Abstract

Pemerintah diberi kewenangan untuk melakukan pengawasan terhadap ketaatan penanggung jawab kegiatan usaha dalam masalah perlindungan dan pengelolaan lingkungan hidup. Berdasarkan pendegelasian tersebut pemerintah mengangkat pejabat pengawas lingkungan hidup untuk mengawasi kegiatan usaha agar tidak menimbulkan pencemaran dan kerusakan. Permasalahan yang timbul dalam pengawasan tersebut adalah bagaimana tanggungjawab pejabat pengawas lingkungan hidup menjalankan tugasnya? Tanggungjawab pejabat pengawas lingkungan hidup dalam menjalankan tugasnya dengan melakukan pemantauan kegiata usaha yang dilakukan oleh penanggungjawab kegitan usaha baik yang berpotensi menimbulkan terjadinya pencemaran maupun kerusakan lingkungan hidup atau tidak. Pejabat pengawas lingkungan hidup juga melakukan pengawasan baik secara langsung maupun tidak langsung terhadap tingkat ketaatan penanggungjawab kegiatan usaha dalam menjalankan izin yang telah diberikan kepadanya. Hasil pemantauan tersebut akan dibuat suatu lapora yang nantinya akan dilaporakan kepada pejabat yang berwenang mengangkatnya.

Abstract

The neutrality of the State Civil Apparatus in local democratic contests, particularly Regional Head Elections, constitutes a fundamental principle for the realization of a clean, professional, and democratic system of governance. As an integral component of the state apparatus, ASN plays a strategic role in public administration and service delivery, thereby requiring impartiality and freedom from practical political interests. Nevertheless, empirical realities indicate that violations of ASN neutrality during Pilkada remain prevalent, manifesting in both direct and indirect political involvement, misuse of state resources, and administrative actions that favor certain candidate pairs. This condition reflects a persistent gap between normative legal frameworks and their practical implementation. This article aims to examine the challenges surrounding ASN neutrality in Pilkada by analyzing regulatory arrangements, implementation practices, and supervisory mechanisms from a constitutional law perspective. Employing a normative juridical approach, this study reviews statutory regulations, legal doctrines, and findings from relevant national scholarly journals. The analysis reveals that although the legal framework governing ASN neutrality is relatively comprehensive, the effectiveness of law enforcement and oversight mechanisms continues to face significant obstacles. These include weak inter-institutional coordination among supervisory bodies, political pressures exerted on the bureaucracy, and a limited level of legal awareness among certain segments of ASN. From the standpoint of constitutional law, breaches of ASN neutrality have serious implications for the quality of democracy, the realization of good governance principles, and the legitimacy of local governments produced through Pilkada. Therefore, strengthening legal policies, enhancing supervisory capacity, and reinforcing bureaucratic ethics development are essential measures to ensure the consistent enforcement of ASN neutrality in every local democratic process.

Abstract

Inheritance disputes within families often arise from limited public understanding of Islamic inheritance law, weak communication among heirs, and the persistence of local inheritance practices that are not always aligned with the principles of justice in Islamic law. This community service program aims to enhance public literacy on Islamic inheritance law as a preventive effort to reduce family disputes in society. The program was implemented through participatory legal education, legal counseling, case discussions, and simple simulations of inheritance distribution based on the principles of farā’iḍ. The participants consisted of community members, religious leaders, local figures, and families potentially facing inheritance-related issues. The educational materials covered the basic concepts of Islamic inheritance law, the pillars and requirements of inheritance, causes and impediments to inheritance, classifications of heirs, principles of justice in inheritance distribution, and the importance of family deliberation in resolving inheritance matters. The results indicate that education on Islamic inheritance law improved participants’ understanding of the rights and obligations of heirs, reduced misconceptions regarding inheritance distribution, and strengthened public awareness of resolving inheritance issues fairly, peacefully, and in accordance with Islamic legal principles. This program affirms that Islamic inheritance law literacy plays an important preventive role in minimizing family conflict, strengthening social harmony, and fostering a more orderly legal culture within society. Therefore, education on Islamic inheritance law should be conducted continuously through collaboration among academics, religious leaders, village authorities, and community-based religious institutions.
