Abstract

Land rights under the Cultivation Rights Title (HGU) can serve as collateral in credit agreements through the imposition of a mortgage right. However, legal challenges arise when the status of HGU land as collateral changes, particularly due to its designation as abandoned land by the Indonesian Ministry of Agrarian Affairs and Spatial Planning/National Land Agency (ATR/BPN). Such status changes have significant legal implications for credit agreements, mortgage rights, and the economic value of collateralized land. This study analyses the legal framework governing the determination of abandoned land status, examining statutory regulations and their impact on credit agreements and collateral objects. Employing a normative legal research methodology, the study utilises statutory analysis, conceptual exploration, and interpretative approaches to assess the legal consequences of such status changes. The findings reveal that the designation of land as abandoned results in the termination of cultivation rights and the extinguishment of mortgage rights. While the credit agreement itself remains legally binding, the loss of economic value in the collateral renders it non-executable, leading to financial losses for both creditors and debtors. To address these legal uncertainties, the study recommends amendments to the regulatory framework governing abandoned land to enhance legal certainty, ensure fairness, and provide adequate protection for both creditors and debtors.

Abstract

Pandemi global yang melanda dunia termasuk Indonesia, tidak hanya berdampak pada bisnis di perkotaan tetapi juga di pedesaan seperti menurunnya omzet penjualan. Perjanjian jual beli berbasis ekonomi digital merupakan salah satu solusi masyarakat pedesaan untuk memanfaatkannya dalam rangka meningkatkan kesejahteraan mereka. Tujuan kegiatan ini adalah memberikan bimbingan teknis terkait dengan penerapan prinsip kejujuran dalam perjanjian jual beli berbasis ekonomi digital. Metode pelaksanaan dilakukan dengan cara ceramah dan diskusi serta dilanjutkan dengan praktik membuat iklan dengan aplikasi penggunaan gambar (canva) berisi prinsip kejujuran yang tujuannya untuk melindungi konsumen. Hasil dari bimbingan teknis menunjukkan bahwa peserta dapat membuat iklan dengan konten memberikan informasi yang jujur dan benar terkait dengan produk yang ditawarkan sesuai dengan peraturan. Namun dalam pelaksanaan pembuatan iklan berbasis ekonomi digital dalam menawarkan produk mengalami kendala karena keberadaan internet yang tidak stabil.

Abstract

The renewal of intellectual property-based financing schemes represents a groundbreaking solution to help creative economy actors secure loans using their creative assets. This breakthrough has the potential to foster creativity and improve the welfare of these actors. However, the implementation of trademark rights, especially as collateral, is still hampered by the valuation of the trademark rights themselves, what are the challenges of binding trademark rights as collateral and the idea of trademark rights valuation as a financing solution for creative economy actors. The research method used is normative juridical supported by empirical data with a statutory approach, analytical approach, conceptual approach and comparative approach as well as primary, secondary and tertiary legal materials which are analyzed descriptively qualitatively.The research results show, challenges such as difficulties in determining the value of trademark rights, high fluctuations in their value, rampant piracy, and general business risks have led to intellectual property-based businesses being viewed as high-risk ventures. The difficulty in valuing trademark rights, along with their volatility, results in low acceptance of intellectual property-based collateral by financial institutions. Despite this, intellectual property development, which translates creative ideas into viable businesses, requires facilities and support, including financing for the transformation of valuable creative economy concepts. Progress can be made by strengthening technical arrangements, standardizing mechanisms for intellectual property-based financing, establishing valuation procedures for securing trademark rights as collateral, creating appraiser institutions, developing secondary markets, and providing incentives and assistance. These steps will accelerate the implementation of trademark-based financing, ultimately enabling creative economy actors to access capital with legal certainty

Abstract

Introduction: The rights of banks as separatist creditors in the UU-KPKPU cannot be implemented. Banks also often get a share that is not under the amount of debtor debt, causing injustice.Purposes of the Research: This study aims to analyze and explain the forms of justice problems in legal protection efforts against banks as separatist creditors related to the execution of collateral tied with mortgage rights on the assets of bankrupt debtors and their solutions.Methods of the Research: This research uses normative legal research. Research materials were used, namely secondary data and primary data as a support. This research material was collected by document study and interviews. The material that has been collected is then processed and analyzed using a qualitative approach, which is then drawn to conclusions using the deductive method.Results of the Research: There are two forms of the problem of justice in the legal protection of banks as separatist creditors related to the execution of collateral tied with mortgage rights on the assets of the bankrupt debtor. First, the neglect of bank rights as separatist creditors by UU-KPKPU can be seen in the provisions of Article 56 paragraph (1) and 59 paragraph (1) which contradicts Article 55 paragraph (1). Second, banks as separatist creditors often get a share that is not under the amount of debt of the bankrupt debtor. The author suggests that the UU-KPKPU be changed based on distributive justice which requires proportional distribution.

