur‟an adalah ilmu Al-Quran yang mencakup kekuatan dari susunan lafal dan kandungan Al-Quran dengan gaya bahasa yang indah dan halus, serta menggunakan isti’arah, majaz (metafora) dan matsal (perumpamaan). Demikian juga dari sudut pandang stilistika, walaupun hanya dalam beberapa baris saja, namun elemen-elemen stilistika telah dapat didapatkan dengan indahnya. Orang-orang yang menentang al-Qur’an dari golongan musyrikin atau Ahlil Kitab, secara pelan-pelan dapat ditaklukkan oleh keindahan bahasa al-Qur’an. This research are analyzed by library research method, with data collection techniques in the form of documentation. One such approach is the stylistic approach. Al-Qur'an has a high uslub/style of language so that it becomes one of its miraculous elements. The results of the study found that the essence of i'jaz Al-Qur'an is the knowledge of the Al-Quran which includes the strength of the composition of the pronunciation and content of the Al-Quran in a beautiful and subtle style of language, and uses isti'arah, majaz (metaphor) and matsal (parable). Likewise, from a stylistic point of view, although only in a few lines, the stylistic elements can be obtained beautifully. People who oppose the Qur'an from the polytheists or the People of the Book can slowly be conquered by the beauty of the language of the Qur'an. This is one of the methods of preaching the Prophet Muhammad SAW by prioritizing the elements of beauty.Keywords: I'jaz Al-Qur'an, Relevancy, Linguistics, Stylistics.
