Abstract

The strong correlation between crime and social interaction is implicitly reflected in the Criminal Code (KUH Pidana), which states that crime is essentially rooted in social interaction. And when that interaction causes harm to another party, a crime occurs. This is the premise that describes how the correlation between crime and social interaction is established. When a harmful act is regulated by criminal law, it is no longer categorized as merely a crime but becomes a criminal offense. This definition defines the act as behavior that, at a given time and within a given cultural context, is considered intolerable and must be corrected through the use of legal means. The author's background in formulating the problem in this research is:How is the capability of Correctional Institutions in Preventing Recidivism in Class IIA Langkat Narcotics Prison in an effort to prevent the phenomenon of repeated criminal acts? This research is a normative-empirical research with a live-case study category based on empirical observations of the implementation of provisions of correctional laws and regulations in Class II A Langkat Narcotics Prison to evaluate the effectiveness of the guidance of inmates in it related to efforts to prevent repeated criminal acts (recidive). He acknowledged that repeat offenders in the Class IIA Langkat Narcotics Prison experience annual recidivism. Therefore, he believes recidivism in his area is a common occurrence, as crime, which is a part of society, also accompanies crime. Where there is society, there is law; where there is law, there is crime; and where there is crime, there is recidivism. Therefore, the goal of rehabilitation is not to eliminate recidivism but to minimize it. To prevent character-based recidivism, the Class II A Langkat Narcotics Prison collaborates with Islamic, Christian, Hindu, and Buddhist religious leaders to provide regular spiritual guidance. This ensures that mental and spiritual development activities can benefit inmates.

Abstract

The ethnic Rohingya, a majority Muslim group living in the state of Rakhine, Myanmar, have been subjected to discrimination and violence forcing them to flee their country of origin. This crisis has led many Rohingya to seek refuge in neighbouring countries, including Indonesia. The city of Medan, as one of the metropolitan centers in North Sumatra, has become a shelter for Rohingya refugees. Immigration Detention Center (IDC) Medan, as a unit under the Immigration Directorate-General, plays a crucial role in dealing with these refugees. The study aims to find out the role of Immigration Detention Center (IDC) Medan in dealing with the Rohingya refugee problem and to analyze coordination and collaboration between Immigration Detention Center (IDC) Medan and the relevant parties. Using a qualitative approach, data is collected through in-depth interviews, participatory observations, and document analysis. The results of the research show that Immigration Detention Center (IDC) Medan is performs surveillance and administration in accordance with Presidential Regulation No. 125 of 2016. Immigration Detention Center (IDC) Medan is working intensively with various international organizations, government agencies, and non-governmental organizations to ensure effective and humane handling. This cooperation covers the relocation, protection, and provision of basic services to refugees. The study emphasizes the importance of coordination and collaboration to improve the effectiveness of the treatment of Rohingya refugees in the field. An integrated and collaborative approach is key to addressing challenges and providing adequate protection for refugees.

Abstract

supervising public policies, particularly in the context of preventing corruption in village funds. Village funds are a source of development financing that are vulnerable to misuse if not monitored transparently and participatively. Mothers, as part of an active community element that is close to the social dynamics of the village, have great potential to encourage accountability and openness in the management of village funds. This research uses a qualitative approach with in-depth interviews, participatory observation, and documentation studies. The results show that the involvement of women in village deliberation forums, budget socialization activities, and monitoring of physical projects contributes significantly to reducing the potential for corruption practices. Additionally, their role in building collective awareness and having the courage to voice alleged irregularities is an important asset in shaping an anti-corruption culture at the village level. However, challenges remain, such as limited access to information, budget literacy capacity, and resistance from certain individuals. Therefore, capacity building and institutional support are key to strengthening the role of women as public oversight agents at the village level.