Abstract

Penelitian ini bertujuan untuk menginventarisasi dan menganalisis Undang-Undang Kekayaan Intelektual terkait dengan keharusan menggunakan akta notariil dalam peralihan kekayaan intelektual. Selain itu juga ingin menganalisis alasan filosofis diperlukan akta notariil dalam peralihan kekayaan intelektual. Secara umum peralihan kekayaan intelektual dapat dilakukan dengan cara pewarisan; hibah; wasiat; dan perjanjian. Peralihan hak dengan cara perjanjian memberikan peluang kepada Notaris untuk melaksanakan perannya dalam membuat akta yang diinginkan oleh para pihak. Sebagai pejabat umum, Notaris diberi kewenangan oleh undang-undang untuk membuat akta autentik, tidak terkecuali akta notariil dalam bidang kekayaan intelektual. Berdasarkan hasil penelitian, ada dua Undang-Undang bidang kekayaan intelektual mengharuskan perjanjian peralihan dibuat berdasarkan akta notariil yaitu Undang-Undang No. 13 Tahun 2016 tentang Paten dan Undang-Undang No. 29 Tahun 2000 tentang Perlindungan Varietas Tanaman. Alasan filosofi dibuatnya perjanjian peralihan dengan akta notariil adalah untuk memberikan kepastian hukum terkait dengan pembuktian bahwa telah terjadi peralihan hak dalam bentuk tertulis dengan akta notaril. Terkait dengan perjanjian peralihan kekayaan intelektual, Undang-Undang kekayaan intelektual tidak memiliki keseragaman karena tidak semua mengharuskan dengan akta notaril. Kekayaan intelektual merupakan intelektualitas dalam bidang ilmu pengetahuan, seni dan teknologi yang memiliki daya cipta, rasa, dan karsa serta memiliki nilai ekonomi yang tinggi. Untuk itu ke depan ada keseragaman perjanjian peralihan hak di bidang kekayaan intelektual perlu dibuat dengan akta notariil.

Abstract

To secure the funds that have been granted to the debtor, in loan agreement between creditor and debtor, a guarantee agreement is usually included. One form of collaterals that is most in demand is land collateral. This research aims to analyze funds security that has been handed over to debtors in connection with loan agreement and promises (clauses) inclusion in a Deed of Granting of Mortgage Rights. This normative research uses statutory, conceptual and interpretive approaches. This study examines several deeds to search and analyze the promises (clauses) in the guarantee agreement. The result shows that the loan agreement includes a promise to provide collateral that will be attached with mortgage rights, to secure the credit that has been given to the debtor as security for repayment of credit loan. Therefore, the loan agreement contains rights and obligations of parties as a form of prudential principles. Furthermore, a Deed of granting of mortgage rights considerably needs to include promises (clauses) as a manifestation of conditions related to the guarantee provided. In its regulation (Mortgage Rights Law), these promises are optional (not mandatory) being included in a Deed of granting of mortgage rights. However, in practice these promises are always included in a deed at the creditor’s request, with the aim being a kind of self-protection to creditor. However, Mortgage Rights Law also provides a balance of protection to debtors, namely promises that are prohibited from being included that creditors can immediately own the object of mortgage rights when the debtor defaults. If such promise is included, then the Deed of Granting of Mortgage Rights is null and void.

Abstract

One of the creations protected by copyright is songs and/or music. Legal protection for them is a necessity in order to create a conducive climate to the development of music industry in Indonesia. In order to facilitate song and/or music writers with better control over their works, they can appoint representatives to regulate the management of their royalty, in this case LMKN (The National Collective Management Institute). Law number 28 of 2014 concerning copyrights regulates that copyright can be used as an object of fiduciary guarantee. However, its use is still hampered by the fact that the economic value of music and song copyrights cannot be determined easily, especially if it is used for fiduciary guarantee. Most banks do not accept it for loan collateral. The objective of this research was to analyze the roles of LMKN as the determiner of the economic values of song and music copyrights for the purpose of binding them for objects of fiduciary guarantee. This normative study uses statutory approach, conceptual approach, analytical approach, and futuristic approach. The determination of the economic values of song and music copyrights can be done by LMKN, a one- stop service institution that collects the royalty of music and song in Indonesia. The National Collective Management Institute (hereinafter briefly referred to as LMKN) as an institution that can provide an appraiser of the economic value of Music and Song Copyrights. The use of SILM (a music and song information system and data center) can help the estimation of music and song’s economic value based on the royalty accepted by the art’s creator or copyright holder. The amount of royalty can determine the binding of music and song copyrights for the objects of fiduciary guarantee.

