Abstract

Akad murabahah merupakan salah satu instrumen pembiayaan yang paling dominan digunakan dalam praktik perbankan syariah di Indonesia. Meskipun secara normatif akad ini telah diatur melalui fatwa Dewan Syariah Nasional Majelis Ulama Indonesia (DSN-MUI) dan regulasi Otoritas Jasa Keuangan, implementasinya masih memunculkan sejumlah persoalan, khususnya terkait penerapan prinsip-prinsip syariah secara substantif. Penelitian ini bertujuan untuk menganalisis penerapan prinsip syariah dalam akad pembiayaan murabahah pada bank syariah di Indonesia dari perspektif hukum muamalah. Metode penelitian yang digunakan adalah kajian kepustakaan dengan menelaah buku, fatwa, peraturan perundang-undangan, serta pembatasan pada artikel jurnal ilmiah terbitan 2024–2026 dilakukan untuk memastikan analisis penerapan prinsip syariah dalam akad murabahah mencerminkan perkembangan terbaru. Hasil kajian menunjukkan bahwa praktik murabahah pada bank syariah umumnya telah memenuhi aspek legal-formal akad, seperti kejelasan objek, harga, dan ijab kabul. Namun demikian, penerapan prinsip syariah secara substansial, khususnya prinsip an tarāḍin minkum, keadilan, dan transparansi penetapan margin, masih menghadapi berbagai tantangan. Penetapan margin yang cenderung sepihak dan minim musyawarah berpotensi mengurangi makna kerelaan para pihak dalam akad. Oleh karena itu, penelitian ini menegaskan pentingnya penguatan kepatuhan syariah yang tidak hanya bersifat administratif, tetapi juga berorientasi pada nilai etika dan keadilan dalam hukum muamalah.

Abstract

Family is the smallest social unit that plays a a crucial role in maintaining social harmony and welfare. However, domestic conflicts between spouses are inevitable due to differences in character, interests, and socio-economic pressures. In the context of Indonesia’s plural society, dispute resolution is not only conducted through formal legal mechanisms but also through customary practices rooted in local wisdom. This study aims to analyze the role of customary leaders in resolving household disputes within the Towani Tolotang community in Sidenreng Rappang Regency, South Sulawesi. This topic remains relatively underexplored in existing literature, particularly in the context of social transformation and the increasing influence of formal law. This research employs a qualitative approach with a descriptive-analytical method. Data were collected through in-depth interviews, observation, and documentation involving customary leaders, married couples, and community figures. The findings reveal that customary leaders (uwa) play a central role as mediators, resolving domestic conflicts by emphasizing cultural values such as siri’ (honor), pacce (empathy), and lempu’ (honesty). The dispute resolution mechanism is carried out through structured yet flexible customary mediation stages that prioritize deliberation, moral guidance, and reconciliation before reaching a final decision. The study also finds that this mechanism is relatively effective, as most domestic disputes are resolved through customary mediation without leading to divorce. This helps strengthen family harmony and social cohesion within the community. In conclusion, the role of customary leaders remains relevant as a form of living law that preserves family integrity and sustains local cultural values amid modernization. Abstract

This study examines the strategies employed by civil servants (ASN) at the Ministry of Religious Affairs (Kemenag) of Soppeng Regency to maintain family integrity amidst the challenges of long-distance marriage, a situation arising from geographic separation due to work assignments. Employing a qualitative case study approach within a sociology of law framework, data were collected through in-depth interviews with eight state madrasah teachers experiencing long-distance marriage and analyzed using Henry Mintzberg's 5Ps strategy theory, Froma Walsh's family resilience framework, and Imam Al-Ghazali's Maqāṣid Syarī’ah. The findings reveal three key points: (1) couples implement six core strategies, including deliberative decision-making, communication optimization, and collaborative financial management; (2) supporting factors (relational, spiritual) and inhibiting factors (psychological, infrastructural) are identified; and (3) all strategies align with the Qur'an and the Kompilasi Hukum Islam and effectively support the five Maqāṣid Syarī’ah objectives: preserving religion, life, intellect, lineage, and property. This research offers theoretical contributions to Islamic family law and provides practical guidance for long-distance marriage couples and policymakers.
