Abstract

Indonesia wants to achieve political and economic modernization as well as protect people from suffering which arice as a result of the industrialization of life at the same time. One of product legislation that push the economic growth is Law No. 5 of 1999 on Prohibition of Monopolistic Practices and Unfair Business Competition. This law gives equal opportunities to all the people of Indonesia to develop its economic potential. Prohibition monopoly practices and unfair competition is business practices that should be avoided because of the effect it has is quite heavy as not efficiens market, market distortions, which will eventually lead to disserved not only for consumers but also for producers, especially the middle class and small. In turn, the country will also be harmed because it is not supported by a solid economic foundation. Monopoly Practices and unfair competition is contrary to the values of justice and welfare, as an intrinsic human values that can lead to business activities intended to bring prosperity will not materialize at all.

Abstract

Background: Pictorial health warning on cigarette packs has been implemented since 2014, but smokers in Indonesia increase every years. Pictorial health warning on cigarette packs must be continuously evaluated regarding its effectiveness in reducing smoking behavior in Indonesia. Regulated about Regulations of pictorial health warning on cigarettes packs are expected to make smokers to quit smoking and regulations that have been in effect since 2014 should have been evaluated to see pictorial health warning on cigarettes packs that can change the behavior of smokers or prospective smokers in adolescents. This study aims to describe perceptions of pictorial health warning on cigarette packs and smoking behavior and intention to quits smoking of undergraduate student of state Islamic University of North Sumatra. Methodology: This research was conducted to students of the Islamic University of North Sumatra as many as 215 students. The study was conducted in March 2019 using a structured questionnaire that had been prepared. The data in this study will be presented in the form of frequency distributions and then the results are presented in the table. Results: The results of this study indicate that the respondents felt not fear with pictorial health warning on cigarette packs as many as 165 people (76.7%). For the smoking behavior of students it was found that as many as 147 people (68.4%) stated that they had not smoking and respondents who stated smokers as many as 68 people (31.6%), wanted to stop smoking after seeing picture health warning on cigarette packaging as many as 28 people (41.2%). Respondents who said they would continue smoking even though they had seen pictorial health warning on cigarette packs as many as 40 people (58.8%). Conclusion: The majority of students undergraduates of the North Sumatra State Islamic University (UIN SU) were not afraid when they saw pictorial health warning on cigarette packs and students undergraduates have smoking behaviour. Those who smoke said they wanted to stop smoking after seeing pictorial health warning on cigarette packs especially when looking at ppictorial health warning on cigarette packs related to smoking resulting in lung cancer.

Abstract

Chemical castration is a punishment against pedophiles, who have committed acts of crime that are considered an extraordinary crime. Pedophiles have ruined the future of children, with tremendous psychological and environmental impacts. This paper aims to uncover the problems of fiqh in Indonesia concerning chemical castration which has the aim of providing a deterrent effect for rape perpetrators of children. The data collection method in this study uses the literature study. There are differences in the views of legal experts with doctors. Legal experts decide on penalties for pedophiles with Law Number. 17 of 2016 concerning the Second Amendment to Law Number. 23 of 2002 concerning Protection of Children, while the Indonesian Doctors Association states reject chemical castration punishment, following the Code of Ethics as stated in the rules of the Medical Code of Ethics Assembly (MKEK) Number. 1 of 2016 concerning Chemical Castration. Fiqh experts disagree over the castration penalty for chemistry. There is no castration punishment in the fiqh, because the Prophet Muhammad forbade castration, as opposed to Islamic principles. Some fiqh experts agree that chemical castration punishment includes ta'zīr, which is a sentence handed over entirely to the legitimate government. Thus, although the castration chemical punishment has been determined, in its implementation there are problems because there are still rejections and problems according to the fiqh expert

Abstract

In life, muamalah activities are an interaction in maintaining the teachings contained in the Qur'an, Islam always teaches how to be responsible and how to do justice in muamalah, especially in recording and managing finances and assets. This study seeks to explore how the thoughts of two Indonesian accounting figures, Sofyan Safri Harahap and Iwan Triwuyono, in applying records that are in accordance with Islamic principles and teachings by referring to several articles published on Google Schoolar. The results of this study reveal that there are some similarities in perceptions and thoughts in the philosophical basis of thinking about Islamic accounting, especially on the basis of the philosophy of monotheism then Islamic accounting plays an important role in being responsible and fostering an attitude of justice in recording, especially in Islamic financial institutions that are widely operating today.