Abstract

A notary is a public official entrusted with the authority to draft legal deeds pertaining to agreements within the scope of private law. However, their ability to fulfill this role is limited when they are unable to draft aircraft mortgage deeds. This study aims to critically evaluate the scope of a notary's authority in preparing aircraft-related deeds and to examine the various forms of legal deeds that have emerged in practice when aircraft are used as collateral in credit agreements. Using a normative legal approach, the research employs statutory analysis, conceptual exploration, and interpretative methods to assess legal materials. The findings reveal that notaries face considerable obstacles in exercising their authority due to the lack of specific regulations on aircraft mortgages, even as the aviation industry continues to grow rapidly. This regulatory void has resulted in the emergence of diverse deed types, such as Deeds of Agreement for the Transfer of Guarantee and Grant of Power of Attorney, Fiduciary Deeds, and Deeds for the Transfer and Guarantee of Power of Attorney. Furthermore, as aircraft, categorized as registered objects, can be classified as immovable property and potentially treated as mortgageable collateral, the establishment of specific regulations governing aircraft mortgages is essential to avoid legal uncertainty and ensure clear regulatory guidance.

Abstract

A fiduciary guarantee is a form of guarantee or security in a financial transaction where a party called the debtor (the party who borrows) gives the right to a certain asset to the creditor (the party who provides the loan or credit) as collateral for the fulfillment of the debtor's obligations to the creditor. The aim of this research is to explore legal protection and settlement strategies in cases of fiduciary guarantees for debtors who default. This research uses a normative juridical writing approach supported by empirical evidence to identify and analyze the legal framework that regulates fiduciary guarantees in various jurisdictions, such as a statutory approach and a conceptual approach. This research also uses normative and empirical legal analysis methods. The results of the research show that the implementation of the legal protection given to creditors in a fiduciary guarantee agreement conforms to Law No. 42 of 1999 concerning Fiduciary Guarantees, namely by providing protection through the execution of fiduciary guarantees, and ultimately providing consideration of options for creditors and debtors to be able to take action negotiate first.

Abstract

Abstrak Penelitian ini bertujuan untuk mengetahui penerapan hak cipta pada kegiatan digitalisasi koleksi perpustakaan. Hasil penelitian ini mengungkapkan bahwa dalam membangun dan mengembangkan koleksi digitalnyaada beberapa upaya yang dilakukan oleh perpustakaan untuk meminimalisir pelanggaran hak cipta, seperti hanya mendigitalkan koleksi yang belum memiliki hak cipta; meminta ijin tertulis dari pennulis, penerbit atau pemegang hak cipta suatu karya untuk memungkinkan perpustakaan mendigitalkan karyanya; untuk jenis koleksi tertentu seperti laporan penelitian, makalah dan/atau publikasi akademik lainnya, perpustakaan dapat mengajukan surat persetujuan kepada penulis; hanya memperoleh koleksi digital berlabel “konten terbuka” di internet; dan menetapkan standar file koleksi digital untuk membatasi kemungkinan pengguna perpustakaan mencoba mengubah isi koleksi digital tersebut. Selain itu, perpustakaan harus melakukan upaya untuk mengatasi permasalahan pelanggaran hak cipta dengan melakukan kegiatan sosialisasi tentang pentingnya melindungi hak cipta dan akibat hukum dari pelanggaranhak cipta bagi pengelola perpustakaan, pimpinan sekolah dan universitas serta pengguna perpustakaan. Kata Kunci : Hak Cipta, Digitalisasi, Koleksi Perpustakaan Abstract The objective of this study was to disclose the application of copyright in the activities of digitilizing library collections. The results of this study reveal that in building and developing their digital collections there are several efforts made by the libraries to minimize copyright infringement, such as digitilizing only collections that have not hadany copyright; seeking written permission from the author, the publisher or the copyright holder of a work to allow the library to digitize his work; for certain types of collections, such as research reports, papers and/or other academic publications, the libraries may submit a letter of agreement to the author; acquiring only digital collections labeled “open content” on the internet; and specifying the standard of digital collection files to limit the possibility of library users trying to change the contents of the digital collection. In addition, the libraries should make an effort to overcome the problems of copyright infringement by conducting outreach activities about the importance of protecting the copyright and the legal consequences of copyright violations for library managers, leaders of schools and universities and library users.
