Abstract

The principles of al-tawābi’, al-aṣhl wa al-fara’ and al-aṣhl wa al-badal in the book al-asybah wa al-nadhair are non-fundamental universal principles that are not limited to partial forms. These principles are closely related to one another, but differ in their main points in context. This study aims to describe and apply the principles of al-tawābi', al-aṣhl wa al-fara', and al-aṣhl wa al-badal and their branches to issues of Islamic family law. This study is normative or library research with a qualitative approach using descriptive analysis methods. The results of the study conclude that the application of the al-tawābi' principle includes the validity of the dowry following the validity of the marriage contract, the rights of children such as lineage, inheritance, and maintenance from their father following the validity of their parents' marriage, and the prohibition of marrying the wife's relatives such as brothers, mothers, daughters, aunts, and grandmothers. Meanwhile, the application of the principle of al-aṣhl wa al-fara’ is that the validity of the marriage guardian determines the validity of the marriage contract, murder and non-Muslims become obstacles for heirs to obtain inheritance, and the existence/absence of rights and obligations attached to husband and wife is determined by the status of the marriage bond. The application of the principle of al-aṣhl wa al-badal is that a wife's request for divorce from her husband through khulu' must be replaced with the payment of 'iwadh (ransom/compensation), the guardian judge becomes a substitute for the absence/excuse of the blood guardian in the marriage contract, and the person entitled to bear the responsibility of providing for the family if the husband is unable to provide for his children and wife due to serious illness, then the responsibility shifts to the husband's family.

Abstract

Bank interest or usury is simply interpreted as an expression of remuneration for the use of money lent or the use of funds. Communities who need funds for business will provide remuneration to banks that have provided loans in the form of credit for additional business capital, investment and working capital in trade. The aims of this study are: 1) To find out the determination of interest rates at BPR Jember branches. and 2). Knowing the perspective of Islamic economic law on the determination of interest rates at the East Java BPR Jember branch. Research method The type of research used by researchers is empirical research, namely where the empirical legal research method originates from facts quoted directly from the words and behavior levels of research informants, by conducting interviews while conducting direct observation of research locations. This empirical research is used to directly identify the informants and retrieve data from the results of their research directly and in the form of direct documentation as data to strengthen the results of the research. The purpose of this research is to study in depth about the determination of interest rates at the Madani Blooms National Capital Bank in Panti Jember District. Then from the results of this study, there are conclusions from researchers regarding the determination of interest rates in BPR Jember.

Abstract

The purpose of this study is to explore how EFL students perceive the role of lyrics in song-based listening activities. Students’ perceptions of the use of lyrics during listening practice were investigated using a qualitative descriptive research approach. Five university students who had experience listening to English songs with lyrics were intentionally selected as participants. This study concentrated on their authentic listening practices rather than using an intervention-based design. Semi-structured interviews, documentation, and observation were used to gather data. Miles and Huberman’s interactive qualitative analysis model, which incorporates data reduction, data display, and conclusion drafting, was used to examine the data. The results show that during listening exercises, participants described lyrics as visual aids that helped them follow spoken input, identify words, and comprehend song meaning. Additionally, participants reported that listening was more comfortable and engaging when lyrics were present. However, some participants reported difficulty comprehending both audio and lyrics simultaneously, particularly in songs with fast-paced sections or unfamiliar terminology. Overall, students view lyrics as a supportive component of their listening experiences. This study is limited by the small sample size, which may limit the generalizability of the findings. Despite this limitation, the results indicate that incorporating lyrics into song-based listening activities can support students’ comprehension and motivation, particularly in informal learning contexts. Future research is therefore recommended to include larger samples and examine additional variables, such as proficiency levels and song genres, to gain a deeper understanding of the role of lyrics in EFL listening development.

