Abstract

Kajian ini menganalisis secara yuridis-normatif klausula eksonerasi dalam perjanjian kredit baku perbankan di Indonesia. Klausula ini menciptakan ketidakseimbangan posisi tawar dan cenderung lebih meningkatkan posisi bank dalam suatu perjanjian. Kajian ini menelaah benturan antara asas kebebasan berkontrak dalam Kitab Undang-Undang Hukum Perdata (KUHPerdata) dengan mandat perlindungan konsumen dalam Undang-Undang No. 8 Tahun 1999 (UUPK) dan Peraturan Otoritas Jasa Keuangan (POJK) No. 22 Tahun 2023. Dengan metode yuridis normatif, penelitian ini menggunakan pendekatan perundang-undangan dan analisis kasus terhadap yurisprudensi. Hasil analisis menunjukkan bahwa meskipun kerangka hukum sektoral (lex specialis) secara tegas melarang klausula eksonerasi dan menyatakannya batal demi hukum (void ab initio), praktik di lapangan masih terus berlangsung. Implementasi hukum (law in action) terhambat oleh inkonsistensi putusan pengadilan, yang terbelah antara pendekatan formalistik yang menguatkan kontrak dan pendekatan progresif yang berpihak pada konsumen. Disimpulkan bahwa persoalan utama terletak pada kesenjangan antara hukum dalam teks dan penegakannya. Rekomendasi difokuskan pada penguatan pengawasan OJK, penyeragaman pandangan hakim melalui Surat Edaran Mahkamah Agung (SEMA), dan peningkatan kepatuhan industri untuk menjembatani kesenjangan tersebut demi perlindungan konsumen yang efektif.

Abstract

This study examines the interplay of legality, proportionality and rights protection in enforcement operations conducted by the Satpol PP in Batam, Indonesia. Local-order enforcement against violations of regional regulations often triggers contestation because it intersects with livelihoods, property interests and security while simultaneously demanding effective public-order governance. The research aims to assess whether enforcement actions comply with applicable mandates and procedural requirements; evaluate how proportionality is applied in selecting measures, escalating interventions and using force; and map available safeguards and remedies for affected residents. A socio-legal case-study design is employed, combining document analysis, field observation and semi-structured interviews with Satpol PP officers, local government units, street vendors and business actors and civil-society representatives. Findings suggest legality is generally satisfied at the level of formal authority, yet procedural weaknesses persist in advance notice, record-keeping, transparency of decision-making and post-operation accountability. Proportionality is not consistently operationalized, particularly regarding the least restrictive option, clear escalation stages and standards on the use of force. Rights protection for impacted communities remains dependent on discretion, with complaint channels and restitution mechanisms insufficiently accessible, especially for vulnerable groups. The study recommends strengthening rights-based SOPs, institutionalizing proportionality training, improving documentation and supervisory controls and providing accessible complaint, mediation and relocation-support pathways. More broadly, inter-agency coordination and performance metrics should prioritize voluntary compliance and reduced grievances, not merely the number of operations, to enhance legitimacy and protect citizens in governance.

Abstract

This study examines the effect of local regulation socialization and complaint service quality on community compliance in maintaining public order in Sagulung District, Batam City. The study is grounded in the argument that community compliance is not determined solely by sanctions, but also by citizens' understanding of regulations, the quality of government communication, service responsiveness, and trust in local law enforcement. A quantitative survey design was employed. Data were collected using Likert-scale questionnaires administered to 120 residents of Sagulung District and analyzed with IBM SPSS Statistics through validity and reliability tests, descriptive statistics, classical assumption tests, multiple linear regression, t-test, F-test, and coefficient of determination. The findings show that local regulation socialization has a positive and significant effect on community compliance. Complaint service quality also has a positive and significant effect and emerges as the more dominant predictor. Simultaneously, both variables explain 64.2% of the variance in community compliance. These findings confirm that effective public order enforcement requires a combination of regulatory education and complaint services that are responsive, transparent, accessible, and accountable. This study contributes to empirical legal studies and local public administration by positioning complaint services as an instrument for shaping social compliance rather than merely an administrative reporting channel.

Abstract

Diagnostic error is a medico-legal issue that concerns not only clinical competence but also patient rights, patient safety, medical record documentation, and access to justice. This study analyzes legal protection for patients who suffer harm from diagnostic errors committed by medical professionals in Batam City by examining the relationship between professional accountability, complaint mechanisms, medical records, and medical dispute resolution. The study adopts a socio-legal approach that combines normative analysis of health regulations with empirical reading of service practices, complaint procedures, and evidentiary barriers in diagnostic disputes. The findings show that patient protection has a relatively strong normative basis through the recognition of patient rights, professional duties, and the evidentiary function of medical records. Nevertheless, its effectiveness remains constrained by medical information asymmetry, limited clinical transparency, restricted access to documents, and the weak integration of ethical, disciplinary, administrative, and civil mechanisms. This study argues that patient protection should move from a reactive litigation-oriented model toward an integrated accountability model that combines prevention, disclosure, clinical audit, documentation, and recovery. The contribution of this study lies in developing a socio-legal framework that connects diagnostic safety with access to justice in local healthcare governance.
