Abstract

The study in writing this paper is the essence of understanding constitutionalism in the context of the administration of the constitutional system. Constitutionalism for modern countries is a necessity. In the understanding of constitutionalism, the constitution is the embodiment of the highest law that must be obeyed by all components of the state. Writing the paper aims to explore further the philosophical meaning of this understanding of Constitutionalism. That in the concept and understanding of Constitutionalism, there are three things that become its essence. First, there is a limitation of power. Second, the exercise of power is carried out based on a general agreement that is crystallized into the constitution, and Third, the exercise of power always requires accountability within the framework of the constitution.

Abstract

The research objective was to identify and analyze the role of district / city government in the guidance and supervision of village regulations. This research method is a normative-empirical approach, by examining Laws and regulations related to the role of district / city local governments in fostering and supervising village regulations with their implementation. The conclusions from the results of this study indicate that in the formation of a Village Regulation, the role of district / city Regional Government is regulated in Article 115 of Act No. 6 of 2014 concerning Villages, one of which is to provide guidelines for drafting village regulations and village head regulations. The technical guidelines for the preparation of village regulations in Kolaka district are regulated in Perda No. 4 of 2009 in its implementation the technical guidelines are still very difficult to adjust to the current conditions due to the issuance of the Law of Permendagri No. 6 of 2014 concerning the Village.Keywords: Coaching; Supervision; Regional Government; Village Regulations; Regent Regulation.

Abstract

A rally or demonstration is a protest movement carried out by a group of people in public. However, demonstrations can also be interpreted as an activity to express opinions in public. Thus demonstration activities are actually a form of human right that is protected by law, in realizing the will of citizens in expressing opinions freely it must be maintained, so that the entire institutional social order is maintained from irregularities or violations of the law and can guarantee a sense of security in life. society, running smoothly, orderly and safely in accordance with what is the purpose of the demonstration. The police are law enforcement officers who directly deal with this matter, so this research examines the role and duties of the police in handling demonstrations in the title, Implementation of the duties and authorities of the Sabhara police unit in handling demonstrations in accordance with the Republic of Indonesia Police Law No. 2 of 2002 This study uses a sociological juridical approach, which is an approach that examines law and its systematics which is then applied to examine a problem in society with the aim of obtaining a fact, formulating a problem and finding the root of the problem. In dealing with demonstrations in this study, the police were at the forefront, namely at the stage of supervising the progress of demonstration activities, the duties of the Sabhara police in this supervision were directly related to the masses in the field, the police experienced only a few obstacles but could be handled properly

Abstract

Penelitian ini bertujuan untuk menganalisis pelaksanaan kewenangan bawaslu sebagai lembaga pengawas pemilu dan penyelesaian sengketa proses pemilu. Penelitian ini merupakan penelitian hukum normatif denganmenelaah semua undang-undang dan regulasi yang berkaitan dengan isu hukum yang sedang diteliti. Pendekatan penelitian menggunakan pendekatan perundang-undangan dan pendekatan konseptual. Sumber bahan hukum yang digunakan adalah bahan hukum primer yakni bahan hukum yang bersifat otoritas, yang terdiri dari peraturan perundang-undangan, catatan resmi, atau risalah dalam pembuatan peraturanperundang-undangan serta bahan hukum sekunder (bahan yang memberikan penjelasan mengenai bahan hukum primer, meliputi, dokumen, buku, majalah, jurnal-jurnal hukum dan laporan penelitian yang terkait dengan penelitian ini). Kesimpulan penelitian ini telah diperoleh hasil bahwa Pertama, Bawaslu sebagai lembaga pengawasan pemilu melakukan fungsi pencegahan pelanggaran. Kedua, Kewenangan Menyelesaikan Sengketa Proses Pemilu Bawaslu merupakan kewenangan atributif  berdasarkan Undang-Undang No. 7 Tahun 2017 tentang Pemilihan Umum pada Pasal 94 ayat (3) poin d dan Anggota Bawaslu telah memenuhi kriteria sebagai hakim pada sidang Adjudikasi Bawaslu karena telah melewati jalur seleksi yang begitu ketat sesuai dengan tahapan-tahapan yang telah mereka laksanakan dan Tim Seleksi telah melakukanpenilaian berdasarkan kriteria yang telah termuat dalam pasal 117 UU Pemilu. Ketiga, Pasal 469 yang menyatakan bahwa Putusan Bawaslu adalah final dan mengikat merupakan kalimat yang memberikan kedudukan atau kekuatan kepada putusan adjudikasi Bawaslu bersifat final. Tetapi, kekuatan tersebut langsung di hapus pada frase selanjutnya yang memberikan pengecualian kepada perihal-perihal tertentu.

Abstract

Indonesia's political culture does have its own characteristics, where regions with a variety of local cultural values also always give different political nuances. However, if we pay close attention, almost no region is free from the legacy of feudalism values, patrimonial practices, patronage and the characteristics of a communal society which tend to be very permissive. This condition then gave birth to political dynasties, one thing that is also a problem for democracy in our country. This research is a doctrinal research or normative legal research. Political dynasties are primitive reproductive systems of power because they rely on the blood and lineage of only a few people. Political dynasty can also be interpreted as a strategy to maintain power in order to remain in the family circle. Political dynasties tend to give rise to multiplication of actors (actors that appear only within dynasties), not pluralism of actors (actors that appear tend to vary from various backgrounds). The presence of political dynasties that encompasses power struggles at regional to national levels makes it difficult to realize the substance of democracy itself. The growth of political dynasties, especially in the regions, cannot be separated from the role of political parties and regulations regarding regional elections. The oligarchy within political parties causes the candidacy and nomination mechanisms to not work as they should. So far, there has been a tendency for political parties to nominate candidates based on the wishes of party elites, not through democratic mechanisms that take into account the abilities and integrity of the candidates.