Abstract

Vocabulary mastery is a fundamental challenge for young learners, particularly in Islamic elementary school environments where traditional textbook-based methods often lead to passive engagement and limited memory retention. This study aims to explore the implementation of the Duolingo application in supporting English vocabulary learning and to identify the specific learning activities facilitated by the platform. Using a qualitative descriptive research design, the study involved 26 fifth-grade students at MI Khilafiyah Syafi'iyah Zainul Hasan Genggong. Data were collected through classroom observations and semi-structured interviews with the teacher and students. The results reveal that Duolingo was successfully implemented through projector-based guided instruction, fostering a dynamic and enthusiastic classroom atmosphere. Six main types of vocabulary activities were identified: matching images, listening exercises, repetition, meaning recognition, vocabulary matching, and completing sentences. These activities utilized multimedia and gamification elements to enhance students' cognitive engagement and confidence. The study concludes that Duolingo serves as an effective pedagogical tool to overcome attention span limitations and strengthen long-term memory through sensory-based repetition. For practitioners, integrating such digital media collectively is recommended to facilitate social interaction and meaningful learning experiences. Abstract

This study investigates how EFL students use English podcasts and their perceptions of the impact of using podcasts in developing their listening skills. By using a qualitative descriptive approach, data were collected through semi-structured interviews, observations, and documentation with five students of the English Education Department at Zainul Hasan Genggong Islamic university, Probolinggo. The findings reveal that students used English podcasts as a flexible learning medium to practice listening anytime and anywhere. Students engaged in several listening activities, such as replaying the audio, focusing on difficult parts, and selecting podcast topics based on their interests. Students viewed English podcasts as an effective learning medium to support listening practice, increase motivation, and help them become more familiar with spoken English. The benefits of using English podcasts include improving listening comprehension, increasing learning motivation, providing opportunities for repeated listening practice, and helping students become more accustomed to authentic English pronunciation and expressions. Thus, it can be concluded that English podcasts serve as an effective medium to support the development of EFL students’ listening skills through exposure to authentic spoken English. Abstract

Although speaking is a crucial skill for English as a Foreign Language (EFL) learners, students often have limited opportunities to practice it in classroom settings. While previous studies have highlighted the potential of Mobile-Assisted Language Learning (MALL), few have examined how specific applications such as Beelinguapp support speaking practices in real classroom contexts, particularly in low exposure environments. This study aims to explore students’ speaking practices using the Beelinguapp application in an Islamic Senior High School. A qualitative case study was conducted involving 20 eleventh-grade students, with three students and one English teacher selected through purposive sampling for in-depth interviews. Data were collected through one classroom observation and semi-structured interviews. The findings show that students practiced speaking through listening, repetition, and story retelling. The application supported pronunciation, vocabulary development, and engagement, although challenges such as limited vocabulary and exposure remained.

Abstract

This study aims to examine the role of cooperative learning groups in reducing speaking anxiety among EFL students at SMPN 2 Gading. This study employed a qualitative descriptive research design involving 18 ninth-grade students selected through purposive sampling. Data were collected through classroom observations, questionnaires, and documentation during three cooperative learning sessions. Data were analysed using thematic analysis based on the Miles and Huberman model, which includes data reduction, data presentation, and drawing conclusions. The findings indicate that students initially experienced high levels of speaking anxiety, characterized by hesitation, low self-confidence, and fear of negative judgment. However, after participating in cooperative learning groups, students became more comfortable, active, and confident in speaking. The main factors contributing to the reduction in anxiety included peer support, sharing opinions, emotional comfort, frequent speaking practice, and shared responsibility. This study concludes that cooperative learning is an effective pedagogical strategy for reducing speaking anxiety and creating a supportive learning environment in English as a Foreign Language (EFL) classroom.

