Abstract

The use of information technology transforms government activities with the aim of increasing the effectiveness and efficiency of government administration which has an impact on the quality of service. One of the innovations from the Ministry of Communication is SiCantik Cloud, a smart application for integrated public cloud-based licensing services that can be used by government agencies independently. The Gresik Regency Investment and Integrated One-Stop Service Office (DPMPTSP) is currently implementing the SiCantik Cloud application in licensing services. This study aims to evaluate the implementation of the SiCantik Cloud application based on the Regulation of the Minister of State Apparatus Empowerment and Bureaucratic Reform Number 15 of 2014. The determination of informants using the purposive sampling method totaling 6 informants consisting of DPMPTSP employees) Gresik Regency and the community as users of the SiCantik application. Based on data from findings in the field, the implementation of the SiCantik Cloud application in Gresik Regency has been able to provide a positive impact on services that can increase the issuance of business permit documents every year. The features in the Sicantik application are considered simple and easy enough for the public to understand, although there are still people who do not fully understand how to operate the Sicantik application. The results of the evaluation by researchers based on the indicators of Requirements, Systems, mechanisms and procedures, Service period, Costs, Service products, and Complaint handling are considered to be in accordance with the SOP stated in the Gresik Regent Regulation Number 94 of 2021 concerning the Implementation of Business Licensing and Non-Licensing Services in Gresik Regency and are very helpful in terms of services that are easy and fast. Abstract

This research discusses the Legal Protection for Trademark Rights Holders for Similarities in Principal Based on Law Number 20 of 2016 concerning Trademarks and Geographical Indications in Supreme Court Decision No. 796 K/Pdt.Sus-Hki/2023 with Linda Anggraeningsih and Muhammad Shakeel as the Plaintiff and Defendant Parties and the legal consequences of the decision for the parties. The purpose of this research is to analyze whether the parties have received legal protection as trademark rights holders and also the legal consequences arising from the Supreme Court's decision. This research uses a normative juridical research approach method that relies on secondary data obtained through literature studies with qualitative normative methods. The results of research and discussion in this study can be concluded that Linda Anggraeningsih has not received legal protection for her Trademark Rights because the lawsuit she won in the Commercial Court was canceled by the Cassation Decision. Supreme Court Decision Number 796 K/Pdt.Sus-HKI/2023 canceled Decision Number 3/Pdt.Sus-Merek/2023/PN.Niaga.Jkt.Pst which results in Umamascarves Trademark is still entitled to produce and market its products because it remains validly registered in PDKI so that it gets legal protection for its trademark.

Abstract

Trade globalization has made trade mark becomes very important, especially in relation to a fair business competition. A trade mark is a sign that functions as a distinguished from those of others, quality guarantee and source of origin.  Owner of a trade mark registered reserves exclusive right to use that trade mark for a period of time or may grant permission to other parties to use the trade mark.  Permission to other parties should be given through a letter of agreement for permission to use (not transfer of ownership) that trade mark for a certain period of time, and this is accordingly called licence.  Registration of a trade mark in the general list of trade mark can be cancelled upon request with an argument that the trade mark has a basic similarity with a previously registered trade mark, or the registration was made for cruel intention.  This paper discusses licence and cancellation of a trademark, as well as the consequences of trade mark cancellation for the licensee. Cancellation of a trade mark registration results in termination of a trade mark license agreement, but the licensee may reserve his right until the completion of agreement period.Key words : exclusive right, license agreement, licensee

Abstract

Katarak merupakan penyebab utama kebutaan di Indonesia, namun proses diagnosis yang masih manual di rumah sakit menyebabkan deteksi dini menjadi lambat dan tidak efisien. Penelitian ini bertujuan mengembangkan sistem deteksi katarak berbasis website dengan metode Convolutional Neural Network (CNN) di Rumah Sakit Mata Pasuruan. Sistem ini dirancang untuk mengklasifikasikan citra mata menjadi dua kelas, yaitu normal dan katarak, dengan menggunakan model CNN yang dilatih pada dataset berisi 512 citra. Model CNN dibangun dengan arsitektur tiga convolutional layers, max pooling, dan dense layer dengan fungsi aktivasi ReLU dan sigmoid, serta diintegrasikan melalui backend berbasis Flask dan layanan ngrok untuk koneksi dengan model yang berjalan di Google Colab. Evaluasi dilakukan menggunakan data validasi sebesar 20% dari dataset dengan hasil akurasi 97%, precision 1.00, recall 0.94 untuk kelas katarak, dan recall 1.00 untuk kelas normal. Sistem berhasil mendeteksi katarak secara otomatis dengan hasil akurat dan antarmuka ramah pengguna, serta mendukung layanan diagnosis awal di rumah sakit dengan lebih cepat dan efisien.
