Abstract

The earthquake that struck Cianjur Regency in November 2022 severely damaged health facilities and disrupted routine medical services, including maternal and child healthcare. Training on the use of digital health technology for Posyandu (integrated health post) cadres serves as a strategic intervention to ensure the continuity of essential healthcare services in post-disaster settings. This activity, part of the 2023 Kosabangsa Program, aimed to enhance the capacity of cadres in early detection of health issues such as Chronic Energy Deficiency (CED) and heart rhythm disorders by utilizing tools like the digital Upper Arm Circumference (LILA) Calculator, Heart Rate Device, and body temperature monitors based on microcontrollers and IoT technology. This training aligns with the fulfillment of the right to health as mandated by Article 28H of the 1945 Constitution and Law Number 36 of 2009 concerning Health, and supports the implementation of public policies on disaster management in accordance with Law Number 24 of 2007. The results show increased understanding and skills among cadres in operating digital health tools, along with active community participation in restoring healthcare services. Thus, the training contributes not only to medical technical aspects but also to the fulfillment of the community’s constitutional right to equitable and sustainable health services. Abstract

This research examines the effectiveness of criminal consequences for corruption offences in COVID-19 handling funds in Indonesia. The research analyses laws and regulations related to disaster management and social assistance funds. The research reveals legal uncertainty due to normative tensions in the legal framework, such as the absence of the death penalty in Government Regulation in Lieu of Law (Perpu) No. 1 of 2020. This research is a descriptive, employing a normative legal research type that utilizes secondary data comprising primary, secondary, and tertiary legal sources. The approach adopted is a legislative approach, with data collection techniques conducted through a literature study. Subsequently, the collected data is analyzed qualitatively. The case study of former Minister of Social Affairs, Juliari Batubara, highlights shortcomings in law enforcement. The study suggests a constitutional review of laws for non-natural disasters to ensure efforts to combat corruption. Furthermore, it recommends the implementation of more robust regulatory mechanisms and stringent punitive measures to strengthen institutional integrity and preserve public trust in judicial processes.

Abstract

This research discusses the application of restorative justice in handling theft cases in the Sukabumi Police District. Restorative justice emphasises the restoration of relationships between perpetrators, victims, and society, in contrast to traditional criminal law approaches that focus more on sanctions. Using a normative juridical method, this research evaluates various obstacles in the implementation of restorative justice, such as a lack of understanding from law enforcement officials and resistance to system change. In addition, there are difficulties in achieving peace between offenders and victims, as well as the absence of legal regulations at the statutory level that fully support this concept. The research findings revealed that the implementation of restorative justice in Sukabumi jurisdiction is still structurally and procedurally constrained. Therefore, further efforts are needed to increase the understanding and awareness of the authorities and the community of the benefits of this approach to achieve fairer and humanity-focused settlements. This research is expected to contribute to the development of fairer and more effective legal policies in Indonesia.

Abstract

Tujuan penelitian ini adalah untuk mengidentifikasi dasar hukum yang dilanggar dalam praktik penahanan ijazah oleh perusahaan, mengevaluasi efektivitas perlindungan hukum yang tersedia bagi pekerja, dan serta merumuskan langkah-langkah hukum yang dapat diambil untuk mengatasi praktik tersebut sebagai bentuk pelanggaran hubungan industrial. Metode penelitian menggunakan pendekatan yuridis normatif melalui analisis undang-undang, asas hukum, serta studi kasus terhadap sejumlah perusahaan di Surabaya yang dilaporkan menahan ijazah pekerjanya. Hasil penelitian menunjukkan bahwa tindakan penahanan ijazah oleh perusahaan merupakan bentuk pelanggaran terhadap bertentangan dengan Pasal 9 dan Pasal 10 Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan. Tindakan penahanan ijazah juga bertentangan dengan prinsip keadilan atas hak milik pribadi, asas kebebasan berkontrak, dan serta nilai-nilai hubungan industrial yang sehat. Penahanan ijazah tidak hanya menimbulkan kerugian administratif dan ekonomi, tetapi juga berdampak psikologis bagi pekerja yang kehilangan kendali atas dokumen penting miliknya. Ketidakhadiran norma eksplisit dalam peraturan perundang-undangan serta lemahnya pengawasan ketenagakerjaan memperparah praktik tersebut

