Abstract

The ethnic Rohingya, a majority Muslim group living in the state of Rakhine, Myanmar, have been subjected to discrimination and violence forcing them to flee their country of origin. This crisis has led many Rohingya to seek refuge in neighbouring countries, including Indonesia. The city of Medan, as one of the metropolitan centers in North Sumatra, has become a shelter for Rohingya refugees. Immigration Detention Center (IDC) Medan, as a unit under the Immigration Directorate-General, plays a crucial role in dealing with these refugees. The study aims to find out the role of Immigration Detention Center (IDC) Medan in dealing with the Rohingya refugee problem and to analyze coordination and collaboration between Immigration Detention Center (IDC) Medan and the relevant parties. Using a qualitative approach, data is collected through in-depth interviews, participatory observations, and document analysis. The results of the research show that Immigration Detention Center (IDC) Medan is performs surveillance and administration in accordance with Presidential Regulation No. 125 of 2016. Immigration Detention Center (IDC) Medan is working intensively with various international organizations, government agencies, and non-governmental organizations to ensure effective and humane handling. This cooperation covers the relocation, protection, and provision of basic services to refugees. The study emphasizes the importance of coordination and collaboration to improve the effectiveness of the treatment of Rohingya refugees in the field. An integrated and collaborative approach is key to addressing challenges and providing adequate protection for refugees.

Abstract

Traffic accidents remain a significant concern in Indonesia, particularly in Deli Serdang, where the number of cases continues to rise. This study examines the role of Deli Serdang Police investigators in handling traffic accident cases, focusing on their tasks, challenges, and efforts to ensure effective legal processes. The research highlights that investigators play a crucial role in conducting comprehensive investigations, gathering evidence, and determining legal accountability in each case. However, investigators face numerous obstacles, including limited resources, insufficient evidence, and environmental factors that complicate the investigative process. The study underscores the importance of collaboration between law enforcement and the community, as well as the need for enhanced investigator training and public education on traffic safety to mitigate accidents.

Abstract

Money laundering is a serious crime that threatens the economic and social systems, often involving sophisticated methods and multiple parties. This study analyzes the application of law in the Supreme Court decision Number: 559 PK/Pid.Sus/2022, which addresses the crime of continuous money laundering involving participation. The defendant, Gulabray Naraindas Keswani, was found guilty of continuous money laundering and sentenced to prison and a fine. Through an analysis of the legal considerations and application of legal principles such as inclusion (deelneming) and continuing acts (voortgezette handeling), this study highlights the judiciary's commitment to eradicating money laundering and its implications for law enforcement. This case sets a significant precedent for combating similar crimes in Indonesia.

Abstract

The Lubuk Pakam Police plays a critical role in maintaining public security, law enforcement, and handling criminal investigations based on community reports. This research examines the procedures implemented by the Lubuk Pakam Police Criminal Investigation Unit in conducting investigations and addresses the challenges faced during the process. The study highlights the investigative steps starting from receiving reports, evidence collection, and crime scene visits to determine the criminal nature of reported incidents. It also identifies obstacles, including insufficient evidence, limited resources, and legal complexities, that impact effective law enforcement. This analysis aims to provide insights into improving investigative efficiency and strengthening the role of police in public service.

Abstract

This study examines the role of the Traffic Police in enforcing Law Number 22 of 2009 concerning Traffic and Road Transportation in the jurisdiction of the Deli Serdang Police. The significant growth in vehicle volume in Deli Serdang, which directly borders the city of Medan, has caused complex traffic problems such as congestion, traffic violations, and accidents. This study aims to analyze the role of the Deli Serdang Police Traffic Police in enforcing traffic laws and identify the obstacles faced. Data were obtained through a case study at the Deli Serdang Police using qualitative methods, including interviews with Traffic Police officers and field observations. The results of the study indicate that the Deli Serdang Police Traffic Police have implemented various law enforcement efforts, both preventive and repressive, but face several obstacles such as limited personnel, facilities and infrastructure, and low public awareness in complying with traffic rules. This study recommends increasing the capacity of the Traffic Police, providing adequate facilities and infrastructure, and intensifying socialization and education to the public to increase the effectiveness of traffic law enforcement in Deli Serdang.

Abstract

General elections are a fundamental pillar of democracy, ensuring the sovereignty of the people through fair and honest electoral processes. The integrity of vote recapitulation is crucial for democratic elections, yet it remains susceptible to fraud and manipulation, undermining public trust and electoral legitimacy. This study examines the application of material criminal law and judicial considerations in Decision Number 523/Pid.Sus/2019/PN.Ckr, a case involving negligence resulting in alterations to vote recapitulation minutes. The research highlights the legal framework, including the sanctions under Law Number 7 of 2017, and explores the challenges in law enforcement due to the complexities of election crimes. Through analysis of the case, the study emphasizes the importance of accountability and consistent enforcement to safeguard electoral integrity and deter future violations.

Abstract

Children as a vulnerable group face unique challenges in the justice system, both as perpetrators and victims of criminal acts. Addressing children involved in criminal offenses requires a balanced approach that prioritizes restorative justice over repressive measures to ensure their development and rehabilitation. This study examines the role of investigators in implementing diversion—a key aspect of restorative justice—at the Deli Serdang Police Station. It explores how diversion helps prevent stigmatization and reduces the negative impact of the judicial process on children. Additionally, the study identifies obstacles encountered by investigators during the implementation of diversion, including institutional and procedural challenges. The findings aim to enhance understanding of the critical role of law enforcement in protecting children’s rights and achieving effective justice.

Abstract

The development of the Industrial Revolution 4.0 has brought significant changes in the business world, especially in the digital startup sector. In this context, human resources (HR) are the key elements that determine the success of entrepreneurship. This study aims to analyze the role of human resources in encouraging the success of entrepreneurship in digital startups in Medan City. The approach used is quantitative descriptive with data collection through questionnaires distributed to digital startup actors. Data analysis was carried out using linear regression techniques to test the influence of human resource competencies on business success. The results show that human resource competencies that include innovation skills, mastery of digital technology, adaptive flexibility, and team collaboration have a significant influence on the success of startups. These findings confirm that in the era of the Industrial Revolution 4.0, strengthening the quality and capacity of human resources is a crucial strategy for the growth and sustainability of digital startups. This research provides practical contributions for business actors and local governments in building a digital entrepreneurship ecosystem based on the development of superior human resources.

Abstract

Demographic shifts in higher education have led to an increase in the number of students under 18, triggering uncertainty about their legal status and the urgency of special protections. This normative legal research comparatively analyzes the regulatory frameworks and institutional mechanisms for student protection in Indonesia and Malaysia. Through a legislative and comparative approach, the study finds divergences in the characteristics of protection. Indonesia implements a structural-administrative model through the PPK Task Force based on Ministerial Regulation No. 55 of 2024, which prioritizes internal prevention and broad coverage, but is hampered by structural independence. In contrast, Malaysia adopts a remedial-legalistic model through the Anti-Sexual Harassment Tribunal Act 2022, which offers executive certainty and independence, but is materially limited to sexual offenses and is reactive in nature. The research concludes that both jurisdictions need to harmonize towards a hybrid model. Indonesia is recommended to establish an external oversight mechanism to mitigate conflicts of interest, while Malaysia needs to integrate a mandatory prevention curriculum and expand protections against bullying. The direction of legal policy is expected to shift from rigid age limits to vulnerability-based protection that is responsive to power relations in the academic environment.