Abstract

As of current, polygamy in terms of polygyny in Islamic law remains to be a debated topic. One of the reasons for the debate is that polygyny is viewed through the lens of men. Research on polygyny viewed from the male sexual perspective is still extremely rare. The research data were gathered through in-depth interviews with four polygyny practitioners to discover the most subtle, private, confidential, and exclusive aspects of polygyny's sexual practice. The study found that the sexual lust on the part of the male (husband) is a form of sexual sublimation and subtle sexuality in the practice of polygyny. Additionally, the findings indicate that the sexual lust is practice for recreational purposes. The research findings may have implications on the emergence of new understandings on the practice of polygyny. Nevertheless, the study raises an intriguing question for future research: why are women willing to be sexually objectified by polygynist men?

Abstract

This research presents the latest information about the inheritance rights of adultery children, analysis of the prosperity approach to the inheritance of adultery children in the Compilation of Islamic Law. The research is presented in a qualitative form with normative legal research type, which aims to investigate the norms of Islamic law to find the rules of behavior that are considered the best and can be applied to provide legal provisions for a case. This research uses a philosophical approach, namely the study of the basic values of Islamic law in answering a legal problem. Furthermore, research makes prosperity theory as an analytical tool in analyzing data. In the end, this research concluded, adultery with biological father has a civil relationship, both in terms of lineage and inheritance. Ownership of lineage relations based on the opinion of Ibn Qayyim al-Jauziyyah, MUI Fatwa, Decision of the Constitutional Court Number 46 / PUU-VIII / 2010. Regarding inheritance, researchers disagree with the Indonesian Ulama’ Council and the Constitutional Court's Decision Number 46 / PUU-VIII / 2010. Researchers believe that the portion received by adultery from their biological fathers is equated with the legal position of inherited children. Researchers see, if the adultery child is given the compulsory testament it becomes something that is ambiguous with the status of the right of adultery with the biological father. One side of the Constitutional Court Ruling Number 46 / PUU-VIII / 2010 confirmed that the adultery child is a child and has a relationship with his biological father, but on the other hand in the case of inheritance is not treated as a child of his biological father. Giving a compulsory will as a scapegoat by the Constitutional Court (government) to adultery children or on family law issues to provide solutions to all marital problems and consequences that do not follow administrative procedures in Indonesia and granting inheritance of inheritance rights is a sanction for adulterers using the theory upside down in Indonesia. Keywords: Adultery Children, Inheritance Islamic Law Compilation, Prosperity

Abstract

This article examines the issue of jarīmah ta'zīr as one of the dimensions of Islamic criminal law which has flexibility in its application.In contrast to ḥudūd and qisāṣ whose rules are very clear and detailed in the Qur'an, ta'zīr is not set clearly in the Qur'an. Therefore, the ijtihad of a ruleror judge to determine the type of crime and jarimah that can be punished (ta'zīr) and the type and form of punishment is really important. The flexibility of ta'zīr allows to accommodate the complex form of crime suchas gratification, corruption, sexual harassment, drugs, and pornography.But ta'zīr also opens the opportunity for the tyranny of the government inpunishing a person. Abstract

Implementation of Inheritance Law of the Muslim Karo in North Sumatra. So far, Indonesia has not managed the codification and unification of a national inheritance law. Among the factors is the difficulty of codifying inheritance laws by reason of the diversity of the legal system that governs family matters of the Indonesian people, including inheritance laws. This study examines the way of implementing the inheritance law in Karo Muslim society, North Sumatra. This study focuses on the models of estate distribution to girls and widows. The article concludes that the Muslim Karo people still use customary law to resolve matters relating to inheritance disputes. Customary law that is used is experiencing dynamics or shifts. This happens without giving rise to tension let alone any disturbances within Karo Muslim community itself.DOI: 10.15408/ajis.v14i2.1279

