Abstract

The purpose of this paper is to conduct a critical study of the application of the presumption of innocence to the perpetrators of criminal acts (suspects) investigated by the police. Implementation of the principle is important to study because the suspect must not be considered guilty before the criminal act is proven. A review of this case was carried out at the Kendal Police Department in mid-2019-2020. Writing texts are written with a normative-empirical approach. The non-doctrinal approach was chosen because it can clearly examine the application of the principle of presumption of innocence in more depth. Therefore, the author considers it necessary to carefully examine the application of these principles in the process of law enforcement at the police level. The results showed that the application of the principle of presumption of innocence in the Kendal Police Department was not optimal, because some of its applications were colored by threats and acts of violence. The suboptimal application of this principle is influenced by various factors, including the lack of legal knowledge of suspects and threats and acts of violence that are not reported. As we know the presumption of innocence is a fundamental principle in the criminal justice system, where a person must be positioned innocent before his guilt is proven in an honest and open trial.

Abstract

This research is motivated by the persistence of religious offenses, which serve as the state’s primary legal instrument for prosecuting acts of blasphemy. This situation raises fundamental conceptual issues regarding the definition and application of blasphemy as a criminal offense. The study aims to examine the historical development and transformation of blasphemy offenses within Indonesia’s legislative framework, from the colonial period to the modern era. The enforcement of blasphemy laws in practice has drawn substantial criticism, particularly concerning potential violations of human rights and freedom of religion. The findings indicate that religious offenses are regulated under the Supreme Court Circular Letter of 1964 and Law No. 1 of 1965 on the Prevention of Religious Deviations and the Maintenance of Religious Harmony. Blasphemy crimes are further codified in the Indonesian Criminal Code and Law No. 11 of 2008 on Electronic Information and Transactions. The concept of blasphemy in the Criminal Code establishes it as a core element of criminal liability, wherein religion is not merely incidental but a constitutive element of the offense itself. The protection of religious freedom is influenced by the plurality of definitions of religion, interpretations of human rights, and the evolving understanding of legal safeguards for fundamental freedoms. Abstract

Abstract

Akimeugah Basin is one of the basins with discovery status, however hydrocarbon production has not yet been established. One of potential petroleum play type for further investigation, estimated to contain hydrocarbon reserves in the offshore Akimeugah Basin, is the Mesozoic–Paleozoic sedimentary play, interpreted to have originated from the Australian passive margin. This study aims to analyze geological and geophysical data to delineate the sub-basin pattern and characterize petroleum system elements. The analysis integrates gravity data interpretation, geochemical evaluation of source rocks, and subsurface interpretation based on seismic and well data. Results indicate that source rocks in the Kola-1 well are primarily composed of Type III (gas-prone) and secondarily of Type II (oil/gas-prone) kerogen. Thermal maturity analysis shows that the Woniwogi, Aiduna, and Modio Formations have reached the oil window. Reservoir potential has been identified in the Tipuma Formation (Triassic), Aiduna Formation (Permian), and Modio Dolomite (Devonian–Silurian). Seal rocks consist of regional and intraformational units composed of tight siltstone and shale. Trapping mechanisms in this area include a combination of structural traps such as fault-bounded anticlines and stratigraphic traps represented by sub-unconformities. Identified exploration leads include seven within the Modio Dolomite structural play, six within the Permian Aiduna Sandstone play, and four within the Triassic Tipuma Sandstone play.

Abstract

This study examines how the sakinah family criteria, which include a peaceful and prosperous family, are achieved. Specifically, it examines whether families have a strong economic foundation to meet their needs and plan. It explores the shifting thoughts, behaviors, and investment strategies of urban residents who work as factory workers, private employees, teachers, and civil servants. The research focuses on the transition from a rural lifestyle, characterized by communal patterns like patembayan (a type of community based on shared bonds), gotong royong (cooperation), and strong kinship, to an urban one that prioritizes association and individualism. The research was conducted in the Bukit Beringin Timur residential area in Semarang City. The neighborhood’s location, surrounded by new industrial areas (Candi, Wijaya Kusuma, and Bukit Semarang Baru), reinforces this trend of individualism. The researchers employed the Asset-Based Community Development (ABCD) method to help the community understand its internal conditions and the potential for change. It was discovered that the shift from seasonal and agricultural income to consistent monthly salaries has fundamentally changed the mindset and behavior of urban communities. This is also reflected in their investment habits. Previously, investments were primarily focused on physical assets, such as agricultural land, plantations, and expensive gold jewelry. Now, residents are shifting to more accessible and affordable options, such as savings accounts, deposits, and gold bars, which can be paid in instalments. These new investments are primarily aimed at preparing for old age and retirement, rather than accumulating assets to be passed down to future generations.