Abstract

Kegiatan pengabdian kepada masyarakat ini bertujuan untuk mengimplementasikan Digital Integrated Marketing Communication (DIMC) sebagai upaya mendukung program inklusi keuangan berkelanjutan di PT Pegadaian Kota Medan. Kegiatan dilaksanakan melalui pendekatan pemberdayaan masyarakat yang meliputi penyuluhan, pelatihan, diskusi interaktif, dan pendampingan mengenai pemanfaatan media digital sebagai sarana komunikasi dan edukasi keuangan. Implementasi DIMC dilakukan dengan mengoptimalkan berbagai kanal digital, seperti media sosial, website, aplikasi digital, dan platform komunikasi lainnya untuk menyampaikan informasi mengenai produk dan layanan keuangan secara edukatif, komunikatif, dan mudah dipahami. Hasil kegiatan menunjukkan adanya peningkatan pemahaman peserta mengenai konsep literasi dan inklusi keuangan, serta meningkatnya kemampuan dalam memanfaatkan media digital sebagai sarana penyebaran informasi dan edukasi kepada masyarakat. Selain itu, peserta memahami pentingnya penyampaian pesan yang terintegrasi, konsisten, dan berorientasi pada kebutuhan masyarakat dalam membangun kepercayaan terhadap layanan keuangan formal. Meskipun masih ditemukan beberapa kendala, seperti perbedaan tingkat literasi digital dan keterbatasan kemampuan dalam mengembangkan konten digital, kegiatan pendampingan mampu meningkatkan pengetahuan dan keterampilan peserta dalam menerapkan strategi komunikasi digital secara lebih efektif. Dengan demikian, implementasi Digital Integrated Marketing Communication di PT Pegadaian Kota Medan dapat menjadi salah satu strategi yang efektif dalam mendukung program inklusi keuangan berkelanjutan melalui peningkatan literasi keuangan, perluasan akses informasi, dan penguatan pemanfaatan layanan keuangan formal oleh masyarakat.

Abstract

Perkembangan teknologi informasi selama lima tahun terakhir telah menyebabkan peningkatan penggunaan media sosial sebagai sarana penyebaran informasi yang cepat dan luas. Namun, perkembangan ini juga menghadirkan tantangan serius di bidang hukum pidana, salah satunya berkaitan dengan tindak pidana pencemaran nama baik melalui media elektronik. Penelitian ini bertujuan untuk menganalisis ketentuan hukum tentang tindak pidana pencemaran nama baik melalui media sosial berdasarkan hukum dan peraturan Indonesia, dan untuk mengevaluasi tanggung jawab pidana pelaku yang menyerang kehormatan anggota kepolisian sebagai pejabat publik. Metode penelitian yang digunakan adalah yuridis normatif, dengan pendekatan hukum perundang-undangan, pendekatan konseptual, dan tinjauan pustaka. Hasil penelitian menunjukkan bahwa ketentuan mengenai pencemaran nama baik digital diatur dalam Pasal 27 ayat (3) junto Pasal 45 ayat (3) UU ITE sebagai lex specialis yang melengkapi tindak pidana penghinaan dalam KUHP. Tanggung jawab pidana dapat dikenakan jika unsur niat, penyebaran konten elektronik, dan penghinaan terpenuhi. Studi ini menegaskan bahwa pencemaran nama baik digital adalah kejahatan dengan dampak luas dan dapat merusak kredibilitas petugas penegak hukum, sehingga memerlukan penegakan hukum yang efektif, proporsional, dan adil.

Abstract

The application of extraterritorial non-tariff barriers within the international trade framework, such as the European Union Deforestation Regulation (EUDR), gives rise to jurisdictional conflicts regarding the principle of permanent sovereignty over the natural resources of developing countries. Such unilateral policies have implications for the vulnerability of the protection of the constitutional rights of Indigenous Peoples (IP) within the governance of commodity supply chains at the domestic level. This study aims to analyse the alignment of a state’s economic sovereignty with global environmental standards through the fulfilment of IP customary rights. Using a normative legal research method with legislative, conceptual, and policy analysis approaches, this study finds that legal mitigation of international market regulations is inadequate if it relies solely on a formal compliance approach within the Indonesian Sustainable Palm Oil (ISPO) instrument and the National Dashboard system. Legal loopholes resulting from procedural obstacles to establishing MHA status in regions risk legalising land tenure that is legally flawed for the sake of meeting certification requirements. Harmonisation of the legal system requires the enactment of specific legislation (lex specialis) on MHA, the establishment of Free, Prior and Informed Consent (FPIC) as an absolute prerequisite for business licensing, and the integration of indigenous territory mapping into the national geospatial database. This legal framework serves as a guarantee of domestic rights certainty whilst also functioning as a legitimate strategic diplomatic instrument in countering environmental protection justifications used as barriers to global trade.