Abstract

Listening is a significant skill in English as a Foreign Language (EFL) instruction, especially in low-exposure settings where students have limited contact with English outside the classroom. However, many students struggle and demonstrate low motivation as a result of monotonous teaching approaches and a lack of engaging activities. Previous research has mostly focused on learning outcomes rather than students' perceptions of enjoyable listening activities. Furthermore, little research has explored students' perceptions in low-exposure settings. As a result, the purpose of this study is to investigate students' perceptions and determine the types of listening activities they enjoy the most. This study used a qualitative case study approach with students from MTs. Zainul Irsyad. Data were obtained through classroom observations, interviews, and documentation, and were analyzed using data reduction, data display, and conclusion drawing techniques. The findings show that while students initially have negative perceptions, they respond positively to participatory activities such as songs, videos, and group discussions. Finally, enjoyable and interactive activities increase students' interest and motivation in learning through listening.

Abstract

The amendment of the Marriage Law through Law Number 16 of 2019, which raised the minimum marriageable age to 19 years, has created a legal paradox in Indonesia. Despite stricter regulations intended to prevent child marriage, requests for marriage dispensation in Religious Courts have significantly increased. This study analyzes the judicial reasoning behind these grants using a qualitative document study and a descriptive-normative approach, specifically focusing on the Probolinggo Religious Court Decree No. 210/Pdt.P/2025/Pa.Probolinggo. The findings indicate that judges often grant dispensations based on the Islamic legal maxim akhaff al-dararain (choosing the lesser of two evils) to prevent perceived social harms such as premarital intimacy or pregnancy. However, from the perspective of Maqasid al-Syari’ah and children’s rights, this study critiques the dominance of short-term welfare considerations over long-term vulnerabilities. The results suggest that current judicial practices often neglect the child's rights to education (hifz al-’aql), reproductive health (hifz al-nafs), and economic stability. The study concludes that a transformation in the judicial approach is necessary, moving from a formal-administrative "rubber stamp" process to an integrative model involving cross-sectoral collaboration with health and psychological experts to ensure the "best interest of the child." [Perubahan Undang-Undang Perkawinan melalui Undang-Undang Nomor 16 Tahun 2019 yang menaikkan batas usia minimum perkawinan menjadi 19 tahun telah melahirkan suatu paradoks hukum di Indonesia. Di tengah pengetatan regulasi yang bertujuan untuk mencegah perkawinan anak, permohonan dispensasi kawin di Pengadilan Agama justru mengalami peningkatan yang signifikan. Penelitian ini bertujuan untuk menganalisis pertimbangan hukum hakim dalam mengabulkan permohonan dispensasi kawin dengan menggunakan metode studi dokumen kualitatif dan pendekatan deskriptif-normatif, dengan fokus pada Penetapan Pengadilan Agama Probolinggo Nomor 210/Pdt.P/2025/PA.Probolinggo. Hasil penelitian menunjukkan bahwa hakim kerap mengabulkan dispensasi kawin dengan mendasarkan pertimbangannya pada kaidah fikih akhaff al-dararain (memilih mudarat yang lebih ringan) guna mencegah kemudaratan sosial yang dipersepsikan, seperti kedekatan hubungan antara laki-laki dan perempuan di luar perkawinan maupun kehamilan di luar nikah. Namun demikian, ditinjau dari perspektif Maqashid al-Syari’ah dan hak-hak anak, penelitian ini mengkritisi dominannya pertimbangan kemaslahatan jangka pendek dibandingkan dengan kerentanan jangka panjang yang berpotensi dialami oleh anak. Temuan penelitian mengindikasikan bahwa praktik peradilan yang berlangsung saat ini sering kali mengabaikan hak anak atas pendidikan (hifz al-‘aql), kesehatan reproduksi (hifz al-nafs), dan stabilitas ekonomi di masa depan. Penelitian ini menyimpulkan bahwa diperlukan transformasi dalam pendekatan peradilan, dari sekadar proses formal-administratif yang bersifat rubber stamp menuju model yang lebih integratif melalui kolaborasi lintas sektor dengan tenaga kesehatan dan psikolog, guna menjamin terpenuhinya prinsip kepentingan terbaik bagi anak (the best interest of the child).]