Abstract

This paper aims at understanding costumers’ behavior and subjective norms in consuming halal food at Suzuya Superstore, Medan. This is quantitative research, with 50 respondents consisting of Suzuya Superstore Medan costumers. They were chosen through an accidental sampling approach. Partially, this research shows that the variable of behavior (X1) and subjective norms (X2) positively influence the behavior (X1), where the value t count >t table (5.828 > 1,677) with the significant level of 0,000 <0,05. This means that (X1) significantly influence on the consumers’ perspectives on halal products (Y) at Suzuya Superstore Medan. Subjective Norms (X2) has a value of t count >t table (4,495 > 1,677) with the significant level of 0,000<0,05. This means that the subjective norm (X2) significantly influences the consumers’ perspectives on halal products at Suzuya Superstore Medan. In conclusion, behaviors and subjective norms simultaneously influence the halal product consumption behavior among the costumers of Suzuya Superstore Medan. Penelitian ini dilakukan dengan tujuan untuk mengetahui sikap dan norma subjektif konsumen dalam mengkonsumsi makanan halal terhadap produk halal di Suzuya Superstore Medan. Jenis penelitian ini adalah deskriptif kuantitatif. Dalam penelitian ini menggunakan sampel 50 responden yaitu konsumen Suzuya Superstore Medan diambil secara Accindental sampling yaitu sampel secara kebetulan bertemu. Secara parsial hasil penelitian menunjukkan bahwa variabel sikap (X1) dan norma subjektif (X2) berpengaruh positif sikap (X1) dimana memiliki nilai t hitung >t tabel (5.828 > 1,677) dengan tingkat signifikan 0,000 <0,05, artinya sikap (X1) berpengaruh signifikan terhadap perilaku konsumen perspektif produk halal (Y) di Suzuya Superstore Medan. Norma subjektif (X2) memiliki nilai t hitung >t tabel (4,495 > 1,677) dengan tingkat signifikan 0,000<0,05, artinya norma subjektif (X2) berpengaruh signifikan terhadap perilaku konsumen perspektif produk halal di Suzuya Superstore Medan. Secara Simultan, hasil penelitian menunjukkan bahwa nilai Fhitung > F tabel (53,372>3,20) dan nilai signifikan 0,000<0,05. Kriteria Fhitung>Ftabel dan signifikan <0,05. Maka Ha diterima, artinya terdapat pengaruh yang signifikan antara sikap dan norma subjektif secara simultan terhadap perilaku konsumen produk halal di Suzuya Superstore Medan. Berdasarkan nilai R Square sebesar 0,694 atau sama dengan 69,4%. Berarti model analisis yang digunakan mampu menjelaskan Sikap dan Norma subjektif terhadap perilaku konsumen perspektif produk halal sebesar 69,4% sedangkan sisanya 30,6% dipengaruhi oleh faktor lain yang tidak diteliti.

Abstract

The concept of Islam Nusantara, which is defined as Islam that accommodates the customs and culture of the (Indonesian) Archipelago, has been rejected by the West Sumatera branch of Indonesian Ulema Council (MUI). Meanwhile, other groups in West Sumatera support the Islam Nusantara concept. This article explains the pros and cons of Islam Nusantara among religious leaders in West Sumatera in the context of social media activities. Ulemas rejected Islam Nusantara in West Sumatera based on the perspective that Islam as a religion has reached peak perfection,adding the word Nusantara is, thus, unnecessary. Other religious leaders in West Sumatera have embraced Islam Nusantara based on the view that in terms of customs in Minangkabau, the principle of Adaik Bersandi Syarak, Syarak Bersandi Kitabullah is followed. This is a field study employing the qualitative method of approach. Data were obtained via in-depth interviews with four West Sumatran religious figures (ulemas) and subsequently analyzed in an interpretative and descriptive manner. The findings in this study show that the ulemas’ rejection of Islam Nusantara via Facebook indicates a shift in the definition of ulemas as religious leaders to that of opinion makers. This is a new finding that has never been studied before as it places the pros and cons of Islam Nusantara within the context of virtual culture. Consequently, this study has implications on the definition of ulemas as religious leaders overlapping with their part as opinion makers and opinion leaders in the current era of new media.Gagasan Islam Nusantara sebagai Islam yang mengakomodir adat dan budaya Nusantara ditolak kehadirannya oleh Majelis Ulama Indonesia wilayah Sumatera Barat. Sementara itu terdapat kelompok lain yang mendukung gagasan Islam Nusantara di Sumatera Barat. Artikel ini menjelaskan pro dan kontra di antara pemuka agama tentang Islam Nusantara di Sumatera Barat dalam konteks aktivitas di media sosial. Islam Nusantara di tolak oleh Ulama di Sumatera Barat didasari oleh pandangan umum bahwa Islam sebagai agama telah mencapai sempurna, sehingga tidak diperlukan penambahan kata Nusantara. Sedangkan pemuka agama lainnya menerima Islam Nusantara di Sumatera Barat karena didasari oleh pandangan umum bahwa adat di Minangkabau Sumatera Barat berpegang pada prinsip Adaik Bersandi Syarak, Syarak Bersandi Kitabullah. Data penelitian dikumpulkan melalui wawancara mendalam terhadap empat pemuka agama (ulama) di Sumatera Barat. Temuan penelitian ini menunjukkan bahwa aktivitas ulama yang menolak Islam Nusantara melalui facebook menggambarkan pergeseran makna Ulama dari religius leader ke opinion maker. Namun pergeseran tersebut justru mengokohkan ulama sebagai pemilik otoritas keagamaan. Temuan ini dapat berimplikasi pada terminologi ulama sebagai religius leader pada era media baru akan berhimpitan dengan terminologi opinion maker dan opinion leader sebagai terminologi baru pada era media baru.