Abstract

This study examines the legal relationship between trade liberalization commitments within the framework of the World Trade Organization (WTO) and the right of developing countries to regulate. The expansion of the WTO’s scope into domestic jurisdictions has legal implications for the policy space of developing countries in the process of formulating national legislation, particularly in the sectors of public health and environmental protection. Using a doctrinal legal research methodology, this study examines general exceptions, Special and Differential Treatment (S&DT), and the jurisprudence of the Dispute Settlement Body (DSB). The research findings outline three key points. First, legal recognition of regulatory autonomy is subject to certain normative limitations. The necessity test and empirical standard of proof under the SPS and TBT Agreements create an imbalance in the burden of proof for developing countries, which has the potential to affect the sustainability of the national legislative process (regulatory chill). Second, the S&DT principle, formulated to accommodate differences in economic capacity, tends to be declaratory in its application. This results in limitations on the binding force of the instrument as a legal basis for defense in dispute resolution. Third, legal interpretations by dispute settlement bodies have direct legal consequences for domestic autonomy. Furthermore, administrative constraints at the Appellate Body level and the implementation of the Multi-Party Interim Appeal Arbitration Arrangement (MPIA) also affect the fulfillment of the principle of legal certainty at the appellate stage. This study concludes that the formulation of national legislation requires the fulfillment of a pre-formulation feasibility review (ex-ante assessment). Additionally, multilateral harmonization efforts are needed to fundamental legal justification.

Abstract

The case of PT Asuransi Jiwasraya (Persero) represents one of the largest financial scandals in the history of state-owned enterprises in Indonesia, illustrating the weak implementation of Good Corporate Governance (GCG) principles. The Board of Directors, as the governing organ of the company, plays a central role in corporate management and is required to perform its duties in accordance with the principles of transparency, accountability, responsibility, independence, and fairness. This study aims to analyze violations of GCG principles committed by the Board of Directors of PT Asuransi Jiwasraya (Persero) and their legal implications from a corporate law perspective. The research method employed is normative legal research using statutory and case approaches. The findings indicate that the Board of Directors of PT Asuransi Jiwasraya (Persero) committed serious violations of GCG principles through imprudent investment management, abuse of authority, and disregard for the prudential principle, resulting in substantial losses to the state. Therefore, law enforcement against the Board of Directors is essential as a form of protection for shareholder interests and public trust in state-owned enterprises.

Abstract

This research is motivated by the convergence of digital technology disruption, which gave birth to the phenomenon of “Uberization of Drug Trafficking,” and the national criminal law reform through the enactment of Law Number 1 of 2023 concerning the Criminal Code (National Criminal Code). This study aims to analyze the dynamics of narcotics trafficking crimes through mass media ranging from the surface web to the darknet within the new legal framework, as well as to identify potential impunity gaps due to the regulatory transition period. The research method used is normative juridical with statutory, conceptual, and comparative approaches, sourced from secondary data. The results indicate that the shift in the penal paradigm of the National Criminal Code from retributive to rehabilitative and restorative provides a sharp differentiation in handling between abusers and syndicates. However, the revocation of certain lex specialis provisions in the Narcotics Law potentially creates a legal vacuum (rechtsvacuum) regarding electronic transaction offenses if not anticipated with progressive legal interpretation, particularly through the construction of “intermediary tools” and corporate criminal liability. The complexity of modus operandi utilizing end-to-end encryption and cryptocurrency demands a reorientation of law enforcement strategies from conventional approaches towards a Smart Power approach that integrates digital forensics, Artificial Intelligence (AI), and solid international cooperation.

Abstract

The registration and classification of inmates constitute a fundamental initial stage in the administration of the correctional system, as they form the basis for placement decisions, security management, and individualized rehabilitation programs. Registration standards, as regulated through technical guidelines and administrative instruments within correctional units, are intended to ensure accurate data recording, risk identification, and the formulation of effective treatment and development programs. However, their implementation continues to face various challenges that affect the overall effectiveness of inmate classification. Empirical studies conducted across several correctional institutions indicate that limitations in human resources, infrastructure constraints, and insufficient training of assessment officers hinder the consistent application of registration standards in accordance with established guidelines. As a result, the objective of achieving appropriate inmate grouping and the optimal design of individualized correctional programs has not been uniformly realized. At the normative level, the enactment of Law Number 22 of 2022 concerning Corrections has renewed the legal framework previously governed by Law Number 12 of 1995. The new statute reinforces the principles of individualization, continuity, and the protection of inmates’ rights as integral components of a modern correctional system oriented toward rehabilitation and social reintegration. Although this updated legal framework strengthens the rights-based and evidence-based orientation of correctional administration, the technical regulation of registration and classification procedures remains largely dependent on guidelines issued by the Directorate General of Corrections. Consequently, further harmonization between statutory provisions and technical instruments is necessary to enhance legal certainty and operational effectiveness. These findings demonstrate that the effectiveness of registration standards in inmate classification is determined not solely by the quality of written regulations, but also by institutional capacity, administrative coherence, and the availability of adequate resources to ensure accurate and sustainable implementation.
