Abstract

This article delves into and elucidates the framework of Qodri Azizy's Islamic legal thought as a prominent Muslim intellectual in Indonesia. His contemplations on eclecticism are deemed crucial in the context of national legal development, emerging from specific situations and contexts. The analysis employs normative and hermeneutical approaches, encompassing significant works such as "Ikhtilaf in Islamic Law" and "Reformasi Bermazhab". The idea of eclecticism in Islamic law is understood through Fazlur Rahman's hermeneutics of the double movement. Qodri's thoughts are influenced by his educational environment in the United States, particularly regarding the concepts of ikhtilaf, madhhab, and talfiq. His critique of scholars who neglect the historical understanding of Islamic law results in a perception of legal opinions as unalterable dogma. Qodri asserts that legal opinions from past scholars result from a dialectical process and interaction of ideas, emphasizing their relative nature. In the modern context, Qodri's views remain relevant as he underscores that legal truth is relative, and a process of mutual enrichment (eclecticism) occurs, where seemingly strong opinions are supported by weaker ones.

Abstract

The purpose of this paper is to conduct a critical study of the application of the presumption of innocence to the perpetrators of criminal acts (suspects) investigated by the police. Implementation of the principle is important to study because the suspect must not be considered guilty before the criminal act is proven. A review of this case was carried out at the Kendal Police Department in mid-2019-2020. Writing texts are written with a normative-empirical approach. The non-doctrinal approach was chosen because it can clearly examine the application of the principle of presumption of innocence in more depth. Therefore, the author considers it necessary to carefully examine the application of these principles in the process of law enforcement at the police level. The results showed that the application of the principle of presumption of innocence in the Kendal Police Department was not optimal, because some of its applications were colored by threats and acts of violence. The suboptimal application of this principle is influenced by various factors, including the lack of legal knowledge of suspects and threats and acts of violence that are not reported. As we know the presumption of innocence is a fundamental principle in the criminal justice system, where a person must be positioned innocent before his guilt is proven in an honest and open trial.

Abstract

This article explores the philosophical and constitutional foundations that form the basis for the development of economic law in Indonesia. As is known, Indonesian legal problems such as economic inequality, corruption, legal uncertainty, and complicated bureaucracy make it difficult for the Indonesian economy to develop. Laws that should have been engineered for development capital did not go according to plan. This article uses normative legal methods on legislative systematics. The approach in the paper uses a combination of legislative, philosophical and constitutional approaches. The research results show that the philosophical foundations of economic law in Indonesia are based on Pancasila, which functions to create stability, support development, uphold justice, and increase legal literacy. Economic law plays an important role in national development with the principles of faith, benefits, Pancasila democracy and social justice. The Indonesian Constitution emphasizes the principles of kinship and social justice in economic policy, although it is still challenged by capitalistic and socialistic tendencies. This is why it is important to integrate Pancasila values ​​to achieve sustainable and just development in Indonesia. Artikel ini mengeksplorasi dasar-dasar filosofis dan konstitusional yang menjadi dasar pengembangan hukum ekonomi di Indonesia. Seperti diketahui persoalan hukum Indonesia seperti ketimpangan ekonomi, korupsi, ketidakpastian hukum, hingga birokrasi berbelit membuat ekonomi Indonesia sulit berkembang. Hukum yang semestinya direkayasa untuk modal pembangunan tidak berjalan sesuai rencana. Adapun penelitian ini menggunakan metode hukum normatif pada sistematika perundang-undangan. Pendekatan dalam artikel menggunakan gabungan pendekatan perundang-undangan, filsafat dan konstitusional. Hasil penelitian menunjukkan bahwa dasar-dasar filosofis hukum ekonomi di Indonesia yang berlandaskan Pancasila, yang berfungsi untuk menciptakan stabilitas, mendukung pembangunan, menegakkan keadilan, dan meningkatkan literasi hukum. Hukum ekonomi berperan penting dalam pembangunan nasional dengan prinsip-prinsip keimanan, manfaat, demokrasi Pancasila, dan keadilan sosial. Konstitusi Indonesia menekankan prinsip kekeluargaan dan keadilan sosial dalam kebijakan ekonomi, meskipun masih tantangan dari kecenderungan paham kapitalistik dan sosialistik. Dari sini penting adanya integrasi nilai-nilai Pancasila untuk mencapai pembangunan berkelanjutan dan berkeadilan di Indonesia

Abstract

This research is motivated by the persistence of religious offenses, which serve as the state’s primary legal instrument for prosecuting acts of blasphemy. This situation raises fundamental conceptual issues regarding the definition and application of blasphemy as a criminal offense. The study aims to examine the historical development and transformation of blasphemy offenses within Indonesia’s legislative framework, from the colonial period to the modern era. The enforcement of blasphemy laws in practice has drawn substantial criticism, particularly concerning potential violations of human rights and freedom of religion. The findings indicate that religious offenses are regulated under the Supreme Court Circular Letter of 1964 and Law No. 1 of 1965 on the Prevention of Religious Deviations and the Maintenance of Religious Harmony. Blasphemy crimes are further codified in the Indonesian Criminal Code and Law No. 11 of 2008 on Electronic Information and Transactions. The concept of blasphemy in the Criminal Code establishes it as a core element of criminal liability, wherein religion is not merely incidental but a constitutive element of the offense itself. The protection of religious freedom is influenced by the plurality of definitions of religion, interpretations of human rights, and the evolving understanding of legal safeguards for fundamental freedoms. Penelitian ini dilatarbelakangi oleh keberlanjutan pengaturan tindak pidana agama yang berfungsi sebagai instrumen hukum utama negara dalam menuntut pelaku penodaan agama. Kondisi ini menimbulkan persoalan konseptual mendasar mengenai definisi dan penerapan penodaan agama sebagai tindak pidana. Studi ini bertujuan untuk menelusuri perkembangan historis dan transformasi pengaturan tindak pidana penodaan agama dalam kerangka legislasi Indonesia, mulai dari masa kolonial hingga era modern. Penerapan hukum penodaan agama dalam praktiknya banyak menuai kritik, terutama terkait potensi pelanggaran hak asasi manusia dan kebebasan beragama. Hasil penelitian menunjukkan bahwa tindak pidana agama diatur dalam Surat Edaran Mahkamah Agung Tahun 1964 dan Undang-Undang Nomor 1 Tahun 1965 tentang Pencegahan Penyalahgunaan dan/atau Penodaan Agama serta Pemeliharaan Kerukunan Hidup Antar Uat Beragama. Selain itu, tindak pidana penodaan agama juga dikodifikasikan dalam Kitab Undang-Undang Hukum Pidana (KUHP) dan Undang-Undang No. 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik. Konsep penodaan agama dalam KUHP menempatkan agama bukan sekadar unsur tambahan, tetapi sebagai elemen konstitusi dari tindak pidana itu sendiri. Perlindungan terhadap kebebasan beragama dipengaruhi oleh keragaman definisi agama, interpretasi hak asasi manusia, serta pemahaman yang terus berkembang terhadap jaminan hukum bagi kebebasan fundamental.