Abstract

This research aims to analyze the dynamics of the position of the chancellor of a private university as a state administrative official in State Administrative Court (PTUN) disputes. The position of chancellor at private universities has a strategic position in higher education management and academic administration, which often intersects with state regulations. The research results show that private university presidents are often involved in PTUN disputes related to academic and administrative decisions. This research concludes that the position of the chancellor of a private university as a state administration official in PTUN disputes is very dependent on the context and content of the decisions taken. Therefore, clearer regulations and stricter legal guidelines are needed to avoid ambiguity in the legal status of private university chancellors. This research contributes to a deeper understanding of the role and responsibilities of the chancellor in private higher education administration and provides recommendations for improving legal policy in the field of higher education.

Abstract

This activity aims to increase the capacity and competence of the Polling Station Supervisory Committee (PTPS) in Ranteangin District, North Kolaka Regency. PTPS plays an important role in ensuring the implementation of honest, fair, and transparent elections. However, limited understanding of election regulations and procedures is a challenge in carrying out supervisory duties. The method used in this program is debriefing, which includes providing structured material regarding election regulations, supervision techniques, handling violations, and reporting procedures. The debriefing was attended by 10 participants from all villages/sub-districts in Ranteangin District. The results of the evaluation showed a significant increase in the participants' understanding and skills related to their duties and responsibilities as PTPS. This program is expected to strengthen the role of PTPS in maintaining the integrity of the electoral process and supporting the realization of quality democracy at the local level

Abstract

Tujuan penelitian ini adalah untuk mengetahui kewenangan Badan Pengawas Pemilihan Umum (Bawaslu) Kabupaten/Kota dalam menyelesaikan sengketa proses pemilu. Sebagai hasil kajian, Badan Pengawas Pemilihan Umum (Bawaslu) Bupati/Kota memiliki kewenangan untuk menyelesaikan masalah melalui keputusan atau risalah. Penelitian ini menggunakan metode yuridis-normatif yang bertujuan untuk mendapatkan sebuah deskripsi analitis terhadap tugas dan fungsi bawaslu dalam penyelesaian sengketa. Data-data yang diperoleh, baik data perimer maupun data sekunder disusun dan dianalisis secara sesuai dengan permasalahan yang telah dirumuskan. Hasil Penelitian menunjukan bahwa perlu dilakukan penguatan terhadap kewenangan Bawaslu dalam hal pengawasan, karena kelahiran Bawaslu sesungguhnya bukan dimaksudkan sebagai lembaga pengadil dalam sengeta proses pemilu, akan tetapi kelahiran Bawaslu dimaksudkan agar Bawaslu melakukan pengawasan pada setiap tahapan pemilihan umum. Sebagai ikhtiar agar Bawaslu fokus pada fungsi pengawasan serta sebagai upaya agar Bawaslu tidak terjebak dalam praktek a buse of power maka perlu dilakukan rekonstruksi terhadap fungsi penyelesaian sengketa proses, dimana penulis berpandangan bahwa akan lebih tepat bila kewenangan penyelesian sengketa proses ini di amanahkan kepada lembaga yang bernaung dalam kekuasaan kehakiman.

Abstract

This study discusses the enforcement of the notary code of ethics against promotional violations through internet media in Indonesia. As a public official, Notary have a great responsibility in maintaining integrity and professionalism in carrying out their duties. However, in the current digital era, promotion through internet media is a complex issue due to the prohibition in the notary Code of ethics related to self-promotion. This study uses juridical-normative approach and descriptive-analytical approach to analyze the legal regulations and notary practices related to promotion in the internet media. The results showed that violation of this promotion ban may result in disciplinary sanctions from the notary Supervisory Board. However, the effectiveness of enforcing the code of conduct is still a matter of debate, with challenges in consistency and transparency in enforcing the rules. The importance of enforcing this code of ethics is not only as law enforcement, but also as a preventive effort to maintain the integrity of the notary profession and public trust. Thus, this study provides a more comprehensive understanding of the enforcement of the notary code of ethics against promotional violations through internet media in Indonesia.

Abstract

The socialization initiative about participatory oversight for the coastal town of Tanggetada in the 2024 Election for Regent and Deputy Regent of Kolaka Regency seeks to improve public comprehension and engagement in the electoral monitoring process. This program engaged 47 participants, comprising community leaders, youth, and representatives from fishing groups, utilizing tactics such as lectures, interactive discussions, simulations, and the dissemination of instructional materials. Evaluation results revealed that 90% of participants demonstrated enhanced understanding, with 70% attaining a superior level of comprehension. Participants expressed favorable opinions of the employed methodologies, especially simulations and talks, which were deemed pragmatic and comprehensible. Nevertheless, 10% of participants still necessitate further support. This initiative effectively heightened community understanding on the significance of transparency and integrity in elections and equipped people to actively participate in oversight activities. Subsequent proposals entail enhanced socializing and mentorship, particularly for populations in isolated regions
