Abstract

Penelitian ini bertujuan untuk menganalisi perlindungan hukum terhadap pegawai pemerintah non pegawai negeri sipil di lingkup Balai Besar Pelatihan Vokasi dan Produktivitas Makassar.  Faktor apa yang mempengaruhi perjanjian kontrak terhadap pegawai pemerintah non pegawai negeri sipil di lingkup Balai Besar Pelatihan Vokasi dan Produktivitas Makassar. Metode penelitianayang di gunakan adalah penelitian hukum normatif empiris. Hasil penelitian menunjukkan Perlindungan hukum terhadap pegawai pemerintah non pegawai negeri sipil (PPNPN) di lingkup Balai Besar Pelatihan Vokasi dan Produktivitas Makassar (BBPVP Makassar) didasarkan pada Undang-Undang ASN, yang mengatur status dan hak-hak PPNPN. Mereka memiliki hak dan kewajiban yang diatur dalam kontrak kerja, serta mekanisme untuk mengajukan keberatan atau sengketa jika hak-hak mereka dilanggar. Kesejahteraan dan jaminan sosial juga harus dijamin sesuai dengan peraturan yang berlaku, mencakup program kesehatan dan pensiun. Dengan demikian, PPNPN di BBPVP Makassar memiliki dasar hukum yang kuat untuk perlindungan hak-hak mereka dalam hubungan kerja. Kontrak kerja di BBPVP Makassar didasarkan pada kualifikasi dan pengalaman pegawai, dengan mempertimbangkan aspek-aspek penting seperti pendidikan, keterampilan, dan komunikasi. Kontrak juga mencantumkan hak dan kewajiban pegawai, termasuk hak gaji dan tunjangan, serta kewajiban kepatuhan dan pengembangan diri. Spesifikasi pekerjaan yang rinci dalam kontrak membantu memastikan pemahaman yang jelas antara pegawai dan organisasi tentang tugas dan tanggung jawab yang harus dilaksanakan. Dengan demikian, BBPVP Makassar memiliki kerangka kerja yang solid untuk mengelola hubungan kerja yang sehat dan produktif. This research aims to analyze legal protection for non-civil servant government employees within the Makassar Vocational and Productivity Training Center.  What factors influence contract agreements for non-civil servant government employees within the Makassar Center for Vocational Training and Productivity. The research method used is empirical normative legal research. The research results show that legal protection for non-civil servant government employees (PPNPN) within the Makassar Vocational Training and Productivity Center (BBPVP Makassar) is based on the ASN Law, which regulates the status and rights of PPNPN. They have rights and obligations regulated in the employment contract, as well as a mechanism to submit objections or disputes if their rights are violated. Welfare and social security must also be guaranteed in accordance with applicable regulations, including health and pension programs. Thus, PPNPN at BBPVP Makassar has a strong legal basis for protecting their rights in employment relationships. Employment contracts at BBPVP Makassar are based on employee qualifications and experience, taking into account important aspects such as education, skills and communication. The contract also lists employee rights and obligations, including salary and benefit rights, as well as compliance and personal development obligations. Detailed job specifications in the contract help ensure a clear understanding between the employee and the organization about the duties and responsibilities to be carried out. Thus, BBPVP Makassar has a solid framework for managing healthy and productive work relationships.

Abstract

Penelitian ini bertujuan untuk menganalisis penerapan sanksi disiplin terhadap pelanggaran disiplin jam kerja Pegawai Negeri Sipil (PNS) di Kantor Wilayah Direktorat Jenderal Bea dan Cukai Sulawesi Bagian Selatan. Metode penelitian yang di gunakan adalah penelitian Hukum Normatif Empiris. Hasil penelitian menunjukkan bahwa penerapan sanksi disiplin terhadap pelanggaran disiplin jam kerja Pegawai Negeri Sipil di Kantor Wilayah Direktorat Jenderal Bea dan Cukai Sulawesi Bagian Selatan telah dilakasanakan sesuai dengan ketentuan peraturan perundang-undangan yang berlaku yaitu Peraturan Pemerintah 94 Tahun 2021 pasal 4 huruf f dan Peraturan Menteri Keuangan Nomor 221/PMK.01/2021, terutama terkait dengan pemotongan tunjangan dan akumulasi ketidakhadiran pada tahap hukuman disiplin ringan, sedang dan berat. Penerapan sanksi disiplin terhadap Pegawai Negeri Sipil yang melanggar ketentuan jam kerja di Kantor Wilayah Direktorat Jenderal Bea dan Cukai Sulawesi Bagian Selatan belum berjalan secara efektif yang ditunjukan masih ada pegawai melakukan pelanggaran dan terdapat pegawai yang melakukannya secara berulang serta tidak merasakan dampak atas pembelajaran dan pembinaan yang telah dilakukan. Penerapan hukuman belum efektif karena: (a) faktor sanksi dan hukuman, (b) penegakan hukuman disiplin, (c) sarana pengawasan dan monitoring dan (d) faktor individu pegawai dan masyarakat. This research aims to determine the application of disciplinary sanctions for violations of the working hours of Civil Servants (PNS) at Regional Office of Directorate General of Customs and Excise Southern Sulawesi.  The research method used is Empirical Normative Legal research. The results of the research show that the application of disciplinary sanctions for violations of civil servant working hours discipline at at Regional Office of Directorate General of Customs and Excise Southern Sulawesi has been carried out under the provisions of applicable laws and regulations, namely Government Regulations 94 of 2021 article 4 letter f and Minister of Finance Regulation Number 221/PMK.01/2021, especially related to deductions. allowances and accumulated absences which are at the stage of light, medium, and heavy disciplinary penalties. The application of disciplinary sanctions to civil servants who violate working hours provisions at Regional Office of Directorate General of Customs and Excise Southern Sulawesi has not been implemented effectively, as shown by the fact that there are still employees committing violations and there are employees who do it repeatedly and do not feel the impact of the learning and coaching that has been carried out. The application of punishment has not been effective because (a) sanctions and punishment factors, (b) enforcement of disciplinary penalties, (c) means of supervision and monitoring, and (d) individual employee and community factors.