Abstract

The phenomenon of bullying perpetrated by minors is a serious problem in the child protection system, for both perpetrators and victims. This study aims to analyze the application of restorative justice as a resolution approach in cases of bullying by children, and to assess the extent to which this approach is able to fulfill the principle of justice for victims. The method used in this study is a normative-empirical legal type with a focus on a descriptive qualitative approach from various sources of legal norms, such as laws, court decisions, and related legal literature. The results of the study indicate that the restorative justice approach can provide a more humane and inclusive solution than the conventional criminal justice system. Restorative justice encourages recovery for victims and promotes responsibility and behavioral improvement from child perpetrators. However, the implementation of restorative justice still faces various obstacles and constraints, such as a lack of consistent law enforcement, limited facilities in fulfilling the legal system, and minimal involvement of community institutions. The conclusion of this study states that although restorative justice has excellent potential in resolving the phenomenon of child bullying that occurs in Indonesia fairly between perpetrators and victims. However, its implementation and success are highly dependent on the involvement and cooperation between legal institutions, education, society, and families in order to achieve appropriate recovery for the victim and proper rehabilitation for the perpetrator.

Abstract

Criminal liability for perpetrators of passive money laundering, with a focus on the analysis of Decision Number 626/PIDSUS/2020/PN JKT.SEL. Passive money laundering refers to actions that are not directly related to the main crime but still play an important role in disguising the origin of the proceeds of crime. This study uses a normative legal method, with analysis of legislation, court decisions, and related legal literature. Law No. 8 of 2010 concerning the Prevention and Eradication of Money Laundering Crimes is the main legal basis for regulating money laundering, both active and passive. Article 5 paragraph (1) of this law stipulates that perpetrators of passive money laundering can be subject to criminal sanctions if they are proven to have received, controlled, or used assets that are known or reasonably suspected to be derived from criminal acts. In addition, the system of evidence in money laundering cases applies the principle of reverse burden of proof, whereby the defendant must prove that their assets are not the proceeds of crime. In the case analysed, the Panel of Judges ruled that the defendant was legally and convincingly proven to have committed the passive money laundering crime by trading accounts and using those accounts for illegal transactions, including online gambling. This ruling emphasises the importance of strict law enforcement in dealing with passive money laundering crimes to support effective prevention and law enforcement efforts in Indonesia.

Abstract

The phenomenon of smoking has become a habit for society. In fact, this smoking habit is difficult to break and is rarely recognised by people as a bad habit. Control of conventional cigarettes and electronic cigarettes, in Indonesia, is very urgent. In this study the author focuses on legal protection for e-cigarette users reviewed based on WHO policy and Law Number 17 of 2023 concerning Health. The research method uses qualitative and document study data collection techniques, as well as a normative juridical approach method. The results showed that legal protection for e-cigarette users from the health aspect through efforts by the government which includes repressive and preventive protection. With the reinforcement through Law No. 17 of 2023 concerning Health and PP No. 28 of 2024 concerning Regulations on the Implementation of the Law on health which regulates the sale and restriction of cigarette advertising, as well as health warnings for cigarette users. The impact of e-cigarette use on health can trigger various diseases such as cancer, affect oral health, brain development, and respiratory disorders. Health protection strategies are realised through regulations issued by the government. The strategy to overcome the use of e-cigarettes in accordance with WHO policy and the Health Law requires cooperation from various parties, not only the government.

