Abstract

The management the mining sector is under the state’s authority as mandated by the Indonesian Constitution. The principle of Hak Menguasai Negara (State’s Right to Control) grants the state comprehensive authority over mining activities, including policy-making, licensing, and supervision. However, decentralization policies have shifted the balance of power between central and regional governments. This paper analyzes the legal and policy frameworks governing this division of authority, focusing on the role of local governments. Employing normative legal research through the examination of statutes and legal principles, the research finds that the centralization of mining permits under Law No. 3 of 2020 has significantly diminished local governments’ authority, resulting in governance inefficiencies and economic imbalances. The paper further explores asymmetric decentralization as a potential approach to harmonize state control with meaningful local government participation.

Abstract

This research and community service aims to analyze the practice of debt and credit agreements and their legal consequences in the community of Palewai Village, Tanggetada District.  The method used in this article is descriptive qualitative through a socialization approach, direct interviews with creditors and debtors, and analysis of laws and regulations relevant to debt and credit agreements. The results showed that there are still many people who do debt and credit without adequate legal understanding, which risks causing disputes. The practice of financing with fiduciary collateral is also not fully understood by debtors, especially regarding the rights and obligations in this lending and borrowing practice. In addition, the mismatch between the date of receipt of salary and income and the due date is a source of problems. This research and service emphasizes the importance of legal education to the community to increase awareness of legal protection in debt and credit transactions.ABSTRAKPenelitian dan pengabdian ini bertujuan untuk menganalisis praktik perjanjian utang piutang dan konsekuensi hukumnya dalam masyarakat Desa Palewai, Kecamatan Tanggetada. Metode yang dilakukan pada artikel ini adalah deskriptif kualitatif melalui pendekatan sosialisasi, wawancara langsung dengan kreditur dan debitur, serta analisa terhadap peraturan perundang-undangan yang relevan dengan perjanjian utang piutang. Hasil penelitian menunjukkan bahwa masih banyak masyarakat yang melakukan utang piutang secara asal tanpa pemahaman hukum yang memadai, yang berisiko menimbulkan sengketa. Praktik pembiayaan dengan jaminan fidusia juga belum sepenuhnya dipahami oleh debitur, khususnya terkait hak dan kewajiban dalam praktek pinjam meminjam ini. Selain itu, ketidak sesuaian antara tanggal penerimaan gaji dan pemasukan dengan tanggal jatuh tempo menjadi sumber masalah. Penelitian sekaligus pengabdian ini menekankan pentingnya edukasi hukum kepada masyarakat meningkatkan kesadaran akan perlindungan hukum dalam transaksi utang piutang.

Abstract

This study examines the legal certainty afforded to healthcare workers in performing emergency medical procedures in Indonesia and compares it with the legal protection framework implemented in Thailand. The urgency of this research arises from the increasing criminalization and malpractice claims faced by healthcare workers acting in good faith under high-risk and time-sensitive emergency conditions. Using a normative juridical method that incorporates statutory, conceptual, case, and comparative approaches, this study analyzes Law Number 17 of 2023 on Health in conjunction with Thailand’s Emergency Medical Act and the application of the Good Samaritan principle. The findings reveal that although Indonesian law normatively recognizes legal protection for healthcare workers, its implementation remains weak due to the absence of technical guidelines, inconsistent law enforcement practices, and the limited role of professional medical institutions in the early stages of legal proceedings. In contrast, Thailand provides more effective legal certainty through explicit statutory immunity, integrated institutional support, and a restorative legal approach toward emergency medical practice. The novelty of this study lies in its comparative analysis, demonstrating that Thailand’s qualified immunity model may serve as a normative and institutional reference for strengthening legal protection for healthcare workers in Indonesia, particularly in emergency medical contexts. This study contributes to the development of health law by offering policy-oriented recommendations to enhance legal certainty, professional security, and patient safety.
