Abstract

Abstract: Legal Conflict in Zakat Management in the Prismatic Communities of Kapuas Regency, Central of Kalimantan. This study is aimed at analyzing the legal conflict in the management of zakat (charity) among prismatic communities in Kapuas Regency, Central of Kalimantan. This intersection occurs between Islamic law relating to the management of zakat and the tradition, or customary law held by the local community. This phenomenon gives rise to poly normativism (legal overlap) between formal rules and living traditions in the local community. This research is empirical-normative in nature, using a combination of several approaches, i.e., the empirical, historical, normative, and conceptual approaches. The data were obtained through interviews, documentation, and direct observation of zakat management institutions and community behavior supported by the tradition of local society. The results of the study indicate that there is an intersection between the rules used in the management of zakat and the customary laws that live in a prismatic society in Kapuas Regency. For this reason, it is necessary to make adjustments in the regulation of zakat management while raising public awareness of the importance of optimizing zakat to support the interests of the state, in general, and in particular, for the interests of the local Muslims themselves.

Abstract

This research is motivated by the efforts made by the National Zakat Agency (Baznas) to manage zakat productively to achieve economic prosperity. Zakat funds at Baznas are quite substantial, both at the Regency/City, Provincial, and National levels. If these zakat funds are only distributed for consumption to those entitled to receive them, poverty will certainly never be minimized, let alone eliminated. As long as zakat funds are only distributed for consumption, the objectives of the zakat mandate will never be achieved. The focus of this research is to delve deeper into the strategic steps taken by Baznas to optimize national economic recovery, particularly in Central Kalimantan. This research is empirical (file research), examined using a socio-legal approach to provide a more holistic view of legal phenomena in society. The results of this study indicate that zakat management in Central Kalimantan itself in supporting national economic recovery is divided into two methods. First, zakat management remains classical, primarily for consumption, aimed at meeting the basic needs of those entitled to receive it, such as basic necessities and the Baznas (National Zakat Agency) housing renovation program. Second, zakat is managed productively each year to ensure continued growth, although it does not yet utilize a revolving fund system that could provide additional capital for productive businesses. Optimizing this system is expected to achieve prosperity, well-being, and social justice.

Abstract

The practice of sighat taklik talak in Indonesian marriage law exclusively grants the right of pronouncement to the husband, creating an imbalance in legal protection and contradicting the constitutional principle of gender equality. This research aims to analyze the ambiguous legal position of sighat taklik talak critically and to deconstruct the gender injustice embedded within it, in order to formulate an argument for legal reform towards a reciprocal model. Employing a normative juridical research method with statutory, conceptual, and historical approaches, this study analyzes primary and secondary legal materials through systematic and teleological interpretation. The findings indicate that the legal position of sighat taklik talak is problematic. While the instrument is recognized by the Compilation of Islamic Law, it misaligns with the principle of consensualism in civil law. More fundamentally, its unilateral nature creates legally legitimized gender-based discrimination by denying an equivalent protection mechanism for the husband. It is concluded that the current practice does not reflect substantive justice. Therefore, regulatory reform of sighat taklik talak is a juridical imperative to transform it into a reciprocal protection agreement that guarantees legal certainty and equality for both husband and wife.

Abstract

Long-distance marriage presents serious challenges to the fulfillment of spousal rights and obligations, potentially triggering conflict and household disintegration. This study aims to conduct an in-depth analysis of these dynamics through a qualitative-empirical case study of a couple in Palangka Raya City. Data were collected through in-depth interviews, observation, and documentation, and subsequently analyzed interpretively using the frameworks of the Compilation of Islamic Law and Maqāṣid al-Syarī’ah. The key finding of this research reveals that the husband’s sustained failure to fulfill his obligation of financial support triggered an extreme role reversal, wherein the wife became the sole financial provider. This imbalance became the root of communication erosion, the creation of emotional distance, and the accumulation of conflicts culminating in divorce. It is concluded that the marital disintegration was not caused solely by physical distance; the primary factor was the couple’s inability to renegotiate their roles and responsibilities equitably. This situation, both juridically and philosophically, contradicts the principles of justice and benefit in Islamic family law. This research contributes fundamental empirical data to the contemporary discourse on fiqh concerning modern marriage.

Abstract

The purpose of this study is to enalysis the effectiveness of the implementation of Law Number 16 of 2019 which amends Law Number 1 of 1974 concerning Marriage. This law revision hopes that the goal of marriage that promotes a happy and sustainable home by the teachings of Islam can be realized. This research uses qualitative methods by conducting field observations. The results showed that increasing the minimum age limit for women in marriage from sixteen years to nineteen, by the changes in Law Number 16 of 2019, brought new legal impacts in society. Although administratively the number of child marriages recorded at the District Religious Affairs Office in West Kotawaringin Regency has decreased, in reality on the ground, unregistered child marriages are increasing. Abstract

Penelitian ini di latarbelakangi permasalahan adanya tambahan harga yang dipatok penjual dalam proses tukar tambah di Pasar Besar palangka Raya. Selain itu dalam tukar tambah juga terindikasi adanya dua proses jual beli dalam satu akad. Fokus penelitian ini dua proses jual beli dalam satu akad pada tukar tambah emas dalam perspektif hukum islam. Metode penelitian yang digunakan dalam penelitian ini yaitu jenis penelitian Hukum empiris dengan pendekatan socio-legal. Hasil kajian ini Proses tukar tambah emas di Pasar Besar Palangka Raya sudah sesuai dengan syarat sah dalam proses jual beli. Dari segi urf termasuk kedalam Al-urf al-shahih karena didalamnya telah terdapat unsur keridhaan antara keduabelah pihak. Dari segi maslahah dapat dikatakan mengandung maslahah karena pemilik toko dan konsumen mendapatkan kemaslahatan dalam proses tukar tambah emas tersebut. Abstract

Tradition is an essential element of Indonesian society, rich in cultural heritage and local values. One tradition that continues to be preserved by the community in Bahaur Tengah Village, Kahayan Kuala District, Pulang Pisau Regency, is the Batumbang Apam tradition. This practice is carried out as an expression of gratitude following the completion of a significant event, particularly a wedding ceremony, with the hope that the newlywed couple will receive blessings, protection, and be spared from future hardships in their marital life. This study employs an empirical legal research method with a socio-legal approach to explore community perceptions of the Batumbang Apam tradition and examine it through the lens of Islamic legal maxims (Qawaid Fiqhiyyah). The findings indicate that the Batumbang Apam tradition holds strong spiritual, social, and cultural values. It is regarded as a form of prayer, a way to preserve ancestral heritage, and a means to establish a harmonious and blessed family life. From the perspective of Islamic law, this tradition falls under the category of ‘urf fi’li (practiced customs) and ‘urf sahih (valid customs) that do not contradict Islamic principles. Furthermore, it embodies maslahah mursalah—a type of public interest not explicitly supported or rejected by Islamic texts but recognized for its benefits. Therefore, the Batumbang Apam tradition is acknowledged as a legitimate local wisdom in Islamic law, as long as it aligns with shariah values and does not contain elements contrary to Islamic teachings.