Abstract

Pendidikan seks sejak dini merupakan langkah strategis dalam upaya preventif terhadap perilaku menyimpang, kekerasan seksual, dan eksploitasi anak. Penelitian atau kegiatan penyuluhan ini bertujuan untuk meningkatkan pemahaman anak-anak sekolah dasar mengenai tubuh mereka, batasan pribadi, serta pentingnya menjaga diri dari tindakan yang tidak pantas. Melalui metode penyuluhan interaktif berdasarkan data empiris yang diperoleh melalui kegiatan Kuliah Kerja Nyata (KKN) Tematik di Desa Wangunjaya kecamatan agrabinta kabupaten Cianjur, yang disesuaikan dengan tingkat perkembangan kognitif anak, kegiatan ini diharapkan mampu membentuk kesadaran sejak dini terhadap pentingnya perlindungan diri. Hasil evaluasi menunjukkan peningkatan pengetahuan dan sikap anak-anak terhadap isu-isu yang berkaitan dengan kesehatan reproduksi dan keamanan diri. Dengan pendekatan yang tepat dan dukungan dari orang tua serta guru, pendidikan seks dapat diberikan secara edukatif dan tidak tabu. Upaya ini penting sebagai bentuk pencegahan primer yang efektif demi menciptakan lingkungan yang aman dan sehat bagi anak-anak.

Abstract

ABSTRACT Adolescent mental health is becoming an increasingly pressing issue that requires serious attention, especially in the context of legal protection. This article discusses the importance of legal protection for adolescent mental health with a focus on the key role of effective communication within the family. Good communication between family members can be the first bulwark in maintaining adolescent mental health. In the context of legal protection, this article discusses various aspects, including adolescents' rights related to mental health, the importance of maintaining communication, and the role of the legal system in providing support for adolescents facing mental challenges. Through in-depth analysis, the article also highlights the implementation of policies and regulations that support the protection of adolescent mental health. The results suggest that strong legal protections can serve as a foundation to promote a holistic approach to adolescent mental health, with effective communication within the family as a key element in such protection efforts. It is hoped that this article will provide further insights into how communication within the family can support legal protections for adolescent mental health, as well as provide a basis for improving the system to better protect the rights and well-being of adolescents in the future ABSTRAK Masalah kesehatan mental remaja menjadi isu yang semakin mendesak dan memerlukan perhatian serius, terutama dalam konteks perlindungan hukum. Artikel ini membahas pentingnya perlindungan hukum terhadap kesehatan mental remaja dengan fokus pada peran kunci komunikasi efektif dalam keluarga. Komunikasi yang baik antar anggota keluarga dapat menjadi benteng pertama dalam menjaga kesehatan mental remaja. Dalam konteks perlindungan hukum, artikel ini membahas berbagai aspek, termasuk hak-hak remaja terkait kesehatan mental, pentingnya menjaga komunikasi, dan peran sistem hukum dalam memberikan dukungan bagi remaja yang menghadapi tantangan mental. Melalui analisis mendalam, artikel ini juga menjelaskan implementasi kebijakan dan regulasi yang mendukung upaya perlindungan kesehatan mental remaja. Hasilnya menunjukkan bahwa perlindungan hukum yang kuat dapat menjadi landasan untuk mendorong pendekatan holistik terhadap kesehatan mental remaja, dengan komunikasi efektif dalam keluarga sebagai elemen utama dalam upaya perlindungan tersebut. Artikel ini diharapkan dapat memberikan wawasan lebih lanjut tentang bagaimana komunikasi dalam keluarga dapat mendukung perlindungan hukum terhadap kesehatan mental remaja, serta memberikan dasar bagi perbaikan sistem yang lebih baik dalam melindungi hak dan kesejahteraan remaja di masa mendatang. Abstract

The development of corruption nowadays is accompanied by other crimes related to hide assets from corruption and one way of it is by money laundering mechanism. The mechanism of it is contained in the Criminal Code, Criminal Procedure Code, Law No. 20/2001 jo. Law No. 31/1999 concerning the Eradication of Corruption and Law No. 8/2010 concerning Prevention and Eradication of the Crime of Money Laundering. There are also international legal instruments adopted to strengthen efforts to seize assets from criminal acts of corruption, such as UNCAC which was ratified by the Government of Indonesia into Law Number 7/2006 concerning Ratification of the UNCAC on April 18, 2006. Indonesia needs a regulation that has stronger legal force and has a special mechanism regarding the mechanism for the confiscation of assets and assets that are suspected of being obtained as a result of corruption. It can be suggested to the Government and the legislature to encourage the discussion and passing of the asset confiscation bill’s immediately.