Abstract

Penelitian ini bertujuan untuk mengetahui faktor yang menyebabkan terjadinya pelanggaran tindak pidana pertambangan ilegal di Sulawesi Selatan dan untuk mengetahui proses penyidikan terhadap pelanggaran tindak pidana pertambangan ilegal oleh Kepolisian Daerah Sulawesi Selatan. Penelitian ini merupakan penelitian kualitatif deskriptif. Data yang diperoleh ialah data primer dengan melakukan wawancara langsung bersama narasumber di Kepolisian Daerah Sulawesi Selatan dan data sekunder diperoleh dari buku-buku, jurnal, dan sebagaina yang masih berhubungan dengan isi penelitian. Hasil penelitian menunjukkan bahwa faktor yang menyebabkan terjadinya pelanggaran tindak pidana pertambangan ilegal di Sulawesi Selatan terbagi atas faktor internal dan faktor eksternal. Faktor internal mencakup kondisi ekonomi, kurangnya kesadaran masyarakat, dan minimnya pengetahuan masyarakat. Faktor eksternal mencakup kurangnya pengawasan, kurangnya sosialisasi, dan sulitnya proses perizinan. Hasil penelitian pada proses penyidikan terhadap pelanggaran tindak pidana pertambangan ilegal oleh Kepolisian Daerah Sulawesi Selatan terbukti bahwa Kepolisian Daerah Sulawesi Selatan telah menjalankan proses penyidikan dengan sangat sistematis, terbuka, dan sesuai dengan ketentuan yang berlaku.

Abstract

ASEAN Outlook on Indo-Pacific (AOIP) plays a role in maintaining peace, security, stability and prosperity in the Asia Pacific and Indian Ocean (Indo-Pacific) region. However, due to common and competing interests, there are still conflicts in the region's implementation. Maritime security cooperation, which includes addressing illegal, unreported, and unregulated (IUU) fishing, is one of the most important issues in the ASEAN region. The research intends to examine law enforcement against IUU violations in the ASEAN region, as well as the consequences of IUU violations by ASEAN countries on waters in the Makassar Strait. This is a qualitative study that employs a normative-empirical approach. The first problem is analyzed using the normative aspect, which is based on international and national law on ASEAN agreements on IUU, law enforcement, and other issues. While the empirical aspect is used to analyze the second problem through in-depth interviews about Makassar Strait water supervision and law enforcement. Based on the research findings, IUU law enforcement in the ASEAN Region must be carried out firmly to parties that threaten security and stability in the ASEAN Region, as outlined in each agreement participant's national law. Meanwhile, the legal consequences of IUU violations in the ASEAN Region have an impact on the security and stability of the waters of the Makassar Strait.

Abstract

Takabonerate is one of the national parks and the third-largest atoll area in the world. The Indonesian government has designated Selayar Regency, South Sulawesi, as a tourist destination because of its charming underwater panorama, which attracts foreign tourists to visit and see hundreds of species of fish and other natural resources. The aim of this research is to analyze the protection of the Takabonerate Coral Reef through community empowerment. This study uses a qualitative approach that refers to legal norms. The study results show that several international agreements regulating the importance of communities being involved in coral reef management have been ratified by the Indonesian Government and have been implemented in several laws and regulations

Abstract

Penelitian ini bertujuan untuk menganalisis penerapan diversi terhadap anak yang berhadapan dengan hukum yang dilakukan oleh penyidik di wilayah hukum Polres Mamasa. Metode penelitiana yang di gunakan adalah penelitian Hukum Normatif. Hasil penelitian menunjukkan bahwa Penerapan Diversi Terhadap Anak Yang Berkonflik Dengan Hukum Yang Dilakukan Oleh Penyidik Di Wilayah Hukum Polres Mamasa yaitu melakukan Perdamaian antara korban dan pelaku dengan mengedepankan prinsip Restorative Justice melalui Musyawarah Diversi, dimana ganti kerugian menjadi perhatian utama dalam mencapai perdamaian. Musyawarah tersebut dipimpin oleh penyidik sebagai fasilitator untuk diupayakan agar selesai tidak sampai ke pengadilan. This study aims to analyze the application of diversion to children in conflict with the law carried out by investigators in the Mamasa Police jurisdiction. The research method used is Normative Legal research. The results showed that the Application of Diversion for Children in Conflict with the Law Conducted by Investigators in the Mamasa Police District is to make peace between the victim and the perpetrator by prioritizing the principles of Restorative Justice through Diversion Deliberations, where compensation is the main concern in achieving peace. The deliberation is led by the investigator as a facilitator to strive for completion not to reach the court.
