Abstract

Progam Pengabdian kepada masyarakat ini yakni Pemberdayaan Kemitraan Masyarakat (PKM) : Pengelolaan Sampah Berkelanjutan Dalam Mendukung Sustainable Development Goals (SDGs) bertujuan untuk menerapkan sistem pengelolaan dan manajemen sampah berkelanjutan berbasis teknologi tepat guna di Desa Kaboro, Kecamatan Lambitu, Kota Bima. Melalui pendekatan partisipatif, kegiatan ini melibatkan mitra sasaran yang terdiri atas Badan usaha Milik Desa (BUMDES) dan Pemerintahan Desa Kaboro dalam proses edukasi, perancangan, dan implementasi alat pengelola sampah, seperti mesin pencacah dan tungku pemanas plastik sebagai bentuk pengelolaan sampah berkelanjutan. Hasil kegiatan menunjukkan peningkatan kesadaran masyarakat terhadap pentingnya pengelolaan sampah, serta kemampuan warga dalam mengoperasikan alat secara mandiri setelah pelatihan. Program ini berkontribusi pada pemberdayaan komunitas, dan pencapaian Tujuan Pembangunan Berkelanjutan (TPB/SDGs) di tingkat lokal. Kegiatan ini juga menunjukkan bahwa integrasi teknologi sederhana dengan kearifan lokal dapat menjadi solusi nyata dalam pengelolaan sampah plastik.

Abstract

Meaningful participation has emerged as a central normative requirement in modern constitutional democracies, emphasizing that public involvement in lawmaking must extend beyond procedural formality to exert substantive influence on both legislative processes and outcomes. This study aims to examine the conceptual foundations, normative framework, and practical implementation of meaningful participation in the formation of laws in Indonesia. Employing a juridical-normative research design reinforced by empirical case analysis, the study analyzes statutory regulations, constitutional principles, and landmark decisions of the Constitutional Court, particularly those addressing legislative openness and public participation. The research further incorporates policy analysis and limited empirical observations to assess how participatory mechanisms function in practice. The findings demonstrate that although Indonesian positive law formally recognizes public participation, its implementation remains largely procedural and symbolic. Significant gaps persist between normative standards and legislative practices, including restricted access to draft laws, inadequate deliberation periods, limited representativeness of affected groups, and the absence of institutionalized feedback mechanisms. The study confirms that meaningful participation, as articulated in legal doctrine and Constitutional Court jurisprudence, consists of three core elements: the right to be heard, the right to have opinions genuinely considered, and the right to receive reasoned explanations. However, structural weaknesses, political dominance, and technical limitations continue to undermine these standards. To address these challenges, the study proposes an operational framework for meaningful participation encompassing access and inclusiveness, transparency of information, substantive influence, deliberative quality, and accountability through feedback mechanisms.

Abstract

In Indonesia, such standards are formally regulated under Law Number 17 of 2003 on State Finance, which functions as the foundational legal framework for the administration of public finances at both central and regional levels. This study aims to examine and analyze the general principles of state and regional financial management as normatively formulated in Law No. 17 of 2003, as well as to assess their implementation from a legal perspective. The research adopts a normative juridical method, employing statutory and conceptual approaches to interpret legal norms and doctrines relevant to state finance law. The analysis relies exclusively on secondary legal materials, including legislation, scholarly writings, and academic studies on public financial governance. The findings indicate that Law No. 17 of 2003 establishes a coherent and comprehensive normative structure consistent with the principles of good financial governance, particularly accountability and transparency. However, the implementation of these principles remains inconsistent, especially at the regional level. The main legal obstacles identified include regulatory overlap, weak synchronization between central and regional regulations, and deficiencies in internal control mechanisms. These issues result in a formalistic application of legal norms, where compliance is largely procedural rather than substantive. Consequently, strengthening regulatory harmonization and legal coherence between central and regional frameworks is essential to ensure the effective realization of the principles mandated by Law No. 17 of 2003.

Abstract

Politik hukum merupakan instrumen strategis dalam menentukan arah pembangunan nasional di Indonesia. Artikel ini bertujuan untuk menganalisis arah politik hukum pembangunan nasional dalam konteks sistem hukum Indonesia serta menilai implikasinya terhadap kepastian hukum dan efektivitas pembangunan. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan (statute approach) dan pendekatan konseptual (conceptual approach). Bahan hukum yang digunakan terdiri dari bahan hukum primer, sekunder, dan tersier yang dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa arah politik hukum pembangunan nasional secara normatif telah terintegrasi dalam sistem hukum nasional melalui berbagai peraturan perundang-undangan dan prinsip-prinsip hukum konstitusional. Namun, implementasinya masih menghadapi tantangan berupa disharmoni regulasi, inkonsistensi kebijakan, serta perbedaan interpretasi norma di lapangan. Oleh karena itu, penguatan politik hukum pembangunan nasional dalam sistem hukum Indonesia diperlukan untuk menjamin kepastian hukum, keadilan sosial, dan efektivitas pembangunan.

Abstract

The crime of sexual intercourse with a minor is a serious offense requiring evidence-based law enforcement to ensure accurate proof and optimal protection for victims. This study aims to analyze the application of Scientific Crime Investigation (SCI) in investigations of such crimes within the jurisdiction of the Bima City Police, identify legal, technical, institutional, and sociocultural obstacles, and formulate an SCI-based law enforcement model suited to the local community's characteristics. The research employs a socio-legal (empirical-legal) approach with a case study design. Data were gathered through in-depth interviews with investigators from the Women and Children Protection Unit, forensic physicians, forensic psychologists, and prosecutors, supplemented by document analysis and field observations. Data were analyzed qualitatively involving reduction, presentation, and conclusion drawing utilizing source and method triangulation. The findings indicate that SCI implementation has not been optimal due to limited forensic facilities and personnel, ineffective inter-agency coordination, and a strong culture of resolving cases through amicable family settlements, which hinders the scientific evidentiary process. The novelty of this research lies in the formulation of an integrative law enforcement model that combines scientific investigation, cross-sectoral institutional strengthening, and an approach rooted in local wisdom to enhance investigative effectiveness within resource-constrained district police units. The study recommends strengthening forensic human resource capacity, developing comprehensive technical guidelines for the implementation of Scientific Crime Investigation (SCI), and establishing integrated forensic services at the regional level. These findings are expected to enrich the development of criminal law particularly regarding child protection and serve as a reference for formulating policies and standard operating procedures for evidence-based investigations. Abstract

This research examines the urgency of reformulating the judicial review authority in Indonesia, which is currently divided between the Constitutional Court (reviewing Laws against the Constitution) and the Supreme Court (reviewing regulations below Laws against Laws). This bipartite system, or dualism of judicial review, is found to trigger inconsistent rulings, divergent legal interpretations, and legal uncertainty due to the separation of legality and constitutionality aspects. The study recommends the integration of judicial review authority into a unified judicial review system under the Constitutional Court. This integration aims to create linear legal harmonization and ensure that the entire hierarchy of legal norms aligns strictly with the principles of a democratic constitutional state.
